Incident Summary_RedactedLong Beach Police Dept Use Of Force Report Incident Entered By: Sergeant Ray Alexander - 5345 Assigned Investigator: [Incident pending assignment] Incident Details Date Received Date of Occurrence Time of Occurrence 5/11/2017 5/11/2017 21:20 Record ID # DR Number IA No 11661 170027850 UOF2017-0267 Date/Time Entered 5/12/2017 01:41 Incident Summary Officer Oak #10573, initiated a traffic stop on a bicyclist in front of 1008 LB Blvd. Officer Oak attempted to use bodily force to gain control of the suspect after he twisted out of his standing modified search. Assisting Officer Ortiz #10025, use baton strikes to the right shin area before the suspect began running across traffic over the Blue line fences where Officer Ortiz deployed his CEW. The suspect was taken into custody.The suspect suffered minor injuries to his back area from the CEW probes, and abrasion to his chin area as well as seven stitches to his chin and two staples to his right shin and a broken right upper incisor. No officers were injuredBoth officers were equipped with BWC which captured the incident, Officer Torres #10022, photographed involved officer, the scene and the suspect. Officer Meyers #10363,photographed the leg injury. No other recording were located. I contacted the suspect in the emergency room and asked the suspect why did he run from the officers and he stated he was stopped for no reason, I informed the deft he was stopped for violation 21201(d)VC riding a bicycle during hours of darkness without a light. The deft stated he placed his hands behind his head and the officer approached him from behind and placed his body against his and he stated, "That wasn't cool". The deft stated he broke out away from the officers and another officer struck him with his "bat" so he took of running. No further questions were asked, I then explained to the deft the charges he was arrested for and suggested he cooperate in the future to avoid any additional charges. My BWC captured the statement. I reviewed the BWC for both officers and I observed the officers utilized approximately one minute explaining why the suspect was stopped as well as attempting to gain his compliance prior to any application of force. Officer's recovered an empty consumed small miniature Gin alcohol bottle and empty marijuana containers. In my opinion, the force used was reasonable, effective, and within policy.I notified Watch Commander Lt. Martinez regarding the Use of Force.
