Reyna still had a knife in his right hand. Reyna looked directly and said in Spanish, "Voy a regresar y te voy
a matar!". This is translated in English as, I am going to return and kill you.
Reyna fled on his bicycle across the street towards a laundry mat.
believed Reyna's threat to kill him was real, credible, and he believes Reyna has the ability to kill him and his
family members. told me he was afraid for his life, and the lives of his family members who were inside the
business.
described the loss as the following:
1. Nesquick Chocolate milk valued at $2.26
described Reyna as a male Hispanic, 38 years-old, 5'7, with a medium build, and Reyna had facial hair and
long black curly hair. Reyna was wearing a black jacket,black pants, and he was riding a blue bicycle. Reyna had
a knife (unknown color) with a blade approximately 6" in length.
showed me the surveillance video of the incident. I reviewed the video (time stamp of 0908 hours) and I
observed the suspect walk into the business. I also observed the outside camera video (time stamp of 0920
hours) and saw standing outside. was on his phone as he walked back into the business. returned
outside with a stick and was still on the phone. advised me he would call Dispatch when he obtained a copy
of the surveillance video.
The suspect was a male Hispanic, 35-40 years-old, black curly hair, brown eyes, 5'6", and had a medium build.
The suspect was wearing dark colored pants and a black backpack.
Officer Tejeda gave a report receipt and desired prosecution.
After leaving the market, Unit 3B84 located a male subject (later identified Defendant as Jose Luis Samuel Flores
Reyna) who matched the description of the suspect. Officer Perez and Neal observed Reyna in the area of Artesia
Boulevard and Butler Avenue. Officer Perez advised via the police radio the suspect was fleeing from them.
Officer Perez and Officer Neal arrested Reyna on Artesia Boulevard east of Butler Avenue.

Unit K3 (Officer V. Ortiz #5983) responded to assist. Officer Tejeda and I responded to assist Unit 3B84.
Upon arrival at Artesia Boulevard east of Butler Avenue, Reyna was already handcuffed and in custody. Reyna
was in the prone position. Reyna was screaming and moving his entire body. I observed Officer Neal had control
of Reyna's left arm. Officer Tejeda took control of Reyna's right arm. An unknown officer took control of Reyna's
legs to keep him from kicking.
Officer Neal let go of Reyna's left arm and I took control of Reyna's left arm. Reyna was placed under arrest for
148 (a) (1) PC resisting an officer. For further refer to Officer Neal and Officer Perez's reports.
Reyna was wearing a white multi colored backpack. I searched Reyna incident to arrest and I located a clear
glass pipe with a bulb end in his right pant pocket. Although the pipe was not charred, I know from my training and
experience this type of pipe is commonly used to smoke methamphetamine. This led me to believe that Reyna
may be a methamphetamine user. While conducting an inventory search of Reyna's backpack, I located a plaid
(white/blue) shirt inside of his backpack. Reyna was wearing a black jacket. Reyna's jacket was later removed (in
booking). I kept the pipe, Reyna's jacket, and shirt in my possession until I booked them into evidence. For further
refer to the property report. I was unable to locate the loss and the knife used during the crime.
Officer Tejeda readjusted Reyna's handcuffs (checked for fit/double locked). I escorted Reyna to the back seat of
my police vehicle and buckled his seatbelt.
Unit 3B80 responded to Long Beach Boulevard and asked if he would like to consent to a Field Show
Up. Officer Ramirez translated and read (in Spanish) the Long Beach Field Show Up Form to
understood the form, and signed it.

Narrative
Unit 3B80 Transported to Reyna's location (Artesia Boulevard/Butler Avenue) for a field show up. was in
the back seat of Officer Ramirez's police vehicle during the field show up. The area was well illuminated as it was
daytime, and was approximately 25 yards when he viewed Reyna. saw Reyna and said, "Yes that's
him. I know because of the beard and face."
Long Beach Fire BLS 12 transported Reyna to Long Beach Memorial Medical Center (2801 Atlantic Avenue)
where he was treated by the medical staff for his injuries. I rode in the back of BLS 12 with Reyna.
It should be noted, I noticed that Reyna was showing obvious signs and symptoms of somone who was under the
influence of a controlled substance. Reyna was sweating,twitching, moving his eyes rapidly, he had dialated
pupils, and a wide gait when he stood up.
Based on the signs and symptoms that observed, I formed the opinion that Reyna was under the influence of an
unknown controlled substance while in a public place. It should be noted that while Reyna was being treated at
Memorial Hospital, Nurse told me that he had an elevated heart rate .
Officer De La Torre responded to the hospital and took photographs of Reyna. For further refer to the
photographs.
Officer Tejeda read Reyna his Miranda Rights Per PD Form 1000.008 and asked him waiver question #1. Reyna
responded to waiver question #1 by saying, "yes".
Officer Tejeda interviewed Reyna. For further refer to Officer Tejeda's report.
Doctor treated Reyna for his injuries. Dr. advised me that Reyna has a broken ulna (right
forearm) and a laceration to his right inner shin bone (approximatley 2"). Reyna also had welts to his left forearm
area and left lower leg area. For further see the submitted photos.
Officer Tejeda and I transported Reyna to the Long Beach Booking facility (400 W. Broadway) where he was
booked as charged. Unit 3C23 (Officer Esquivel #11274) and Unit 3C22 (Officer J. Raff #10538) responded to
booking and took custody of Reyna.

I reviewed my body worn camera footage prior to writing this report and this is report is a summation of events
based on my recollection of events.
DISPATCH
On 09/28/2019 at 0928 hours, my partner (Officer S. Perez #10129) and I (Officer W. Neal #10128) were working
as Unit 3B84 when we assisted Unit 3B83 (Officer M. Tejeda #11010 and Officer D. Salcedo #11029) at the
located at Long Beach Boulevard regarding an armed robbery that had just
occurred (call #0582).
INITIAL ACTIONS
Officer Perez and I arrived first and Officer Perez remained at the scene to interview the calling party while I
checked the surrounding area for the suspect (later identified as Defendant Jose Reyna). Officer Perez relayed
that the defendant was a male Hispanic, approximately 5'08" tall, with long curly hair, a black jacket, black pants,
and a black and brown backpack. I was unable to locate the defendant at that time and drove back to the
dispatched address to retrieve my partner.
Once there, Officer Perez showed me a picture of defendant via the store's video surveillance footage and added
that the defendant was last seen on a bright blue bicycle. Officer Perez explained that the defendant came into
the store and stole an item before walking out. A store employee walked outside and was confronted by the
defendant, as the defendant remained outside of the store. During the confrontation, the defendant pulled out a
knife and threatened to kill the employee before fleeing the area with the loss before police officers arrived. I took
this information to mean the defendant was wanted for robbery, was armed with a knife, had threatened to
kill/injure with that knife, and had the present means to carry out his threats.
INITIAL OBSERVATIONS OF DEFENDANT JOSE REYNA
It should be noted that when I watched the store's video surveillance footage earlier, I noticed the defendant was
not wearing a shirt. The weather on this day was cloudy and cool, which made the choice of not wearing a shirt

seem odd to me. From experience, I knew people that consumed narcotics would often get hot (even on cold
days/nights) and remove articles of clothing. Further,people who used narcotics could become violent, often had
jerky/over exaggerated bodily movements. The movements of the defendant on video and his actions toward the
victim furthered my suspicions that he could be under the influence of a narcotic.
Officer Perez and I drove from the area and were heading eastbound on Artesia Boulevard approaching Butler
Avenue when I observed a subject who matched the above suspect description (i.e. the defendant) in the parking
lot of Eddie's Jr. Market located E. Artesia Boulevard. The defendant was on a bright blue bicycle and had
his hands/face pressed up against a glass wall of a closed business. I could not see the defendant's face, but
decided to drive into the parking lot in hopes of determining if the defendant was in fact the suspect we were
looking for.
DETENTION AND USE OF FORCE OF DEFENDANT JOSE REYNA
I drove northbound into the parking lot perpendicular to the defendant and his back was still turned to us. I still
could not see his face, but as I started to park, the subject turned his head to the side exposing his face. At this
point I was clearly able to identify him as the subject/defendant I saw on video that had threatened store
employees while stealing items from the dispatched business.
I parked our vehicle and picked up the radio to alert assisting units that we had located the defendant. However,
before I could complete my radio transmission, the defendant looked at us and started to ride his bicycle
southbound away from us. Officer Perez was already out of our vehicle and shouted at the defendant to stop.
The defendant mumbled something in English indicating he was going to ride some place else while pointing
southeast away from us. Since we were wearing police uniforms, driving a marked police vehicle, and Officer
Perez gave him a lawful order, I took the defendant's actions to mean he was fleeing our lawful detention.
Officer Perez was out of the vehicle and I started to make a turn to pursue the fleeing wanted felony suspect. As I
was making my turn, I observed another police vehicle (Officer V. Ortiz #5983; Unit K3) in the parking lot facing
westbound. I finished my turn and pulled up to allow Officer Perez to get into our vehicle. At this point I could see
the defendant fleeing on his bicycle eastbound along the bike lane of westbound Artesia Boulevard east of Butler
Avenue. Officer Ortiz was already driving his police vehicle eastbound to chase after the suspect with his
overhead lights on. This indicated to me that Officer Ortiz had his vehicle's forward facing solid red light on and
the defendant was fleeing to avoid Officer Ortiz's lawful detention.
I knew the defendant had already committed a felony crime while armed with a knife and was concerned with
Officer Ortiz's safety if he were to contact the defendant alone. As a result of the above, I activated our overhead
lights and chirped our siren as I chased after the defendant and Officer Ortiz. I watched as the defendant rode his
bicycle under the 91 Freeway overpass while on Artesia Boulevard. The defendant rode from the north side of
westbound Artesia Boulevard to the south side across both lanes toward the center median. He then rode his
bicycle back northbound into the bike lane area before riding back southbound toward the center median again.
The defendant rode his bicycle across the center median southbound into the eastbound lanes of Artesia
Boulevard. Officer Ortiz's vehicle crossed the center median and I drove our vehicle across the center median to
follow after the defendant.
Once on the eastbound side of Artesia Boulevard, I noticed the defendant ride his bicycle back over the center
median northbound in an effort to elude Officer Ortiz's lawful detention. It should be noted that Officer Ortiz's
vehicle's overhead lights were still activated as he tried to detain the defendant. Our overhead lights were still
activated as I drove back across the center median in pursuit of the defendant. The defendant rode his bicycle
onto the north sidewalk and I lost sight of him momentarily as I was clearing traffic. I noticed Officer Ortiz drove
eastbound of the overpass and I took this to mean that he was preparing to intercept the defendant if the
defendant continued eastbound.
I was driving eastbound when the defendant suddenly cut directly in front of our vehicle southbound. I was forced
to slam on the brakes to avoid striking the defendant with our vehicle and he came within a few feet of the front of
our vehicle. Officer Perez got out of our vehicle to chase after the suspect as the suspect started to ride his
bicycle southwest away from us. I could not see what the defendant was doing, but decided to reverse my path

and drive westbound to Butler Avenue. This would have left the defendant between Officer Ortiz and my position,
with a solid wall to the north and a chain link fence to the south. I hoped this would cause the defendant to realize
he had no place to flee and he would give up, or it would at least afford us time to set up a perimeter to safely
take the defendant into custody.
While reversing our vehicle, I noticed the defendant was no longer on his bicycle, but was running southbound
away from Officer Perez. I could see Officer Perez chasing after the defendant and realized the defendant was
running straight toward the above mentioned chain link fence. My line of sight of Officer Perez was blocked
periodically by large concrete freeway supports and when I saw Officer Perez again, he was now on the south
sidewalk. The defendant was facing him and the defendant had his fists raised up chest height while held out in
front of him. The defendant was clearly not surrendering to Officer Perez and he actually appeared to be readying
to attack Officer Perez. I observed Officer Perez strike one time at the defendant's upper arm with his baton, but I
am not sure if the strike made contact and my line of sight was once again blocked by a concrete freeway
support.
I now believed that the defendant was physically resisting and Officer Perez was involved in a use of force. I
notified the Communication Center of the above and I knew I now had to abandon my plans to take up a perimeter
position in order to come to Officer Perez's immediate aid. I once again drove over the center median with my
vehicle's overhead lights still activated and drove to where I last observed Officer Perez. As I was driving and
clearing traffic, I observed the defendant was now on the ground. The defendant was on his back with his feet
raised off the ground in front of him and his hands were held up in front of him.
From recent training, I knew that a subject in the position could kick upwards and strike an adversary in the face,
jaw, or even the lower legs. This would either serve to injury the adversary or allow the subject on the ground
time to get up. I observed the defendant kick towards Officer Perez with one of his legs and Officer Perez strike at
this leg with his baton one time. I do not know if Officer Perez's baton struck the defendant, but I could see
Officer Perez was saying/yelling something at the defendant. I could not hear what was being said due to the
acoustics of the overpass and traffic conditions (even with my vehicle windows rolled down). Officer Perez
returned his baton to the upper cradle position along his right side and appeared to be assessing the situation
while yelling (I assumed giving commands) at the defendant.
I stopped our vehicle and immediately ran toward Officer Perez to assist him while tapping my body worn camera
twice to activate it (I later discovered that it did not activate, possibly because I missed tapped while trying to
activate it). As I approached, I could hear Officer Perez yelling for the defendant to roll over onto his stomach, but
the defendant was not following Officer Perez's commands. Further, I noticed the defendant was still on his back
with his feet raised and his hands at his chest. I did not want to be kicked, but knew the defendant had a knife
earlier and had threatened to use it. This meant immediate action needed to be taken to secure the defendant's
hands to bar him from getting a weapon. I used both of my hands to grab the defendant's left wrist and forearm. I
tried to roll him onto his stomach and was not originally successful, as the defendant tried to pull his arm toward
the center of his chest. At some point Officer Ortiz must have arrived and I could see he had his K9 at his side
while he was yelling for the defendant to get onto his stomach.
I was then able to pull the defendant onto his stomach via his left wrist and once he was on his stomach I put his
left wrist in a rear wristlock. I kept my right hand along the back of the defendant's left hand/knuckle line and I
placed my left hand against his elbow to maintain a constant pressure to complete a control hold. The defendant
was now lying on his stomach with his right hand placed out in front of him. He was still moving his upper body
around a lot and he was able to bring his right arm under his body. This caused me to be concerned for our safety
and I alerted other officers to the defendant's movements. I was concerned for our safety because I knew the
defendant had not been searched, he at one point was armed with a knife, he had threatened to kill/injure others,
his bulky clothing could have concealed a weapon, he was actively/violently resisting arrest, and he had
purposefully placed his right arm under his body.
The defendant was yelling, but was still not handcuffed. I saw Officer Perez approach the defendant's right side
and he started to try to pull the defendant's right arm out from under the defendant's body with both of his hands.
While Officer Perez was doing this, I heard him tell the defendant to place his hand behind his back. The
defendant did not do as demanded, but a short time later I observed Officer Perez had the defendant's right hand

behind the defendant's back. Officer Perez told me that had the defendant's right arm secured and he told me to
bring the defendant's left arm toward the right hand. I did as he requested and the defendant was handcuffed
(double locked) by Officer Perez.
I maintained control over the defendant's left hand via my above mentioned control hold and waited for assisting
officers to arrive. Shortly thereafter officers arrived and they took control over the defendant. I stood up and
looked at my body worn camera to turn it off and discovered it was not activated. I turned it on at that point in the
hopes it would capture my roll in the detention, but later discovered it only partially captured my actions. I later
alerted Sgt. J. Cole #6169 (Unit 3S28) of the late body worn camera activation. I remained in the immediate area
and noticed the defendant was still wiggling his body while assisting officers tried to search him incident to arrest.
While this was occurring, I heard Officer J. Rodriguez #10153 (Unit 3B54) telling the defendant to calm down and
stop moving.
CONCLUSION
The defendant was eventually completely searched and moved to a nearby police vehicle. While he was being
moved, I heard him complain about ongoing pain to his left arm. I did not know if the pain was from possibly being
struck by Officer Perez's baton or from my control hold. However, since there was an ongoing complaint of pain,
I decided to document my actions as a reportable use of force and alert Sgt. Cole.
Long Beach Fire Department personnel arrived on scene and eventually transported the defendant to the hospital
for further medical assessment. Prior to their departure, a field show up was completed and the defendant was
positively identified by the victim.
Officer Perez and I walked the area where the defendant had fled to look for any evidence (e.g. the knife used in
the robbery). We were unable to locate anything of any significance, but noticed Eddie's Jr. Market had video
surveillance cameras that covered the parking lot. We contacted a store employee and he allowed us to use the
store's video surveillance system to review the incident. We were able to review our original contact with the
defendant and when he fled from our detention. The store employee was unable to make us a copy of the
incident on a DVD, but we left a note for the store's owner detailing the times of the incident (1045 hours on the
store's surveillance system) so that a copy could be made later for placement into evidence. Officer Perez took a
video of the incident and later placed this copy into Mideo. It should be noted that the time stamp on the video
surveillance footage was approximately 17 minutes behind.

USE OF FORCE

On 09/28/19 at 0928 hours, my partner (Officer W. Neal #10128) and I (Officer S. Perez #10129) were working as
unit 3B84 when we assisted units at Long Beach Boulevard () regarding an
attempted armed robbery that just occurred (call #582).
It should be noted that we were driving a marked black and white police vehicle and wearing a standard blue
police uniform with a badge and patches.
While en route, we were advised the suspect was described as a male Hispanic wearing a black jacket, white
shorts and armed with a knife.
Upon arrival, I contacted the victim who stated a male suspect entered his business and stole a carton of milk. He
was notified by an employee of the theft and followed the suspect outside. Shortly after, he observed the suspect
still standing outside the business. As he walked out of the business, the suspect brandished a knife and
threaten to kill him. The victim backed away and called the police.
During our investigation, the victim showed me the video surveillance from the business. I was able to get a clear
look of the suspect and would be able to identify him if later seen. I provided an updated crime broadcast and left
the scene when unit 3B83 (Officer M. Tejeda #11010 and Officer D. Salcedo #11029) arrived and took over the
investigation.
At approximately 1000 hours, we were checking the surrounding area when we observed the suspect standing in
the shopping center of E Artesia Boulevard. I observed the suspect standing near the door to a business with
his face pushed against the glass as if he was looking into the business. I recognized the suspects backpack and
bicycle as the same I observed in the video. We approached the suspect and stopped our vehicle approximately
40 feet from him. He turned around looked at us and I was able to confirm he was in fact the suspect from the
video.
I exited my vehicle and knowing he was an armed felony suspect, I pointed my gun at him and ordered him to get
off his bicycle. He slowly started to ride southeast across the parking lot away from me and he was saying, "I'm
leaving" several times. I told him to stop and again ordered him to get off his bike. He refused to comply and fled
eastbound towards Butler Avenue. I then observed K3 (Officer V. Ortiz #5983) driving southbound through the
parking lot.

Narrative
I observed K3 follow the suspect and activate his emergency lights in an attempt to detain the suspect. He
followed the suspect eastbound in the westbound lanes of traffic on Artesia Boulevard as the suspect continued
eastbound. My partner activated his emergency lights as we entered the intersection of Artesia Boulevard and
Butler Avenue. We followed K3 eastbound as I observed the suspect ride along the north curb. He rode through
both lanes of traffic several times to avoid being detained. He then rode on the raised center median and entered
eastbound lanes of traffic. He rode westbound in the eastbound lanes as we drove over the median to intercept
him. He rode northbound back over the median and again fled eastbound. We followed him over the median and
followed him eastbound. As we approached him, he again attempted to ride over the median southbound and
lost control of his bicycle. He was able to jump off his bike and land on his feet. I exited the vehicle and was now
chasing him on foot as he fled southbound across traffic. It should be noted as I was exiting my vehicle the
seatbelt got caught on my body worn camera (BWC) and fell off of my chest landing on the median.
As I followed the suspect, I yelled for him to stop. I continued to give him orders for him to stop and get on the
ground. I was able to catch up to the suspect on the south curb of Artesia Boulevard east of Butler Avenue under
the 91 freeway. At this point the suspect had numerous opportunities to surrender and comply with officers. The
suspect turned around and faced me. Knowing he was possibly still armed with at least a knife I maintained a
distance of approximately 15 feet. I advised the suspect he was under arrest and told him to get on the ground.
He again refused to comply with my lawful order as he brought his hands up around his midsection and motioned
them up and down as he said, "What what." I could see his hands were empty however, I did not feel comfortable
tackling and wrestling with an armed suspect. I decided my baton was the best option because it will allow me to
maintain a distance from the suspect. I raised my baton and gave him a final opportunity to comply. I told him
that I was going to hit him if he refused to get down on the ground.
The suspect raised his hands around chest high and brought them towards the center of his body. He made a fist
and had his arms out in front of his body bent at the elbows. He had them up as if he was preparing to fight and
physically resist arrest. I approached and struck him one time on his right arm (between the wrist and elbow). I
backed away and again yelled for him to get on the ground. He stayed on his feet and did not comply. I stepped
forward and struck him one time on the left forearm with my baton. He started to back pedal from me and
somehow fell onto his back. I gave him another chance to comply and told him to roll onto his stomach. He
refused and stayed on his back. He raised his legs bringing his knees towards his chest with his feet up towards
me. It appeared he was preparing to kick me. As I walked towards him, he attempted to kick me with his right
foot. I struck him on the right shin as his leg was stretched out. He again kicked at me and I struck him with my
baton on the bottom of his right foot. I yelled for him to roll onto his stomach as I circled around him to move away
from his legs. He kicked at me again and I struck him with my baton across his left shin. He finally stated, "Okay
okay" as he was still on his back. I gave him the opportunity to comply and reassessed the situation.
At this time, my partner and Officer Ortiz arrived at my location. The suspect was no longer kicking at me and I
instructed him to roll over onto his stomach. My partner was able to gain control of his left arm and helped roll him
over onto his stomach. The suspect refused to bring his right arm behind his back and moved it towards his right
pant pocket. I took control of his right hand and told him to place it behind his back. I placed his arm behind his
back and handcuffed the suspect. Additional officers arrived on scene and help take control and search the
suspect. I released my hold and moved away from the suspect in order to recover my lost BWC.
Sergeant J. Cole #6169 (unit 3S28) arrived on scene and was notified of the use of force. He was also notified
that my BWC fell off and did not record the use of force.
The suspect complained of pain and Long Beach Fire Engine 12 arrived to treat the suspect. Long Beach BLS12
arrived and transported the suspect to Long Beach Memorial Hospital for further treatment.

On 09-28-19 at approximately 0923 hours, I (Officer V. Ortiz #5983) was working uniform patrol in a marked black
and white Police K9 vehicle as unit K3. I heard over the Police radio that units were dispatched to Long
Beach Blvd regarding an attempted armed robbery. For further refer to call #0582.
Prior to arrival unit 3B84 Officers, Neal #10128 and Perez #10129 aired over the radio that the suspect was
possibly last seen traveling south bound Long Beach Blvd towards Artesia Blvd on a bicycle. 3B84 described the
suspect as a Male Hispanic with long curly hair with a black jacket with a red logo on the front of it wearing a black
backpack with some brown on it. He was also wearing black pants with white high tops.
I arrived in the area and began to search for the suspect in the area of Butler Ave and Artesia Blvd. I drove into
the parking lot of Artesia Blvd (Eddies Liquor) when I saw unit 3B84 in the parking lot. Officer Perez had his
gun out pointing it at a subject that met the description of the robbery suspect. Officer Perez was attempting to
detain the suspect when he fled from Officer Perez. My vehicle was facing west bound as the suspect fled pass
me east bound the parking lot into the west bound Artesia Blvd traffic lanes riding against traffic. I activated my
vehicle's forward facing red lights and chased the suspect attempting to detain him. As we passed east of Butler
Ave the suspect looked back at me and saw that I was chasing him. The suspect almost crashed into a green
bicycle lane divider and slowed down almost to a stop. I stopped my vehicle and was going to exit my vehicle as
he continued to flee east bound in the number two lane against traffic. The suspect was zigzagging from the
number two and number one lanes going east bound. The suspect turned back again seeing where I was when
he jumped on his bicycle south onto the Island and into the number one east bound lane. I drove over the island
and onto the east bound number one lane. The suspect looked back at me again then jumped north bound onto
the Island. I accelerated and drove towards the entrance to the 710 Free Way in an attempt to prevent the
suspect from entering the Free Way.
As I got to the entrance to the 710 Free Way I noticed the suspect turned back and was travailing back towards
Butler. I drove west bound against traffic in the number two lane when I saw the suspect on the south side walk of
Artesia Blvd. As I exited my vehicle I noticed Officer Perez holding his baton in a upper cradle position looking
down at the suspect. The suspect was on his back with both his legs up pointing towards Officer Perez and
moving them up and down as if he was going to kick the Officer. Fearing the suspect was going to kick Officer
Perez in the face I exited my vehicle and yelled out for Officer Perez to back away. I was going to deploy my
partner K9 Rocky to bite and detain the suspect to prevent Officer Perez from getting hurt. As I took out Rocky I
yelled out to the suspect to get onto his stomach. I heard Officer Perez tell the suspect to rollover. Officer Neal
arrived and assisted Perez in gaining control of the suspects hands as Perez handcuffed the suspect and took

Narrative
The incident was captured on Body Worn Camera (BWC). I attempted to review the footage but was unable to
with my camera. I reviewed Officer Neal's footage, and the following is a sumary of the incident.
On 09/28/2019 at approximately 1002 hours, I (Officer J. Rodriguez #10153) assisted Unit 3B84, Officer W. Neal
#10128 and Officer S. Perez #10129, in the area of Artesia Blvd and Butler Ave regarding a robbery suspect
fleeing from them, call #0582.
While en-route, unit 3B84 aired the suspect was fleeing from them eastbound Artesia Blvd from Butler Ave.
Upon arrival, I observed the suspect, Officer Neal and Officer Perez all on the ground facing northbound, on the
south curb of Artesia Blvd. Officer Neal was holding the suspect's left arm, as the suspect was on his stomach.
Simultaneously, Officer Santos was holding the suspect's right arm. I ran up to assist and Officer Perez released
the suspect's right arm after it had already been handcuffed.I took control of the suspect's legs using my baton to
apply pressure. The suspect kept moving his feet around and screaming it was too much pressure, so I released
some of the pressure and his left leg came loose and he started using his left leg to try to and role himself to his
side.
Unit 3B79, Officer S. Diarte #11415 and Officer J. Foerster #6088 assisted on scene. Officer Diarte took control
of the suspect's left leg and assisted with controlling the legs. Officer Diarte was able to control both legs with her
hands, at which point I moved away from the suspect.
Unit 3B83, Officer M. Tejeda #11010 and Officer D. Salcedo #11029 assisted on scene and took over for Officer
Neal and conducted a search of the suspect.

Narrative
While working as unit 3S28, I (Sgt. J. Cole 6169) responded to the area of Artesia and Butler regarding the
apprehension and arrest of a 422/211 Estes suspect that resulted in a use of force. The crime occurred at
Long Beach Blvd. Officers located the suspect at Artesia/Butler in the parking lot of the Eddie's Liquor Store. The
suspect fled from them on his bicycle. The arrest and use of force occurred on the south sidewalk of Artesia east
of Butler and just west of the southbound 710 FWY on-ramp.
Upon my arrival, officers had the suspect in custody and were searching him incident to arrest. I spoke with
Officer Perez #10129, who told me he had utilized his baton during the arrest. I spoke with Officer Neal #10128,
who told me he had utilized a control hold during the arrest. For further on their use of force, see their respective
reports under the same DR number.
LBFD responded to the location and the suspect was transported to LB Memorial for treatment/clearance to book,
accompanied by unit 3B83 (Officer Tejeda #11010 and Officer Salcedo #11029).
Officer A. De La Torre #10947 took photographs of the scene,suspect, and involved officers. The photos were
placed into Mideo.
Officer Diarte #11415 contacted a witness who was at the bus stop, approximately 100 yards west from where the
incident occurred. For further, see Officer Diarte's report.
No cameras were located at the scene of the UOF. Video from the liquor store at Artesia and Butler was found
and showed Officer Perez and Officer Neal's initial contact with the suspect and the suspect fleeing from them.
The video was unable to be downloaded at the time. Officer Perez used his phone to record the video and
uploaded it into Mideo. For further, see his report.
K9 Officer V. Ortiz #5983 located footage from the backyard of a residence along the route of the short chase,
which showed the top of the suspect's head go by over the backyard fence, followed shortly by the top of Officer
Ortiz's marked black and white police car with lights activated. The resident was unable to download the video.
Officer Ortiz used his phone to record the video and uploaded it into Mideo. For further, see his report.
I went to LB Memorial and contacted the suspect. I read him his Miranda Advisement per form PD1000.008,
which he stated he understood. I asked him several questions, which he refused to answer and remained silent.
He appeared to be falling asleep. I recorded my interview with my BWC and uploaded it into Evidence.com.
While at the hospital, I was informed that the suspect had suffered a fractured ulna in his left forearm as a result of
the UOF. I notified on call IA Sgt. J. Flores, who responded to the hospital.

On 9/28/19 at approximately 1002 hours, my partner (Officer D. Salcedo # 11029) and I (Officer M. Tejeda #
11010) were working uniformed patrol in a marked black and white patrol vehicle as Unit 3B83. We assisted Unit
3B84 (Officer N. William # 10128 and Officer S. Perez # 10129) who was in foot pursuit of an armed felony
suspect in the area of Artesia Boulevard and Butler Avenue (CALL # 0582).

While en route, Unit 3B84 aired they were code four and had one in custody.
Upon arrival, we located Unit 3B83 on the south sidewalk of Artesia Boulevard, east of Butler. Officer Neal had
arrested the suspect (Arrestee, later determined to be Jose Luis Samuel Flores Renya) who was lying face down
on the side walk with his handcuff behind his back. Officer Perez had control of the arrestee's legs. Officer Neal
had the arrestee's handcuffed behind his back in a control hold. Officer Salcedo and I took control of the arrestee
and searched him incident to arrest. We assisted the arrestee off the ground.
Once he was stood up I adjusted his handcuffs. He proceeded to bang his head multiple time on our patrol
vehicle. The arrestee had a back pack that was still on him. I asked the arrestee if I could cut the backpack off of
him and he said, "Yes." The arrestee was placed into the back seat of our patrol vehicle. Long Beach Fire
Department (LBFD) arrived on scene, because there was a Use of Force when taking the arrestee into custody.
For Further, see Unit 3B84's report. BLS12 arrived on scene and transported him to Long Beach Memorial
Medical Center (LBMMC) located at 2801 Atlantic Avenue. My partner rode with BLS 12 to LBMMC. It should be
noted that LBFD cut the arrestee's pants to evaluate him at the scene.
While the arrestee was being medically cleared for booking, I read the arrestee his Miranda Advisal per P.D.
1000.008. He responded, "Yes," to question one. I told him he was being arrested for robbery and threatening to
kill the store employee. The arrestee said he did not threaten anyone or that he had a knife. He never robbed
anyone either. The arrestee kept falling a sleep and waking up while I was interviewing him.
I asked the arrestee if he had taken any drugs and he said he smoked, "Crystal," in the morning. Due to my
training and experience I now, "Crystal," is street slang for crystal Methamphetamine. I asked the arrestee if he
would consent to a blood draw and he said, "Yes."
LBMMC nurse extracted blood from the arrestee's right arm at approximately 1445 hours. She used

Narrative
On 9/28/2019 at approximately 0927 hours, my partner (Officer M. Tejeda #11010) and I (Officer D. Salcedo
#11029) were working uniformed patrol as Unit 3B83. Officer Tejeda and I were dispatched to Long Beach
Boulevard regarding an attempted armed robbery to the business (Call #582).
Prior to starting my shift, I accidentally grabbed Officer L. Valdez's #10142 body worn camera. After the incident, I
discovered I was wearing Officer Valdez's body worn camera during the incident. I activated Officer Valdez's body
worn camera during the incident. I notified Sergeant Cole I was wearing Officer Valdez's body worn camera and I
captured the incident on the wrong body worn camera.
The body worn video I captured while wearing Officer Valdez's body worn camera was uploaded into
evidence.com under Officer Valdez's (evidence.com) profile.
