STATE: BOOK#:
I, Officer J . Foster #5570, was dispatched to West Pacific Coast
Highway, , regarding an unwelcome subject. Dispatch
stated that an unwelcome subject from a previous call I handled (Call
No. 980450716) had returned to the business. The unwelcome subject was
described as a male Black, 25 to 30 years old, wearing a checkered black
and white shirt and jean shorts.
Upon arrival, I observed the unwelcome subject standing on the southwest
corner of the business under an awning and out of the rain. I drove in
the south driveway of the business and approached the subject. I exited
my vehicle and ordered the subject to walk to the front of my police
car. I asked the subject, "Didn't I tell you to get out of here
earlier?" The subject responded, "Hey man, I'm just trying to get some
money."
I ordered the subject into a standing modified search position and I
felt that he was not complying. The subject kept both his arms to his
sides. I grabbed the subject's left wrist and attempted to place it
into a rear wrist lock. The subject immediately tensed up and
straightened his left arm, thereby resisting my efforts to control him.
I ordered the subject to put his right hand behind his head. As the
subject began to raise his right arm, I could again feel him tensing up
and pulling away from me .
I began to twist the subject's left wrist harder in an attempt to gain
control over his movement, but the subject was extremely strong and was
able to resist my control hold. I ordered the subject for a second time
to put his right hand behind his head and I asked him, "You don't have
any weapons, do you?" As I finished this question, the subject lounged
forward and broke free of my hold. The subject ran eastbound across
Cedar Avenue on the south side of Pacific Coast Highway.
My initial thought was that the unwelcome problem had been solved as the
subject was now fleeing from the business; however, as I observed the
subject running, I noticed that he was grasping his waistband with his
left hand. From my previous training and experience, I know that this
sort of behavior is consistent with someone carrying a handgun in their
waistband. I notified Dispatch of the subject's description and
location and stated that I believed he was carrying a concealed weapon .
I returned to my patrol car and exited out the north driveway of the
business and turned right to travel east on Pacific Coast Highway behind
the fleeing suspect. I notified Dispatch that I could still see the

suspect running and that he was now turning southbound to run in the
north/south alley behind Pacific Avenue and Cedar Avenue. I noticed
that the suspect was continuing to run with his left hand still holding
his waistband. I was now certain that the suspect was running because
he was holding a loaded firearm. I advised Dispatch to send me an
assisting unit and due to the wet weather conditions . I asked that a
unit be sent regular code. Unit 4B34, Officer J. Rios #5568, advised
Dispatch that he was en route to assist.
As I turned right to travel southbound in the alley behind the suspect,
I noted that he was still in the alley and was now walking casually
towards Doctor's Hospital,_ Pacific Avenue. I sped down the alley
in an attempt to detain the suspect prior to his entering the hospital,
however, he heard the sound of my engine and glanced over his shoulder
to see me approaching.
Upon seeing me, the suspect ran again, this time turning left to travel
eastbound between the two buildings of Doctor's Hospital. I advised
Dispatch of my observations and asked for my assisting unit to go to the
corner of 17th Street and Pacific Avenue. As I turned left between the
hospital buildings to follow the suspect, I temporarily lost sight of
him. I continued east between the buildings eventually reaching the
driveway that exits to Pacific Avenue. While stopped in the driveway, I
observed Officer Rios in his patrol car traveling south on Pacific
Avenue toward 17th Street. Upon passing me in the driveway, I observed
the suspect run eastbound across Pacific Avenue behind Officer Rios'
patrol car.
I told officer Rios on the radio that the suspect was running behind him
and I drove east across Pacific Avenue toward the suspect . I observed
the suspect crouch behind the front of a parked van located on the east
side of Pacific Avenue in front of a mini market . I drove my vehicle
across the northbound lanes of Pacific Avenue and parked it pointing
directly at the suspect. I noted that during the entire time the
suspect was running, he was still clenching his left waistband with his
left hand. I still believed that the suspect had a loaded gun in his
waistband.
I exited my car, pulled out my gun and pointed it at the suspect while
yelling, "Stop, Police!" The suspect darted out from the front of the
van and ran west across Pacific Avenue between my patrol car and Officer
Rios, who was now driving north on Pacific Avenue. The suspect ran back
toward Doctor's Hospital where I had just seen him. I feared that if
the suspect had a loaded gun and ran into the hospital, he could easily
take hostages or injure innocent people.

I chased the suspect on foot west across Pacific Avenue, eventually
running through a parking lot on the north side of the hospital. The
suspect turned left to travel south through a small outdoor corridor
prior to reaching the alley. As I was running after the suspect, r
continued to yell, "Freeze! Police! Stop! I think you have a gun."
However, the suspect never broke stride and ~ontinued to run.
As the suspect ran down the corridor, I temporarily lost sight of him
again and only saw the very back of his jacket as he turned right to
reenter the alley rear of the hospital. I continued to chase after the
suspect and eventually turned right to enter into the alley. I made a
wide sweeping turn as I began to enter the alley and pointed my gun
southbound as I believed the suspect was fleeing toward 17th Street.
As I entered the alley, I saw the suspect running southbound toward a
series of large blue dumpsters and a parked maroon car. I was still
yelling at the suspect to stop when I noticed that he was still
clenching his left side. After yelling at the suspect, he immedi ately
spun to the right with both his hands at waist level. There was no
doubt in my mind that the suspect was now turning to fire a gun at me.
I noted that several times during my pursuit, the suspect had looked
over his shoulder, however, this was the only time the suspect had
completely spun his hips and shoulders toward me .
In fear for my life, I fired one round from my duty weapon at the
suspect and stopped to take cover behind the hospital wall. The suspect
immediately spun back around and ran into a parking lot rear of the
apartment complex at - Cedar Avenue. Again I lost sight of
the suspect.
I could now hear Officer Rios approaching from behind me and I advised
him of where I had last seen the suspect. Both Officer Rios and I
continued southbound the alley toward the suspect's last known location;
however, upon reaching the parking lot, we could not see the suspect
anywhere. Fearing that the suspect may still be armed and running
through the family homes in the area, Officer Rios began advised
Dispatch where to send assisting units to establish a perimeter.
Officer Rios and I continued to maintain our positions in the alley.
Within a few minutes, we could hear Officer L. Cox #5370 on t he radio
stating that the residents in the area were pointing out the suspect's
location. Officer Cox stated that he could see the suspect hiding
behind the dumpsters in the parking lot. Officer Cox ordered the
suspect to stand and place his arms above his head. When the suspect
complied, we could see the suspect's hands extend above the tall

dumpsters.
Officer Rios and I were joined in the alley by Officer M. McDonald #5666
and we maintained our positions while assisting units responded to
Officer Cox. Within a few seconds, Officer W. Swaim #5462 and Officer
J. Mercado #5563 .came into our view. They directed the suspect into a
felony prone position. As the suspect lied face down on the ground with
his arms extended, Officers Rios and McDonald and I circled around from
behind the dumpsters. I advised all officers that I would be the
handcuffing officer.
I grabbed the suspect's left wrist in an authorized handcuffing
technique and, prior to searching his waistband, I asked him, "Do you
have a gun? Do you have a gun?" The suspect replied, "Yes, I have a
gun."
I noted that the suspect was resisting my control hold on his left wrist
and was attempting to break free of my grasp. I asked for another
officer .to cont rol the suspect's right arm and Officer McDonald grabbed
the suspect's right arm and pulled it toward his back in an authorized
control hold. I was able to cuff the suspect's left wrist, however , it
took several seconds to cuff the suspect's right wrist, as he continued
to resist against Officer McDonald's control hold.
We were eventually able to handcuff the suspect and I rolled him onto
his left side to pull what I believed was a gun out of his left
waistband. As I patted down the waistband, I did not feel any objects
on the suspect. I asked the suspect, "Where's the gun? Where's the
gun?" After stuttering for a few seconds, the suspect replied, "I don't
have a gun ." Officer Mercado stood the suspect up and walked him to his
patrol car where he was seated in the back seat.
Numerous units were now arriving on scene to assist and I was approached
by Unit 4S39, Sergeant A. Tol #3962, who asked me to describe the scene
of the shooting. We were eventually able to find the shell casing from
my fired bullet in the alley near the opening between the two buildings
of the hospital. I took a seat in a nearby patrol car and waited f o r
Homicide detectives to respond to investigate the scene.

I, Officer L. Cox #5370 responded to Officer J. Foster's #5570 request
for assistance in the area of Cedar Avenue and Pacific Coast Highway.
Officer Foster advised that he was chasing a subject he believed had a
gun. While en route, I heard assisting Officer Rios #5668 broadcast
"Shots fired." Officer Rios immediately began setting up a perimeter
from 17th Street to Pacific Coast Highway and from Chestnut Avenue to
Pacific Avenue.
I took up a perimeter position facing northbound in the north/south
alley east of Cedar Avenue at the mouth of the alley at 17th Street.
Upon arrival, I saw Officer Rios at the south end of the alley behind
a garage holding a perimeter position. I observed Officer Foster just
north of Officer Rios in the alley.

I contacted both Officers Rios and Foster and asked them what happened.
Officer Foster advised me that he was chasing a subject with a gun and
that he had fired one round at the suspect. I walked west of the
garages when a male juvenile, later identified as witness ,
waved to me and pointed into the parking lot behind his house.
I looked through a chain link fence north and saw a male black wearing a
black and white checked jacket crouched down behind a trash dumpster in
the parking area. I ordered the subject, later identified as defendant
Keilo DIXON, to place his hands up in the air. Defendant DIXON stood up
and had both hands at his side. I again ordered him to place both hands
up in the air where I could see them and I told him that I thought he
had a gun. Defendant DIXON raised his right hand, but kept his left
hand down by his side. I ordered him again to place both hands in the
air, telling him I thought he had a gun and I would shoot him if he
lowered his hands. Defendant DIXON raised both hands above his head and
I directed assisting officers to defendant DIXON'S location, at which
time, defendant DIXON was taken into custody.
I was contacted by Sergeant A. Tol #3962, who advised me I would be
handling the Incident Report on this call. Sergeant Tol directed
Officer J. Mercado #5563 to remove the defendant from the scene and
transport him to the station. I contacted assisting Officer W. Swaim
#5462 and directed him to contact and obtain a statement.
I secured the crime scene in the alley and put up yellow police tape.
I contacted Officer Foster and asked him to direct me to the area he
fired his round from. He walked me down to the east/west alley located
between Long Beach Doctor's Hospital and the medical suites where I
conducted a search for his spent shell casing. I was able to locate the
casing near the center of the alley and I directed Officers. Van Duin
#5612 to stand guard over the evidence.
Officer Swaim interviewed witness who said he was sitting in his
brother's van in the parking lot watching television. When he got out
of the van, he saw a police officer standing next to the fence, who
asked him if he had seen a male black with a checkered shirt. Witness
said he told the police officer, "No," but when witness
turned around, he saw the defendant hiding by the trash dumpster.
Witness said he yelled at another police officer (determined to
be me, Officer Cox) and pointed out the defendant.
During the investigation, I recontacted witness and he told me
the same story. I asked him if he heard any shots, and he told me he

heard one shot fired . I asked him if he heard anyone yelling either
before or after the shot, and he said, "No ." He went on to say he did
not know anything was going on until an unidentified police officer
asked him if he saw a male black with a checked shirt .
I also contacted two small children in the residence who were identified
as , and
. I asked them if they heard anything and they
both said they heard one shot, but did not see or hear anything else.
When I arrived on scene, prior to the defendant being taken into
custody, there was a heavy overcast of clouds and a light rain. At the
time the incident occurred, it was still daylight and there were no
external lights on either in the alley or any of the buildings outside.
The area where the incident occurred is primarily residential with one
and two story buildings along Cedar Avenue. There is an adult
continuation school at the north end of Cedar Avenue at Pacific Coast
Highway. The east side of the alley off Pacific Avenue is comprised of
the Long Beach Doctor's Hospital, which is a two story building, and
medical suites.
This incident began at West Pacific Coast Highway,
, which is located on the southwest corner of Pacific Coast
Highway and Cedar Avenue. There is a parking lot on the west side of
the check cashing business and a drive-up check cashing window located
on the south side of the business.
The initial chase began at and proceeded eastbound
along Pacific Coast Highway, and then southbound in the alley east of
Cedar Avenue from Pacific Coast Highway. The chase then went through
the alley located between Long Beach Doctor's Hospital, Pacific
Avenue, and the medical suites located at to Pacific Avenue
and onto Pacific Avenue.
The foot pursuit then ensued and the defendant fled through the parking
lot on the north side of the medical suites, then south through a
walkway, then back eastbound in the alley between the medical suites and
Long Beach Doctor's Hospital. The defendant then turned southbound in
the alley. The defendant turned toward Officer Foster while he was near
a red vehicle just located in the parking lot at the rear of the
apartment complexes located at - Cedar Avenue. Officer Foster
had just entered the alley and was between Long Beach Doctor's Hospital
and the medical suites when he fired one round at the defendant. Officer
Foster lost sight of the defendant when he fled into this parking lot.

This parking lot services the apartment complexes from to
Cedar Avenue, which are both two story buildings. It also services two
single story residences at and West 17th Street. On the east
side of the parking lot off the alley, there is a detached four unit
garage with the garage doors facing the alley. There were several
vehicles parked in this lot at the time of the incident. On the north
end of the detached garages, there were four· large trash dumpsters. The
defendant was located crouched down behind the westernmost trash
dumpster from the alley, between the dumpster and a car.
I was contacted by Officer R. Foster #2807, who advised me he had found
the location where Officer J. Foster's round had struck. Officer R.
Foster then took me to a set of garages at Cedar Avenue and pointed
to a fresh bullet impact mark, approximately 1 1/2 to 2 inches
horizontally in length, in the stucco above the garage door. Officer R.
Foster also showed me fresh stucco debris directly below the bullet
impact.
Officers M. McDonald #5666, J. Stilinovich #5610 and J. Rios #5668 were
directed to search both the alley and the parking area where the
defendant was taken into custody for the defendant's outstanding
firearm.
Lab Technician D. Krueck #7888, Unit Ll5, responded and took photographs
of the crime scene. Homicide Detectives J. Boston #2976 and R. Hamand
#2969 responded to conduct their investigation. Officer K. Bradburn
#5445 responded to the scene and drew the sketch of the incident.
After Lab Technician Krueck photographed the crime scene, Officer Van
Duin recovered the spent shell casing and gave it to me. I retained it
in my possession until later placing it into police Evidence .

At approximately 1640 hours on February 14, 1998, I, Officer P. O'Dowd
#5604, working Unit 1C37, was dispatched to at W.
Pacific Coast Highway in order to obtain witness statements.
Upon arrival, I contacted victim , who
. Victim told me that while working at one of
the teller windows at today, she had several customers
complain to her about a male black subject who was harassing them for
money in the parking lot. They said the subject seemed "very strange"
and he caused them to fear for their safety.
Victim saw a male black, approximately 5'7" tall, medium build,
shaved head, no facial hair, wearing a black and white Pendleton shirt
o r jacket with blue jean shorts, standing in front of her business. She
watched as he approached several customers on their way into the
business . Victim asked witness , who also works at
, to go outside and tell the subject to leave. Witness
went outside and talked with the subject, however, the subject
refus ed to· leave . Victim called the police (Call #716).
Victim walked into the back room where she took care of a few
business related tasks. When she returned to the front, the subject was
gone. Her co-workers told her that police had come and made the subject
leave the property.
Approximately 45 minutes to one hour later, victim saw the same
subject panhandling in the parking lot again. She watched as the
subject approached a car in the parking lot, inside o f which was a
female occupant. The subject then walked away from the car and followed

several customers from their cars right up to the front door of
, apparently asking them for money. Victim called
the police for the second t i me (Call #1019 ).
Minutes later, Victim saw a black and white police vehicle park
along the south side o f , facing westbound. A male
off icer in full uniform exited the dr iver's seat of the police vehicle
and walked to the fron t of the car. The off i cer spoke with the subject
who was on the north side of the car near the southwest cor ner of
, while the officer stood on the south side o f the car.
The subject was apparently "pretending to be sick," grabbing his stomach
with bot h hands and bending over. Suddenly, the subject ran eastbound.
Victim saw the office~ begin talking i nto his h and held radio
while walking eastbound after the subject . The officer was out of
victim sight for approximately ten minutes. When he returned
to the police vehicle, he got in and drove westbound through the parking
lot and then southbound in the alley just west of .
Approximately fifteen minutes later, victim saw police vehicles
"all over t he place." Victim saw neither the officer nor
subject draw a gun and did not hear any gunshots.
I spoke with witness , who is employed
. Witness told me that he arrived at work today at
approximately 1130 hours. Witness stated that while he was
working, victim asked him to go outside and tell a panhandler to
leave the property. Witness described the subject as a male
black, 5 '6" -5'7" tall, medium build, shaved head, no facial hair,
wearing a black and white Pendleton jacket and blue denim shorts.
Witness went into the parking lot and explained to the s ubj ect
that it was illegal for him to loiter or panhandle in the parking lot
and asked the subject to leave. The subject mumbled something about not
bothering anybody and appeared to have a ~strange look" on his face.
Witness went back inside the business while the subject continued
harassing customers in the parking lot. Victim then ca lled the
police.
Witness saw a black and white police vehicle drive into the
parking lot. The officer in the car contacted the subject
near the alley just west of , apparently telling him to
leave the property. The subject walked westbound in the lot away from
and out of witness sight and the police vehicle
left the scene.

Approximately 45 minutes later, the same subject returned and resumed
harassing customers in the parking lot. After receiving several
customer complaints regarding the subject's behavior, victim
called the police for the second time. Witness saw a police
officer park a black and white police vehicle on the south side of the
business, facing westbound in the parking lot. Witness watched as
the officer got out of the car, however, he was busy helping customers
at his window and did not see anything further.
Seconds later, witness heard his co-workers saying that the
subject had run from the police but he did not take note of the
officer's actions subsequent to that. Approximately fifteen minutes
later, witness saw polic_e cars arriving in the area. Witness
did not see the officer or the subject holding a weapon and did
not hear any gunshots.
I also spoke with witness , who is employed as a teller at
. She said that when she arrived at work today at
approximately 1130 hours, she was approached by a male black subject,
5'6" -5'8" tall, medium build, shaved head, no facial hair, wearing a
black and white Pendleton shirt and blue denim shorts, in the parking
lot, asking her for money. Witness refused to give the subject
money and walked inside the business.
While working at her window, witness was approached by several
customers who pointed at the same subject through the front window,
complaining that the subject was panhandling. They added that they were
afraid of the subject because pe seemed "weird.n Witness watched
as the subject followed one of the female customers to her car,
apparently asking for money. Victim then called the police.
Witness did not see the police contact the subject the first
time, however, she noticed that the subject was no longer in the parking
lot. Approximately 30 minutes later, witness saw the same
subject in the parking lot approaching customers as they walked toward
. Victim again called the police.
Witness saw a police officer park a marked black and white police
vehicle along the south facing window of , facing
westbound . She saw an officer get out of the car and say something to
the subject, who was now standing near the southwest corner of the
building. Witness saw the subject run eastbound in the parking
lot and out of sight. She sa~ the officer begin talking into his hand
held radio while walking eastbound after the subject, out o f sight.
Approximately one minute later, the police officer returned to his car

and got in the driver's seat . Witness was helping customers at
the time of the incident and did not see the police officer leave the
scene. When she looked outside approximately thirty seconds later, she
saw "cop cars everywhere." Witness did not see the police
officer or the subject with a weapon in his hand and did not hear any
gunshots.
Finally, I spoke with witness , who is employed
. She saw a male black subject, 5'7 " tall,
medium build, shaved head, no facial hair, wearing a black and white
Pendleton shirt or jacket with blue denim shorts, standing in the
parking lot, harassing customers. Victim called the police
regarding the subject.
Witness saw a black and white police vehicle pull up along side
the south facing window of . The officer parked the
car and exited. The police officer began speaking with the subj ect and
asked him to step over to the side of the parking lot. Witness
began helping a customer at her window, and when she looked up the
subject in question was gone. She saw the police officer walking
eastbound through the parking iot and out of sight . Five seconds later,
t he officer returned to his car, began talking on the radio and drove
westbound in the parking lot and then southbound in the alley just west
of . Witness did not see the police officer or
the subject holding a weapon in his hand, and she did not hear any
gunshots.
Victim told me that had been officially posted
for "No Trespassing," however,· the signs had been stolen from the front
of the building. Victim knows that
are against panhandling, loitering and trespassing, and as the
responsible party for the business, she wished to place the subject
under private person's arrest. I provided her with a private person's
arrest form, which she signed. Victim is willing to prosec ute.
I contacted the customers who .were inside the business at the time of my
arrival, however, none of them had been inside during the incident and
had not seen anything.

While working Unit 4B1 , I, Officer J . Mercado #5563 assisted Unit 4B4 ,
Officer J. Foster #5570 on an unwelcome call at West Pacific Coast
Highway. While en route, Officer Foster advised, via dispatch, t hat the
subject he had detained fled southbound.
Officer Foster described the subject as a male/black, wearing a black
and white checkered shirt and blue denim shorts . Officer Foster
announced over the air that the subject was running southbound t~e
alley between Ceda r Avenue and Pacific Avenue from Pacific Coast
Highway and was reaching into his waistband, possibly reaching f or a
weapon .
Upon arriving on scene, Officer Foster broadcasted that he had just
shot at the suspect, who was last seen running into the parking lot
rear of Cedar Avenue.

Dispatch asked for a unit to take up a position at 17th Street and Cedar
Avenue, and I advised that I was at that location . While maintaining my
position at the perimeter, I heard Officer Cox #5370, Unit 4835 ,
shouting that he spotted the suspect hiding behind a car in the parking
lot rear of Cedar Avenue.
The residents at Cedar Avenue allowed me to enter their apartment
to gain access to the rear of Cedar Avenue . Officer W. Swaim #5462,
Unit 485 and I found the suspect hiding between a car and a trash bin in
the parking lot. At gun point, we ordered the male/black, who was
wearing a black and white checkered shirt and blue denim shorts, to lay
face down on the ground. After the suspect laid face down, Officers
Foster and McDonald, M. #5666 handcuffed the suspect .
As Officer Foster was handcuffing the suspect , I heard him ask, "Do you
have the gun?" and the suspect answe red, "Yes". Officer Foster searched
the suspect for weapons and did not find any. Sgt. A. Tol then asked me
to escort the defendant, later identified as Dixon, Keilo, to my car and
transport him to jail.
While en route to Long Beach Police Department, Men's Jail, the
defendant spontaneously stated, "I was just running cause I just got
outta jail and I ain't fix' to go back. I don't know why you guys tried
to shoot me, I didn't have no gun and the only reason I kept my hands
tucked in my front was to hold my buckle and keep my pants from falling .
He thought I had a gun didn't he? You ain't pinning that shit on me".
While in Booking, the defendant submitted to an intoxilizer breath test,
which resulted in a reading of .00/.00

on the defendant for violation of Penal Code 3056.
The defendant was then booked as charge d and released into the custody
of Men's Jail personnel.

On Saturday, February 14, 1998, at 2059 hours Detective Hamand and I
contacted the defendant Keilo DIXON in the third floor Homicide
interview room. I advised the defendant of his Constitutional rights by
reading him PD form 1000.008 . The defendant stated that he heard and
understood his rights and signed the form. He said he would talk with
detectives.
I asked the defendant if he remembered the officer telling him to leave
earlier in the day. The defendant said he remembered
the officer telling him this and he left the check cashing store. He
said he returned later because he was trying to get out of the rain. He
said he remembered the officer coming back, but he could not remember
what he said to the officer. I asked him why he ran from the officer
and he said he was on parole and did not want to go back to prison.
I asked defendant DIXON why he kept his left hand in his waistband as he
ran and he said he could not remember doing that. He said that, if he
did keep his hand there, it was because he was trying to hold his pants
up. He said he did not have a belt and, when he runs, his pants fall
down. I observed that the defendant was wearing baggy shorts that were
obviously too big for him and he did not have a belt to hold them up.
The defendant said he was running southbound in the alley away from
the officer and he heard the officer say, "Stop or I'll shoot!" He
said he cut sharply to his right towards a parking lot with trash cans
in it when he heard a gunshot. He said he hid behind the trash cans
and then he heard a cop order him to put his hands up . He said he
looked around and saw that he could not go anywhere, so he put his

had a gun and he said that he did not have a gun. I asked him if he
told the officers that he had a gun and he said, "No." He said the
officer asked him twice, "Where's the gun at? Give it up," and he told
the officer that he did not have a gun .
The defendant advised me that he was on parole out of the Long Beach
office and his parole officer was Balderrama.
The interview was terminated.

I was assisting Officer J. Foster #5570 with a suspect running away from
him in the north/south alley between Cedar Avenue and Pacific Avenue
from Pacific Coast Highway. Officer Foster described the suspect as a
male black, 25 to 30 years, wearing a checkered black and white shirt
and jean shorts. Officer Foster stated that the suspect was possibly
armed with a gun in his waistband.
He asked for a unit to respond to the corner of 17th Street and Pacific
Avenue. I was arriving at that location when I heard him broadcast over
the radio that the suspect was just crossing the street. I looked in my
rear view mirror and observed the suspect, who was wearing the described
clothing, running from the east side of the street to the west side of
the street in the middle of traffic. I could see Officer Foster in his
vehicle driving towards the suspect in an attempt to stop him. I
immediately turned my police vehicle around and drove towards the
suspect .
Officer Foster, by this time, had gotten out of his vehicle and was
chasing the suspect on foot. I stopped my vehicle, got out and ran
behind Officer Foster. The suspect ran through the driveway at
Pacific Avenue and I could see Officer Foster cautiously following
behind him. I saw the suspect run southbound through the north/south
alley, and I was attempting to parallel his route from Pacific Avenue.
I heard one shot and broadcast over the radio that shots were fired.
I ran back to the location where I last saw Officer Foster.
I saw Officer Foster standing near the alley and driveway just south
of Pacific Avenue. I saw him standing in a "modified weaver"

position holding his gun. I saw the smoke from his weapon dissipating
into the air. I ran to h im and asked him if he was all right. Offic er
Foster answered, "I shot one time." I asked him where t he suspect went
and Officer Foster pointed southbound down the alley and said, "He went
into the parking lot near those blue dumpsters."
I immediately ran to the south end of the alley at 17th Street and
Pacific Avenue and set up a perimeter by having a police unit set up at
Pacific Coast Highway and Cedar, Pacific Coast Highway and Chestnut, and
17th Street and Chestnut Avenue. An unknown police unit asked about t he
suspect's build and age, and I advised over the air that the suspect was
large build and at least 20 years of age.
There was a boy inside a van which was parked in the parking lot that
Officer Foster told me the suspect ran into. I asked the boy, who was
later identified as , if he saw a male black wearing a black
and white checkered jacket and jean shorts. The boy said he did not see
a person matching that description. I advised the boy that the suspect
was armed with a gun and was seen in that parking lot.
I saw the boy put his head into the van and say something to someone
inside. A number of young children began to walk out of the van. The
boy looked towards the trash dumpsters and turned around with a look of
fear in his face. Without saying a word, he turned towards me and
pointed towards the trash dumpsters, and he told Officer Cox #5370 and
me that the suspect was "back there." Officer Cox saw the suspect and
detained him at gun point.
I ran northbound through the alley to the easternmost trash dumpster,
where Officers J. Foster #5570 and M. McDonald #5666 were standing and
waiting to take the suspect into custody. Officers W. Swaim #5462 and
J. Mercado #5563 ordered the suspect into a prone position for control.
Officer Foster approached the suspect and took control of his left hand.
While maintaining control of the suspect's left hand, Officer Foster
repeatedly asked the suspect, "Do you have a gun?" The suspect
answered, "Yes, I got a gun!" After hearing this, Officer McDonald took
control of the suspect's right hand and attempted to assist Officer
Foster in handcuffing the suspect. As the officers handcuffed the
suspect, I could see the suspect pull his arms away from both officers
and kick violently. I drew my baton and advised the suspect to submit
to the officers orders, not to resist and to stop kicking, which he did .
After the officers safely took the defendant into custody, I was ordered
by Officer Cox to locate the spent round, which was found by Officer R.

Foster #2807. I was t hen ordered by Officer Cox to further search the
parking lot rear of Cedar Avenue for the gun. I searched under
every parked vehicle, all the vehicles wheel wells, a nd on the roof o f
the unattached garages, but could not find the gun.
I was then ordered to c heck the roof of the two story bui lding at
Cedar Avenue . With the assistance of the Fire Department, I climbed up
a ladder and searched the roof, but did not recover any gun. Sergeant
C. Shur #5003 directed me to search the roofs of the adul t school
bungalows located at the southeast corner of Pacific Coast Highway and
Cedar Avenue . After a thorough search of the bungalows roofs, I was
unable to find the gun.

I, Officer M. McDonald #5666, was working as Unit 4B3 when I assisted
Unit 4B4, Officer J. Foster #5570, who was in pursuit of a male black
subject, who was possibly carrying a concealed weapon. Officer Foster
reported that the subject was last seen fleeing southbound in the
north/south alley north of Pacific Coast Highway west of Pacific Avenue.
Officer Foster described the subject as a male black, wearing a black
and white checkered shirt, 18 to 20 years old.
While en route to 17th Street and Cedar Avenue, Unit 4B34, Officer M.
Rios #5668, who was also assisting, broadcast that shots were fired.
When I got there, Unit 4B35, Officer L. Cox #5370, broadcast that he had
the suspect at gun point at the rear of Cedar Avenue. I made my
way rear of Cedar Avenue, where I contacted Officers Foster and
Rios. Officer W. Swaim #5462 ordered the suspect at gun point to lie
prone on the ground. Officer Foster asked the suspect if he had a gun
and the suspect stated, "Yes, I have a gun."
At that point, Officer Foster and I handcuffed the suspect. Once the
suspect was handcuffed, Officer Foster asked the suspect a second time,
"Where's your gun?" The suspect answered, "I don't have one." Officer
J. Mercado #5563 escorted the defendant to his patrol car where he was
transported to the Long Beach Police Department.
I was advised by Unit 1S42, Sergeant C. Shur #5003, to retrace Officer
Foster's pursuit to try to locate the defendant's weapon. I began my
search at , West Pacific Coast Highway. I walked
eastbound on Pacific Coast Highway checking the gutters, bushes and
shrubbery for the defendant's weapon. I then turned southbound in the

and continued my search for the defendant's weapon. I looked at the
trash bin rear o f Pacif ic Avenue, as well as all the t a ll grass
located i n the alley.
I was unable to locate a gun at that point and I directed my search to
the shopping center located at - Pacific Avenu e. Officer
Foster informed me that the defendant ran to that location and hid
behind a white van that was parked facing northbound on Pacific Avenue
o n the east side of the street . I searched the entire parking lot, as
well as under the cars in the direct area of the white van parked on
Pacific Avenue. I was still unable to locate the gun.
I was informed by Sergeant Shur that he requested Long Beach Fire to
respond to my location and provide me with a ladder so I could continue
my search on top of the roof of the hospital located at -
Pacific Avenue. Once on top of the roof, I did a complete and thor ough
search for the gun, but was still unable to locate it.
I directed my search to the immediate area where the defenda~t was
arrested, at - Cedar Avenue. At the rear of that location
there is a parking lot with several parked cars and four large trash
bins, as well as several pieces of lumber which were next to the trash
cans. I checked underneath all the cars, paying special attention to
the tires and fenders. I then looked underneath the lumber and an
unlocked water heater compartment. At this point, I climbed into the
four dumpsters and checked the contents of each one. Three of the
dumpster lids were down and the fourth one was open. After a thorough
c heck of the dumpsters, I was unable to find the defendant's weapon.
I continued my search in the immediate area until I was advised that we
were to break down the perimeter.

When we arrived, we were instructed by Sergeant J. Levy #4009 to do
knock and talks.
I spoke to witness , who was inside the Laundromat
(standing in front facing westbound) at Pacific doing laundry. He
stated he did not see or hear anything because it was raining.
I spoke to witness , who was inside his store (facing
westbound) at the front cash register counter at Pacific . He
stated he did not hear or see anything.
I spoke to witness , who was inside his second floor
apartment (west of the parking lot where the defendant was handcuffed)
at . Witness stated he was laying on the couch in
the living room (west side of the apartment) with the television on when
he heard one gunshot . About five minutes later, witness looked
out his bathroom window (eastbound, overlooking the parking lot) he saw

Officer S. Kunkle #5693 and I were sent to Seventeenth Street and Cedar
Avenue to assist on a no hit officer involved shooting. Sergeant J.
Levy #4009 assigned us to talk to any potential witnesses of the events
prior to, during or after the shooting. We were told to go to the area
of Pacific Avenue just south of Pacific Coast Highway.
I went to the P-Video store located at Pacific Avenue and
contacted the clerk. The clerk was identified as , who
lives at . She is described as a female
, and goes to
. said she was working all day at the store
and knew nothing about the shooting until I told her about it. She also
said that nobody matching the suspect description had entered the
business today.
I then went to the Laundry Mat at Pacific and talked to
, female w. Fourteenth
Street, Long Beach. She works at the business and was inside the office
at the time of the shooting and saw and heard nothing . She also said
the described suspect did not enter the business that she is aware of.
This was translated via her daughter .
I then saw a standing in the southern part of the
Arco gas station at Pacific Coast Highway/Pacific Avenue, where I
contacted him. He was identified as , male
, who lives at S. Normandie, Torrance, CDL #. He
was at the tent selling flowers when he heard a "shot" from south of
his location, then heard a lot of sirens. He never saw the described

The clerk at the Arco gas station at w. Pacific Coast Highway
started his work shift at 1600 hours and was not there during the
shooting. This was the same f~r the clerks at the Eddies Liquor store
at W. Pacific Coast Highway.
We were then directed to go to the area of Cedar Avenue for further
interviews, per Sergeant Levy.
I contacted
W. Seventeenth Street, CDL# unknown Social Security number.
She said that she was at her mother's apartment at Cedar watching
t elevision when she heard a single gunshot outside. She stepped to the
door which faces south and into the parking lot just south of her
apartment. She saw two uniformed police officers at the east end of the
trash dumpsters next to the north south alley.
She said both officers were yelling "Come on out with your hands up."
Witness then ran southb~und towards her apartment to get her
children inside. Once she ran towards her apartment, she stopped
between and Cedar and saw two officers standing on the south
side of the chainlink fence just south of this parking lot.
She could see a male Black subject ducking down behind the western mos t
dumpster, the one with the open lid. This subject had on a very
distinctive black and white checkered long sleeve shirt and dark pants.
This subject was "bobbing• up and down as if to see where the officers
were. She motioned to the officers where the male Black subject was by
pointing towards him. Witness said it was very obvious that the
male Black subject was hiding from the police and was the subject they
were looking for. The two officers then ran around to the alleyway and
near the dumpsters and began to order the subject to come from behind
the dumpsters with his hands up.
The subject then quickly dropped his hands and ducked down behind the
dumpster . She believed that the subject was on drugs because he was
acting so strange. The suspect refused to listen to the officers
repeated commands to come from behind the dumpsters with his hands up in
the air.
I then contacted brother,

. He said that he was working in his grey
in the lot just south of where the suspect was hiding .

his little brother, , who lives
at , say something to somebody. When looked to
see who was talking to, he saw a police officer sitting in a
police car on Seventeenth Street facing east.
The officer asked them, "Have you seen him?,·" and they said, "~Jo."
then turned around and saw a male Black wearing a black and white
checkered long sleeve shirt hiding behind a trash dumpster just north
of him. began to point to where the subject was to the officer,
but in a manner so not to draw the attention of the subject. was
sure that this was the subject the officer was looking for because of
the way he was acting.
As was pointing, he had now made eye contact with the male Black
subject who was trying to wave his hands to Kevin as if to say, "You
don't see me." The officer told and to get into the house
and began to shout orders at the male Black subject. The officer told
the subject to stand up with his hands in the air. The subject did
this, but then suddenly dropped his hands and dropped behind the trash
dumpster.
By now was standing on his back porch doorway which is southwest
of where the subject was. was standing on his porch and was
somewhat elevated and could still see the subject. When the subject
suddenly dropped and hide his hands, yelled at him, "Get your
hands up dummy or the cops are gonna shoot youfH said that the
officers ordered the subject many times to get his hands up with little
or no response. The subject was believed to be on drugs per
because "Nobody is that stupid. When the cops point guns at you, you do
what they say."
Both said the male Black subject was actively resisting arrest
and had to be restrained by the officers. Both remember that
when the officers were handcuffing the subject that an unknown officer
asked him, "Where's the gun?• numerous times. Only after the third time
of being asked did the subject reply, "I don't have a gun." There is
no relation from the witness to any of the on the Long
Beach Police Department.

I was working uniformed patrol and was assisting officers at the officer
involved shooting rear of Pacific Av e. Once on scene, I was
assigned by Sergeant J. Levy #~009 to contact any person(s) who wo rked
at Pacific Ave, Doctors Hospital, to see if they heard or saw
anything rear of the hospital in the alley.
I knocked on the office door at Pacific Avenue of
, General Thora cic Vascular Surgery. As I waited f or a
response, I noted that several paper flyers and debris had accumulated
at the foot of the door. I knocked a second time and attempted to turn
the knob , however, it was locked. Nobody ever answered the door.

I subsequently knocked on the office door at Pacific Avenue of Dr.
., Internal Medicine General Practice. While I
waited for a response, I noted many paper flyers jammed in the door jam
of the office door. I also attempted to turn the door knob, but it was
locked. Nobody ever came to the door.
The last o ffice door I knocked on was at Pacific Avenue of
. While I waited for
a response, I noted there were several paper flyers jammed in the door
jam. I attempted to turn the door knob but noticed it was locked. I
knocked a second time, however, there was never a response.
After leaving this portion of Doctors Hospital Medical Center, I walked
southbound to Pacific Av~nue, the main building of Doctors
Hospital, to speak to the personnel at this location. I spoke to
security guard , who told me he was inside the
hospital walking down the hallway which leads to the kitchen around
1530. The hallway which leads to the kitchen is located towards the
middle of the hospital and does not have any windows or doors to look
outside.
When he returned approximately five minutes later, he walked outside of
the hospital onto Pacific Avenue. Once there, he noticed several police
vehicles to the south and north of him. He never saw anybody running
from the police or the police running after anyone. He also did not
hear any gunshots nor did he hear any yelling or screaming outside of
the hospital.
I then spoke with , who told me he
was mopping the floors along the far east wing of the hospital. While
he was mopping the floors, security guard had just walked
past him and exited the building onto Pacific Avenue to catch the bus
home. About fifteen to twenty seconds after leaving the building,
knocked on the door. Janitor opened the door,
letting security guard back into the building.
The security guard asked janitor if he heard the gunshots, and he
stated that he did not. Security guard told janitor that
he heard one gunshot coming from what he thought was east of his
location on Pine Avenue. The security guard did not tell the janitor if
he saw anybody running from the location or heard any yelling. The
security guard remained at the hospital until approximately 1515 hours,
then left to go home. The janitor does not know the security guard's
phone number or home address ..

The janitor never went outside to investigate himself.
The l ast person I spoke with is receptionist . She
told me she was supposed to be at work by 1500 hours, but due to the
traffic she arrived late at approximately 1600 hours. When she arrived
at work, she saw several police vehicles sur_rounding the hospital. She
did not think anything of the police vehicles and started working. She
never heard any gunshots in the area and never saw anybody running from
the police.
After speaking to the above hospital personnel, I walked around inside
the hospital attempting to locate any other personnel but was unable to.
I advised Sergeant Levy that L completed the interviews with the
personnel at the hospital complex. He advised me to assist Lab
Technician D. Krueck #7888. I assisted her by logging the photographs
she took of the crime scene.

I, the undersigned, complain that upon information and belief,
on or about FEBRUARY 14, 1998, in the City of Long Beach, County of Los
Angeles, State of California, a misdemeanor was committed by said defendant
who then and there did willfully and unlawfully enter and occupy the real
property and structure at W. PACIFIC COAST HIGHWAY, in said City,
without the consent of the owner, his agent, or the person in lawful
possession thereof, in violation of Section 602 (L) of the Penal Code of the
State of California.
All of which is contrary to the form, force and effect of the
statute in such cases made and provided and against the peace and dignity
of the People of the State of California. -Said complainant therefore prays that a warrant be issued for
the arrest of the said defendant and that said defendant may be dealt with
according to law. A declaration in support of the issuance of an arrest
warrant is submitted. This complaint is based on the facts and circum-
stances in BK# 5552532 incorporated herein by reference.
PLEASE TAKE NOTICE that pursuant to §§1054.1-1054.7 of the
California Penal Code, the Prosecutor hereby informally requests defendant
to produce all materials described in Penal Code §1054.3(b) no later than
30 days prior to trial.

Officer Involved Shooting Review Board OIS 98-3 convened to review the no hit shooting
incident involving Officer James T. Foster #5570, which occurred on February 14, 1998.
The Shooting Review Board unanimously determined the actions of Officer Foster in
regards to the shooting incident were INTENTIONAL, IN POLICY.
The recommended action determined for Officer Jackson was:
• Incident Review: To be conducted by Commander Anthony Batts #3941 .
There was no recommended action determined for the Department.
The Shooting Review Board results were reviewed and approved by Chief of Police
Luman, who made no further recommendations.
An audit of the case revealed that all recommendations have been completed. Officer
Foster has been advised of the Shooting Review Board results.

Subject: Unusual Occurrence -OIS -Call #1019
SUMMARY
On February 14, 1998 at 1534 hours, Officer Jim Foster #5570 responded to an
unwelcome call at W. Pacific Coast Highway, the . This
was the second call at this location for the same unwelcome subject. Upon
Officer Foster's arrival, the subject fled from the location. The subject
immediately grabbed his waistband while running, leading Officer Foster to
believe he was armed. Officer Foster advised assisting units on the police radio
of the suspect's description and that he believed the suspect was "CCW'.
Assisting units responded and a perimeter was started.
Officer Foster continued his foot pursuit, at times losing sight of the suspect. At
one point, Officer Foster turned into the north/south alley, south of 17th Street
and west of Pacific Avenue. It was there he again confronted the suspect. The
suspect turned towards Officer Foster and reached for his waistband. Believing
the suspect was arming himself with a handgun, Officer Foster fired one round
from his duty weapon, missing the suspect. Assisting Officers were in the
immediate area and the suspect was apprehended in a courtyard approximately
two minutes after the shooting.
The crime scene was contained by Watch II, West Division Officers. Watch Ill
West Division Officers responded and canvased the neighborhood for witnesses.
Watch II West Division Officers re-traced the path of the foot pursuit and were
unable to locate a weapon. I was the Incident Commander and established a
command post on 17th Street, between Cedar Avenue and Pacific Avenue.
Homicide responded to the location.

As the incident developed, numerous officers responded during a heavy rain.
All Officers arrived safely and a loose perimeter was established immediately.
There was good radio communications and pertinent information was aired,
allowing for a timely apprehension of the suspect. The Long Beach Fire
Department assisted with ladders, allowing officers to check roofs for the
outstanding weapon. There was good coordination between our two
agencies.

6.8.5 FIREARMS -SHOOTING POLICY
The policy of this Department governing the display and discharge of firearms affirms that
officers have the duty to use firearms whenever the necessity exists to protect their lives or
the lives of others. It shall be the responsibility of the individual officer to use firearms only
when reasonably necessary and justified under the circumstances.
F1rearms shall be regarded as defensive weapons and· shall be used by an officer only
in the absence of reasonable alternatives and the presence of one or more of the
following compelling circumstances:
• Immediate threat -In self-defense or in defense of another when the officer
reasonably believes there is an immediate threat to life or of serious injury.
• Substantial risk -To effect the arrest or prevent J.he escape of a felon or suspected
felon when the officer has reasonable cause to believe that:
• Toe crime for which the arrest is sought involved the use of or threatened use
of deadly force, or the infliction of serious bodily injury; and,
• There is substantial risk that the person whose arrest is sought will cause
death or serious bodily harm, if apprehension is delayed .
Circumstances may necessitate the use of a firearm for other than defensive purposes.
Situations in this category include, but are not limited to, the following:
• To sound an alarm or call for assistance when other means of communication
cannot be used.
• In the humane interest of terminating the needless suffering of a critically injured
(pending death) animal, an officer may use a firearm to dispatch that animal only
when ALL of the following criteria are met:
• Animal Control is _unavailable or is unable to respond in a timely manner.
• The animal's owner has given consent.
• A Field Supervisor has given approval. (In an extreme siruation, a Edd
Supervisor at the scene ™ approve dispatching a critically injured animal ,
when death is pending, in the owner's absence).
NOTE: A void shooting animals in the head; rabies testing requires intact
brain tissue .

F°ll'earms shall NOT be discharged under the following circumstances:
• As a warning shot.
• At a moving vehicle or through a vehicle window, unless circumstances clearly
warrant the use of a firearm as a final means of defense.
This policy is not intended to prohibit an officer from discharging a firearm during
authorized practice and training at an approved area.
The discharge of any weapon by careless or negligent handling by an on-or off-duty
employee shall constitute a neglect of duty. ·
Any discharge of a firearm by a member of this Department for whatever reason, except as
pan of an authorized training exercise or recreational __ shooting, shall be reported and
documented by the involved employee in compliance with the existing reporting policy.
Each incident involving the discharge of a firearm by a member of this Department, with the
exception of training, qualification, and recreation, shall be thoroughly reviewed .

6.9.14 FIREARMS-AUfHORIZED
All sworn and other authorized personnel may exercise an option in the type of authorized
firearms carried on-and off-duty.
Procedures
Toe Training Section has approved and the Chief of Police has authorized the use of the
following firearms as either a primary uniform or non-uniform holster weapon.
Any of the approved weapon systems that have a change in frame, sights, slide, safety
and/or the material used in the construction (plastic or light-weight material) must be tested
and approved by the Range Staff. This also includes modification made by officers to their
own weapons.
Any officer carrying a weapon which was approved prior to June 1, 1992, may continue to
carry the weapon until he or she changes over to the new authorized weapon system .

6.9.14.3 . BACK-UP WEAPON
These weapons are authorized for use by uniform or plainclothes personnel and in specified
undercover assignments. The weapon must be approved by the Training Section and
authorized by the Chief of Police (PD Form 2210.003). For undercover purposes, written
permission to use a back-up weapon shall be obtained from the officer's Division
Commanding Officer. The back-up weapon shall be easily concealed and carried on the
person; i.e., belt, ankle, wallet holster, cuff case, or pocket.
The use of .22 magnum, rim fire ammunition in a back-up weapon is authorized. Use of
other magnum ammunition is not permitted.
Personnel must complete a Department-approved training course as a requisite for
authorization to carry a back-up weapon.
Personnel are required to re-qualify with a back-up weapon annually.

Any weapon authorized for Primary Uniform and Primary Non-Uniform duty
Authorization to carry semi-automatic weapons requires compliance with the following:
• Weapon shall be submined .to the Police Armorer for inspection relative to
defects and malfunctions.
• If the weapon passes inspection, the officer shall complete a training course as
prescribed by the Range Master. Training will be conducted during off-duty
hours without compensation.
• After satisfactory completion of the course, the officer must qualify with the
weapon by firing 50 rounds of ammunition without malfunction. The officer
must also demonstrate that the weapon will function with the ammunition and
magazine that will be carried on-duty .

• Division Commanders who authorize firearms for back-up or primary
plainclothes use, shall maintain a roster of all officers carrying such firearms.
The roster shall identify the weapon each officer is carrying by manufacturer,
model and caliber. Division Commanders shall provide the information to the
Training Section (Range Master's file).
Semi-Auto Transition Class
• All personnel transitioning from a revolver to a semi-automatic must complete
the eight-hour, Semi-Auto Transition Class and Range qualification prior to
carrying the semi-automatic on-duty.
• Officers who are on probation, who have completed six months of training in the
FI'O program (Academy not included) may take the Semi-Auto Transition Class.
Probationary officers must obtain a score within five points of their average
revolver score before they can carry a semi-automatic pistol as a duty weapon.
• Reserve officers must have permission from the Reserve Sergeant and also must
obtain a score within five points of their average revolver score.
• All officers who talce the Semi-Auto Transition Class must do so at their own
expense and time .
Certificate of Completion
A "Certificate of Completion" will be issued to officers who satisfactorily complete the
aforementioned. The certificate and three copies will be distributed as follows:
• 1be original is placed in the officer's Personnel file
• One copy to the officer's Division or Section Commander
• One copy to the officer
• One copy in the Academy Section training file

7.6.l SHOTGUNS -BLACK & Wfil'IE VEHICLES
Shotguns shall be permanently placed in black and white police vehicles. Personnel using
black and white vehicles will confirm that the shotgun is locked in the rack with the chamber
empty, and verify the vehicle is secure when left unattended.
If during the time officers are checking a black and white vehicle they find a dirty or
defective shotgun, the weapon should be removed from the vehicle and checked ~ the
Ptopeny Section. A memorandum identifying the defect and the vehicle number should
accompany the shotgun to the Issue Room. In the event a vehicle must be towed, the
shotgun will be removed from the vehicle and returned to the Issue Room.
If a black and white vehicle is without a shotgun, a new shotgun shall be obtaiDed from the
Issue Room. A memorandum shall be filed to Information Management/Fleet (copy to Pistol
Range) identifying the serial number of the shotgun and the vehicle number in which the
shotgUn was placed .

7.6.3 SHOTGUNS • INVENTORY, MAINTENANCE & TEST FIRING
All shotguns owned by the Department, identified by inventory, shall be inventoried,
maintained., cleaned, and test fired bi-annually. The approved shotgun for the Department
is a Remington, 12-gauge, Model 870 Wingmastcr Pump.
EXCEFI'ION: Shotguns approved for and used by S.W.A.T.
Training
1be Personnel/Training Division shall be responsible for maintaining a complete and current
invemory of all Department-owned shotguns. The inventory shall be maiorained by Police
Range Personnel using the inventory number and weapon serial number. 1be current
invemory of Department shotguns shall be entered into the California Department or Justice
Information Services, Automated Firearms System as an Institutional Registration.
Information from the current invemory shall be entered into the system by the Information
Management Division.
With the exception of S.W.A.T. shotguns, the Range Master shall be responsible for
checking, cleaning and test firing all shotguns at least twice anmially. A maintenance log
shall be kept detailing all work completed on the shotguns. Subsequent to maintenance,
shotguns shall be returned from the Range to the Issue Room, Public Safety Building, 1st
floor, for issue.
Safety Check
Each police officer shall safety check the shotgun he/she will be using and determine if the
shotgun requires cleaning or repair. If c1eaning or repair is required, the officer shall return
the shot~ to the Issue Room and check-out another .

8.1.2 FIREARMS -DISCHARGE RESULTING IN NO-mT
Firearms Procedure Following a No-Hit Shooting
1be Homicide Detail shall forward a completed notification memorandum to the Commander
of Internal Affairs indicating information regarding the officer-involved shooting for entry
into Early Warning System (E.W.S.).
The following procedures shall be adhered to whenever an officer(s)/employee(s) discharges
a firearm either in or out of the City limits while ON-or OFF-DUTY, which does NOT
result in the injury or death of an individual. This policy does not apply to discharging a
firearm for training or recreational shooting.
The involved officer(s)/employee(s) shall notify the on-duty Supervisor immediately or as
soon as circumstances permit, but no later than the conclusion of the current work shift. The
advised Supervisor shall notify the Station Commander ·and Division Commander. If the
incident occurs off-duty, officer(s)/employee(s) shall notify the Station Commander as soon
as time and circumstances permit.
The Patrol Division Supervisor sball proceed to the shooting location, evaluate the incident
and notify the Homicide On-Call Team, when applicable, If the shooting is off-duty and out
of jurisdiction, when practical, proceed to the shooting location and complete the Officer-
Involved Shooting Field Supervisor's Repon (O.1.S.F.S.R.), PD Form 4000.024. In the
case of an off-duty, out of jurisdiction hit-shooting, follow hit-shooting guidelines, Manual
Section 8.1.3.
In all cases where shots are exchanged between officers and suspect, HIT OR NO-HIT, the
Homicide O.1.S. Supervisor or designee, and the On-Call Homicide Team sball be notified .

If an ON-DUTY officer/employee discharges a firearm which results in injury or death,
he/she shall notify his/her Supervisor or a Field Supervisor, immediately, or as soon as
circumstances permit. The Supervisor shall verbally notify the Station Commander. The
Station Commander shall make all appropriate notifications including to the officer's/
employee's Division Commander. ' If an OFF-DUTY officer/employee discharges a firearm which results in injury or death,
be/_she shall notify the Station Commander, immediately, or as soon as circumstances permit.
If the incident is within the Long Beach Police Dcparanent's jurisdiction, the shooting shall
be handled consistent with procedures for handling an on-duty shooting.
Officers/Employees. whether on-or off-duty, shall notify the Station Commander as soon
as practicable when involved in a no-hit shooting.
Station Commander Responsibilities
If an officer(s)/employee(s) · is involved in a hit-shooting, ON-or OFF-DUTY. The Station
Cornrnand~r shall notify the Homicide 0.1.S Supervisor or designee and On-Call Homicide
Team who shall respond to the location and, if within the Dcparanent's jurisdiction, assume
ABSOLUTE control of the investigation. If the shooting is beyond the jurisdiction of the
Long Beach Police Department, the Chief of Police or his designee shall determine whether
personnel should be sent.
The Station Commander. where feasible. will respond or dispatch a Field Sergeant and other
personnel, as required, to the scene to perform the duties outlined in support of the
officer(s)/employee(s) and to ensure the officer(s)/employee(s) remains at the scene, unless
injured, until the Homicide 0.1.S. Supervisor or On-Call Homicide Team arrives .

• Firearms Procedure Following a Hit-Shooting

The initial responding Supervisor and Patrol Officer(s) shall secure immediate medical needs
and render other aid as required. The responding Supervisor and Patrol Officer(s) shall also
secure the scene to avoid alterations or contamination and to preserve all physical evidence.
Under emergency circumstances where it is IMPRACTICAL to maintain the scene, the
responding Supervisor or Patrol Officer(s) shall collect all physical evidence, exercising care
to accurately record the location of each item. All relative repons shall be filed as soon as
practical and submitted to Homicide for review. Collected evidence shall be reviewed by
the Homicide O.1.S. Supervisor or Senior Homicide Investigator prior to being placed into
property.
Once the perimeter has been established and secured, the Supervisor in charge shall designate
a Supervisor or Senior Patrol Officer to provide security for, and attend to, the needs of the
officer(s)/employee(s) involved in the shooting. The designated Supervisor/Senior Officer
shall remain with the officer(s)/employee(s) throughout the investigation, including the filing
of all reports. The involved officer(s)/ employee(s) ?"baU uot be left alone, The involved
officer(s)/employee(s) shall, except under extraordinary circumstances, remain in the
immediate area so that they can be interviewed by Homicide Investigators. The involved
officer(s)/employee(s) shall, under normal circumstances, retain his/her weapon and
ammunition, snapped in its respective holster until relinquished to a Homicide Investigator .
1bc weapon shall not be opened, loaded or unloaded prior to examination by a Homicide
Investigator.
Except under extraordinary circumstances, sworn and civilian witnesses shall remain in the
immediate area of the shooting accompanied by officer(s). Officers shall obtain proper and
complete identification and a statemem as to what the witness observed. The witnesses shall
be released and/or transpOned to the Station ONLY at the direction of the Homicide O.1.S.
Supervisor or Senior Homicide Investigator.
The civilian witness statements shall be recorded on audio tape, whenever possible .

The Review of Officer-Involved Shootings
In addition to making specific findings as to whether the shot(s) fired was in or out of policy,
the review process of an 0 .1.S. shall include an examination of the circumstances of the
shooting, including the events leading up to the incident.
With regard to the shot(s) fired, the Board shall make one or the following fmdings:
• Intentional, in policy
• Intentional, out of policy
• Accidental, in policy
• Accidental, out of policy
In making a decision as to whether the shooting was in or out of policy, the Board shall
include an examination of the following questions regarding the tactics used by the involved
officer(s).
• Was the method of approaching the subject consistent with our training?
• Was it appropriate for the officer to draw his firearm?
• Was it appropriate for the officer to point his firearm at the subject?

Review or The Incident Up To The Time Of The Shooting
• Were there any Department policy, procedure, or training issues that require
modification?
• Were there any personnel issues that should be addressed?
Recommendations shall specify the type of action, such as: Re-training at the Academy;
policy review by the appropriate Bureau Deputy Chief; Internal Affairs review; counseling
or training at the Divisional level; or other appropriate action.
With respect to any issue addressed in this Section, the Detective Bureau Deputy Chief shall
determine whether further Internal Affairs review is appropriate.
The employee's Deputy Chief shall forward the completed, ·signed and dated investigative
notebook to the Chief of Police for review, addition.ii comments/recommendations and
signature. The Chief of Police will then forward the signed notebook to the Homicide
Supervisor for permanent storage .
