Application for 72-hour Detention ...
On 11 /23/13 1117 hours, I (Ofc. B. Woods 10125) while working uniformed patrol in a marked police vehicle was
dispatched to Hill Street and Deforest Avenue regarding a homeless subject camping in the park (call 0568).
While en route, the calling party (later identified as--) stated a male Black transient was inside the
park camping waving his hands in the sky and acti~elieved he was possibly mentally ill. He was
further described as in his 20's with short dread lock hair and wearing a blue shirt and khaki pants.
This park (Kaboom) is located off of the north curb of 21st street west of San Francisco Avenue. At this location ,
21st street dead ends into the LA riverbed. North of the park is a sewage plant that has an address off of Hill
Street. There is a small wood chip walkway that leads from Hill Street to the park. Inside the park there is child
playground jungle-gym.
On scene, I walked southbound from Hill Street into the park where I observed seated on the
jungle-gym inside a sleeping bag and several other personal belongings. I know rom numerous
incidents where he has been cited for different crimes (such as camping in a par , an respassing in the parks
after closing hours). --was wearing a homemade superman onesie and yellow pants overtop his outfit.
In his mouth was a l~acifier with a picture of Pluto on it. --was looking to the sky with this head
~eked. He was uttering some unintelligible words prior t~ct. At this point I determined
--was in violation of camping in a park.
Upon my contact --recognizing me got out of the sleeping .a and off of the equipment. He starting
talking to me abo~imself was God due to his name being . While engaged in the conversation he
went off in different tangents about Christian Baptism religion and him eing a slave to our society due to him
having brown eyes. Due to overall demeanor and random tangents on different conversation I believed he was not
in the right mental status. I attempted to interject and change the conversation to a relevant topic.
At this point he became visibly angry and stated, "I'll fight you. What do you think you are in the UFC." Perplexed
at the new tangent I attempted to calm him down through conversation. At this point Officer Vega and Officer
Rodriguez walked to my location. upon seeing them climbed back onto the playground equipment and
sat on top of his sleeping bag. reached into an unsearched blue backpack and pulled out a wad of
paper. He then retrieved a red can estIc lighter from the bag and attempted to light the papers on fire in his lap.
Upon see this I feared that-was a danger to himself, by possibly lighting himself on fire.
Officer Vega went on the equipment and grabbed --right arm to stop him from lighting the papers on
fire. I grabbed left arm and pulled it awayfromhis body. Officer Rodriguez assisted me by grabbing
his left arm an p I off the playground equipment. This was a much safer route than Officer Vega
attempting to pull ards down a set of stairs.
Coming off the equipment landed on his feet and attempted pull away from us in order to escape.
While standing in front of interlaced my fingers behind his neck and attempted to control his head while
he continued to thrash wI y a out. Officer Rodriguez grabbed --from behind and took --to the
round. While --was on the ground, he started to kick~ towards Officer Rodriguez.lstruck
withmybatonfour times in the lower legs, twice in the right leg and twice in the left leg. Officer Vega

Officer Rodriguez gained control of his right arm and placed him into handcuffs (double locked). There was no
further use of force.

and began to utter unintelligible things to himself. Long Beach Fire Department was called to the scene. Engine 7
and Rescue 13 responded on scene. Rescue 13 transported to Pacific hospital where he was released
not booked and placed on a 5150 hold for mental examination.
Due to action he was deemed unable to take care of himself and gravely disabled. For the most part
he was unable to carry on a conversation and could not answer questions. From knowing personal
history he has been placed on several 5150 holds prior to becoming a transient.
Sergeant Baum was notified of the use of force and RNB. He responded to the scene. Watch Commander Assef
was notified of the incident. Officer Cochran spoke with the original calling party, for further see his report. Officer
Castellanos took photographs at the scene. Sergeant Baum notified the on call arson Investigator Easely of the
call.

I, Off. J. Cochran #574 1, assisted units that were dispatched to the park in the area of Deforest and Hill St.,
regarding an Unwelcome Subject, see call #568.
Upon arrival I saw that the officers had a subject handcuffed and detained. I saw that the subject was wearing a
Superman onesie costume and sucking on a pacifier. The subject did not have any visible injuries and did not
appear to be in any distress.
The above park is located to the rear of several homes on San Francisco. It is separated from the homes by
wooden fences and cinder block walls that are approximately six feet high. On the west side of the park there is
an embankment that leads up to a bike path that runs along the riverbed. To the north there is a small opening
that leads to Hill St. To the south there is wide opening that leads to 21st St. The park is also partially surrounded
by a six foot chain link fence. The park has a jungle gym, swings, and several benches.
I was tasked with speaking to the Calling Party and doing knock and talks with the residences located to the east
of the park.
I spoke to Calling Party -who told me the following. She was walking to the park at the above location to
allow her 23 month old clil?c!to p~und. When she got close to the jungle gym she noticed a
subject, (later identified as RNB ____ ), walking up the ladder of the jungle gym. The subject then
layed down on the bridge.

REP could see that the subject was acting strangely and talking to himself. She did not feel safe letting
her child play on the jungle gym due to the subject's behavior. REP believed that the subject was
behaving as if he was, "Not in his right mind." REP left the park with her child and called the police.
I walked to the residences to the east of the park. I spoke to the resident of , (),
who told me that he was inside his residence and he did not hear or see anything.
I spoke to the resident of , (), who told me that he did not see or hear
anything.

Narrative
On 11/23/13 at approximately 1000 hours, my partner (Officer R. Vega #5761) and I (Officer R. Rodriguez #
10051) were working routine uniform patrol in a marked black and white police vehicle as Unit 1B64. We assisted
Unit 1B4 (Officer B. Woods #10125) who was dispatched to the area of Hill Street and De Forest Ave, regarding
an unwelcome subject who was possibly intoxicated. Call # 568
While en route, dispatched advised us of the following:Unwelcome possibly intoxicated subject at the park
(Kaboom park). He was described as a male Black subject in his 20's with dread locks, wearing a blue shirt, khaki
and orange pants. Subject is sleeping in the playground with a sleeping bag and lots of trash around him. Subject
is possibly mentally ill.
This location is a park, located on De Forest Ave. between 21st Street and Hill Street. There is a north/south alley
along the east side of the park that separates the park form the residential area. There is an embankment along
the west side of the park that leads into the bike path and L.A riverbed. There are several wooden benches and a
multi colored jungle gym located in the center of the park. The ground is covered with brown color soft bark.
Upon arrival, I observed Officer Woods speaking with a subject (Later identified as RNB )
matching the dispatched description. was sitting on the bark/ground along the south side of the jungle gym
playground. Officer Woods was standing in front of him giving him verbal commands. Officer Woods informed me
that was had not been searched and he was being uncooperative.
I observed several items (Sleeping bag), were weapons could easily be concealed.stood up and entered
the jungle gym through an opening with a ledge that has a 3-foot wall climb. He sat next to his belonging and
gathered several miscellaneous papers, placing them on his lap. He retrieved a red and black plastic candle stick
lighter with his right hand and proceeded to lighting the papers on fire. Officer Vega walked up the stairs along
the west side of the jungle gym and took a hold of right hand, to prevent him from successfully igniting the
papers on fire and causing himself injury. I assisted by taking a hold of left hand/wrist area. I believed it
would be safer if I pulled towards my direction,due to the stairs located next to Officer Vega. Officer Vega
released his hold and I managed to pull off of the ledge of the Jungle gym.
I gave a command to place his hands behind his back. He ignored my command and stood standing up as I
maintained a hold of his left hand/wrist. attempted to pull away from my grasp and Officer Woods assisted
by taking a hold of upper shoulder/head area. I wrapped both of my arms around waist, lifted him
off the ground so he may lose his balance. Once lost his balance, I was able to conduct a take down.
While on the ground, used both of his arms/hands and pushed himself off the ground attempting to stand up
and preventing us from safely handcuffing him. I gave him another command to stop resisting and place his

stood up and retrieved my department issued baton from my baton holder. I gave -a command to stop
kicking and conducted a baton strike to his lower right leg area. The baton strike was ineffective because he
continued to kick.!!roceeded to give -two more baton strikes to his lower right and left leg area. Officer
Woods also gave a baton strike totielp assist the arrest. Officer Vega managed to safely apply the carotid
control hold, whic was successful and we were eventually able to safely handcuff him. For further see Officer

I advised dispatch of the incident and the use of force. 1 S24 (Sgt. P. Baum #5864) responded on scene.
Long Beach Fire Department engine #7 assisted on scene and rescue #13 transported -to Pacific Hospital
where he was placed on a 5150 H&S hold. I rode in the ambulance rescue #13 as they~sported the subject to
the hospital. I advised dispatch of the incident and the use of force. 1S24 (Sgt. P. Baum #5864) responded on
scene.

On 11 /23/13 I, Officer R. Vega#5761 along with my partner Officer R. Rodriguez#10051 were working uniformed
patrol as unit 1864. We assisted unit 184 Officer 8. Woods #10125 who had been dispatched to the Kaboom
Park that is located between Hill St, 21st St and just east of the east bike trail of the L.A. River.
Officer Woods was called to the park regarding an unwelcome transient who was sleeping on the bridge of the
"Play structure", aka the children's jungle gym. The call stated that the transient who was described as a M/8 in
his 20's, with short dread locks, a blue shirt and khaki pants. The calling party stated that she believed this
subject, later identified as--had strewn trash everywhere. The calling party stated that -
was acting strange and sh~as mentally unstable. Call# 568.
The above park is a community pocket park which has a Parks and Regulations sign clearly posted listing
numerous park regulations including Camping prohibited-16.16.01 O(E) L8MC.
U on arrival to Hill St and Deforest Ave we noticed that Officer Woods was already on scene and was talking to
who was sittin on the jungle gym. Officer Rodriguez and I walked to the area of the jungle gym from
1 • noticed was sitting on the west end of the jungle gym with his backpack next to him and his
sleeping bag on e n ge a~ungle gym. I also noticed several papers and trash on the ground all
around the jungle gym area. --was in violation of 16.16.01 O(E)-Camping anytime.
I told to get down from the jungle gym to talk to us. --said "No" and refused to come down the
stair . then retrieved a red candle stick lighter from~ack along with s~ces of paper.
t en ignited the lighter and was attempting to set fire to the papers. I believed --was going
er try to light himself on fire or use the fire as a weapon against us.
I walked up the stairs on the south end and ordered him to turn the lighter off. --did not comply with my
order and I then took the lighter out of his ri-t hand and grabbed his right arm~ hands to prevent him
from reaching into his pockets or backpack. tensed his right arm and began pulling away from me.
--and his backpack had not yet been searc ed for possible weapons. Officer Rodriguez then took hold
oT'liTsie?tarm. Due to the confi~ of the jungle gym and the danger of me or another officer falling off the
apparatus we decided to bring --down off the jungle gym apparatus.
I let go of--right arm once I saw Officer Rodriguez was able to pull -safely off from the north
side of thejuiiglegyiii.
I walked down the south stairs of the jungle gym and when I turned around I saw officer Rodriguez and Woods
had not gained control of-even after officer Rodriguez had taken him down to the ground with a bear

was getting up off the ground by pushing up with his arms. ignored several
commands to ge own on the ground and place his hands behind his back. I placed my e s oulder against his
back and grabbed his left arm in an attempt to place his left arm behind his back and he resisted by tensing his
arm and pulling it toward his body and underneath his torso.
Officer Rodriguez grabbed a hold of--right arm. --flailed his legs around and was ignoring
several commands given by Officer ~ stop resis~ put his hands behind his back.
--used both his arms and began to push himself off the ground. I then placed my right shoulder against
'liTsbackand used my body weight to keep him from getting off the ground.
Officer Woods and Rodriguez ~ several times in the lower legs with their batons. I believed the
baton strikes had no effect on _.-Eecause he was still pushing himself off the ground.
I then laced my right arm around --neck and placed him in a carotid control hold. After a few seconds
lost consciousness an~le to safely handcuff ..... No further force was used on
. I placed --on his side and then to a seated po~e shortly thereafter regained
consciousness and askedwhat had happened.
LBFD was immediately called to the scene. I monitored his breathing until Engine 7 and Rescue 13 arrived. Unit
1 S20 Sergeant P .Baum #5864 was notified of the use of force and responded to the scene.
Per policy --was transported to Pacific Hoiiiital for observation by Rescue 13. --was medically
cleared by~spital Emergency room staff. told hoiiiital staff he was ~ had not been
taking his meds. I placed a 5150 72 hour mental eva uatIon old on and he was released to the care
and custody of the College Mental health Center, (Pacific Hospital) wit out urther incident.
Unit 112B Officer A. Castellanos #5705 assisted with photos of the scene. For further see officer Castellano's
photo report. WC1 Lieutenant Asset was also notified of the incident.
