Roth #5879 working, Quality of Life, unit CP11, with Los Angeles County Department of Mental Health Clinician T. Kirk. The Quality of Life (QoL) unit is a specialized unit that helps homeless individuals in accessing services and getting off the street. While checking the area of Long Beach Blvd and 6th street we noticed a individual who appeared homeless laying on the south sidewalk of 6th st west of long Beach Blvd. The individual was laying against the planter on the sidewalk with his head on a large duffle bag with his feet facing east. I started to make contact with the subject, who was later identified as Suspect Olsen, Bob, as I approached I observed the duffle bag was partialy unzipped and a 1.75 L bottle of American Blendid Whiskey which appeared to be partially gone, was sticking out of the bag. I asked the Suspect Olsen if he was O.K. and he ignored me, I could see he had a small abrasion under his left eye and was concered he had been beaten up or had fallen. I stated to him, "Sir, I’m Officer Roth with the Long Beach Quality of Life unit, I would like to talk to you about getting some services to help get you off the street." He then opened his eyes and stated, "Fuck you! Go away!" I stated I could not do that and asked him to please sit up. He replied, "Fuck you! Leave me alone." It was at this point I observed the objective symptoms of him being under the influence of an intoxicating beverage. He had blood shot watery eyes, his speech was slurred along with a poor attitude, and there was an odor of an intoxicating beverage coming from his person. DMH Clinician Tom Kirk advised me this was the same individual that had to be hospitalized by Long Beach Fire, due to being intoxicated, a few weeks ago, and at that time he was very confrontational. DMH Clinician Tom Kirk tried to explain to him that we were there to try and help him. Suspect Olsen stated once more "Fuck you!" as he sat up. I got on my police radio and asked for a unit to assist and while I was doing that Suspect Olsen looked at me and stated, "I’m going to pull my gun out and shoot you." He then reached into his bag and I told him to keep his hands out of his bag. He removed a plastic container that contained tobacco and a lighter. I told him to put the container down and he ignored me and began to roll a cigarette. I asked him what he said to me and he replied, "Fuck you! I’m going to pull my gun out and shoot you." I told him to stand up and put his hands behind his head. He ignored me and continued to roll a cigarette. With my right foot I pushed the container of tobacco away from him at which time he stood up clinched both fist in a fighting stance and said he was going to "kick my ass." I stepped back, preparing to take on the assault, as he began to charge me. Officer G. Betanzos #10237 working DE9, arrived on scene, as the suspect closed the distance to about four feet from me, Officer Betanzos struck him one time on the left side with his baton, stopping him from charging me. I pulled my ECD (Taser) and told him to get on the ground. Suspect Olsen continued to ignore our orders to get on the ground and Officer Betanzos delivered a second strike to his left thigh but suspect Olsen moved his hand down into the striking path,and was struck on the top of his left hand. Suspect Olsen layed on the ground and Officer Betanzos Handcuffed and took him into custody. No further force was used. For further see Officer Betanzos report. LBFD was requested and responded to the scene, they transported him to St. Mary’s hospital for treatment. K. Villegas #10049) assisted Unit CP11 (Ofc. C. Roth #5879) at Long Beach Blvd. with obtaining witness statements to a use of force incident that Ofc. Roth was involved in. For further on use of force incident, see Ofc. Roth’s report. Upon arrival, contacted Ofc. Roth’s partner (Thomas Kirk #10695) who told me the following, Kirk is a License Psychiatric Technician who is assigned to ride with Ofc. Roth and provide resources to the homeless and mentally unstable. Together, they for the quality of life team. Today at approximately 1412 hours, both were on routine patrol when they came across a male White subject (suspect) who was asleep on the sidewalk of Long Beach Blvd, 6th St side. Upon contacting the suspect, Kirk stated that he looked disheveled, dirty, and appeared to be in some assistance. Both exited their marked black and white police vehicle to check on his welfare. As Ofc. Roth contacted the suspect, Kirk stated that the suspect immediately became belligerent for waking him up. The suspect began yelling obscenities at Ofc. Roth and told him to "leave him the fuck alone". Kirk also heard the suspect threaten to shoot Ofc. Roth with a gun. As Ofc. Roth attempted to oblige with the suspect’s request to leave him alone. Kirk stated that the suspect quickly stood up and began to charge at Ofc. Roth. At this point, Ofc. Betanzos had arrived and was at the scene. As the suspect charged at Ofc. Roth, Kirk stated that both Ofc. Roth and Ofc. Betanzos gave his commands to stop and to get on the ground. Kirk stated that the suspect ignored both of the officers commands and continued to charge at Ofc. Roth. When the suspect continued to charge at Ofc. Roth, Kirk saw Ofc. Betanzos strike the suspect twice with his baton. Once in the left hand and another in the left hip area. Betanzos #10237) was working routine uniformed patrol in a marked black and white patrol vehicle as Unit DE9 when I assisted Officer C. Roth #5879 (Unit CP11) at 6th Street west of Long Beach Blvd (call #938). I was wearing my police uniform with my police badge and my nameplate front of my uniform. My police uniform has police patches on both shoulders and I wore my police holster. I drove in my black and white police vehicle with overhead lights to the above location. Officer Roth is a Quality of Life officer who works with the Multi Service Center and the Village on assisting the homeless. I have observed Officer Roth assist homeless people on several occasions and never get into an altercation or need police assistance. I heard on my police radio Officer Roth asks for a unit to assist. I know from working with Officer Roth he rarely asks for a unit to assist unless he really needs the assistance because of a combative subject. Upon my arrival with Officer Roth I observed a large White male subject (later identified as defendant Bob Olson) seated on the sidewalk. I observed an unzipped gray duffle bag next to Olson and observed an open alcoholic beverage inside the duffle bag. I observed the alcoholic container seal was broken and half drank, in violation of 25620(a) BP. I observed Olson was rolling up cigarettes with his tobacco, which was inside a plastic container. I observed Officer Roth move the container from Olson; I believed it was to get his attention. Olson suddenly stood up, appeared to be angry, clinched his fists when he said, "I am going to kick your ass." He briskly walked toward Officer Roth and I believed he was going to attack Officer Roth and hurt him. I feared for Officer Roth’s safety, to control a resistive combative threatening subject, I pulled out my baton, and struck Olson once on his left thigh to stop the attack. Upon striking Olson he said, "I just want to be left alone!" I told him to get on the ground or I would strike him again with my baton and he did not follow my lawful directions. I didn’t know if Olson had been searched when I observed him reaching into his pant pockets with his hands and I swung my baton toward his left thigh and struck his left hand. I instructed Olson to get on the ground when he said, "That hurt!" He was seated on an upright-seated position. Defendant Bob Olson is approximately 6’03" tall and weighs approximately 200 lbs. The defendant had ample time to follow Officer Roth’s and my lawful directions and he refused to follow them. Sgt. C. Grimes #5561 (Unit 1S7) and Lt. J. Kanaley #5166 (Unit EC31) were notified of the Use of Force and responded to the scene. WC3 (Lt. K. Coy #5101) was notified of the Use of Force. Long Beach Engine 1 arrived on scene to treat Olson for his injures. Olson was transported by Long Beach Fire to St. Mary’s Hospital were he was treated for his injuries. Grimes #5561) responded to assist Unit CP12. Officer C. Roth #5879, who was responding to a 647F subject on the southwest corner of 6th/Long Beach Blvd. When I arrived, Officer G. Betanzos #10237, working unit DE9, contacted me that he had to use force against the suspect in the form of baton strikes after the suspect attacked Officer Roth. For further see DR# 16-60033 When I first saw the subject he was seated against a wall at the above location, handcuffed. I inspected him and observed that he had a welt, approximately an inch in diameter on the back of his left hand. The subj was sweaty, his eyes were glassy and he smelled an alcoholic beverage coming from his body. I called the WC, LT Coy and notified him of the UOF. Officer L. Barba took photos. The subj could not be interviewed because he was unresponsive. There is no video available. Officers Roth and Betanzos were not injured. The subj was transported, by ambulance to St. Mary’s Hospital to be cleared for booking for public intoxication, resisting arrest, assaulting a police officer and terrorist threats. Officer Roth’s partner, Dept. of Mental Health Clinician, Tom Kirk, witnessed the UOF. Mr. Kirk’s statement is consistent with Officer Betanzos’ and Officer Roth account of the incident.
