SUPERIOR COURT COUNTY OF LOS ANGELES, ST TE OF CALIFORNIA FFIDAVIT IN SUPPORT OF COURT ORDER) I, Officer Matthew Stachowiak, declare under penalty of perjury, that I am a Police Officer for the City of Long Beach, County of Los Angeles, State of California, and have been employed as such for the past two months. I am presently assigned to North Division Patrol. On 1/18/2018, Long Beach Police Officers responded to a suspicious person call. Further investigation revealed the Defendant(Robert Martinez) had made entry into an occupied residence. Martinez locked the front door of the residence and barracked himself into the garage with the homeowner still inside. Martinez refused to come out of the garage and a K9 was deployed. The K9 bit Martinez in the leg causing multiple large lacerations. Martinez also had a large laceration on his face. There was a large amount of blood on Martinez and on the ground. Assisting officers apprehended Martinez. Martinez was resisting officers and trying to spit on them. While apprehending and transporting Martinez to the hospital, multiple officers were exposed to Martinez's blood. Sergeant C. Nava asked that I prepare and write a court order to have Martinez provide a blood sample and have it tested for any possible communicable diseases. I therefore ask that this court order be approved so that can be done. This affidavit is sworn under penalty of perjury and is executed in Los Angeles County on the 18th day of January 2018.
