Officers arrived and determined was in violation of Camping in the Park (16.16.010(E) LBMC). refused verbal orders to come down from a child's jungle gym he was standing on and attempted to light several objects he was holding on fire. Fearing was either trying to harm himself with the fire or use it as a weapon, Officers used bodily force to remove from the jungle gym and place him onto the ground. continued to actively resist being taken into custody. He attempted to stand back up and kick at officers. Officer Vega used bodily force to keep on the ground and Officer Woods and Officer Rodriguez used several baton strikes on in an attempt to force him to stop kicking at officers. The baton strikes appeared to have no effect on because he continued to flail his feet and kick at officers. Officer Vega then placed the carotid restraint on and momentarily lost consciousness. was handcuffed, immediately rolled onto his side, and he regained consciousness. Officers immediately requested fire to respond to treat and they monitored breathing until fire arrived. I arrived with fire and observed handcuffed and seated on the ground in front of the jungle gym. stared blankly straight ahead and refused to answer questions from fire or myself. Fire then transported to Pacific Hospital. Officer Castellanos arrived on scene and photographed the scene of the UOF, Officer Woods, Officer Rodriguez, and Officer Vega. Officer Castellanos then went to the hospital and photographed injuries. Officer Cochran attempted to locate witnesses to the Use of Force. For further, see his follow up report. I was unable to locate any video cameras that may have captured the incident. I notified WC Lt. Assef of the Use of Force at approximately 1050 hours. I went to the hospital and attempted to speak to but he again stared blankly at me and refused to answer any of my questions. I observed redness to the front of right shin. This injury was consistent with a baton strike. I did not observe any other injuries to . I determined the Use of force was reasonable and justified. was illegally camping in the park, actively resisted being detained, and attempted to light a fire and either harm himself or use it against the officers. All three officers involved used the least amount of force to detain and eventually place him under a 5150 HS hold for his own safety.
