For your review. Comments/Response from Lieutenant Darren Lance: Approved: Approved Reason: Comments: Approved, the Use of Force was reasonable and within department policy, no further action. The 40MM launcher was used at close range, (inside 10 feet), under the circumstances and due to the exigency this was an appropriate use of this tool. The Carotid restraint was used after numerous lesser levels of force were attempted and unsuccessful. The carotid restrain was appropriately applied and effective. Multiple drive stuns (6-8) were used on the suspect, due to the violent resistance of the suspect and the fact three officers were unable to control the suspect this level of force was reasonable and appropriate in the incident. Comments/Response from Commander Patrick O'dowd: Approved: Approved Reason: Comments: In policy, no action Two officers had BWC's assigned. One was inoperable, the other did not activate with the emergency light trigger. Upon realizing this minutes later, the officer activated the BWC but only after the 40mm was utilized. The BWC captured only the handcuffing; therefore, it was not effective in helping me form an opinion.
