LONG BEACH POLICE DEPARTMENT
Narrative
The call stated there was an armed robbery to a person. The suspects were three male Blacks that were seen
running towards the Pike Ferris Wheel located on Shoreline Drive west of Pine Avenue.
While en route, Unit-1C38 Officer Potter #5487 contacted the victim and immediately broadcasted on our police
radios that one of the suspects was a male Black subject wearing a black hooded sweatshirt with white writing on
the back. The other two suspects were described as male Black and last seeing running towards the Aquarium
parking lot.
Upon arrival, my partner and I searched the area for any suspects. Unit-MG13 (Officer J. Longoria #10131 and
Officer S. Perez #10129) aired that they had one suspect in custody. They further advised a second suspect
wearing a black hooded sweatshirt with white writing on it was still outstanding.
As my partner and I drove northbound on Pine Avenue north of Shoreline Drive, my attention was drawn to a male
Black with a black hooded sweat shirt and white back pack that was walking northbound on Pine Avenue (west
curb) south of Bay Street. The subject (later identified as Defendant Delvyn Gadlin) was walking with his hood
over his head and walking at a fast pace.
My partner and I conducted a pedestrian stop on Gadlin in the area of Pine Avenue and Bay Street pending
further investigation. As soon as I contacted Gadlin, I asked him to place his hands in the air. I immediately
noticed Gadlin was out of breathe and sweating from his face and head. I placed him in handcuffs and seated
him in the back seat of our police vehicle pending further investigation.
I notified our Communication Center we had a subject detained that matched the suspect description that was
previously aired.
Officer Grajeda conducted a Field Show Up with the victim. The victim viewed Gadlin and positively identified him
as one of the subjects who robbed him. For further on the FSU, refer to the FSU forms.
Officer Potter conducted a second FSU with a witness of the robbery. The witness viewed Gadlin and positively
identified Gadlin as one of the subjects involved with the robbery.
After the conclusion of the FSU's, I notified Gadlin he was under arrest for robbery and read him his Miranda
Advisal (Per PD Form 1000.008), which he stated, "Yes" to both waiver questions.
I asked Gadlin why he was so sweaty and out of breathe when I first contacted him. He told me "I was running
because I saw some Mexicans do something and I started to run." I asked him what exactly did he see the
Mexicans do. Gadlin stated he did not know. I asked him if he had come to Long Beach alone or with friends.
Gadlin advised me he rode the #142 bus from San Pedro by himself to come and enjoy the beach. He later
changed his story and stated he had come to Long Beach with some female friends. No further questions were
asked.
My partner collected Gadlin's white backpack, black hooded sweatshirt, blue jeans, and shoes as evidence. He
maintained possession of these items until he placed them into Evidence. For further, refer to the Evidence
Report.
My partner and I drove Gadlin to Jail located at 400 West Broadway where he was booked as charged and placed
in the care and custody of the 6th Floor Men's Jail without incident.

order him to get on the ground, however he stayed standing and backed up towards a door (kitchen access)
located against the east wall. I continued to strike the suspect (approximately 3 or 4 more times) on his left arm
and leg as he refused to follow my lawful orders.
My baton shattered on my last strike as he remained standing. I again ordered him to get on the ground as I
grabbed him by the jacket and was able to take him to the ground. He landed face down with his arms under the
center of his body. As I was on his right side holding him by his jacket, I told him to pull his arms out from under
his body. He did not respond verbally and physically resisted by keeping his hands under his body. Unsure if he
was reaching for a weapon, I positioned myself on top of his back and began to apply the carotid hold.
I continued to order him to pull his arms out as I rolled him onto his right side giving him the ability to comply and
pull his arms out. I maintained the carotid hold form approximately 30 seconds as my partner was able to gain
control of his left arm. While applying the carotid the suspect did not go unconscious and stated, "Okay okay" as
he began to bring out his right arm. I released my carotid hold and grabbed his right arm bringing it behind his
back. Force was no longer used as my partner handcuffed the subject. The entire use of force incident was quick
and only lasted approximately 1 minute.
Assisting officers stood the suspect up and walked him outside the hotel. He was placed in the back seat of a
patrol vehicle as we conducted our investigation. The suspect was later transported to the hospital for medical
clearance and eventually taken to Booking after being positively identified during a field show up by the
victim and witness.
I recovered my broken baton from the scene and Officer R. Davenport #6289 later took photos of it.
During our investigation Officer Davenport retraced the suspects steps and located a blue steel with black grips
Taurus .38 caliber revolver (serial # ). The firearm was located on the north end of the pedestrian bridge
(just east of Bay Street) against the west wall near a vending machine. Officer Davenport took photos of the
firearm and collected the item. He rendered the firearm safe and found it was loaded with one live round and two
spent Winchester .38 caliber casings. Officer Davenport was advised the firearm was reported stolen out of
LAPD- Harbor Division on 01/04/13 (LAPD DR # 130504207). He maintained possession of the firearm until
placing it into evidence. For further see property report.
Sergeant Richens was notified of the incident and arrived on scene.
For further details regarding the incident see main report and additional follow up reports.

ordered him to get down on the ground (I pointed to the ground).
failed to comply with my lawful order and stated in an aggressively loud tone, what did I do!
I gave him the same commands in order to give him an additional opportunity to comply. Officer Perez ordered
him to comply; therefore, giving him ample and multiple opportunities to comply. Officer Perez then struck
approximately 5-6 times with his baton on the left side of his body (while striking with his
baton, it broke). For further see his report.
fell to the ground (face down) with both hands under his stomach. I yelled at to place his
hands above his head but he did not comply. Officer Perez got on top of his back and applied the carotid hold.
Officer Perez leaned on his right side of the body leaving back free. I then reached under his stomach
and grabbed his left wrist with both hands. I gave him several commands to give us his hands but he refused. I
could feel his arm tense up and his left hand clinching into a fist. I could feel pushing his hands
together towards his stomach. I struggled to maintain control and continued t pull his arm out.was
very strong and I felt I was losing control of his wrist.I applied leverage on his back with my left elbow while
squatting above his left shoulder.
I was able to pull his hand out and handcuff his left wrist, but he still kept his right hand under his stomach. As
Officer Perez applied the carotid hold yelled, "Okay! Okay! Okay!" and moved his right hand out from
under his stomach.
Officer Perez released the carotid hold and Officer Rios pulled his right hand out without any resistance. I was
able to handcuff him without further incident and no further force was used. Officer Rios and I escorted him to the
back seat of his patrol vehicle. For further refer to his follow-up report.
While struggling to pull hand out from under his stomach I injured my ring finger and middle finger on
my left hand. My fingers were slightly swollen and have continuous pain.
Sergeant M. Richens #6056 was advised of the Use of Force and responded on scene.
I interviewed Security Officer who told me the following: was ridding his bike in the Pike area when
he heard people yelling for help. The people were pointing at a male Black subject. saw the male Black
wearing all black clothing running westbound towards the saw the suspect enter the hotel and
watched him go into the bar area. entered the hotel entrance and waited for police to arrive. pointed out
the suspect to me.

Narrative
I, Detective F. Gonzalez #5608, was assigned as the investigating detective of an armed robbery with two
suspects in-custody, one adult and one juvenile.
I was assigned to the adult, Delvyn Gadlin. On 8/13/13, Detective S. Trentini #5591 and I interviewed Defendant
Gadlin in the 6th floor men's jail interview room. I asked Gadlin about personal information, such as who he lives
with and if he graduated high school. I asked him about his prior record which he said he had a ticket for
.
I asked Gadlin if he could read and understand English and he said he did. Gadlin was re-advised of his Miranda
Rights via the Advisement of Legal Rights form. He read out loud and initialed each right confirming he
understood. He signed the form agreeing to talk to us.
I asked him how long he has known the arrested , and he stated he did not know anyone by that
name. He was advised he was identified as being involved in a robbery. When asked how he came to Long
Beach, Gadlin stated he came on the 142, Commuter Express. He said he caught it First/Gaffey, mid afternoon.
Gadlin said he came to Long Beach to see his , who lives in the area of 7th unknown cross
street.
When asked what did he do when he got off the bus, Gadlin said he walked around the beach until came
home about 5:30. He said after walking on the beach, he started to walk to house when he was
stopped by police.
I advised him when he was stopped he was sweating and out of breath and he denied being sweaty and did not
start sweating until he was in the back of police car because it was hot. Gadlin was advised he was identified as
being involved in a robbery and Gadlin said he was not involved in any robbery. He said he saw some Mexicans
chasing someone prior to getting stopped but he was not involved.
I advised Gadlin the victim and a witness described the second suspect being a male Black with a black hoodie
with a white backpack. Gadlin said he was not involved in any robbery.
I asked him if he spoke with anyone and he said he talked to a female on the bus but no one else. Gadlin
continued denying being involved in any robbery. No further question were asked.
He was released back to the jail staff.
On 8/15/13, I photographed the clothing Gadlin was wearing, in property. One item was a black hoodie with white
"San Pedro" on the front and back, white backpack with black lines, blue jeans, blue sneakers. I printed the
