DR16-35480 _ BlueTeam_RedactedLong Beach Police Dept Use Of Force Report Print Incident Details Date Received Date of Occurrence Time of Occurrence 06/03/2016 06/03/2016 23:27 Record ID Number DR Number IA Number 10660 16-0035480 UOF2016-0166 Date/Time Entered Entered By Assigned Investigator 06/04/2016 03:57 Sergeant Dominick Scaccia [Incident pending assignment] Incident Summary Dispatch: Officers were dispatched to a possible domestic dispute with a male voice yelling at a female and possibly hitting her. As officers arrived on scene, concerned citizens pointed out a broken window to the apartment in question. Force Used: Officers knocked on the door and announced themselves as the Long Beach Police Department, but received no response. Shortly after, they heard a female voice yell, "Let me leave!" This was followed by a loud banging sound. In an effort to prevent serious bodily harm to the female inside, Officer Hughes kicked the front entry door ajar. As the door swung open, it struck above his left eye. No further force was used. Injuries: Mr. suffered a large laceration above his left eye. Photographs/Videos: Officer Sheffield photographed the scene, Mr. injuries, and the broken window. Statements: I interviewed Saint Mary's Hospital. For further on his statements refer to my supplemental report, or the digital recording of his statements that was uploaded to the Mideo Kiosk software. Conclusion/Actions: Based on the totality of the circumstances, I believe the force used was reasonable and within department policy. Notifications: WC3 Lieutenant Baum was notified of the incident. Based on the reports and sergeant's investigation, I believe the officers had exigent circumstances to force entry and the force used (unintentional but caused by the forced entry) was reasonable and justified. I also concur with Lieutenant Baum's decision to have the forced entry also viewed as a use of force due to the injuries and so that the incident will have the same checks and balances as a typical use of force.
