Stein # 5915, responded to E. 14th St for a report of a family disturbance where the calling party's son,Luis Avila, was trying to break a window. I arrived at the same time as Officer J. Marquez # 6281. We were the first officers there, and we walked to the back house. I know both Luis Avila and the location from prior calls at this location. I also know that Avila is a member of the Barrio Pobre criminal street gang. Officer Marquez and I entered the yard north of the calling party's bungalow and moved west. This brought the storage shed west of the bungalow into view. It is in this shed where we found Luis Avila. He was standing inside the shed, and the shed is set up to be his living space. The shed has double-swing doors that opened outward. The west door was open all the way, but the east door was closed. I immediately formed the belief that Avila was under the influence of a drug or suffering a psychotic episode. He was holding both of his hands out to his sides and was talking with a deliberately low and raspy voice. He was giving us this wide-eyed stare and was repeatedly opening his mouth all the way and sticking his tongue out. Officer Marquez tried to talk Avila into coming out of the shed. Avila was not even acknowledging the request but instead telling us we had no right to be there. I asked Avila if he would attack us if we tried to arrest him. Again, he did not respond to this question but just stared at me with his wide-eyed stared and told me, "Oh my God! Oh my God!" I did not want to go into the shed to detain Avila, because this would have been unsafe for the following reasons: There was no lighting in the shed or yard, and we had to use our flashlights for illumination. We could see Avila but we could not see his hands or what was at his sides in the shed through the open shed door. There was no room to move around in the shed due to the furniture in there, and the shed had a low entrance I would have had to duck down to get through. I also believed that Avila could get violent with us as the original call was for him breaking a window. Officer Marquez requested additional officers to meet us in the yard. More officers arrived, and I continued trying to get Avila out of the shed. I was able to talk him into coming out of the shed and standing in the yard. I next asked him to drop down to his knees. He did not comply and again did not even acknowledge the request. I was hoping to get Avila to lay down in the prone position, because a suspect in the prone position allows an officer to as safely as possible handcuff a dangerous suspect. I heard another officer warn Avila that he would be "tased" if he did not get down on his knees. Avila did not get down on his knees but instead said something to the effect that we should go ahead and "tase" him. The probes struck Avila and caused him to fall down. Officers then moved up and handcuffed Avila. Given the way that Avila was acting before the ECD deployment, I decided to apply the hobble restraint. I believed that once Avila regained his senses after the ECD deployment, he would realize his legs were still unrestrained and begin kicking or using them to resist. I believed an application of the hobble restraint under these circumstances could prevent the need for further applications of force. I was able to apply the hobble with no resistance from Avila. Avila was non-responsive after the ECD deployment, so we decided to summon paramedics. The pathway to get to the backyard was very confined, and I believed it would have been difficult for paramedics to get a gurney back there. Officers L. Valdez # 10142, V. Nguyen # 5970, and C. Ignacio # 5883, and I carried Avila to the south sidewalk of 14th St, so it would be easier for paramedics to begin treatment. We laid him on his side in the grass. I watched his chest to monitor his breathing. He was breathing with no difficulty. Paramedics from LBFD Engine 3 arrived and began their treatment of Avila. I returned to the shed and began photographing the scene as well as some evidence contained in the shed. When Sgt. S. Benson # 6205 arrived, I told of her of my hobble restraint application and of officers carrying Avila to the sidewalk. Call #2050. The caller , stated she lived in the back house and her son (Luis Avila DOB 06/25/1993) wanted to break the windows out. Avila was also talking about the devil while outside. Upon my arrival, I saw numerous police units already on scene at the back house. I walked to the rear residence and noticed the officers focusing their attention on the tool shed located along the west wall of the residence. The tool shed door was open and I saw a male Hispanic wearing a black t-shirt, dark colored shorts and a black baseball cap. I also noticed multiple tattoos throughout his face and limbs. He was talking in a slow deep raspy voice, with his eyes wide open, appearing to me that he was under the infulence of some type of drug. As I approached the officers, I asked Officer M. Rios #5668 who was on scene prior to my arrival, if Avila had committed a crime. Rios told me Avila made criminal threats against his family. I walked over to where the shed was and I heard Officer B. Stein #5915 giving Avila orders to exit the shed with his hands up. Avila replied "No" with the same slow deep raspy voice, as he began breathing hard and pumping his arms up and down along his sides. Officer Stein continued ordering Avila to walk out of the shed and Avila continued to ignore Officer Stein's orders. Avila began posturing with his chest up in the air, shoulders straight up and back and arms to his side as if he was preparing to charge at us. The lighting and visibility into the shed was very limited due to the low light conditions and it was difficult to see what Avila was actually doing or holding, so lethal cover was provided by officers while I told Officer Stein I was going to provide less lethal cover. I removed my Electronic Control Device (ECD) from my holster and aimed the red laser at Avila's mid section between his lower chest and his belt line, from about 10 feet away. Officer Stein told Avila once more to step out of the shed with his hands up so we can speak to him and Avila once again said "No" as he began breathing heavy and hard. Seconds later Avila walked out of the shed with his chest up in the air, his arms tight and wide to his sides and hands balled up, taking a fighting stance. I immediately felt Avila was preparing to physically fight us, and was pumping himself up. Avila told me "No" and began rambling in his slow deep raspy voice once more. I once again ordered Avila to get on his stomach or I would "taze" him. Avila said "No, do it." and he began looking around. It appeared to me that Avila was getting ready to take a step forward towards us, so in order to prevent a combative confrontation and to gain control of Avila and the situation I deployed my ECD. As soon as the prongs made contact with Avila I saw the ECD take effect on Avila as his body locked up and stiffened. Avila began falling backwards, towards the ground and hitting a nearby large plastic city trash can, slowing his fall. After the first 5 second cycle was over it appeared as if Avila was attempting to pull away so I activated another 5 second cycle of the ECD. After the second ECD cycle Avila began yelling "I'm burning, I'm burning!" Officer B. Mitchell # 6042 and Officer C. Ignacio # 5883 approached and handcuffed Avila. Officer Stein applied the hobble to Avila's ankles to prevent him from kicking, without resistance. Avila was taken into custody and Sergeants M. Richens # 6056 and S. Benson # 6205 responded. Long Beach Fire Department engine # 3 and rescue #10 responded, to treat Avila. Avila was later transported to St Mary's hospital for treatment. Officer V. Nguyen # 5970 followed rescue #10 to St Mary's hospital and was later relieved by Officer C. Lapworth # 6282 and C. Silva # 6321, pending Avila's medical clearance to be booked. Officer V. Nguyen photographed Avila's injuries which consisted of abrasions to both cheeks, forehead, and chin. While at the hospital and recorded video footage at the direction of Sergeant Richens. Once at the West police substation Sergeant Richens burned a copy of the video onto a CD-R and gave it to Officer Nguyen who later placed it into evidence. Mitchell #6042) was working uniformed patrol in a marked black-and-white police vehicle as Unit 1C94. I responded to the house rear of E. 14th Street, to assist with a possible family disturbance. (Call 2050) For further, refer to the report filed by Unit 1C35 (Officer J. Rios #5668). While at the scene, I was in the back yard of the dispatched address. There was a small wood shed located in the yard, with the door facing northbound. The door consisted of two side-by-side barn style doors. As I was facing south bound, the left door was closed and the right door was wide open. I observed a male subject, later identified as Luis Avila, standing inside the wood shed. I heard Officer Rios approach and advise that Avila had made terrorist threats against his family. I heard Unit 1C96 (Officer B. Stein #5915) and Unit 1C3 (Officer P. Valenzuela #6170) give Avila several official orders to exit the wood shed, but he refused. Officer Stein ordered Avila to come out, but Avila kept saying, "No". I observed that Avila was breathing heavily and his eyes were very wide, and he had a wild look on his face. Avila continually made growling noises, while baring his teeth. After several orders, Avila finally stepped outside of the wood shed, but refused to lay down on the ground. Officer Stein gave Avila several orders to get down on the ground, but he refused. Officer Valenzuela advised Avila that if he did not get on the ground, he would use his taser (Electronic Control Device). Avila told him to do it. Officer Valenzuela deployed the ECD, which was effective. Avila stiffened his body and fell backwards, landing on his back. Unit 1C93 (Officer C. Ignacio #5883) and I approached Avila, who said, "I'm burning!" I grabbed Avila's right wrist and, without resistance, rolled him onto his stomach. I placed his right wrist behind the small of his back, while Officer Ignacio placed Avila's left wrist behind his back. Officer Ignacio placed handcuffs on both of Avila's wrists. Officer Ignacio and I rolled Avila onto his back, and I observed that he was breathing. I observed that one ECD prong was lodged in the front left waist band of Avila's shorts, and the other was lodged in his shirt, on the upper chest area. Both prongs were removed and placed, inverted, back into the expended ECD cartridge, which I received from Officer Valenzuela. The item remained in my possession until I later placed it into evidence. Once Avila was taken into custody, I entered the wood shed to ensure there were no other people, including gang members, inside. Upon entering the shed, I observed a glass pipe, sitting in plain view, on a small desk. The pipe was round on one end and contained a crystal substance, which I believed was methamphetamine. Report Officer 6042/MITCHELL,BRANDON T Printed At 11/04/2020 07:19 Page 1 of 2 13-69372 Supplement No 0005 LONG BEACH POLICE DEPARTMENT Narrative I approached a large desk and observed another crystal substance, which I believed was methamphetamine, sitting in plain view. Next to it was a small clear plastic box that contained a paper bindle. Based on my experience, narcotics are commonly placed in small paper bindles. I opened the bindle and observed that it contained a crystal substance, which I believed was methamphetamine. I observed a needle (uncapped) sitting on the desk, in plain view. I turned and looked above the front door, on a small ledge, and observed a small plastic lid. I retrieved the lid and observed a small bag that contained a green leafy substance, which I believed was marijuana. I recovered the above listed items, and they remained in my possession until I placed them into evidence. I later interviewed Officer Ignacio about what he had witnessed, and he told me the following: when Officer Ignacio arrived, he saw suspect Luis Avila standing just north of the storage shed. Avila was wearing dark baggy clothing, with an oversized black shirt hanging over his black shorts. Officers were unable to determine if Avila had a weapon concealed under his clothing. Officers on scene gave Avila several commands to get down on his knees in order to minimize his movement. Officer Ignacio heard Officer Stein give Avila several warnings to listen or he was going to get tased. Avila replied, "Go ahead, tase me." Officer Valenzuela deployed and activated his ECD on Avila. Upon the ECD making contact with Avila, Avila's body stiffened up and he fell backwards onto his back. Officer Ignacio grabbed Avila's left arm and placed it behind his back, then placed handcuffs on both of Avila's wrists.
