Body Worn Camera Footage Reviewed Prior to Filing
On 5/11/17, I (Officer E. Oak #10573) was working as Unit 4C2 in a marked black and white police vehicle when I
was driving southbound on Long Beach Boulevard approaching 10th Street and observed a subject riding his
bicycle northbound on Long Beach Boulevard from 10th Street without a bike light and conducted an investigative
stop in front of 1008 Long Beach Boulevard (Call #1709 and Call #1711).
I turned on my forward facing red light and turned on my siren to notify the suspect (later identified as Chandler
May) that he was being stopped. The suspect rode his bicycle several feet before acknowledging me, stopped
and stood with the bicycle placed down at his feet and he stepped aside from it. I stopped my vehicle, turning off
the siren and keeping the forward facing red light on and immediately opened my driver side door and stepped
out. I advised the suspect that he was being stopped and detained for not having a bicycle light. He began
looking around and said that he did not need a bicycle light because it was well lit outside and that he did not need
to ride with a bicycle light. I notified dispatch I was stopping a subject at 10th Street and Long Beach Boulevard
on an investigative stop.
The suspect kept his hands near his front waistband and he was wearing a thick letterman style jacket and large
black baggie pants. His front waistband area was difficult to see due to his hands and jacket. Based on my
training and experience, I know that gang members and other subjects who carry firearms usually carry their
firearm in their front waistband area. I also observed a bulge in his front right pant pocket. Since I had not
searched him and could not see if there were any weapons on him, and because of his uncooperative behavior, I
removed my firearm and advised him to interlock his fingers behind his head and to turn around. The suspect
refused and continued to say that he had no reason to be stopped and searched. I advised him that he was being
stopped because he had no bicycle light and he became argumentative by continually saying he did not need a
light and that I could not detain him. As I told the suspect he needed to place his hands behind his back so I could
search him he calmly told me, "No," and kept his hands in front of him near his front waistband area. I observed
another police vehicle stopping to assist (later identified as Unit 1C7, Officer J. Ortiz #10025).

As Officer Ortiz exited his vehicle, I was telling the suspect to interlock his fingers behind his head and turn around
and he refused. I advised the suspect that if he did not cooperate he would be placed under arrest for refusing to
obey a lawful order and delaying the duties of an officer. I also advised him we would use whatever reasonable
force necessary to arrest him then. Officer Ortiz stood to my right, next to the front passenger door of my vehicle
and had his Taser pointed at the suspect. The suspect continued to refuse to follow our lawful orders and then
placed his hands behind his back where I could not see his hands. The suspect continually looked around while
ignoring our commands.
Officer Ortiz advised the suspect that he was recording and I also advised the suspect that I was recording
because I believed my body worn camera had been activated as I exited the vehicle but later found out it had not.
I advised the suspect that he would just get a citation if he cooperated and since he told me that he was not on
parole or probation and if he did not have any warrants, I would just let him go. He continued to stand there with
his hands behind his back waistband area where I could not see what he was doing with his hands. I also know
there was a potential for weapons because I could not visually clear his back waistband because he was standing
facing me and was also wearing a large baggy letterman style jacket. I told him that I did not know if he had any
weapons on him and that I could not see his hands and he replied, "I don't have any weapons," and I replied, "I
don't know that." He shrugged his shoulders and replied, "You don't have to know that." I advised the suspect
that he does not do my job and advised the suspect to show me his hands. The suspect continued to refuse to
obey and show me his hands. I continued to tell him to show me his hands and after multiple commands he then
placed his hands in front of his body and stared at his hands. I explained to him that he needed to turn around
and interlock his fingers behind his head so that I could search him for weapons and make sure that both of us
were safe so that I could do my job. I thanked him for showing me his hands and then ordered him to turn around,
interlock his hands behind his head and spread his feet and advised him that I was giving him a lawful order. He
continued to stare at me with his hands in front of him and refused to comply with my lawful order.
Officer Ortiz advised the suspect that he was now under arrest and the suspect placed his hands in his back
waistband area again where I could not visually see what he was doing with his hands. Officer Ortiz gave orders
to the suspect and I advised the suspect that he was now under arrest. Officer Ortiz gave the suspect repeated
commands to place his hands on top of his head and the suspect complied after several commands. I
immediately holstered my firearm and walked up to the suspect as Officer Ortiz told the suspect to not move. I
stood behind the suspect as the suspect faced a northwesterly direction and ordered the suspect to spread his
feet. Because I had not searched the suspect and I felt that there was a potential for the suspect to have a
weapon in his front right pant pocket or waistband area, I immediately grabbed the suspect's fingers in an attempt
to gain control of his hands and to prevent him from reaching into his pocket or waistband. I told the suspect to
spread his feet approximately four times but the suspect refused. I searched his front waistband and began to pat
his front right pant pocket when the suspect began to tense up, and then spun around, violently pushed me away
with both hands and faced me. As he did so, he said, "That's harassment man."I kept my left hand on both his
hands and attempted to grab his fingers as I attempted to grab his left arm with my right hand. While I did so, I told
him that he was under arrest but the suspect continued to violently push me off and hit my hands so that I could
not grab him. The suspect continued to say that's harassment and then pushing off of my left hand he ran away
from us. As he began to run away I reached out with my right hand and grabbed part of his shirt from the back
right side and pulled on it to prevent his escape. The suspect's shirt ripped and I let go, dropping the piece of shirt
on the ground. I chased after the suspect with Officer Ortiz.
The suspect ran westbound across the southbound lanes of Long Beach Boulevard, crossed the train tracks and
climbed over the fence that separates the north and southbound lanes of Long Beach Boulevard. I heard the
'popping' sound of a Taser and then saw the suspect fall down onto the ground in the southbound lanes of Long
Beach Boulevard. I immediately aired that we needed a Sergeant for a use of force and climbed over the fence to
handcuff the suspect. Officer Ortiz was ordering the suspect to not move or that he would Tase him again and
grabbed his right arm. I saw that the suspect's left arm was under his stomach near his waistband and I
immediately grabbed it out from underneath him and pulled it out and handcuffed his right arm and then
handcuffed his left arm. The suspect continued to resist arrest as we were attempting to handcuff him. I double
locked his handcuffs and advised dispatch that we were in the southbound lanes of Long Beach Boulevard with
one in custody and needed paramedics to respond to treat the suspect. No further force was used.

Narrative
Officer B. Mihkelson #6219 and Officer R. Oscar #6317 responded on scene and assisted.
Prior to the fire department responding to the scene, the suspect began to move violently on the ground, kicking
his feet back and forth on the ground. I advised the suspect he was under arrest and then placed the hobble on
his feet without any resistance.
Long Beach Fire Department Truck 7 and Rescue 1 responded on scene. Rescue 1 transported the suspect to
St. Mary's Hospital where he was treated for his injuries. Officer Oscar went with the suspect to St. Mary's
Medical Center.
I collected the ripped t-shirt on the ground and the suspect's bicycle from where I had stopped the suspect and
kept them in my care and custody until I gave them to Officer J. Marquez #6281. Officer Marquez kept the items
in his care and custody until booking them into evidence. For further see the Property Report.
I went to St. Mary's medical center and stood by until Unit 1A78, Officer M. Silva #10836 and Officer K. Meyers
#10363 responded and assisted. Officer Silva transported the suspect to booking where he was booked as
charged. Officer Silva collected the Taser wire from St. Mary's Medical center and placed them into evidence.

Unit 4S8, Sgt. R. Alexander #5345 responded on scene.
Lt. O. Martinez #5550 was notified of the incident.
Sgt. G. Brown #5638 from Internal Affairs responded due to the suspect sustaining injury to his head area.
Using department resources, I later discovered that the suspect had lied about not being on probation and that he
was on probation for assault (CII A31595982) and also had a $1,000 warrant for his arrest.

On May 11, 2017, my partner (Officer B. Mihkelson #6219) and I (Officer O. Morales #6317) were assigned to
work uniformed patrol in a marked black-and-white police vehicle as Unit MG2.
At approximately 2121 hours, we responded to the area of Long Beach Boulevard and 10th Street to assist Unit
1C7, (Officer J. Ortiz #10025) with a subject that was being uncooperative, (call #1711).
Upon arrival, Unit 4C2, (Officer E. Oaks #10573) advised over our police radio that the unit was in the southbound
lanes of Long Beach Boulevard by the Superior Grocers.
We looked toward that direction when we observed one subject lying down in the middle of the street and two
officers attempting to control him.
Several vehicles were observed traveling southbound on Long Beach Boulevard but were making a right turn into
the Superior Grocers parking lot.
My partner activated the police vehicle's lights and siren, drove our police vehicle northbound on the southbound
lanes of Long Beach Boulevard and canted our police vehicle in front of the officers and suspect.
I contacted Witness (who told me the following: was loading groceries inside of her trunk
when she heard a male subject screaming. looked eastbound toward Long Beach Boulevard when she
observed a male Black subject, running from an officer. The officer then 'tazed' the subject in the back. The
subject immediately fell down, face forward onto the street.

stated that two officers subsequently placed handcuffs on the subject and no other force was used.
told me that she recognized the male Black subject from previous contacts at the 7/11 store on the
northeast corner of the aforementioned location. described the subject as a habitual problem or panhandler
at the location. On one occasion, the male Black subject became extremely aggressive at another customer
because they offered the subject food instead of money.
Long Beach Fire responded on-scene to treat the subject. Engine 7 subsequently transported the subject to St.
Mary Medical Center for further treatment. I rode with Engine 7 and the subject to the hospital until Officer Ortiz
relieved me.
I observed an approximate two inch laceration to the subjects chin.

On 05-11-17, I, (Officer J. Marquez #6281) assisted Unit 4C2 Officer Oak #10573 at 10th Street and Long Beach
Boulevard regarding a use of force incident. (Call #1711)
Upon arrival, I contacted a witness (later identified as and he told me the following. He was
walking his dog on Long Beach Boulevard when he observed a police officer inside a police vehicle attempt to
detain a subject (later identified as who was riding a bicycle. May was riding the bicycle
northbound in lane #2 near the curb when an officer told him to stop. May was hesitant and he did not want to
stop but May finally stopped 50 feet away from where the officer initially told him to stop. did not hear
exactly what was said, but he believed that officer told May to sit down, and May acted as if he was going to sit on
the curb. May suddenly stood up and kicked at the officer and the officer had to back away so that he would not
be kicked. May then ran across the street and two officers began to chase him. May was able to jump the center
divider fence, and one officer "Tazed" May and May fell to the ground. The officers then held May down to the
ground, because it looked as if he was trying to fight while he was on the ground. The officers then handcuffed
him. did not witness any other force used on May.
I then contacted a ride-along (later identified as at St. Mary's Hospital.told me
the following. She was in Officer Ortiz's vehicle, and they assisted Officer Oak with a subject Officer Oak had
detained. Officer Ortiz exited his police vehicle, and he unholsterd his "Taser." Officer Oak told May to put his
hands behind his head, and May refused. Officer Oak continued to tell May to place his hands behind his head,
and May finally did so. Officer Ortiz stood near their side, as Officer Oak began to "frisk" May. May began to
move around, and May broke away from Officer Oak and May ran towards the middle of the street.

asked to describe the sound, but she was unable to.told me that she was standing in
between the front passenger door and the front passenger door jam when the incident occurred, and that is why

Narrative
While working uniformed patrol as 1S8, I responded to 1008 LB Blvd regarding a Use of Force incident.
I arrived on scene and observed LBFD treating the deft for a laceration to his chin area, the deft was resisting their
efforts and thrashing his body around to the point the firefighters had to physically restrain the deft. The deft was
transported to a local area emergency room where I was able to speak with him.
I asked the deft why did he run from the officers and he stated he was stopped for no reason, I informed the deft
he was stopped for violation 21201(d)VC riding a bicycle during hours of darkness without a light. The deft stated
he placed his hands behind his head and the officer approached him from behind and placed his body against his
and he stated, "That wasn't cool". The deft stated he broke out away from the officers and another officer struck
him with his "bat" so he took off running. No further questions were asked, I then explained to the deft the
charges he was arrested for and suggested he cooperate in the future to avoid any additional charges.

Body worn camera (BWC) was used and reviewed prior to filing this report.
While working Unit 1C7, I (Officer J. Ortiz #10025) assisted Unit 4C2 (Officer E. Oak #10573) during a field
investigation in front of 1008 Long Beach Blvd. (Popeye's Chicken), Call #1711. I was in the area because I had
just responded to a shots call on the 200 block of 12th St. I pre-empted off of my call to assist Officer Oak
because I was Code-4 (no more police assistance needed) on my call and I saw that he was dealing with an
uncooperative subject (Arrestee Chandler May). For further see Original DR #17-27850 filed by Officer Oak.
I drove southbound on Long Beach Blvd. and made a U-turn at 10th St. I parked just south of Officer Oak's patrol
car and used my handheld radio to air that I was assisting a West Division unit at Long Beach Blvd./10th St. Both
Officer Oak and I were in full police uniform with visible badges and patches. We were also both riding in marked
black and white police vehicles.
I exited my vehicle and saw that Officer Oak was standing near the front of his patrol car with his gun at a low
ready position, while he was giving May orders and commands such as, "Let me see your hands. I don't know if
you have any weapons on you." May was standing on the east sidewalk of Long Beach Blvd. in front of the
Popeye's and he was not complying with Officer Oak's lawful orders.
As I walked up closer I asked May what the problem was and he told me that Officer Oak was trying to stop him
for a bicycle light violation. Knowing that this is a violation of California Vehicle Code section 21201(d) VC, I told
May to cooperate with Officer Oak's investigation. I could clearly see that May's bicycle was laying on its side near
the east curb of Long Beach Blvd. and it did not have an affixed bike light. I began to record May with my BWC
because I could already tell by his words and his actions that he did not want to comply with our lawful orders.
May kept placing his hands out of view even though Officer Oak kept telling him to keep his hands visible. May
was wearing baggy clothing that could have easily concealed weapons and his front pockets appeared to have
large bulges. Concerned for my safety and the safety of Officer Oak, I took out my conducted electrical weapon
(CEW) and warned May that force would be used if necessary. I felt that my CEW was an appropriate tool to use
at the time because Oak had lethal cover and I was presenting a less than lethal weapon as an option not to use
lethal force on the non-compliant May, who had not been searched for weapons yet. I then used my handheld
radio to request back-up assistance because May was still uncooperative.To make it clear to May that he had no
choice but to follow our lawful orders, I specifically told him that he was under arrest.

Narrative
After talking to May a little more and attempting to verbally de-escalate the situation, we observed that he finally
placed his hands on top of his head and was somewhat beginning to comply. Officer Oak asked him to spread his
legs and he remained still, again not following orders. Believing May was trying to bait Officer Oak into getting
closer before putting up a fight, I kept my CEW out until Officer Oak finally made physical contact. As Officer Oak
began his standing modified search I began to place my CEW away so that I could have both hands free to assist
him with handcuffing May. As soon as my CEW was re-holstered and before I could get my hands on May, he
quickly spun around on Officer Oak and freed himself from his grip. Believing that May was about to punch Officer
Oak to get away, I immediately drew my baton from the baton ring and swung it at his right shin approximately
2-3 times with no apparent affect. May did not go down from the impact of the baton and he did not yell in pain as
if I had not affected his ability to flee and/or fight. May had so much physical potential left in him that he chose to
back away and began to run. Before he could escape Officer Oak attempted to grab onto May's shirt, but he was
so powerful that he pulled away regardless and caused his own shirt to tear.Officer Oak lost his grip on May and I
recall telling him to let him go at that very instance for two reasons.
The first reason I told Officer Oak to let May go at that moment was because I did not want to swing my baton at
May and accidentally hit Officer Oak with it. The second reason I told Officer Oak to let May go is because I did
not want to get into a wrestling match in the middle of the roadway with him. May is about 5'10" tall and about 185
lbs. In comparison Officer Oak is about 5'04" tall and about 135 lbs. and I am about 5'05" tall and about 135 lbs.
By now May had already demonstrated with his actions his intention to be violent and he reasonable presented
the potential to harm to Officer Oak and I. It should be noted that May is on active probation for 245(a)(4) PC
(assault by means likely to produce great bodily injury) and he was fleeing a lawful 148(a)(1) PC (obstruct/resist a
public officer) arrest where there is significant governmental interest to apprehend him. For these reasons I finally
put away my baton and transitioned to my CEW in order to apprehend and controlMay.
I ran past Officer Oak and proceeded to chase May across Long Beach Blvd. Seeing that May was running
towards the approximate 3-4 foot chain link fence near the median, I began to bring my CEW up with the intention
to aim at his back torso. I hesitated to deploy the CEW right away because I did not want to hit him in the back
while he was hoping over the fence. Once his feet touched the ground on the other side of the median, and seeing
that no Blue Line Metro train was passing through, I deployed my CEW with the intention to stop May on the
empty train tracks before he set foot on the roadway. My CEW caught him at the end of the tracks, causing him to
fall forward towards the paved roadway on the southbound Long Beach Blvd. left turn lane that is north of 10th St.
I immediately hoped over the fence and walked in front of May making sure that the oncoming traffic that was still
at a distance could see me, and both lanes of southbound Long Beach Blvd. immediately came to a stop. My
CEW cycled once (5 seconds) and when it stopped cycling I could see that May was still moving around so I said
to him, "Put your hands behind your back or I'm going to tase you again." Oak caught up to us and it took both of
us some time to handcuff him because he kept tensing both arms refusing to give up. Once he was handcuffed, I
did not use any more force on May.
I sat May up to get his face off and away from the ground and I could see blood on his mouth and chin area as
well as on the pavement. Officer Oak aired on channel 4 for paramedics and I also for paramedics on channel 1.
Several units assisted on scene including Unit MG2 (Officer O. Morales #6317 Officer B. Mihkelson #6219).
Long Beach Fire Engine #7 and Rescue #1 responded to the scene to treat May. At one point May began moving
around while paramedics were trying to help him, so Officer Oak ended up using his hobble to prevent him from
kicking anyone. Long Beach Rescue #1 transported May to St. Mary's Hospital and Unit MG3 went with them.
Officer Mihkelson kept my CEW probes and cartridge in his possession until later placing them into evidence (for
further see Property Report). Officer Mihkelson told me that one probe was stuck to the back of May's head and
the other probe was stuck to his lower back prior to being removed.
I later responded to St. Mary's Hospital where I saw May's injuries. I noticed that he had an approximate 2-3 inch
horizontal laceration to his chin that later required stitches. I also noticed that his upper right incisor tooth had
chipped in half, but only after his mouth had been opened by the nurses there. His right shin had a small circular
wound about the size of a small coin that had broken through the skin causing blood to be visible. Two staples
were later used to seal this shin wound. Both of his left and right knuckle areas also had visible scrapes. May had
more scrapes from his nose area down to his chin area. Officer R. Torres #10022 (Unit MG3) responded for

Dr.treated May at St. Mary's hospital and he did not report any further injuries to May.
Sgt. R. Alexander #5345 was notified of the use of force and he responded to the scene and to St. Mary's
Hospital. He notified Sgt. G. Brown #5638 from Internal Affairs, who also responded to St. Mary's Hospital. He
also notified Watch Commander Lt. Martinez.
It should be noted that I also spoke to employee at 1032 Long Beach Blvd. (Albert's Pawn Shop) to
see if he had any video of the incident. stated he did not see or hear the use of force himself and that the
video cameras are pointed towards the pawn shop and not towards Long Beach Blvd. He added that he does not
know how to review the footage, but his manager can be contacted by investigators at if
they have any more questions regarding video.

On 5/11/17 at 2249 hours, my partner (Officer K. Myers #10363) and I (Officer M. Silva #10836) were working
uniformed patrol in a marked Black and White police vehicle as Unit 1A78. We assisted multiple units at St. Mary
Hospital located at 1050 Linden Avenue regarding follow-ups for a use of force (call #1711).
Upon arrival at St. Mary Hospital, I contacted a ride along who was riding with Officer Oak #10573 (identified as
and he told me the following:
On 5/11/17 at approximately 2130 hours, they were inside of a marked Black and White police vehicle traveling
southbound on Long Beach Boulevard.stated Officer Oak observed a subject (later identified as
arrestee Chandler May) riding on his bicycle in the northbound lanes of Long Beach Boulevard with out a bike
light. stated they made a U-turn and headed northbound on Long Beach Boulevard. As they drove up
behind May, Oak activated his red lights and siren and detained May.
stated as soon as Oak exited his vehicle, May set his bike down and turned around to face the officers.
stated May was very agitated and had his arms in front of him with his fists clenched and arms bent at
the elbow. While May was facing the officers he said, "Fuck this, why'd you stop me?" stated Oak pulled
his weapon and told May to turn around a put his hands on the back of his head.stated this is when
Officer Ortiz #10025 arrived on scene and pulled his taser and pointed it at May. Officer Oak holstered his weapon
and both officers started to tell May it was just a ticket. Both Officers were trying to calm him down and were
saying they just wanted to talk to him about it. stated Officer Oak grabbed May by his hands and as he
began to search May, he was moving around a lot and kept trying to turn around. Officer Ortiz told May, "Calm

down or I'm gonna tase you." Officer Oak continued to search May until he pulled away from the search and
turned around, facing Officer Oak.
After May turned and faced Officer Oak, Officer Ortiz hit May with his baton 4 to 5 times in his right leg. After May
was hit, he took off running westbound across the northbound lanes of Long Beach Boulevard. stated
May ran over the train tracks and tried to jump the fence that separates the northbound and southbound lanes of
Long Beach Boulevard. stated as May was jumping the fence, he observed Officer Ortiz tase May and
watched him fall onto his chin on the other side of the fence.
stated Officer Oak and Officer Ortiz jumped the fence and watched Officer Oak placed handcuffs on
May. stated after Officer Oak placed May in handcuffs, both officers were keeping May's head as if they
were making sure his air way was clear. stated Officer Oak and Officer Ortiz left the subject where he
was until Long Beach Fire Personnel arrived.
Once Long Beach Fire Personnel arrived,they transported May to St. Mary Hospital. I did not ask any
further questions.
My partner and I transported May to 400 West Broadway for booking. Before releasing May to the 6th Floor Men's
Jail, I asked May if he was willing to sign an Authorization for Release of Health Information per P.D. Form
2310.036 and May refused to sign. May was then released to the 6th Floor Men's Jail without incident.
