SUMMARY
Unit K4 while on patrol observed the suspect assaulting a female numerous times at the location.
Officer Moscoso took the suspect's left hand which was already behind his back, in a rear wrist lock and placed in in a prone position for handcuffing, no other force was
used.
The suspect suffered a chip tooth as a result of being placed in a prone position, no injuries to the officers.
Officer Reyes #10005, photographed the scene, officers and the suspect. I searched the area for video surveillance and none were located.
I interviewed the suspect in booking at 400 W. Broadway. The suspect was advised of his Miranda Rights per PD form 1000.008, by Officer Reyes who also translated
Spanish. The suspect he did not understand everything the officers were saying to him because he does not speak English. The suspect stated he went to his knees on
his own and placed his hands behind his back. The suspect stated he does not know which officer approached him, but he was pushed to the ground and struck his tooth
on the pavement causing a minor chip. The suspect did not require medical attention. The suspect did not make officers aware of his injury until he was in booking. Officer
Reyes was booking the suspect when he began to bargain that he will not complain if he was released. There was a communication issue due to a language barrier. The
interview was recorded and placed on CD and submitted as evidence.
In my opinion, the force used was reasonable, effective, and within policy.
Internal Affairs Det. Mendoza and Watch Commander Lt. Coble was notified.
