was no longer in the area. She was a female Hispanic in her thirties, wearing a dark jacket and light colored
pants. She was medium build and approximately 5'5 inches tall.
I asked for Units to assist me. When Units arrived, I called out to the driver. I ordered the person to step out of the
vehicle with his hands up. The person (now identified as Def. Lee Anthony Armijo) did not come out as ordered.
Armijo was moving around in the front compartment. I could hear loud banging noises, which sounded like he was
kicking something in the vehicle.
Officer I. Hughes attempted to give Armijo commands on the loud speaker of my black and white Police Car.
Armijo refused to come out of the vehicle. He stuck his head out of the driver's seat and yelled out something I
could not understand.
Officer D. Paul attempted to call Armijo out of the vehicle on the loud speaker. She used English and Spanish to
give him commands to come out of the vehicle. He again refused. He stuck his head out of the vehicle and yelled
profanities at us. He then stated, "I don't care any more. Shoot me." Armijo continued to move about in the front
compartment. Officer Paul continued to give him commands. For further see her follow-up report.
While we attempted to call out Armijo, he broke out his driver's side window with an unknown object he had in the
vehicle. He then threw out miscellaneous objects out the window. Some of the objects hit a parked vehicle,
causing scratches to it (LIC 8214123). This vehicle was later also damaged by less lethal projectiles. For further
see Officer Contreras' report.
Long Beach K9 was on scene. Officers gave out commands for several more minutes. Armijo continued to refuse
to step out of the vehicle. K9 was deployed. For further see the follow-up reports.
Sgt. Scaccia and Sgt. Steinhauser were notified and were on scene. Ocean Blue was notified and responded for
the clean up of a 2-foot by 1ft puddle of blood. Officer Calub #10784 assisted with towing the vehicle. For further
see his follow up report.
Long Beach Fire treated the Def. at the scene. Long Beach Fire transported him to Community Hospital where he
was treated. Officer R. Herrera and Officer Conrad assisted with transporting Def. Armijo to the downtown booking
station where he was booked as charged.
I spoke to at Bennett Ave and he told me the following: and his wife were asleep in
their bedroom when they heard what sounded like Police Officers on a P.A speaker. He looked outside and
observed Male Hispanic subject sitting in the driver's seat of a white van. There were approximately ten Police
Officers and Police vehicles behind the van. could hear the Police telling the driver to come out of the
vehicle with his hands up. and his wife were afraid so they stopped looking out the window and laid flat on
the floor of their bedroom.
While lying on the floor, could hear a Male voice yelling profanities at the Police. The voice was laughing
and screaming and sounded as if he had mental issues. further stated, the Police were very patient. They
gave him many opportunities to come out of the vehicle. They were giving him commands for an hour.
heard a loud popping noise and dogs barking. He then heard a Male voice screaming. He also heard Officers
yelling out commands to "Get on the ground and put his hands behind his back." did not look outside and
did not observe Officers taking the Def. Into custody.
I also spoke to who told me the following: heard Police giving commands to someone in a white
van. It appeared to be a Male Hispanic sitting in the driver's seat. The Police were continuing to give him
commands for over an hour. He refused and was yelling out profanities at Police. He was throwing objects out the
window and was acting very strangely. He then observed the Male Hispanic stick his head out the window from
the driver's seat. The subject then climbed through the driver's side window. then heard loud popping noises
and saw the subject fall onto the ground. The subject then got up and ran around the front of the van when he was
bit by a K9 dog. He then observed several Police Officers attempting to handcuff the subject. stated he could
no longer see the subject due to the Officers standing between him and the subject. He could hear a lot of yelling.
was far away so he could not hear much else. further stated he has a camera at his home that points
onto Bennett Ave. I asked him if the camera shows the intersection and he said it does not. I asked him if we
could see the footage and he said he does not know how to work the surveillance system. He then stated the

appeared unsure about the system because it was new. I advised him to call us out if he does have any footage of
the incident recorded and he said he would.

On Thursday, January 14, 2016, at approximately 0449 hours, I, Officer G. Sargent #5723, was dispatched to
assist Officer P. Thach #6319 who had located an occupied 10851(a) VC stolen vehicle on 11th Street, just west
of Bennett Avenue, Call #0261.
Upon arrival, I observed a white 2008 Ford E-250 Van with a California license plate of 8K91040 that was parked
in the middle of 11th Street, facing eastbound. The sole male occupant (Suspect) of the vehicle was a male
Hispanic, approximately 25 years old, brown hair, wearing a black baseball cap, grey sweatshirt and blue jeans.
The Suspect was yelling and screaming while throwing miscellaneous papers, gloves and plumber type pipes out
the driver's side window of the vehicle.
Assisting Officers arrived on scene. I positioned myself behind the driver's door of Officer Thach's police vehicle.
A tactical blanket was deployed and positioned directly in front of my position in case the Suspect had a firearm. I
was assigned as lethal coverage for Officer D. Blizzard #5636 who had deployed his AR rifle and was standing to
my right. Officer I. Hughes #5767 and Officer K. Contreras #10805 deployed a 40 mm less than lethal launcher.
Officer D. Paul #10137 was using the vehicle's public announcement speaker system in an attempt to order the
Suspect out of the vehicle during our felony vehicle stop.
The Suspect refused to exit the vehicle after being ordered to exit the vehicle for approximately 90 minutes.
Officer Paul used the vehicle's public announcement system, which could be clearly heard by the Suspect
because he would stick his head out of the vehicle's open window and yell at the Officers to "Go fuck yourselves."
During the felony stop, the Suspect continued to yell out his driver's door window while throwing miscellaneous
items out the open driver's window. The Suspect continued to yell at responding Officers and refused to listen to
our commands to exit the vehicle with his hands in the air. On multiple occasions the Suspect replied, "I would
rather die then get out of the car."
K9 Officer V. Ortiz #5983 arrived on scene with his canine. The Suspect was becoming more agitated and was
swinging an unknown black object that looked like a pipe.The Suspect then rolled up the driver's window to the
vehicle and then broke the window out with the unknown pipe. The Suspect then exited out the driver's window of
the vehicle and sat on the frame of the open window. The Suspect then kicked the door open with both of his

feet. The driver's door swung wide open with the Suspect still sitting on the driver's door window frame.
Officer Hughes who was standing to my right then fired a 40 mm less than lethal round at the Suspect, which
struck the Suspect on the abdomen. Officer Contreras who was standing to my left then fired one 40 mm less
than lethal round that struck the driver's door mirror of a parked truck that was positioned just behind the
Suspect's vehicle. Officer Hughes fired a second 40 mm less than lethal, but I don't known where that round
landed.
K9 Officer Ortiz then released his canine to contact the Suspect. The canine then ran up to the vehicle and began
to climb into the driver's compartment of the vehicle. The Suspect then suddenly jumped down onto the ground
and ran around to the front of the vehicle. Officers on the EAT (Emergency Arrest Team) ran around the right
passenger side of the vehicle to intercept the Suspect because we believed he was going to flee the scene on
foot. As we came around the right front side of the vehicle and unknown Officer deployed his Electronic Control
Device, which struck the Suspect in an unknown area of his body. The Suspect then began to scream and rolled
onto his left shoulder.
I then grabbed his right wrist as additional officers grabbed other parts of his body. The Suspect then tensed up
and began to twist his body about in an attempt to break free of our hold. The Suspect continued to twist his body
about and made several attempts to stand up to his feet. At one point there were at least six or more Officers
attempting to control the Suspect. I began ordering the Suspect to stop resisting and roll over onto his stomach.
However, the Suspect continued to resist by twisting his body about in an attempt to break free.
The Suspect then pulled his right arm away from me and other Officers rushed in to control the Suspect. I
repeatedly ordered the Suspect to stop resisting and roll over onto his stomach, but he refused. The Suspect was
eventually rolled over onto his stomach and handcuffed by an unknown Officer.
The Suspect was then escorted to the intersection of 11th Street and Roswell Avenue where Long Beach Fire
Department personnel from Engine 4 and Rescue 8 were staged. Long Beach Fire Department personnel then
treated the Suspect for his injuries and he was later transported to the hospital for additional treatment.
Sgt. J. Steinhauser #6060 was notified of the Use of Force.

I spoke to and she told me the following: She was awakened by the police over a loud speaker.
She could hear a male and female giving commands in English and Spanish. The commands were to turn off the
vehicle, throw the keys out of the vehicle and exit with your hands up. She looked out the window and saw Armijo
in the front of the van throwing things around and refusing to come out. She went to the other side of the house
but could still here commands to exit the vehicle. She heard the commands several times (over 12 times). About
a half hour to 45 minutes later she heard two or three "pops." At that point she went to her window to see what
happened. She saw Armijo at the front of the van and there were several officers (about a dozen) around him.
The officers were very calm and kept telling him to relax, lay on your stomach and place your hands behind your
back. They took him into custody and were very professional.
Her husband (CDL DOB ) was also home. She stated he was sleeping during the
incident but was now awake. I asked if I could talk to him real quick and she went to get him. When she returned,
she told me he did not want to talk to the police and was not going to get involved

Narrative
Sergeant Hodge interviewed ARR Armijo at Long Beach Community Hospital's emergency room # 4C. Prior to
the interview Sergeant Hodge read ARR Armijo his rights per P.D. form 1000.008 and he responded yes to the
waiver question. The interview was digitally recorded, the audio file was transferred to a compact-disc, and it was
placed into evidence. The following is a summary of Sergeant Hodge's interview of ARR Armijo.
ARR Armijo replied, "I don't know why I was arrested" when asked why he had been arrested. ARR Armijo said
he knew the owner of the vehicle and had their consent to drive it. ARR Armijo acknowledged seeing the
emergency lights of police vehicles,hearing sirens, hearing officers ordering him to surrender and exit the vehicle,
a dog barking, and hearing officers state a police canine may be used to arrest him if he continued to resist arrest
by disobeying the lawful orders of officers. ARR Armijo replied, "Confidential reasons sir, I can not speak about"
when asked why he chose not comply with the officers' orders.
During the interview ARR Armijo stated he no longer wished to discuss his arrest and refused to answer any
questions. The interview was concluded at this time and no further questions were asked.

On Thursday, January 14, 2016 at approximately 0451 hours I (Officer I. Hughes #6263) responded to 11th Street
and Bennett Avenue to assist Officer P. Thach at the scene regarding a suspicious vehicle. Officer Thach
discovered that the suspicious vehicle was stolen (License 8K91040).
Several patrol units responded to the scene to assist. Once there were sufficient officers at the scene, we began
giving suspect verbal commands to exit the vehicle. Officer D. Paul used the patrol vehicle PA system to order the
suspect out of the vehicle. Officer Paul gave the suspect verbal commands in English and in Spanish. The
suspect did not comply. Instead, he yelled out the window at officers using profanity.
During the standoff, I observed that the suspect was seated in the driver's seat of the vehicle with the driver's front
window rolled down. Officer Paul continued to give the suspect periodic commands in an attempt to get him to
exit the vehicle so that we could safely take him into custody.
The suspect continued to disobey commands to exit. He taunted officers and threw several objects outside of the
vehicle. The suspect's behavior was bizarre. He violently struck the inside of the vehicle with an unknown object
and breaking glass inside of the vehicle.
While he was being ordered to exit the vehicle, he leaned his upper body out of the window but refused to comply.
K9 Officer V. Ortiz responded to the scene along with Sgt Hodge. Sgt Steinhauser was at the scene of the
high-risk stop.
I deployed the 40 mm less lethal launcher as part of the Emergency Action Team (EAT). With guidance of Sgt
Steinhauser the EAT formulated a plan to take the suspect safely into custody. Being that the suspect was in a
stolen vehicle, there was potential that he could be armed. As a EAT we determined that it was not safe to
approach the vehicle and take the suspect into custody.
The EAT gave the suspect verbal commands to apply for approximately 45 minutes. Yet, he did not comply. He
opened the door several times but closed it back refusing to exit. I heard Officer Ortiz verbally warn the suspect
that a K9 was at the scene. Officer Ortiz ensured the suspect that he would not be harmed if he surrendered to
the nearest officer.
Again, the suspect did not comply. The SWAT team was activated. While we were awaiting the arrival of the
SWAT team, the suspect sat on the driver's front door with his upper body through the window and his legs seated

on the interior of the door. As he sat on the door, the door swung open facing the EAT.
I believed that his positioning gave the EAT an opportunity to attempt to take him into custody. Being that there
was potential that he was armed, I determined that launcing the 40 mm round at the suspect to gain his
compliance was the best force option. I launched the 40 mm round at the suspect without warning. The projectile
struck the suspect on his stomach. I feared that if I gave the suspect a warning prior to launching, he would have
gone back inside of the vehicle.
After the suspect was struck with the less lethal round,he came down from the driver's side door. I observed that
the K9 was deployed. The K9 took control of the suspect but released his grip. The suspect was ordered to get on
the ground but he did not comply. I fired a second round at the suspect. The second round did not strike the
suspect. The EAT moved as a group to take the suspect into custody.
I observed that officers order the suspect to the ground. He did not comply. Officer Ortiz deployed the Electronic
Control Device at the suspect. The ECD deployment appeared to be effective. The suspect went to the ground. I
observed officer attempting to place the suspect into handcuffs. The suspect appeared to be resisting by not
placing his arms behind his back. I assisted the officers by taking control of the suspect's right arm but he pulled
away.
Another officer was able to take control of his arm and place him into handcuffed. The Fire department was
requested to treat the suspect. Officer escorted the suspect to the paramedics so that he could be medically
evaluated and treated. During the incident, I was exposed to the suspect's blood on my hands. Sgt Steinhasuer
was notified of the Use of Force and exposure.

On 1-14-16, my partner (Officer M. Calub #10784) and I (Officer R. Cruz #10009) assisted Unit 2A12 (Officer P.
Thach #6319) at 11th Street and Bennett Avenue regarding a subject refusing to exit a stolen vehicle (call #261).
Upon arrival, my partner and I placed ourselves with the EAT that was staged behind the stolen vehicle. The
vehicle was parked on 11th Street west of Bennett Avenue facing eastbound in the westbound lane.
The subject (later identified as Lee Anthony Armijo) was sitting inside the vehicle. While in the vehicle he would
stick either his head out or half of his body out to curse us out and tell us he wasn't going to jail.
Armijo broke the driver side window out put his head through the opening put half of his body through the opening
and sat on the door. Armijo was sitting in the window with the driver side door open facing us.
Officer I. Hughes #6263 deployed the 40mm less lethal launcher and launched one round at Armijo, striking him in
the stomach. Armijo buckled over in the car window in pain. Officer Hughes deployed one more round but I did
not see where the round went. K9 Officer V. Ortiz #5983 then deployed his dog at Armijo as he was still sitting in
the window but was unsuccessful.
Myself, along with the rest of the EAT approached Armijo after he fell out of the window and walked in front of the
van and out of sight. As I approached, Armijo was standing at the front of the van when Officer Ortiz's dog
contacted Armijo on the right side of his upper body. The dog quickly let go of Armijo and ran away. Officer Ortiz
and multiple officers continued to tell Armijo to get on the ground but he refused. Officer Ortiz deployed his ECD
(electronic control device) at Armijo which caused him to fall down and land on the left side of his body. Even after
Officer Ortiz deployed his ECD at Armijo, he continued to resist by clenching his fist and pulling them tight into his
chest as Officer Ortiz attempted to get control of his arms.
Officer Ortiz's dog then re-appeared and approached Armijo as he was moving around on the ground at
re-contacted Armijo on the upper right side of his back. As Officer Ortiz's dog maintained control of Armijo, he
puckered his lips and began to make "kissing" noises and whistle at the dog. After approximately five to ten
seconds, Officer Ortiz removed his dog from Armijo. Armijo continued to resist even after being struck with an
ECD and bit by a police dog.
I attempted to control Armijo's left arm once the dog was removed but he continued to resist by rolling over onto
his stomach. Due to all the officers on scene and assisting, I was unable to see who pulled his right and left arm

handcuffs. Once he was placed in handcuffs I removed myself from Armijo.

On 01-14-16 at approximately 0611 hours, I Officer V. Ortiz (5983) received a text from home by Long Beach
Police dispatch requesting a K9 to respond to 11th street and Bennett Ave. Officers had a suspect who was
inside a stolen vehicle and refusing to exit.
Upon arrival on scene I contacted unit 1S35 Sergeant Steinhauser and he told me the following. The suspect is
barricaded in a stolen van and is throwing objects out the drivers side window. The suspect has armed himself
with a metal pipe and is breaking things inside the van. When Officers attempt to call the suspect out he begins to
curse at the Officers and challenges them to fight and for them to come and get him. Sergeant Steinhuser
believes the vehicle is inoperable because his hazard lights were on and now they are dimming down. Prior to my
arrival the suspect had opened the drivers door challenged the Officers to fight then would close the door. Long
Beach Police SWAT has been activated and was in route to our location.
I noticed that the stolen vehicle was on 11th Street just west of Bennett Ave facing east bound. Approximately
twenty feet behind the stolen vehicle there were Officers standing behind a tactical ballistic blanket with there
firearms and less lethal launchers pointed towards the stolen vehicle.
I advised Sergeant Steinhauser that if the suspect opened the door again I would deploy my K9 after Officers
deployed less lethal rubber batons to prevent the suspect access back into the van. Sergeant Steinhauser and I
both agreed that in conjunction with deploying the I'm rubber baton. Sending my K9 was the safest tools we had
available at the time
I gave a K9 announcement at approximately 0550 hours, to the suspect advising him to surrender or a Police dog
would be used to bite him. The suspect replied that he was a K9 Officer also and told my K9 to bite me. He then
said that he would make Chihuahua tacos out of my Police dog if I sent him to bite him. The suspect then
challenged me and told me to go ahead and send the K9. He then stated " Come on mother fucker come and
suck my dick". A few minutes later the suspect used a black pipe and broke out the drivers side window. The
suspect stuck half his body outside from the window with his elbows up faced the Officers while holding the pipe
as if it was a rifle and aimed it at them. The suspect paused for one to two seconds then laughed as he reentered
the vehicle.
Unit SK9 Sergeant Hodge arrived on scene and I briefed him of the incident. I advised Sergeant Hodge that we
were waiting for SWAT but if the suspect opens the drivers door I was planing to deploy my K9 after Officers

On 01-14-2016 at approximately 0455 hours, my partner (Officer D. Paul #10137) and I (Officer H. Schneider
#10786) were working uniformed patrol as Unit 2A71 when we responded to a stolen vehicle that was stopped on
11th Street and Bennett Avenue (call #0261).
We assisted Unit 2A12 (Officer P. Thach #6319), Unit 2A15 (Officer D. Keeney #6148), Unit 2A16 (Officer M.
Whybrew), and 2S40 (Sgt D. Scaccia #6048 and Officer I. Hughes #6263) who were already on scene with a male
subject (later identified as Arrested Lee Armijo) in the driver seat of a white Ford Econoline van (CA #8K91040).
Armijo was not listening to officers' commands to get out of the vehicle with his hands up.

Upon arrival, I observed Armijo inside the stolen white van, throwing items out of the vehicle, and not listening to
officers' commands to exit the vehicle. He was moving around in the vehicle and banging around in the van. He
was not exiting the vehicle after multiple commands
My partner and I began to alternate giving Armijo verbal commands on the P.A. to exit the vehicle with his hands
up. We gave him these commands every 45 seconds for approximately an hour. He continued to not listen to
these commands. Armijo started to lean his head out the window talking about how we were going to have to get
him out of the vehicle and he was not going without a fight. He would go back in the van and bang around in the
vehicle. I could not see what he was doing. I could just hear loud banging sounds. This happened multiple times.
Armijo was able to shatter the driver passenger window with an unknown object.
At approximately 0610 hours, Armijo opened the driver's door and sat on the window opening legs on the inside of
the door with the door all the way open. Officer Hughes and Officer Contreras launched three 40mm projectiles at
Armijo. Armijo fell to the ground in front of the van. At this time Unit K3 (Officer V. Ortiz #5983) released his
canine on the suspect. For further, see their supplement reports.
I approached Armijo with other officers after he fell in front of the van. He was attempting to flee by trying to stand
up and he was in a fighting position on his back with his hands in a fist in front of his face. He was not listening to
officers' commands to get on his stomach and place his hands behind his back. Other officers were able to place
him on his stomach. Based on Armijo breaking the window, I did not know if he had any weapons on his person

and he had not been searched. While Armijo was on his stomach, I used bodily force to take hold of both his legs
and push his calves together, because he was actively resisting by kicking, as Officer Contreras began to apply
the hobble restraint. I placed my right knee on top of his left calf and used both hands to hold down the back of his
right leg. Armijo was actively kicking while the hobble was being applied. The hobble was applied to effect the
arrest and stop him from kicking, and seriously injuring myself and other officers.
Officers' placed Armijo in double-locked handcuffs.
After handcuffing and applying the hobble there was no further force was used.
Officer Paul photographed the scene, the suspect, and the officers involved in the use of force.
Unit 1S35 (Sgt. J. Steinhauser #6060) Unit 2S40 (Sgt. D. Scaccia #6048) was on scene and was notified of the

On 1-14-16 at 0514 hours, my partner (Officer J. Wood #10040) and I (Officer K. Contreras #10805) were working
uniformed patrol in a marked and black and white police vehicle as unit 1A68. We assisted unit 2A12 (Officer
Whybrew #6160) at the intersection of 11th Street and Bennett Avenue regarding a stolen vehicle (call#261).
En route, we were notified that the subject was not cooperating. Officers were giving the suspect commands to
exit the vehicle and the suspect would begin to yell at the officers. The suspect made statements that he wanted
to commit suicide.
Upon arrival, I observed a white Ford van stopped at the intersection of 11th street and Bennett Avenue. The van
was facing eastbound on 11th. The driver side window was open half way down. There were two windows at the
rear of the van, but was unable to see through them due to condensation. There were numerous police vehicle to
the rear of the primary unit. A second unit was parked just north of the primary unit providing additional cover for
officers trying to gain a position of advantage.
Inside the white van was a Hispanic male suspect in the driver seat yelling profanities, and questioning commands
given by officers. The suspect began to throw objects (i.e. clothing, hats, plastic objects) from inside the vehicle
out onto the street. The subject would place his upper body out of the driver side window, and would begin to yell
at officers that he would "fuck them up," and "dome them." He would enter back into the vehicle and would begin
to yell. I heard what sounded like a hard object hitting the vehicle upholstery and dashboard in the car. The
suspect did this repeatedly.
While staging with the primary unit, the primary unit was continuously giving the suspect commands to exit the
vehicle. With every command, the suspect began to argue and said he was not going to get out of the car. When
ordered to exit he stated, "I'd rather die, than get out of the car."
The suspect continued to be uncooperative. With the unknown hard object, the suspect shattered the driver side
window. He stuck his upper body out and sat on the driver side window frame with his legs still inside the vehicle.
The suspect had his left hand on the roof of the vehicle and had his right hand inside the vehicle. His right hand
appeared to be placed just to the outside of his right leg. The subject continued to yell profanities at officers. He
then took his right hand out from the vehicle in a quick and sharp manner. I observed his index and middle finger
pointed forward and his thumb was up as if his hand was a gun.
I was placed on the Emergency Action Team (EAT).I was responsible for less lethal (40 mm Soft sponge

projectile) along with Officer Hughes. It was decided that if the suspect exited the vehicle we would launch the
40mm simultaneously if he did not comply, and then the K-9 officer would deploy his K-9.
The suspect was still sitting on the driver side window frame he opened the driver side door. The door swung
open while the suspect was sitting in the window frame. The suspect was facing westbound 11th towards our
EAT. I aligned my 40 mm sights on the suspect. Officer Hughes launched the first 40 mm round striking the
suspect in the abdominal area. I heard the suspect yell "Ow," but the suspect was still sitting in the window frame
and was not complying with orders that were being given. That is when I launched my 40 mm at the suspect, the
suspect had been violently resisting being taken into custody by throwing objects out of the vehicle, and making
threats towards officers that he was going to "Fuck them up," and he wanted to commit suicide. The suspects had
access to weapons inside the vehicle, and based on his actions I believed if he was not apprehended the suspect
could cause injury to himself or another officer. I was approximately 30 feet away from the suspect when I
launched the 40mm. Unfortunately, when I launched the 40 mm, the soft sponge projectile struck the driver side
rearview mirror of a white Ram pick up (#8Z14123) parked on the north curb of 11th street. The projectile
damaged the mirror, breaking off part of the plastic frame around the mirror. That is when Officer Hughes
launched a second 40mm round at the suspect. I did not see where the projectile struck the suspect. The K-9
officer released his K-9, and the K-9 and made contact with the suspect.
The EAT advanced towards the suspect who fell from the driver side window frame and began to run away from
the van. Officers advanced from around the van and I heard the suspect begin to yell. I was unable to understand
what he was saying. When I made it around the vehicle the K-9 made contact with the suspect upper body, which
prevented him from standing up. Officers attempted to gain control of the suspect's hands and legs to get him into
custody. I observed the suspect resisting, kicking and flailing. Four officers were attempting to handcuff the
suspect when the suspect was able to roll away and sit up and continued to kick his feet, and yell, "Get off of me."
Officers gave the suspect commands to cooperate and to stop moving, but he did not comply. Officers were able
to roll the suspect over onto his stomach while he continued to yell, "Get off of me." The suspect was tense and
had his hands under his chest and would not let officers get control of his hands.
I saw the suspect's feet were exposed and were able to kick. To prevent injury to myself or other officers I applied
the hobble restraint to the suspect's feet, and secured it while other officers were placing the suspect into
handcuffs. I maintained control of the suspect's feet until he was placed in handcuffs and no longer resisting. No
Further force was used.
Sergeant Steinhauser#6060 was notified.
The suspect was handcuffed and evaluated by Long Beach Fire Department.
I located the residence of the registered owner for the vehicle that was struck by the 40 mm projectile. I notified
the registered owners ) stephdaughter of the incident. I provided her with a report
receipt.

On 1/14/2016 at 0546 hours, my partner (Officer R. Cruz #10009) and I (Officer M. Calub #10784) assisted
numerous units regarding a stolen vehicle and driver refusing to get out of the vehicle (Call #261).
Upon arrival, I could see a white van (License #8K91040) with a male Hispanic suspect leaning outside the
driver's side door window and numerous officers with their weapons drawn. The van was facing east on E. 11th
Street west of Bennett Avenue. The suspect made numerous statements that he did not want to live anymore. I
took cover behind a patrol car along the north side of E. 11th Street and drew my weapon. I saw the suspect
break the driver side door window with an unknown object. I saw the suspect go in and out of the driver's side
window three to four times. The suspect threw various items out of the window in various directions.
I moved to the center of the street to provide lethal cover for an officer who had deployed the 40MM less than
lethal munitions. The suspect was sitting in the driver's side door window and continued to yell profanities. I saw
the suspect open the driver's side door and the door slowly started to open. The suspect was now facing west
toward the officers. I heard a 40 MM less than lethal munitions launched at the suspect. I heard two more 40 MM
less than lethal munitions launched at the suspect.I saw two rounds hit the suspect in the stomach area.
I then saw the K-9 deployed on the suspect. The K-9 was unsuccessful at contacting the suspect. The suspect fell
out of the driver's side door and out of my view. I moved up toward the van and around the south side of the van.
As the suspect came into view, I saw an officer to my right deploy an Electronic Control Device at the suspect who
was standing. I saw the suspect fall to the ground and unknown officers attempt to handcuff the suspect.
While the officers were attempting to handcuff the suspect, I assisted by attempting to grab the suspect's right

hand to take control. I noticed the K-9 was contacting the suspect's right arm. As soon as the K-9 was removed
several officers and I attempted to handcuff the suspect.The suspect continued to resist handcuffing by tucking in
his arms and clinching his fists on his left side. It took several attempts to get the suspect onto his stomach
because he was continuing to resist by tucking in his arms and clinching his fists.
Once the suspect was on his stomach, I was able to bring his right hand behind his back and I handcuffed his right
wrist. I informed an unknown Officer to my left the suspect's left arm was still underneath his stomach. An
unknown officer pulled his left arm behind his back and I was able to handcuff his left wrist. I checked the
handcuffs for fit and I double locked them.
I was informed the hobble restraint was placed on the suspect's ankles. An unknown officer took control of the
suspect, searched him, and stood him up. I placed gloves on my hands because I could see blood on the suspect.
Two unknown officers, Officer Schneider (#10786), and I carried the suspect to the southeast corner of Roswell
Avenue and E. 11th Street to wait for Long Beach Fire Department treat and evaluate the suspect.
Long Beach Fire Department responded to start treatment and transported the suspect for injuries received during
the use of force. Officer Schneider and I assisted Long Beach Fire Department with placing the suspect on the
gurney.
Officer Cruz (#10009) checked my head and face to see if I had any blood on me. Officer Cruz found blood on the
right side of my forehead.
The van was towed by PD Tow per V.C. 22651 (Recovered Stolen on a public street).

Narrative
locking mechanism was damaged and punched in. On the passenger side, the sliding door was also damaged
with a large dent and visible paint transfer. The sliding door damage was significant enough that it prevented the
sliding door from opening. The rear door locking mechanism was also damaged and punched out. The ignition
was damaged and punched out. I took photographs of the damages I observed.
The cargo section of the van had metal shelves with miscellaneous items scattered on the floor. The items I
observed inside of the van was an empty red color gasoline can, a half filled water bottle, a cowboy hat, and blue
paper towels. The shelves did not have any tools that mentioned to me.
I researched Kelley Blue Book value for a 2008 Ford, E-250 van and the fair price is $10,437.
