Narrative
USE OF FORCE
On 04/09/16, my partner (Officer A. Leon #10057) and I (Officer A. Sturgeon #10055) were working corridor
enforcement (along the major corridors of West Division). We were wearing LBPD Bike Patrol uniforms, which
include a black polo shirt with City of Long Beach patches on both shoulders, a Long Beach Police embroidered
badge on the left chest, our name embroidered on the right chest, and the word "POLICE" embroidered in the
middle of the back. We were also driving a Long Beach Police black and white vehicle at the time. At
approximately 1500 hours, we observed via our vehicle's computer that a petty theft call had come in from 7-11
mini-mart (1165 E Anaheim St), call #892.
The call stated that a petty theft just occurred and the suspect was a male Black, in his 30's, wearing a black shirt,
grey jeans, and red shoes. The loss was listed as "merchandise" and the calling party stated they would only like
to be contacted if the suspect was detained.
Throughout my experiences dealing with "petty theft" calls from businesses in the area, it is often that they are
mis-classified and could actually be commercial burglaries or robberies. Due to the fact that our enforcement
efforts are currently to decrease robberies in the areas of the major corridors (including Anaheim St), my partner
and I began heading toward the 7-11.
We traveled southbound on Alamitos Av from Pacific Coast Hwy. With the knowledge that the suspect was last
seen heading northbound from the dispatch location, we believed we would possibly see the suspect walking on
Alamitos Av.
As I drove southbound on Alamitos Av, passing 15th Street, Officer Leon said, "There he is" as he pointed to the
east side of the street. I looked to my left and noticed a male Black who matched the suspect's description,
walking northbound on Alamitos Av along the east sidewalk. The subject was wearing a black sweater, grey
jeans, and red shoes. The suspect was holding onto a gallon water jug and seemed to be eating an unknown
item.
I turned my vehicle around and drove northbound toward the suspect's location, which was approximately 30'
south of 15th St on the east sidewalk. As I pulled up, Officer Leon quickly exited the vehicle and asked the
subject (known only as John DOE) to come over to us and talk to us. I also exited the vehicle and walked around
to the front of the car. DOE then immediately put his gallon water jug down on the ground and began taking off
his sweater. DOE took off both his sweater and a white t-shirt, which was underneath, and threw the clothing on
the ground. DOE asked in a boisterous manner, "Why do I have to come over to you?" I told DOE that he was
being detained for stealing from 7-11. DOE then began yelling, "Nope, Nope!"
This behavior is not a common response when people are being detained by the police. Based on past
experiences with combative subjects and my training throughout my career, I believed that DOE was pumping
himself up for a fight.
I ordered DOE to come to our vehicle, but he refused. I attempted to ask DOE to sit down on the side of the curb,
but DOE also refused that order. DOE stated, "This is what's gonna happen. I'm gonna take a drink from my
water, and you two are gonna get in your car and drive away." DOE paused and then said, "Just.. Drive.. Away."

I told DOE again to sit down on the ground and he refused. DOE walked to where he had placed his water jug
and began drinking from it. DOE then held onto his water jug as he began walking backward off of the sidewalk
and into the street. DOE seemed very agitated and made it clear that he was not going to comply with us.
Dispatch asked us via police radio if we were "Code-4" (ok) with the subject and I advised her that we were not
"Code-4" because the subject was not complying with our orders.
DOE verbally refused our orders several times by saying, "No" when told to sit down. DOE continued to walk
away, now heading in the middle of the intersection of 15th Street and Alamitos Av. My partner advised me that
he had deployed (removed) his "Taser" (Conducted Electrical Weapon, or CEW) if needed. As DOE continued
into the intersection, he turned away from me for a second and I believed I had an opportunity to take control of
him. As soon as I stepped closer to DOE,he quickly turned back toward me held up two fists and jumped toward
me into a fighting stance.
Believing DOE was going to start swinging at me, I quickly removed my department issued CEW and discharged
the probes into DOE's stomach and chest. Officer Leon simultaneously discharged the probes of his CEW into
DOE's stomach and chest as well. Although DOE had been struck by two CEW cartridges (4 probes) at the same
time, it had no affect on him whatsoever. I have never personally encountered this before in the past 10 years of
my career. I expected that when the CEW was deployed, that it would have caused DOE's muscles to lock up
and he would be incapacitated for a few seconds. This was not the case.
DOE began swinging his fists at us in an attempt to strike us. My first instinct was to think my CEW had not
worked correctly and I began depressing the trigger several times. I realized that this was not going to change the
outcome. Officer Leon had transitioned to his baton and attempted to strike DOE in the upper arms several
times. DOE continued to charge at Officer Leon and was attempting to punch him.
I dropped my CEW on the ground and pulled my baton out. In an attempt to hit his upper arms, I struck DOE two
times in the upper back. DOE turned an attempted to grab my baton as I hit him.I then struck him a third time on
his right arm. DOE continued to fight and acted as if nothing fazed him.
At this point I could only assume that DOE was under this influence of a narcotic substance, and based on his
demeanor, I believed he was possibly high on PCP, which demonstrated itself in a manner that provides people
with the ability to not feel pain. This means that any pain compliance techniques, including our CEW's and
batons, were never going to be affective in getting DOE into custody.
The only option I could see fit to use was the carotid restraint technique. This technique would cause DOE to go
unconscious for several seconds and provide us the opportunity to place him into handcuffs.
I saw that DOE had turned toward my partner and I was able to position myself behind DOE and encircle his neck
with my right arm. I then used my body weight to pull DOE to the ground. Once on the ground, I held onto DOE
in the carotid restraint for several seconds. I had landed on my right side and we were both lying in the middle of
the street.
As I held DOE in this position, Officer Leon took the opportunity to handcuff DOE's left hand. Once I felt DOE's
body go limp and I was sure he was unconscious, I let go of the control hold and removed his right arm out from
under his body. I brought his right arm back and Officer Leon was able to finish handcuffing.
We quickly turned DOE to his side and could see he was still unconscious. I attempted to check his pulse, but
due to the fact that we had just fought with DOE for the last couple of minutes and my pulse was high, I could not
find his pulse. We then sat DOE up into a seated position and kept direct observation of DOE until he regained
consciousness. DOE then looked directly at me and said, "What just happened." I told DOE, "You're ok. Stay
calm. You are ok."
Long Beach Fire Personnel were requested to the scene.
We were assisted by several units including: Unit 1B8 (Officer B. Komori #10546), Unit 18B (Officer D. Adams
#5900), Unit 1S35 (Sgt. E. Fernandez #10062), Unit 1B3 (Officer E. Barba #10006), Unit 1B37 (Officer O. Morales

and Unit 1B35 (Officer J. Gonzalez #10024).
Officer Komori showed up onscene as DOE was in a seated position in the street. We stood DOE up and began
walking him toward Officer Komori's police vehicle. DOE immediately began to struggle with us, using his body to
push and pull us in different directions. We continued toward the vehicle and DOE then used his left foot to push
off the front of the vehicle and almost knocked us over.
Sgt Fernandez arrived onscene and we came up with a plan to bring DOE back down to the ground and place a
hobble on his feet. As I held onto DOE's left arm and Officer Leon held onto his right arm, we used our weight to
force DOE back down onto the ground. While in a prone position, Sgt. Fernandez was able to place a hobble
around DOE's lower legs.
DOE continued to struggle while on the ground, trying over and over to kick his legs and get out of our hold.
Officer Leon, Officer Komori, Sgt. Fernandez, and I all assisted in holding DOE on the ground until Long Beach
Fire Personnel arrived onscene. We did not believe that DOE would safely get into a police vehicle, so we waited
for LBFD to bring a gurney so that we could restrain DOE and ultimately keep anyone else from being injured.
Once LBFD arrived, they were advised of the incident and began treating DOE. A gurney was brought to our
location and with the assistance of Fire personnel, we were able to safely pick DOE up and lie him down on the
gurney. DOE was then restrained with the gurney harnesses and secured in the back of the ambulance.
Officer Garcia got into the back of the ambulance and rode with DOE to St Mary's Hospital, where he was treated
for his injuries.
Unit BKS4 (Sgt. D. Lance #6041) was notified of the incident and responded to the scene.
Due to the fact that several subjects were standing around when the incident occurred, assisting officers
contacted these witnesses for their statements (For further see the follow-up reports).
Officer Corona took photos of the scene.
Once the scene was safe, I looked around and noticed that my tools and Officer Leon's tools (including our
CEW's, and batons) were strewn about in the northbound lanes of Alamitos Av at the north crosswalk of 15th
Street. My wrist watch had gotten knocked off during the incident and was also lying on the street, as well as the
gallon jug of water that DOE had been carrying at the time. These items were photographed by Officer Corona.
Along the sidewalk, I observed DOE's clothing, including his black sweater and white shirt, which he left just south
of 15th Street. These items were also photographed by Officer Corona.
Officer Komori collected the evidence at the scene, for further see his report.
***** While at the scene, I noticed that the business on the southeast corner of the intersection (Dollar Tree) had
exterior cameras on the building and possibly captured the incident. *****
Several minutes after the incident, Officer Leon started feeling pain to his right knee, which caused him to limp. I
also noticed that my right elbow began to swell up and I could feel throbbing to my upper back. Due to the
sustained injuries, we responded to the after hours health department office at Community Hospital of Long
Beach. We were seen by the Doctor on-call.
Officer Corona took photos of our injuries.
Unit 1C67 (Officer B. Vriens #10658 and Officer F. Archuleta #10649) later responded to St Mary's Hospital and
collected DOE's clothing. Officer Archuleta packaged the evidence and finished the paperwork, which he
provided to me at the station. I placed the items into the evidence locker.
While filing my report, I was advised that DOE was possibly identified as Dion Rivers, DOB 04/04/80, and was
advised that his blood was taken at the hospital and had tested positive for PCP, methamphetamine, and
marijuana.

Once everything was taken care of at the scene, Officer Leon and I responded to 7-11 mini mart (1165 E Anaheim
St) so speak with the calling party on call #892.
I contacted the calling party (Witness who told me the following:
At approximately 1455 hours, a male Black subject walked into the store and grabbed two bananas from the fruit
basket at the front counter. was operating the register at the time and there were a few people in line, so
he was not sure if the subject had already paid for the bananas. The subject (later identified as DOE) walked
directly to the exit and was about to leave. asked his co-worker if DOE had purchased the
bananas and said, "No." then told DOE, "Hey Bro, you gotta pay for those bananas."
DOE came back into the store and walked up to the counter with the bananas in hand and asked "Can I
have the bananas?" said, "No, you have to pay." stated that DOE then just began staring at them
"in and odd manner." then walked around to the front side of the counter and stepped in between DOE and
the front door. told to call 9-1-1, so he began calling. stated that DOE then took a bite
directly out of the banana, without peeling it first, and then "pushed" past as he exited the store. DOE then
took off heading northbound on Alamitos Av and out of sight.
stated he wished to prosecute on behalf of the store and signed a Private Person's Arrest form.
described the suspect as a male Black, in his 30's, wearing a long sleeve black sweater, grey jeans, and
red shoes. stated the suspect had long hair that was tied up at the top of his head. The suspect was
holding onto a gallon of water, which he had with him when he entered the store, and left the store with two
bananas, which he did not pay for.
Officer Leon contacted who told him the following:
stated he did not want to provide his information because he was worried about going to court and
testifying. stated that at approximately 1455 hours, his co-worker ( told that a male Black
subject had just taken some bananas without paying. stated he confronted the suspect and asked him to
pay for the bananas. The suspect refused, so attempted to stop the suspect from exiting by walking
towards the exit. As stood at the exit, the suspect walked around and left the store without paying
for the bananas. stated that the suspect "brushed" past him as he walked out, but he did not mention the
suspect pushing him.
contacted the store manager who authorized him to provide us access to the video surveillance. Upon
accessing the surveillance system, we observed DOE enter the store, walk directly to the counter, take two
bananas, and walk to the exit. is seen speaking to and then saying something to DOE. DOE returns
to the counter and speaks to for a few seconds. walks to the front side of the counter and is
speaking to DOE. DOE then peels the two bananas apart from each other and then takes a bite out of one of the
bananas without first peeling the banana. DOE then steps toward in a confrontational manner.
walks between DOE and the exit and DOE is then seen speaking to other customers. DOE then walks past
and exits the store. DOE made no attempt to pay for the items.
After seeing the video, it is clear that the same person we detained was in fact the same person who stole from
7-11. I took still images from the video surveillance and attached them to E-files on this report.
We obtained a copy of the video, which Officer Leon copied into Mideo. A copy was provided to the detectives
and a copy was placed into evidence.

Narrative
On 4/9/16 I, Officer D. Adams #5900, was working west division patrol unit 18B. I assisted BK40, Officer A.
Sturgeon # 10055, and BK41 A. Leon #10057 at Alamitos Ave and 16th St. with an uncooperative petty theft
suspect.
When I arrived on scene I saw the suspect laying in the middle of the intersection of Alamitos Ave and 16th St. He
was handcuffed and his legs were restrained with a hobble restraint. I saw that several officers were controlling
him. I saw that there were two tasers and two batons lying in the street close to the north east sidewalk. I stopped
traffic from traveling in that area to preserve any evidence.
I was assigned to obtain witness statements from onlookers who may have witnessed the use of force.
I spoke to witness who told me the following: He saw the suspect walking North on the
East sidewalk of Alamitos Ave towards 16th St. There were two uniformed police officers following him trying to
get him stop.
Witness did not hear what the officers or the suspect were saying but, the suspect was not stopping.
When the suspect got to the North/East corner of Alamitos and 16th St. the officers tried to grab the suspect from
behind. The suspect pulled away from the officer and started fighting with them. He saw both officer hit the
suspect several times with batons and one of the officers use a "taser" on him. The suspect did not stop fighting
and seemed to be unaffected by the baton strikes or the taser.
The suspect walked into the street and one officer "jumped on his back". They continued to the middle of the
intersection with the officer on the suspect's back until they fell to the ground behind a police vehicle. He did not
see what happened after that. Through the entire incident witness did not hear anything that was said

***USE OF FORCE***
On 04/09/16 at 1503 hours, I (Officer B.Komori #10546) was on uniformed patrol as Unit 1B8 when I assisted Unit
BK40 (Officer A. Sturgeon #10055) and Unit BK41 (Officer A. Leon #10057) at 16th Street and Alamitos Avenue
regarding a pedestrian stop of a petty theft suspect, which resulted in a use of force (call #898).
Unit 1S35 (Sergeant E. Fernandez #10062) assisted.
While en route, Dispatch asked Unit BK40 and BK41 if they were "code 4" and BK 40 advised that they were not
"code 4" yet and that the suspect was not being cooperative. I was then authorized "code 3" to assist the Units.
Upon arrival, I observed both Officers in the middle of the street on the north side of 15th St and Alamitos Av.
Both officers were standing on either side of the suspect (male Black, John Doe). The suspect was standing in
between both Officers and had his hands behind his back and appeared to be handcuffed. The suspect had long
pants on but had no shirt or jacket on his upper torso. I saw that the suspect had two prongs and wires located on
his stomach and chest area, which I recognized were from our Department issued Conducted Electrical Weapon
(CEW).
The suspect was actively attempting to get away from the Officers by pulling away in all directions. The suspect
would continually put his head down and lean his entire torso forward as if to begin a sprint. He also moved his
legs as if he was running. Officer Leon was controlling the suspect's right arm and Officer Sturgeon was
controlling the suspect's left arm.
I could see that the two Officers were struggling to escort the suspect to a Police vehicle due to the suspects
behavior so I went to the rear of the suspect and attempted to use pain compliance in order to have the suspect
comply. I grabbed the suspect's right hand and used a wrist control pain arrow to direct the suspect to walk to my
patrol vehicle. The pain compliance technique did not work as the suspect continued to move his body around
and pull away from us. I immediately released the pain arrow and used my physical force to direct him to my
patrol vehicle.

Narrative
Using our physical force, we were finally able to walk the suspect to my patrol vehicle. He continued to try to pull
away from us and I could feel that there was much muscle tension from his entire body. Due to his active
resistance, we decided to place the suspect on the ground in order to place a hobble on his feet so that we could
prevent the suspect from attempting to flee or hurting anyone with his legs.
Officer Sturgeon controlled the suspects upper torso and used his bodily force to guide the suspect to the ground.
I grabbed the suspect's midsection area and used bodily force to overcome the suspect's resistance of being
placed on the ground. Throughout the entire process of placing him on the ground, the suspect tensed his entire
body and flailed around. Officer Leon controlled the lower portion of the suspect's body.
Once on the ground, I used my body weight to keep the suspect from getting up.He was moving around in an
attempt to get up from the ground. I handed Officer Leon my hobble and he and Sgt. Fernandez applied the
hobble on the suspect's feet.
Once the hobble was on, we put the suspect in the recovery position and waited for the Long Beach Fire
Department to arrive. The suspect sporadically would tense his entire body up and attempt to push himself up
from the ground. I stayed near the suspects upper leg and lower back area and kept my physical force on him to
prevent him from getting up. The suspect began vomiting while in the recovery position. He then began singing, "
You can't deny it! I'm a rider! You don't wanna mess with me!!"
The Long Beach Fire Department arrived on scene and strapped the suspect to a gurney. He was taken to a local
hospital.
Based on my training and experience, I believed that the suspect was under the influence of a narcotic called
Phencyclidine (PCP) based on the following signs and symptoms: skin was warm to the touch, the lack of clothing
for his upper torso, his entire body and muscles were tense, he was sweating profusely, and he had a blank
stare.
I was tasked with collecting evidence at the scene. I located one shirt and one sweater on the east sidewalk of
Alamitos Avenue, south of 15th Street. Officer Sturgeon told me that the shirt and sweater belonged to the
suspect. I collected the items and kept them in my possession until I later placed them into evidence. I also
located two CEW cartridges along with the wires and three prongs at the scene. I collected these items and kept

On 4/9/16 at 1504 hours, I (Sergeant E. Fernandez #10062) assisted Unit BK40 (Officer A. Sturgeon #10055) and
Unit BK41 (Officer A. Leon #10024) at Alamitos Avenue and 15th Street. Officer Leon advised via radio that they
were detaining a theft suspect and he was being uncooperative. (Call #898)
While enroute to the call, I drove northbound Alamitos Avenue from Anaheim Street. As I approached the
intersection of Alamitos Avenue and 15th Street, I noticed a patrol vehicle stopped in the middle of the intersection
facing northeast. I drove my patrol vehicle into the intersection and parked east of the prior mentioned patrol
vehicle. As I exited my patrol unit, I noticed Officers Leon, Sturgeon, and Komori detaining the suspect in the
number two lane of northbound Alamitos Avenue, approximately 20 feet north of the north crosswalk of the
intersection. Officer Leon was controlling the suspect's right arm, Officer Sturgeon was controlling the suspect's
left arm, and Officer Komori was controlling the suspects's wrist.
The suspect had been handcuffed and the officers were attempting to walk him to the patrol vehicle that was in
the intersection. The suspect was shirtless, appeared to be altered, and was sweating profusely. As the officers
attempted to walk the suspect, he violently torqued his upper torso from side to side and away from the officers as
he attempted to escape custody. The officers struggled to maintain control of the suspect as he repeatedly
planted his feet on the ground and attempted to run. The officers eventually walked the suspect to the rear door of
the patrol vehicle in an attempt to place him the rear seat. As the suspect stood by the rear door of the vehicle, he
continued to violently pull away from the officers and began kicking at the officer's legs. As the officers struggled
to control the suspect, I noticed a conducted electrical weapon prong inserted into his upper torso, indicating that
a CEW had been deployed on the suspect prior to my arrival. Per department policy, the suspect would need to
be transported to the hospital by LBFD due to the deployment of the CEW, and placing him in the rear seat of the
patrol vehicle was unnecessary. Due to the suspect's assaultive behavior, to prevent potential injury to the
arresting officers, and to gain better control of the suspect while the LBFD responded for the transport, I ordered
the officers to take the suspect to the ground. Officers Komori, Sturgeon,and Leon controlled the suspect's upper
torso and pulled him to the ground. For further refer to their reports.
Once on the ground, the suspect continued to violently torque his upper torso from side to side as he attempted to
break loose from the officer's control holds. The suspect also violently kicked his legs at the officers and used his
legs to lift his torso off the ground. Unable to gain complete control of the suspect, I broadcasted for an additional
unit to respond. As we waited for the requested assistance, the suspect continued to violently kick at the officers.
With no other officers on scene to assist with the arrest, I had no option, but to actively involve myself, and use
force to control the suspects's legs and impede his attack. I gained control of the suspects ankles and used bodily
force to overcome his resistance as he continued to kick. Officer Leon used his hands and body weight to control

the suspect's legs. While Officer Leon used bodily force to control the suspect's legs, I applied the hobble restraint
system around the base of his ankles.
After the application of the hobble, the suspect was placed on his side while we waited for LBFD assistance. Once
LBFD arrived, the suspect was placed on a gurney and transported to St. Mary's hospital without further incident.
After the arrest incident conlcluded, I assisted Unit BKS4 (Sergeant D. Lance) in coordinating the interviews of
witnesses to the incident. I also directed Officer Morales to locate surveillane video related to the incident. Officer
Morales responded to the Dollar Store (1480 Alamitos Avenue) in search of surveillance video and was advised
by the staff to return the following day when the store's manager was present.

USE OF FORCE:
On 04/09/16 at approximately 1505 hours, while working uniform patrol as unit 1B5, I Officer M. Zeidan # 10135
assisted unit BK40 (Officer A. Sturgeon # 10055) and unit BK41 (Officer A.Leon # 10546) who requested units to
assist in the intersection of Alamitos Ave and 16th Street with an uncooperative subject.
Upon arrival, I noticed Officer Leon, Officer Sturgeon, Officer Komori, and Sgt Fernandez on the ground in the
middle of the intersection attempting to control the Suspect who was handcuffed and on the ground. The Suspect

I was directed by Officer Sturgeon to contact a male subject, later identified as Witness who was
standing southwest corner of the intersection who witnessed the incident. I contacted Witness who told
me the following:

walk away from Officers in the middle of the street in a northbound direction. stated Officer Leon and
Sturgeon ordered the Suspect to stop several of times; however, he refused and continued walking northbound
away from them.
As they reached the northeast corner of the intersection, Officer Leon and Sturgeon attempted to grab the
Suspect from behind when he turned around and began to swing at them/throwing punches at Officers with two
close fists. The Suspect almost knocked one of the officers out, but could not tell me what officer at this time.
Witness stated that Officers struck the Suspect with their batons several times and tased him, however, it
was not working to gain control of the Suspect and take him into custody. stated Officer Sturgeon and
Leon then jumped on the Suspect and were able to physically take him down and place him into handcuffs as
other units arrived on scene.
Witness further stated that he knew the Suspect was going to fight with Officer because he was "Wet" and
had, "That look on his face man." I asked what does that mean. Witness told me that he believes
the Suspect was high on PCP. I asked him how did he know that. Witness told me he knows the Suspect
from the "Streets."
Witness was glad that Officers did not shoot the Suspect.

On 04/09/2016 I, Sergeant D. Lance # 6041 was working unit BKS4 when I assisted Unit BK40 Officer A.
Sturgeon # 10055 and Officer A. Leon # 10057 on a Use of Force. Call # 0898.
Upon my arrival I observed Officer Sturgeon, Officer Leon, Officer Komori, Sergeant Fernandez and unknown fire
personnel attempting to control and treat the suspect while he was handcuffed in the prone position in the middle
of the intersection of 15th Street and Alamitos Avenue. The suspect had a quarter-sized abrasion to his right
forehead, had no shirt on and was sweating profusely. I instantly thought the suspect was under the influence of
PCP, based on the thousands of people I have contacted as a police officer and the hundreds who I have seen or
arrested under the influence of various narcotics. The suspect appeared to have a blank stare, was sweating
profusely and appeared to have super-human strength. Based on my training and experience these are all signs
of possibly being under the influence of PCP.
I confirmed the suspect was getting medical treatment and coordinating the suspects transport to St. Mary's ER.
Fire Engine 10 and Fire Rescue 2 were on scene and providing advanced life support. Officer R. Garcia # 6178
rode in the back of the Rescue with the suspect to the hospital where he was joined by his partner Officer L.
Corona #6196. I directed Sergeant K. Green # 6276 (Unit 1S29) to respond to St. Mary's Hospital to monitor the
condition of the suspect and assist the officers in anything they needed to secure the suspect. The suspect was
subsequently admitted to the hospital for observation. For further see arrest report follow up by transporting units.
I was contacted by the involved officers, BK40, BK41, 1B8 (Officer B. Komori #10546) and 1S35 (Sergeant E.
Fernandez #10062). They each advised me of the force they used. For further see their follow up reports.
Officer Komori collected evidence at the scene and later booked it into evidence.
Officer Corona was directed to take photographs of the scene, the evidence, the suspect and the involved officers.
For further see his photographs in the Mideo system.
I immediately directed officers to attempt to get possible witness statements. I observed numerous onlookers in
the parking lot of 1480 Alamitos Avenue, The Dollar Tree store and parking lot. Officers attempted to contact
these possible witnesses but most of them left the location and did not want to talk to the police. I observed
approximately 12 Male and Female Black subjects in the parking lot get into various vehicles and leave the
parking lot when approached by officers to get witness statements. I put two of the vehicle license plates in the
call as they drove away,AND . For further on witness statements see follow up reports.
I made a search for possible surveillance cameras. The Dollar Tree store has cameras on the exterior but they
were not available to access. Sergeant Fernandez and I will make future attempts to retrieve any video. For

On 04-09-16 my partner (Officer A. Sturgeon #10055) and I (Officer A. Leon #10057) were working corridor
enforcement, along the major corridors of the West Division area. We were driving a marked black and white
police car dressed in bike patrol uniform with Long Beach Police Department patches on each shoulder and the
word "POLICE" stitched on the back; for further see photographs. We were traveling southbound on Alamitos
Avenue searching for a male subject who was a suspect in a recent theft of a 7-Eleven store located at 1165 East
Anaheim Street (call #0898).
The supplemental text in the call read that the calling party described the suspect as a male Black in his thirties,
wearing a black shirt, grey jeans, and red shoes. He was last seen walking northbound from the 7-Eleven with the
loss in hand.
While driving south on Alamitos Avenue, I informed my partner of a male Black subject who closely resembled
that of the suspect from the theft incident that occurred at the 7-Eleven store. The subject, later identified as
JOHN DOE, was walking northbound on the east sidewalk of Alamitos Avenue just south of 15th Street.
DOE was wearing a black long sleeve sweater, grey jeans, and bright red shoes. He was carrying a plastic
container of potable water and eating out of a brown paper bag, believed to be the loss taken from the 7-Eleven
store. Officer Sturgeon and I made a u-turn and activated our overhead forward facing red light.
We exited out patrol car and contacted DOE for further investigation. DOE turned to face us and shook his head in
a side-to-side manner as a gesture of saying no. I asked DOE to stop and he immediately took his black sweater
and white undershirt off and tossed them on the ground. DOE continued to shake his head in a side-to-side
fashion saying, "No." I could see DOE was physically fit displaying muscular definition.
After removing his clothing, DOE started to flex his biceps and clench his fists leading me to believe he was
getting ready to fight us. DOE had taken a fighting stance; his posture was that of a boxer with his arms up in front
of his chest, his hands in the form a fist, and his legs shoulder width apart with his left foot forward. I immediately
removed my Conducted Electrical Weapon (CEW) and held it down to my side, advising DOE he would be tased if
he attempted to attack us.
We continued to ask DOE to comply with our commands, but he continuously refused to do so and started to walk
away from us, continuing northbound on Alamitos Avenue. Officer Sturgeon attempted to explain to DOE that we
were investigating a theft incident and we needed to talk to him in regards to that incident.
DOE continued to ignore us and said, "No. I am going to drink my water and ya'll going to get in your car and drive
away." DOE picked up his gallon of potable water and drank from it, continuing to walk northbound Alamitos

Based on DOE's demeanor and combative behavior, I continued to warn him he would force me to "taser" him if
he did not comply with our orders. As we followed and got within close distance of DOE, he quickly turned towards
Officer Sturgeon with his fists raised high and his knees bent, as if he was going to punch him.
DOE had clearly demonstrated to us he was now an immediate danger to our safety and could cause us harm, so
Officer Sturgeon immediately discharged his CEW and struck DOE on his upper torso. The CEW had no effect on
DOE, and he continued to walk toward Officer Sturgeon in a threatening manner. I could see DOE had a fierce
look on his face and his hands were still clenched in the form of a fist. I quickly discharged my CEW and saw that
both prongs made contact on DOE's left stomach area, but the contacts were not effective. DOE continued to
move towards us and started swinging his fist in an attempt to strike us.
Based on my observations and experience, I assumed DOE was possibly under the influence of a controlled
substance because any other sober individual would yield to the voltage of a CEW, especially that of two
simultaneous CEW's.
I quickly dropped my CEW and transitioned to my baton. DOE continued to violently swing his fists at us in an
attempt to strike us. As I held my baton I aimed and swung my baton at DOE's left leg. I struck DOE on his left
lower leg, and he quickly turned toward my direction. The baton strike had no effect. DOE attempted to swing his
fist at me, so I swung my baton and struck DOE a second time on his lower right leg, which caused him to fall on
his right knee.
I stopped and retreated believing DOE would stay down and no longer resist us, but DOE quickly got up and
proceeded to approach me in a menacing manner continuing to violently swing his fists at me. I aimed and swung
my baton approximately three times at DOE's left arm, but his movement and violent swings caused me to strike
DOE on his left rib area. At some point, I slipped and fell on the ground striking my right knee on the pavement,
which caused a large abrasion, swelling, and discomfort.
I quickly got up and saw Officer Sturgeon apply a carotid control hold on DOE from behind, encircling his arms
around his neck area. Officer Sturgeon's momentum when applying the carotid control hold caused DOE to fall
face first onto the pavement.
While on the ground, I quickly rushed over to assist Officer Sturgeon. I could see Officer Sturgeon was having
difficulty maintaining control of DOE, as DOE continuously resisted by using his body weight in an attempt to push
Officer Sturgeon off of his back. I took control of DOE's left arm and attempted to place it behind his back, but he
was stiff and resisted by pulling his arm under his stomach. While attempting to control DOE, I could hear a male
subject's voice yelling, "Please don't kill him! He's on PCP!" The subject continued to say, "I know he's violent, but
please don't kill him!"
Approximately ten seconds later, DOE stopped resisting and his body became limp after losing consciousness
from the carotid control hold Officer Sturgeon had applied. I was able to take control of his left arm and bring it
behind his back. I then applied a set of handcuffs to his left wrist. With the assistance of Officer Sturgeon, we were
able to apply both handcuffs and safely secure DOE.
We immediately placed DOE on his left side, in the recovery position, and seated him up after he regained
consciousness. DOE immediately said, "What just happened?" Officer Sturgeon informed DOE he would be okay
and assured him he was safe. We waited for other units to assist us.
Unit 1B8 (Officer B. Komori #10546) was the first assisting unit to arrive along with unit 1S35 (Sergeant E.
Fernandez #10062).
With the assistance of Officer Komori, Officer Sturgeon and I escorted DOE to our black and white police car to
seat him in the back seat while we waited for Long Beach Fire personnel to arrive. During the escort, DOE
resisted again and started to forcefully use his legs by planting his feet flat on the ground to prevent him from
moving forward.
I could feel DOE's arms become rigid and started to violently move his upper body in a side-to-side fashion in an

attempt to break free from our control. We felt it was best to have DOE lay on the ground to prevent him from
causing further injuries to himself and Officers.
We used our body weight to take DOE to the ground and laid him on his stomach. DOE started to violently kick his
legs up toward my face. To prevent DOE from striking my face, I took control of both DOE's legs and held them
down until Sergeant Fernandez assisted with a hobble restraint. After the hobble restraint was placed and we
safely secured DOE's legs, we remained next to DOE until paramedics arrived.
Once paramedics arrived, we safely took control of DOE and placed him on the paramedic gurney. DOE was later
transported to St. Mary Medical Center for his injuries.

radio that they had a subject detained that matched the description of a petty theft suspect, (call #898).
An officer then aired over the radio that the suspect was uncooperative. A short time later, the officer advised that
they needed units Code-3 as the suspect became violent and combative.
Upon arrival I secured the scene on Alamitos Avenue just south of 15th Street. I observed that the business at

1480 Alamitos Avenue (Dollar tree) had several surveillance cameras outside of the business. I later contacted a
store employee who only identified herself as the assistant manager. I asked the employee if the video
surveillance cameras were operable and she stated, "yes". I asked her about the camera on the west side of the
business and she told me that specific camera faces southbound toward their trash bins. The employee further
told me that she did not have access to the video surveillance system and that I could return on 4/10/16 to contact
.
On 4/10/16 at 0900 hours, I responded to the aforementioned business and contacted OCP, (
who identified herself as the store manager.had access to the video surveillance system via the loss
prevention office. I provided with the time frame of the incident that occurred on 4/9/16 at approximately
1503 hours. At that exact time, while looking at the monitor (Channel/Screen #8), I observed a male Black subject
walking northbound on the east sidewalk of Alamitos Avenue just south of 15th Street. The subject was wearing a
black sweater or jacket, blue pants, red shoes and dread locks that were up.As the subject walked, he appeared
to be eating a banana with his left hand as he held onto a large water bottle with his right hand.
A few seconds later, a black-and-white police vehicle is seen traveling southbound on Alamitos Avenue from 16th
Street, suddenly makes a U-turn, then drives toward the male Black subject. The subject in question and the
police vehicle move forward and out of the screen.
The video surveillance camera did not capture the Use of Force incident.
stated that she will contact loss prevention and have them transfer the video footage onto a USB or CD
for evidence.stated that she believes the video footage can be ready for pick-up on Monday, 4/11/16.

Narrative
This Follow-up is solely to document the injuries sustained during the incident.
It should be noted that during the confrontation, my partner (Officer A. Leon #10057) and I (Officer A. Sturgeon
#10055) sustained injuries.
Officer Leon sustained injuries to his right knee, including bruising and swelling. The on-call physician observed
the injuries and deamed it necessary for Officer Leon to stay off work until the swelling went down and he was
able to walk without limping.
I (Officer Sturgeon) sustained abraisions to my right elbow, which caused swelling and bruising. I also had
muscle pain in the upper right area of my back. No work restrictions were placed at this time.
The injuries were caused do to the suspect's actions during his detention.For further on the incident, see the
Main DR.

Narrative
I, Officer D. Moreno #5150 working Unit 112C was dispatched to St Marys Hospital to assist Unit 1C34 Officer S.
Miller #6067 with a 990 from the hospital back to jail call #0898.
The call further stated the prisoner was on the 6th Floor of the hospital in room #231.
Upon arrival in room #231, I contacted Officer Miller who advised me they were medical clearing the prisoner
(John Doe) for booking.
John Doe was laying on his back on top of a hospital bed with his left hand cuffed to the bed rail. John Doe heard
that he was going to jail and quickly sat up in the bed, ball up his fist and said I'm not going to jail.
Officer Miller requested for additional units to assist as well as a Sergeant.
Unit 1C64, Officers E. Perez #10008 and Officer M. Sandoval #10806, arrived to assist along with Unit 1C65,
Officers C. Silva #6321 and Officer J. Connell #10777.
Unit 1S19 Sgt S. Vanden Bosch #6064 arrived on scene also.
I advised John Doe we were going to transfer him to another gurney so that he could be transported to another
hospital. John Doe then tried to jump off the bed, I took control of his left shoulder by placing both of my forearms
against his shoulder and tried to hold him down. John Doe then lifted up his head I thought he was going to bite
Officer Sandoval so I took my right hand and grabbed his hair to hold him down, my left forearm was still on his
shoulder.
I released hold of John Doe when he was transferred to the other gurney and strapped in for his safety.
Sgt Vanden Bosch was advised of the use of force.

On 4/11/16 I, (Officer S. Miller # 6067) was unit 1C34. I was assigned by unit 1S34, Sgt. Ramirez #5979, to
relieve unit 3B23, Officer R. Mohagen #5796 who was guarding a prisoner at St. Marys Hospital. (Call #898).
Upon arrival approximately 16:00 hours, I went to the sixth floor, room 631. I switched out the handcuffs, on his
left arm while the patient/prisoner was being medically treated.
I spoke to She told me around 17:00 hours the patient would be cleared for booking.
I went through the booking forms and noticed they were blank for the most part with John Doe. I asked the patient
his name and he stated, "I don't have to tell you that." I replied, "That's fine, sit up. I'm your taxi to jail." He
jumped to his feet, in a crouching position, making his right fist into a ball. He replied, "I'm not going with you. Let
me go, or their will be a fight. (As he raised his right fist close to his body under his chin in a fighting aggressive
stance.
I backed up, and notified unit 1S19, Sgt. S. Vandenbosch #6064, The prisoner was still combative and I requested

additional units and a supervisor to assist.
I spoke with RN I asked if the Doctor would give the prisoner/patient a sedative to calm him down. Dr.
and RN agreed but would not force the shot and the prisoner refused further treatment stating,
"Get away from me. You are trying to trick me. I don't want what you say."
Unit 112C, Officer D. Moreno # 5150, arrived on scene. Officer Moreno tried numerous times to get the prisoner
to relax and go with the program. The prisoner stated, "It goes higher than you. I'm not going where you want me
to go. I will only go where I want to go."
Unit 1S19, Sgt. Vandenbosch and Sgt. Ramirez both arrived on scene. Sgt. Vandenbosch tried numerous times
to reason with the prisoner not to fight uniformed officers and that he was going to jail and that we could not let
him just go.
I called booking and booked John Doe over the phone per booking Sgt. S. Soliszano. Due to the prisoners on
going violent behavior we were directed to order a private ambulance and transport the prisoner to USC Medical
Center Jail Ward.
Ambulance unit 236, EMT Pierce Bennett, and EMT Anthony Nevarez arrived to the hospital.
Additional units also arrived. Unit 1C65 (Officer Connell #10777 and Officer Silva #6321) and unit 1C64 (Officer
Perez #1008, and Officer Sandoval #10806 ) .
I asked the subject to comply and keep his legs straight as I held the hobble.He sat up Indian style with his legs
under the blankets. Uniform officers held him down. I attempted to place the hobble on his feet and was unable
to do so because the prisoner kept moving his legs. I then placed my entire body weight on his quad muscles
above the knees attempting to lock out his legs. Officer Perez , and myself put on the hobble, while other officers
held him down. Officer Sandoval held on to the prisoners right arm with the help of officer Moreno and Silva. At
one point the prisoner kicked up his legs with me on top of him, causing me to elbow officer Silva in the face.
Together we were able to control and hold him, then carried him from one bed to the gurney. We then secured
him to the gurney without using injuring force to the prisoner.
I then interviewed EMT Pierce Bennett. He told me he was unit 236, saw police restrain the patient, holding him
down, then lifted the patient onto the gurney, strapping him in place with handcuffs. He mentioned nothing he saw
the police do concerned him, that the patient was not injured during the incident.
I then interviewed EMT Anthony Nevarez. He told me the police restrained the patient, patient was transferred to
gurney, patient placed inside ambulance to be transported to another hospital. He saw the patient was not
answering basic medical questions such as his name, and was aggressively pulling back and away from officers
trying to hold the patient down. He mentioned the police handcuffed the patient's right arm above his head, and
his left arm to the side of the gurney, and had the black rope around his feet tied to the gurney.
Sgt. Vandenbosch observed RN Nwani in the hall watching the incident. I then spoke to RN Nwani and asked
what he saw. He told me he was the oncoming RN for the patient and that the patient tested positive for PCP,
Marijuana, and Meth. He mentioned that the patient would not cooperate with hospital staff when the tried to get
medical information, and came to the hospital in an altered state. He saw six police officers lay and hold the
patient down, and tied the patient to the gurney. He told the patient to "Relax." Nothing he saw the police do to
the patient concerned him and he stated the patient was not harmed by police.
Unit 1C64, rode in the ambulance with the prisoner. Unit 1C65, followed behind the ambulance.
WC Lt. Coy was notifed of the incident.

Narrative
On 04/11/2016 at 1811 hours, I (Sergeant S. Vanden Bosch #6064) was working uniformed patrol in a marked
black and white patrol supervisors SUV. I was notified by unit 1C34 (Officer S. Miller) that the prisoner at St. Mary
Medical Center had been medically cleared by hospital staff and was ready to be transported to a booking facility.
Officer Miller also advised me that the suspect, identified only as John Doe, had informed Officer Miller that he
was not going to comply with Officer Miller. I responded to St. Mary Medical Center to assist. Call #0898.
I spoke with John Doe and advised him again that he was under arrest and that he was obligated to comply with
the officers. I informed him that his only choice was to comply with the officers and that if he did not comply with
the officers that the officers would have to use force to make him comply with them. John Doe repeatedly told me
that he did not want to comply with the officers and that he did not have to comply.
Based upon my discussion with John Doe, I contacted LBPD Booking and spoke to Sergeant Solorzano. We
decided that, due to John Doe's non-compliant attitude and his prior fight with police officers, that the best course
of action was to transport John Doe to USC Medical Center via private ambulance on a gurney.
A private ambulance was summoned and I again contacted John Doe. I advised him that he needed to cooperate
with the officers. John Doe was lying on his back on a hospital bed, with a blanket pulled up to his upper chest.
His left hand was handcuffed to the bed rail and his right hand was free. I told him that we were going to apply a
hobble restraint to his lower legs and that he needed to extend his legs out.
As soon as I told John Doe to extend his legs out, he pulled his legs up toward his buttocks and pulled the blanket
up higher. He then made a fist with his right hand and appeared to be preparing to actively resist the officers.
I was standing near John Doe's head on his right hand side, Officer Moreno was standing across from me on his
left hand side. Officer Sandoval was standing next to me to my right, Officer Miller was standing to Officer
Sandoval's right. Officer Silva, Officer Perez and Officer Connel were also present near John Doe's lower body.
I observed Officer Moreno take control of John Doe's upper body along with Officer Sandoval. Officer Miller
attempted to control John Doe's midsection. These officers attempted to control John Doe by placing their body
weight and using bodily force to hold him in position while handcuffing.
I repeatedly told John Doe, at least 20 times, to calm down and relax and to allow the officers to place the hobble
restraint on his legs. I then observed John Doe move his head forward near Officer Sandoval's hand and John
Doe appeared to be attempting to bite Officer Sandoval's left hand. I told Officer Sandoval to move and then I

observed Officer Moreno grab onto John Doe's hair and pull his head back away from Officer Sandoval's hand,
consistent with the use of a hair pull takedown type pull.
Officers then continued to hold John Doe down while the hobble was applied.Once the hobble was applied, all
the officers slightly lifted John Doe off of the hospital bed and placed him onto the ambulance gurney. I secured
the hook end of the hobble restraint to the gurney while the officers secured John Doe's wrists to the gurney using
handcuffs.
Once John Doe was secured to the gurney, I did not observe any further force being used.
I attempted to speak to John Doe however he refused to make any statements at all to me and merely stared at
me.
I directed Officer Miller to interview the two ambulance technicians and the doctor, all whom were present during
the use of force.
I did not observe any injuries to John Doe as of a result of this use of force.
John Doe was transported to USC Medical center by the private ambulance.
The Watch Commander, LT. K. Coy, was notified of the use of force.

On 04/11/16 at 1708 hours, my partner (Officer M. Sandoval #10806) and I (Officer E. Perez #10008) responded
to Saint Mary's Hospital to assist Officer S. Miller #6067 regarding an uncooperative prisoner, call #0898.
My partner and I were wearing department issued police uniforms. We had Long Beach Police patches on both
shoulders, which would easily and readily identify ourselves as Long BeachPoliceOfficers.
Upon arrival, we contacted the assisting officers in room #631. Arrestee John Doe was lying on a hospital bed. He
was lying on his back and was partially covering himself with a hospital blanket. His left hand was handcuffed to
the bed rail, however, his right hand was not handcuffed. Therefore, allowing him a free range of motion to
possibly attack any police officer. Sergeant S. Vanden Bosch advised John Doe that he needed to cooperate with
us. He advised him that we were going to apply a hobble restraint to his lower legs and he needed to extend his
legs outward.
Doe immediately refused and pulled his legs up toward his buttocks. Based on his history and current actions, I
believed he was going to resist any commands and fight with us. He had been given ample time to peacefully
comply without any force being used.
I was standing near John Doe's feet when he began to resist. For everyone's safety, I held onto his lower legs. I
applied pressure using both of my open hands. I placed my hands on top of his lower legs and used force to pin
his legs on top of the hospital bed. By doing so, I was able to prevent Doe from kicking officers. This method was
the safest option available. Officer Miller was attempting to place the hobble restraint on his lower legs. I observed
that due to Doe continuously moving his legs, he was having a difficult time applying the hobble. I assisted him
and as a result, we were able to safely place the hobble restraint on both of his lower legs.
We were able to transfer him onto the private ambulance's gurney. I handcuffed his right arm onto the gurney's
rail. Once he was secured, he was removed from the hospital via the gurney and no further force was used. He
was transported to USC Medical Center by the private ambulance.
Sergeant Vanden Bosch was advised of the use of force.

On 04/11/16 at approximately 1708 hours, while working uniform patrol as Unit 1C64, my partner (Officer E. Perez
#10008) and I (Officer M. Sandoval #10806) assisted Unit 1C34 (Officer S. Miller #6067) at St. Mary's Medical
Center located at 1050 Linden Avenue, in room 628, to assist transporting a prisoner from the medical center to
the jail facility.
Upon arrival, we were informed the subject (determined to be John Doe) was uncooperative and did not want to
comply.
Officer Miller asked Doe to keep his legs straight out to apply the Hobble Restraint. Doe crossed his legs and sat
on them underneath the blanket. Doe was advised he had to be moved to the gurney. Doe was not listening and
continued sit on his legs and tense his body. Doe's left hand was handcuffed to the hospital bed but his right arm
was free to move around. I noticed Doe's right hand was clenched into a fist.I held onto Doe's right arm to avoid
Doe punching myself or assisting officers. Assisting officer's helped hold down Doe as Officer Miller placed the
Hobble Restraint. Doe attempted to move around and kick his feet but was held down by assisting officers. As I
held Doe's right arm, Doe attempted to get his mouth closer to my left hand in an attempt to bite me. Sergeant
Vanden Bosch advised me to move my hand away from Doe's mouth to avoid being bitten.
Once the Hobble Restraint was placed and Doe was controlled, collectively we moved Doe from the hospital bed
to the gurney. I handcuffed Doe's right hand to the gurney, and double-locked the handcuff.
Officer Perez and I rode in the ambulance to USC Medical Center (1200 North State St) with Doe.
Unit 1C65 (Officer C. Silva #6321 and Officer J. Connell #10777) followed behind the ambulance.
Doe was left in the custody of Officer Silva and Officer Connell at USC Medical Center.
Unit 1S19 (Sergeant S. Vanden Bosch #6064) was advised and on scene.

Narrative
On 4/11/2016 my partner (Officer J. Connell #10777) and I (Officer C. Silva #6321) working unit 1C65, assisted
units at St. Marys Hospital regarding a combative prisoner. Call #898.
Upon arrival we responded to hospital room #631 and met with officers S. Miller #6067, D. Moreno #5150, E.
Perez #10008, and Officer M. Sandoval #10806. There were also two EMT's from Liberty Ambulance Company in
the room. The EMT's were there in order to transport the prisoner (later identified as John Doe) to LA County USC
Medical Center. Shortly after our arrival Sgt. Vanden Bosch #6064 arrived on scene.
It should be noted that Mr. Doe was arrested on 4/9/2016 and during that arrest Doe was combative with officers
and a use of force ensued during his arrest. Doe was transported to the hospital following his arrest and has been
there since.
Doe was lying on his back in the hospital bed. Doe had his left hand handcuffed to the hospital bed as he was in
police custody. Officer Miller explained to Doe that due to his previous violent behavior with officers that we were
going to place a hobble on his legs near his feet so that he would not kick officers. After this was explained to
Doe, he immediately shook his head No and pulled his feet in towards his body. Officer Miller decided that we
should wait for Sgt. Vanden Bosch until he arrived on scene before attempting to hobble and move Doe from the
bed to the gurney.
As Sgt. Vanden Bosch arrived he spoke to Doe and explained that we were going to move him from the hospital
bed to the gurney provided by Liberty Ambulance, so that he could be transported to USC Medical Center. Sgt.
Vanden Bosch asked Doe if he would put his legs straight so that officers could apply the hobble. Doe did not
respond to Sgt. Vanden Bosch and refused to put his legs straight.
After failing to respond to Sgt. Vanden Bosch, we then moved in towards Doe in an attempt to move him from the
bed to the gurney. Officer Miller and I immediately grabbed Doe's legs in an attempt to control them as Officer
Connell and Perez applied the hobble. Officer Moreno and Sandoval controlled Doe's upper body. As we all
attempted to control Doe, he was trying to sit up, grab officers arms, kick and move about the bed in order to
prevent officers from applying the hobble. After approximately 15 seconds of struggling with Doe, the Hobble was
applied and he was safely transferred from the hospital bed to the gurney. Doe was secured to the gurney and
transported by ambulance to USC Medical Center.
Doe was transported and released to the custody of the LA County Sheriffs Department and hospital Staff.
Sgt. Vanden Bosch was on scene and notified of the incident.

Narrative
On 04/11/16 at approximately 2025 hours, while working uniform patrol as Unit 1C65, my partner (Officer C. Silva
#6321) and I (Officer J. Connell #10777) assisted units at St. Mary's Medical Center located at 1050 Linden
Avenue, in room 631, to assist transporting a prisoner from the medical center to the jail facility (Call #0898).
Upon arrival, I entered room 631 and observed ARR Doe sitting in a hospital bed with his left hand handcuffed to
the railing of the bed and his right hand free. Officer Miller #6067 told Doe to put his legs out straight so that he
could apply a hobble restraint to Doe's legs. Doe immediately began to shake his head from left to right that I
interpreted as Doe refusing to comply with Officer Miller's request. At the same time, Doe began to pull his legs
towards the torso of his body and sat upright in the hospital bed.
Unit 1S19 (Sergeant S. Vanden Bosch #6064) entered the hospital room and asked Doe to put his legs out so that
we could apply the hobble restraint. Doe blankly stared at Sergeant Vanden Bosch and did not make any effert to
change his posture in the hospital bed. Officers began to grab hold of Doe's legs and Doe immediately began to
tense his entire body. Doe began to kick his legs from left to right in an effort to prevent officers from applying the
hobble restraint.
I placed my right knee on top of Doe's left leg in an attempt to straighten and stabilize Doe's leg in an effort to
apply the hobble restraint. I assisted Officer Perez #10008 in applying the hobble restraint. Sergeant Vanden
Bosch repeatedly asked Doe not to resist and to comply during the application of the hobble.
Once the hobble restraint was placed and Doe was controlled, collectively we moved Doe from the hospital bed to
the gurney.
Unit 1C64 (Officer M. Sandoval #10806 and Officer E. Perez #10008) rode in the ambulance to USC Medical
Center (1200 North State Street) with Doe while my partner and I followed behind in our patrol vehicles.
Doe was left in the custody of Unit 2A39 (Officer E. McGowan #10519) and Unit 2A16 (Officer E. Olmos #10574)
without further incident.
Sergeant Vanden Bosch was notified of the use of force.
