insignia, and an overhead ligthbar. Despite these signs of police presence, the suspect did not comply with their
demands.
They were assisted by Officer D. Evans #5569 who had just arrived on scene.
Officer Garcia tried going hands on with the suspect but the suspect spun away from him causing both of them to
go to the ground. Both Officer Garcia and the suspect were in the number two lane of southbound Atlantic
Avenue.
The suspect spun away once more from Officer Garcia while on the floor. The suspect was now on his back, and
began to kick his legs towards both Officer Garcia and Officer Dillon. Officer Garcia stood up and removed his
baton from his duty belt. The suspect continued to kick in their direction, and Officer Dillon and Officer Garcia had
to apply baton strikes to prevent the suspect from landing those kicks. The baton strikes were ineffective and the
suspect stood up from the ground.
The suspect clenched his fists, and faced Officer Garcia. The suspect then reached back and swung his right leg
at Officer Garcia (similar to a roundhouse kick). The suspect was wearing tennis shoes. The kick struck Officer
Garcia on his left arm.
Officer Garcia paced backward, and struck the suspect with his baton in the leg area. Officer Garcia believed the
suspect was attempting to advance towards him and possibly kick him once more. Officer Dillon struck the
suspect's legs with his baton to prevent injury to his partner and subdue the aggressive suspect. The suspect then
turned towards Officer Evans and Officer Garcia. The suspect began to swing both fists in their direction but did
not land the strikes. Officer Dillon once again struck the suspect with his baton to protect Officer Garcia and
Officer Evans. The suspect advanced towards them and Officer Garcia and Evans applied baton strikes to the
suspect to prevent him from punching them.
The suspect began to walk away from the officers and the officers followed him from a distance. Due to his violent
behavior, they remained at a distance giving him orders to stop. The suspect looked in their direction and
appeared to be taking an aggressive stance towards them, with both arms extended and his hands in a fist.
Officer Garcia used his ECD to subdue the suspect but was ineffective. Officer Dillon then used his ECD and was
successful having a positive effect. The suspect's body tensed up and fell head first, striking the pavement. Once
the suspect was on the ground, Officer Garcia placed handcuffs on the suspect with some difficulty. For further
see use of force reports prepared by Officers Garcia, Dillon, and Evans.
Unit 3S24 (Sgt. T. Olson #5711) was advised of the incident and responded to the scene.
Officer Garcia complained of pain to his left bicep but did not require medical attention.

away from our car, south on Atlantic Avenue on the west side of the street. I yelled for the subject to come back.
The subject turned and faced me and raised both middle fingers on his hands. The subject continued to walk and
placed his hands in his jackets front pockets.
We drove up behind the subject. Officer Garcia used the car's PA system and told the subject to stop and come to
the car. The subject again turned and showed both of his middle fingers and continued to walk away. The subject
put his hands in the front pockets of his jacket again as he walked away. The subject walked in and out of the
street as he walked away from us. The subject was a danger to himself and others by carelessly walking in and
out of the street.
We again drove up behind the subject. Officer D. Evans (5569) assisted us. I told Officer Evans we were going to
try and detain the subject. Officer Garcia and I got out of our vehicle and walked up behind the subject. I told the
subject again to stop and come back. The subject ignored me and continued to walk. He still had his hands in his
jacket pockets.
It was obvious that the subject would not stop without physically detaining him. Officer Garcia grabbed the
subject's left arm from behind and attempted a control hold. The subject then spun towards Officer Garcia as he
grabbed his arm. Officer Garcia then went to the ground with the subject. Both went to their knees, then to the
ground. Officer Garcia and the subject were in the middle of the number two lane of southbound Atlantic Avenue.
As Officer Garcia and the subject went to the ground I reached down in order to grab the subject's right arm.
Before I could grab his arm the subject spun onto his back and kicked at me and Officer Garcia. I drew my baton
and backed away from the subject. I approached the subject again and he kicked at me once more. He kicked
with his right leg. I swung my baton and struck the subject on his right leg. I told the subject to stop kicking. He
kicked again and I struck the subject again in the leg with a baton. The subject was kicking at both me and Officer
Garcia.
The baton strikes were ineffective, the subject got off of the ground and clenched his fists. At that point, it was
obvious that the subject wanted to fight and was attempting to hurt me and fellow Officers. He stood and faced
Officer Garcia and kicked his right leg at him. The kick hit Officer Garcia in the stomach area. I struck the subject
with my baton three more times on both of his legs. The subject turned towards Officer Evans and Officer Garcia
and threw punches with both of his fists. Officer Garcia and Officer Evans struck the subject with batons but the
strikes were again, ineffective.
The subject then backed up the street. He walked away from Officer Evans, Officer Garcia, and I southbound
Atlantic Avenue in the number two lane. I believed the subject was going to now try and flee.
Officer Garcia and I followed the subject. Officer Garcia deployed his electronic control device but it was
ineffective. The subject continued to walk south. I deployed my electronic control device as he was walking away
from me. I believe the darts of the electronic control device struck the subject in the middle of his back and the
right side of his chin. The subject tensed and fell to the ground. The subject fell head first towards the ground.
Officer Garcia grabbed the subject's left arm once he was on the ground. The subject's right arm was still tucked
underneath his body. Officer Garcia placed a handcuff on the subject's right arm and was trying to pull the
subject's left arm out from under his body. The subject was not allowing Officer Garcia to handcuff him. Officer
Garcia told the subject to bring his arm behind his back. The subject would not.
I told the subject I would "Taze" him again if he did not bring his arm behind his back. The subject did not bring his
arm back. I told Officer Garcia I was going to deploy the electronic control device once again and warned him to
back up from the subject. Officer Garcia stood back from the subject and I pulled the trigger of the electronic
control device. I did not run the device's cycle for a full five seconds. Once I turned the device off, the subject
immediately brought his left arm out from underneath his body and placed it behind his back.
Officer Garcia handcuffed the subject and searched him. Officer Garcia and I assisted the subject to a seated
position. I observed blood coming from the subject's right eyebrow as we sat him up. I also observed a electronic
control device dart on the front of the subject's jacket and on the back of his jacket. The dart that I believed struck
the subject's chin, was not in his chin.

Narrative
We immediately moved the subject out of the roadway and sat him on the west curb of Atlantic. We also ordered
Long Beach Fire for the subject's injuries and the deployment of the electronic control device.
While waiting for Fire, I asked the subject his name and birthdate. The subject stated his name is
with the birthdate of . I sated, "I don't think your birthday is right." He stated, "I'm five years old." I asked the
subject where he lives and he stated he was a "Navy Seal, with Seal Team 6". He stated he was in the 50th
Division and that he was "5150". He then stated he lived at . The subject also asked if he was in
Afghanistan. By the way that the subject was acting, I believed that the subject was possibly under the influence
of a controlled substance.
Sgt. Olson was notified of the use of force and he responded to the scene. The subject was transported to
Memorial Hospital by Long Beach Fire Rescue 9. Officer Okerman rode in the ambulance with the subject and
then photographed the subject's injuries. The subject received three stitches to his left brow and three stitches on
the left side of his chin. There were multiple bruises on the subject's right thigh and the subject received a staple
stitch to his right shin (for further see photos). The subject was also found to have a small brain bleed and was
being admitted for treatment. Dr was the Doctor treating the subject in the ER Room.
The subject was identified as (DOB ) while at the Hospital. was released and
not booked.
I retrieved the expended cartridges and wires from both of Officer Garcia's and My electronic control devices. I
retained and then placed them into evidence (for further see property report). Officer Reyes photographed Officer
Garcia, Officer Evans and myself.
Watch Commander Kanaley was notified of the incident as well as Internal Affairs, Sgt. Marchesee and Sgt.
Johnson.

Narrative
I was in the area of Del Amo and Atlantic when I heard Unit 3B79 (Dillon #5998 and I Garcia #10792) go out for
investigation on a subject in the area of 46th and Atlantic Ave. (Call 608)
I went to assist Unit 3B79, when I arrived on scene, I saw Unit 3B79 stopped facing southbound on Atlantic just
south of 46th St. I saw a subject wearing a green hooded jacket, tan pants and black shoes walked away from
them on the service island.
I was advised by Unit 3B79 they were going to contact the subject for a couple of traffic violations. I drove ahead
of the subject, and as I passed him he was holding up both hands extending his middle fingers. The subject then
placed both hands back into his jacket pockets.
The subject had not been searched and we did not know if he had any weapons on him.
I pulled ahead of the subject and when I got out of the vehicle, Officer Garcia, was walking up behind him and
then grabbed his left arm. Officer Garcia then pulled on the subject and the subject and Officer Garcia went into
the street. The subject went to the ground and rolled onto his back and immediately started kicking at Officers.
I saw Officer Garcia let go of the subject and took a step back and pulled out his baton. Officer Dillon and Garcia
apply several baton strikes, however, I dont remember where on the subject. The subject jumped up and then
started to swing with closed fist and then also started kicking at Officer Dillion and Garcia.
The subject turned and advanced towards me while throwing punches at me and then tried to kick me, but did not
make any contact. I took my baton and jabbed it into the subjects stomach 1 time. The subject then turned
around and advanced towards Officer Garcia and Dillion. Our baton strikes at this time seemed to be ineffective.
The subject started to walk southbound in the number 2 lane of Atlantic when I heard a ECD deployed. I saw it
strike the subject, but it was ineffective and the subject continued walking. I saw Officer Dillon deploy his ECD and
strike the subject in the back, and this time, the subject tensed up and then fell on to the street.
Officer Garcia went over to the subject and then handcuffed him. I could see blood coming from the subjects eye
brow. The subject lifted out of the street and seated in a safe location. We requested LBFD to respond to treat him
for his injuries.

Narrative
On 12/1/2015 I, Officer D. Reyes #6268 assisted unit 3B79 (Officers I. Garcia #10792 and J. Dillon #5998) who
were on a pedestrian stop at 46th Street and Atlantic Avenue. The pedestrian stop resulted in a use of force with
officers after the suspect failed to comply with orders, and he was actively resisting their detention. Call #0608.
I assisted with photos of the scene, as well as photos of the officers involved.
I also observed the use of force occurred in the southbound lanes of traffic of Atlantic Avenue. There were a group
of businesses on the east side of the street,and I responded there for potential video evidence.
I observed there are exterior cameras at the KFC restaurant ( Atlantic Avenue) and the Wells Fargo Bank
( Atlantic Avenue). The camera at the KFC restaurant however points downward towards the drive thru. The
camera does not appear to have a view of the street where the use of force occurred. The cameras at the bank
also point downward towards the parking lot area.Wells Fargo manager provided me with a phone number for
their security company that runs the video cameras if needed. WF SRC . The cameras do not
appear to have a view of the street where the use of force occurred and are approximately two hundred feet east
of the use of force location.
The following group of business are also located on Atlantic Avenue and do not have exterior cameras. Citibank
( ), UPS ( ), See's Candies ( ), Western Dental ( ), H & R Block ), Sprint ( ), and Chase
Bank ( ). I was unable to locate any witnesses of the incident.

Narrative
On 12/01/2015 at approximatley 1005 hours I, Sergeant Stough #5527, was driving in an dual purpose Ford
Crown Victoria vehicle #17631. I was stopped in the left turn bay facing s/b Atlantic Avenue in order to turn w/b on
46th Street.
At this time I observed a subject walking against the red don't walk signal for e/b and w/b foot traffic across
Atlantic Avenue in violation of 21453(d) CVC. The suubject was wearing a green hooded long jacket with multiple
pockets and tan pants. By the time I realized he was walking against the don't walk sign I observed a blue mini
van brake hard and stop just before hitting the subject as he walked across the s/b lanes of Atlantic Avenue. The
subject continued walking across Atlantic and then s/b on the west sidewalk of Atlantic Avenue.
I observed unit 3B79 Officers Dillon #5998 and Garcia #10792 in their B/W patrol vehicle facing e/b on 46th Street
at Atlantic Avenue. I observed them begin to follow the subject as he continued walking s/b on the west sidewalk
of Atlantic Avenue. When it was safe I made a u-turn with my vehicle and started to pull up behind them. At this
point the subject was approximatley 50 to 75 feet away still walking s/b. The subject then pulled his hands out of
his jacket and extended his arms upwards and extend his two middle fingers as he turned to look n/b in the
direction of unit 3B79. I observed Officer Dillon extend his hand out the passenger side window and show me four
fingers, which I believed meant they were going to continue to follow the subject and just make sure he would stay
on the sidewalk and not walk into traffic and/or wait for a MET unit to respond before attempting to stop him as
the subject appeared to possibly be 5150 WIC. As I pulled along side of them they rolled down there window and
advised me they were not going to stop the suspect.
At this time I continued s/b on Atlantic Avenue to e/b 45th St. I observed a second unit (later identified as unit
3B52 Officer D. Evans #5569) pulling up to unit 3B79's location. As I turned to drive n/b on Linden Avenue I heard
Unit 3B79 go out for investigation on Atlantic Avenue between 45th and 46th St.
As I turned to drive e/b on 45th Street I heard unit 3B79 ask for a Sergeant for a use of force. I immediately drove
to their location. As I pulled up to the scene two additional units had arrived to assist. I exited my vehicle at which
point I observed the subject laying on his right side handcuffed in lane #2 of s/b Atlantic Avenue with a head
wound and two expended ecd cartridges lying on the ground.I had the officers help the subject up off the ground
out of the middle of Atlantic Avenue to a seated position on the west curb to wait for LB Fire/Paramedics.
I contained the scene until unit 3S24 Sergeant T. Olson #5711 arrived to handle the use of force.

Narrative
As he walked to the southwest corner, Officer Dillon told the subject to stop. The subject stared at Officer Dillon
and stuck his middle finger at us and immediately put his hands inside of his sweater pocket. The subject had a
serious stare on his face and was not obeying Officer Dillon's orders (a violation of 148 PC). He began walking
southbound on the sidewalk. We attempted to contact the subject again but he did not stop. I grabbed the police
vehicle microphone and told the subject to stop and walk to the front of the police vehicle but he refused and
continued to put his middle fingers up. As he proceeded to walk southbound we stopped the police vehicle and
parked.
Officer D. Evans (5569) arrived on scene to assist.
As we observed the subject from a distance, he reentered the roadway, turned around, and stuck both of his
middle fingers out at us. He then walked back onto the sidewalk and proceeded southbound. Considering the fact
that the subject continued to enter the roadway and was a danger to drivers on the roadway, we approached him
in an attempt to detain him.
As I walked behind the subject, I told him to stop but he refused to obey my command. Believing that the only way
to detain him would be to physically stop him from walking away, I decided to put him in a control hold. I grabbed
his left arm in an attempt to pull it out of his pocket and place him in a wrist-lock. I drove my right shoulder into the
center of his back as I tried to take his balance. The subject immediately tried to pull his arm away and turned
towards me. I slid my left hand down to his left wrist and I did wrist-lock takedown and took him down to his knees
and then to the ground. I went down with the subject and fell on my right knee. The subject and I were now on the
roadway.
The subject immediately rolled onto his back and began kicking at Officer Dillon and Officer Evans. I released the
subject's arm and took a step back so I could pull out my baton. As I saw the subject violently kicking at the
officers, I struck the subject approximately 2 times on his right arm and ribcage. The subject turned towards me
and began to kick towards me. I hit the subject an additional time on the lower left leg and he immediately stood
up. I realized that our baton strikes were having no affect on the subject.
The subject stared at me, clenched his fist, put his weight forward, and began to walk towards me with his fists up
by his chest. The subject immediately kicked me on my left side, around my shoulder and rib cage area, as struck
his left arm with my baton. The subject began to throw punches at me as I struck him approximately twice on his
arms and left side. The subject turned around and began approaching Officer Dillon and Officer Evans.
Considering how violent the subject was acting, I immediately struck him on his right lower leg. The subject did not
bend his knee or move his leg; he stood in a fighting stance facing the officers. Our strikes continued to have no
effect.
I pulled out my Electronic Control Device (ECD) and yelled at the subject, "Stop fighting or I'm gonna tase you."
He then turned around and began to walk away in an attempt to flee the scene. He walked approximately 10 feet
before turning back towards me and taking a fighting stance as. I warned him again but he kept his fists clenched
as chest level. I deployed my ECD and I saw the prongs enter the sweater at chest level, but it was ineffective.
The subject turned away from me and placed his hands back into his sweater pocket and began walking
southbound on the number two lane of southbound traffic. Officer Dillon deployed his ECD and the subject's body
tensed up as he fell to the ground headfirst.
After the ECD effects, I grabbed the subject's right hand and placed it behind his back. At this point, the subject
began to tense up and would not take his left hand out of his pocket. I told the subject several times to put his
hands behind his back but he was not complying. I stood up and Officer Dillon applied his ECD again. I grabbed
the subject hands and placed him in handcuffs.
Officer Dillon and I moved the subject on to the curb and began requesting paramedics to treat his injuries.
Long Beach Fire Department Engine 11 and Rescue 9 arrived on scene to treat the subject. Rescue 9 was
transported to Memorial Hospital for further evaluation.
Officer D. Reyes (6268) arrived on scene and took pictures of the scene and the subject's injuries. He then took
pictures of my partner and I in our uniform.
