Incident Summary
Dispatch:
O cers responded to the area regarding a ght call where one subject was possibly armed with a gun.
Force Used:
O cer Roberts conducted an armbar takedown of the arrestee (Joshua Randolph) and deployed his CEW with 2 cycles (non-effective). He also punched Randolph twice in the
ribcage when Randolph tried to bite him and jabbed his baton twice against Randolph’s thigh.
O cer Hernandez deployed his CEW with 2 cycles, struck Randolph 5 times on the shin with his ashlight,
and punched Randolph once in the chest when Randolph attempted to remove O cer Hernandez’s gun from the holster and once in the face when Randolph tried to bite him.
O cer Fox used bodily force while handcu ng Randolph, which consisted of pulling on Randolph’s arms.
O cer Rivett struck Randolph once on the upper arm with his baton and used bodily force while handcu ng Randolph, which consisted of pulling on Randolph’s arms.
O cer Manu punched Randolph once in the face when Randolph ran towards him and struck Randolph 3 times in the lower leg and three times in the lower leg using his ashlight.
O cer Moss applied her department issued hobble to Randolph while he was still kicking his feet.
Injuries:
O cer Roberts had minor scrapes on his left forearm.
O cer Hernandez had minor scrapes on his forearms.
No other o cers were injured.
Arrestee Randolph had minor probe contact related injuries on his left upper arm, left nipple area, and the right side of his torso. Randolph also had a very small abrasion above his
right eyebrow.
He also had a laceration to his left shin and his left tibia was found to be broken.

O cer Burleson took photographs of the scene, all involved O cers, and of Randolph.
No video was located at the scene that might have captured the incident.
Statements:
I attemped to interview Randolph at the hospital, but due to his altered state (most likely due to drug abuse), I was unable to obtain an sensible statement from him. For further, see
my Supplemental report.
Miscellaneous:
It should be noted that while being treated at Lakewood Regional Hospital, Randolph attacked ER staff and hospital security staff while still handcuffed to the gurney causing minor
injuries to one nurse. O cer Castro completed a supplemental report for battery on hospital personnel and took photographs of the victim.
While ghting with the hospital personnel, Randolph exposed O cers Castro, Burleson, and Moss to his blood and IV uids.
Arrestee Randolph was subsequently admitted to the hospital due to complications directly related to his drug abuse.
I completed exposure reports for O cers Castro, Burleson, and Moss as well as for O cers Roberts, Hernandez, and Fox for exposure to Randolph’s saliva when he tried to bite
them.
Upon LBFD’s arrival at the scene of the incident, they cut off Randolph’s pants to provide him medical treatment. The pants were later given to hospital personnel as patient’s
property. When Randolph was being prepared for transportation to booking, the transporting O cer discovered that Randolph had a black plastic cap-style toy revolver in his pants

pocket. This item was subsequently booked into evidence.
I spoke to all the O cers on the call regarding the proper search of prisoners in custody. I also provided In-Service training to all North Watch 1 personnel regarding the proper
search of prisoners in custody. I further advised DET Sergeant Bernsen and Watch 3 Sergeants to provide similar In-Service training to their personnel.
Conclusions/Actions:
I verbally counseled both O cer Hernandez and O cer Roberts on their choice to go hands on as opposed to proning out the suspect. I discussed the hazards of approach and
dealing with and detaining armed suspects. I also reminded them about LBPD training regarding dealing with armed suspects and how we are trained to prone out anyone suspected
of being armed.
I further verbally counseled both O cer Hernandez and O cer Roberts regarding the decision to let go of Arrestee Randolph when the CEW was deployed. I reminded them that
LBPD training both says and demonstrates that just because an O cer is physically touching a suspect, that O cer will not necessarily be incapacitated by the CEW deployment.
I also verbally counseled O cer Roberts regarding his decision to break from being lethal cover and attempt to take control of Arrestee Randolph’s arm. I reminded O cer Roberts
that if he has taken the role of lethal cover, he should continue in such a role until someone else takes over for him or the suspect is in custody.
They were both receptive to the all the counseling.
Based on the statements provided by all parties and the evidence at the scene, I conclude that the force used was In Policy with Verbal Counseling provided for O cers Hernandez
and Roberts and In-Service Training provided to the involved O cers and relevant watches.

I noti ed On-Call Violent Crimes Detective Ternullo about the incident.
I noti ed On-Call IA Sergeant Scaccia and Mendoza, both of who responded.
I called out Unit L1 Moncure to swab O cer Hernandez’s gun at the NPSS.

Sergeant Perez, Please review the incident with O cers Roberts and Hernandez covering the following areas: Both o cers articulate reasons they believe the
subject(s) they are stopping are armed. However, they order them to the front of the car and decide to go to rear wristlock to handcu ng. This is contrary to
training where we prone suspects out if we believe they are armed. A rear wristlock provides no control of a suspect’s free hand and is not suitable for handcu ng
an armed suspect. If we articulate a suspect is armed then our actions should be consistent with that. O cer Roberts articulates he is lethal cover while his
partner takes a rear wristlock. “as my partner instructed Randolph to place his other hand on the back of his head, I noticed he was beginning to lift his left hand
off the vehicle…. I immediately approached Randolph and grabbed a hold of his left wrist so as to gain control of his arm.” This sounds as though Hernandez told
the suspect to do one thing and as he was complying Roberts took it as a sign of resistance. The use of force essentially begins here. Roberts never articulates
why the second person is not a threat and why he feels he can safely become involved in a physical altercation when a person they previously described as
possibly being armed is left unattended. He was lethal cover and then he wasn’t. In Hernandez’s report he writes” My partner yelled out to me to let go of his arm,
because he was going to deploy his CEW. I immediately let go….” Please review with the o cers that the use of CEW while in physical contact with the suspect will
not result in the o cer being incapacitated. If the concern is a probe will strike him, the ring o cer should move closer or take precautions to prevent the
inadvertent striking of the partner. However, turning the suspect lose and having him confront o cer Manu in the manner that he did is something that should be
discussed with the o cers. Hernandez over utilizes the word “immediately” and it reduces the readability of his report. Remind him to reread his reports and look
for repetitive words. Many times repetitive words can be eliminated without affecting what is being said. It is unacceptable that a person suspected of being
armed was not searched until he reached the hospital where a replica cap gun was recovered from his pocket. This issue should be addressed with the entire
watch. The potential for a shooting in the hospital or the shooting of a handcuffed prisoner can be greatly reduced by a proper search. Once you have reviewed
the incident with them please re-submit the UOF to me. Call if you have question.

Use of force incident was reviewed in entirety, and the application of force based on the totality of circumstances, was determined to be within Department policy.
However, several legitimate concerns/training de ciencies were identi ed by Lieutenant E. Herzog regarding the incident, and discussed with Sergeant Louis
Perez resulting in verbal counseling/retraining for involved police o cers. A Divisional Project Assignment is being generated for handle by W-1 and W-3
lieutenants with involved employees to address notable risk management and quality control issues regarding the below incident. Project assignment shall
include thorough debrief of training bulletins addressing appropriate patrol tactics when confronting suspected armed individuals, proper searching techniques
related to the searching of potentially armed and handcuffed prisoners, as well as available force options in dealing with combative individuals. Divisional Project
Assignment to also include, for all watches, a critical debrief of incident by lieutenants and sergeants for respective patrol personnel.

UOF was in policy. There was verbal counseling provided to the involved o cers related to multiple issues during the incident. There was also a divisional project
issued by Cmdr Komisza to debrief and train his personnel on tactics and search techniques. No further action necessary.
