Incident Summary
Units responded to a call for service of an armed robbery that had just occurred, in which the weapon used was a gun.
The victims pursued the suspect with the gun, and directed officers to the location of the suspect. The robbery occurred
near the Aquarium of the Pacific.
Officers contacted the suspect inside the bar area of the The Pike. The suspect failed to comply with commands
and resisted arrest. Ofc. Perez used approximately five to six baton strikes, a takedown, and the carotid, Ofc. Longoria
used bodily force to place the suspect under arrest. Ofc. Perez's baton broke during the use of force. No further force
was used. It was later determined that the suspect was a ).
As a result of the use of force, the suspect had complaint of pain to his left leg and left arm. There were no marks or
bruises on either. The carotid was ineffective on the suspect; he did not lose consciousness. While being treated at St.
Mary's Hospital it was learned that his left wrist was fractured. The suspect signed a medical release form. It is
attached. His parent or guardian was unavailable.
Due to the suspect's injury, IA Sgt. O'Dowd was notified and responded.
The Pike has surveillance video of the use of force. It was not available at the time this report was completed.
The surveillance video was CH. 10 and CH. 13, 1944-1946 hours.
There was only one witness to the use of force, identified as the lone bartender inside the bar where the use of force
occurred. For further on her statements refer to the supplemental reports.
I interviewed the suspect. The interview was digitally recorded and attached to this file. For further refer to the
supervisor's supplemental report .0005.
Ofc. Longoria injured his middle and fore fingers on his left hand as a result of the use of force. The injury was minor
and IOD paperwork was completed.
Units located the suspect's gun on the suspect's flight path. The gun was loaded and stolen.
Based on my investigation I believe the force used was reasonable and in-policy.
