On 1/11/14, I (Officer S. Alatorre #10119 and Officer S. Perez #10129) were working at Unit 1A67. We responded
to a burglary in progress at East 5th Street, call #1845. The dispatcher stated and the call's text read the
following. There was a burglary in progress. For further see DR#14-2411.
Upon arrival to the burglary location my partner (Officer Perez) placed himself on the north/east side of the home.
I took a security/perimeter position on the south/west corner. My partner and I held our security/perimeter
positions until assisting units arrived. After a few more units arrived to the scene, we began to make a bigger
perimeter which surrounded East 5th Street and ran from 4th Street/Cerritos Avenue, 5th Street/Cerritos
Avenue, 4th Street/Bonito Avenue, and 5th Street/Bonito Avenue.
Assisting units began to interview the victim of the burglary and a few possible witnesses. We were advised that
the victim had high power rifles in the residence, which were not secured in a safe and would be easily accessible
to the burglary suspects. A witness also stated that he witnessed a suspect jump a fence to his property, which
was just west of E. 5th Street, then jump back to the original location, possibly re-entering the home.
My partner, who was still holding his perimeter position on the north/east corner of the home, noticed an open
window. Based on the victim's statements we believed that window was the entry/exit location. We were then
advised that the window my partner was looking at is where the victim had his high power rifles.
Based on the above statements, my partner decided to deploy his patrol rifle and donned his ballistic helmet. I
also donned my ballistic helmet and became his cover officer.
My partner's duty was to keep a clear view with his patrol rifle of the above window, which we believed to be the
entry/exit of the suspect(s). My duty at this point was to make sure my partner had a clear view and to make sure
no suspect(s) walked behind him while he kept a clear view.
We both held our position and view to the above window. An air ship unit was assigned to the incident and was
flying above the location, also searching for any possible suspects.
While my partner and I were holding our position, we heard and saw two subjects riding their bicycles northbound
on Cerritos Avenue from 4th Street, which should have been cleared of any vehicle and pedestrian traffic.
I used my flashlight to direct them back south on Cerritos Avenue toward 4th Street, but they continued to ride
toward my partner and me.
They (Michael Guy and Jamiel Nowparvar) continued to ride until they got approximately two arm lengths away
from me and my partner. Not only had they entered the police outer perimeter, but they had now entered an
immediate danger area, which was approximately 50 feet away from the window where the possible armed
suspect was.
I advised both Guy and Nowparvar to turn around and ride away from our location because of the danger they
were in. Nowparvar began to argue stating he lived across the street from E. 5th Street. He further stated he

could see his home and wanted to ride toward it. I again advised both Guy and Nowparvar that they were in a
police perimeter and were now in a danger area where we had a suspect with high power rifle hiding in a home.
I then heard Guy tell Nowparvar to turn around and go back. Guy seemed to understand the danger they were in
and asked if there was another way to their home. As I was trying to speak to Guy, Nowparvar began to inch his
bicycle closer and closer to me and my partner.
I placed myself in front of Nowparvar's bicycle and held him from inching closer toward the danger area any
further. Nowparvar then began to yell that he needed to work tomorrow morning and that he was going to ride his
bicycle further deeper into our police perimeter and to his home.
I then heard my partner also ordering Nowparvar and Guy to turn around the ride away and out of our perimeter.
At this point, I knew that my partner was being distracted from his duties of keeping a clear view of the suspect(s)
entry/exit window.
I aired over my police radio that I had two uncooperative subjects attempting to cross our perimeter and refusing
to leave my location.
I then noticed Nowparvar reached into his pocket and began to record our conversation with his cell phone.
Nowparvar stated he had the right to record the incident. I advised him that he needed to exit our perimeter.
Nowparvar refused and stated, "Fuck this," he continued to record and refused to leave the perimeter.
I ordered Nowparvar to leave our perimeter or he would be arrested. Nowparvar again refused and began to inch
his bicycle closer to my partner and into the danger area.
While Nowparvar was still straddling his bicycle, I reached for his left hand and advised him he was going to jail for
obstructing our investigation. I took control of his left hand and began to assist him off his bicycle. Nowparvar's
then began to pull away from my grasp and I felt I was losing control of his left hand.
I then took a step closer to Nowparvar and took control of his left hand with both of my hands. He continued to pull
away, so I conducted an arm bar takedown using his left arm.
As I took Nowparvar to the ground, he pulled his left arm away from me and I lost total control of Nowparvar's left
hand. At this point he was now lying on his stomach with both of his hands underneath him by his chest. I ordered
Nowparvar to place his hands on his back. He refused to place his hands on his back then I heard him yell to Guy,
"Here, here get this." I did not know what Nowparvar was now holding in his hands or what he was attempting to
give to Guy.
At this point Guy was approximately 5 feet away from us. I ordered Guy to stay away. Guy refused and reached
toward Nowparvar's torso area. I again ordered Guy to stay away. He refused again and reached even closer to
Nowparvar and was now approximately 2 to 3 feet away from us.
I ordered Nowparvar to place his hands on his back, but he refused and kept his hands underneath his torso. At
this point, I took a position of advantage on top of Nowparvar's back. I placed my weight on his body in an attempt
to hold him until assisting units arrived to help. I felt Nowparvar begin to lift himself off the ground. I ordered
Nowparvar to stay on the ground, but I felt as if he was attempting to push himself off the ground even with my
weight on him.
I reached for my impact weapon (Flashlight) and realized I lost it during the initial struggle with Nowparvar. I
feared my impact weapon, if found by Guy or Nowparvar would be used against me. I was already in a position of
advantage on his back and I decided the carotid control hold would gain immediate compliance from him. I then
noticed Nowparvar gave an item to Guy then Guy stepped away from us.
While looking at Guy, I continued to apply the hold on Nowparvar until he stopped attempting to push himself off
the ground. I then felt his body go limp. I this point I did not feel him resisting any further and I believed he was
rendered unconscious. I released the hold and began to place his hands on his back. Assisting Officer Cazares
arrived and took control of his left hand and I took control of his right hand. Nowparvar was then handcuffed
without further incident. No further force was used.

I then placed Nowparvar in the recovery position and adjusted his handcuffs (Double Locked). Nowparvar woke
up and I asked him if he could stand on his feet, he nodded his head up and down and stood up. I then walked
Nowparvar to the back seat of a patrol vehicle near by.
Assisting Officer D. Geer #10156 and Officer C. Sok #10154 requested Long Beach Fire Department to respond
to our location to treat Nowparvar. LBFD responded and treated Nowparvar at the scene then Officer Geer and
Officer Sok transported him to St. Mary's Hospital to be medically cleared for booking.
After Nowparvar was medically cleared he was transported to booking. He was then booked as charged then
released to the care and custody of the 6th floor men's jail facility personnel without further incident.
Officer Longoria #10131 transported Guy to 400 W. Broadway (Booking) were he was booked as charged. He
was then released to the care and custody of the 6th floor men's jail facility personnel without further incident. For

Officer B. Komori #10546 and Officer T. Diaz #10234 (Unit 1A74) responded and took photographs. For further
see photographs.
Our investigation later revealed that during the use of force Nowparvar gave Guy a cell phone. Nowparvar stated
he had the entire incident recorded. Officer Perez recovered both Nowparvar's and Guy's cell phones. For further

I advised Sergeant Magallanes #10123 (Unit 1S39) of the carotid control hold.

On 01-12-14 at 0024 hours, my partner (Officer F. Mora #10120) and I (Officer A. Cazares #10311) were working
uniformed patrol, in a marked black and white, as Unit 1A66. We were assisting on a burglary in progress call, at a
perimeter position, at the corner of 5th Street and Cerritos Avenue (Call 1845 DR 14-2411).
While at out perimeter position, Officer Alatorre #10119 aired for a unit to assist with some uncooperative
subjects. A few seconds later Officer S. Perez #10129 aired that his partner (Officer S. Alatorre) was in a use of
force and needed assistance (Call #39 DR 14-2406).
I ran to their location and saw Officer Alatorre on top of a male subjects (Later identified as Jamiel Nowparvar)
back. Standing approximately 3 - 5 feet away from him was another subject (Later identified as Michael Guy).
Due to the fact that Guy was so close to Officer Alatorre and I was unsure if he was involved in the use of force, or
was about to fight Officer Alatorre, I ran up to Guy, had him step away from Officer Alatorre, and had him get on
his knees. I ordered Guy to stay where he was at and ran to assist Officer Alatorre.
I placed Nowparvar's left hand behind his back and Officer Alatorre placed his right hand behind his back. I placed
handcuffs (Double locked) on Nowparvar and Officer Alatorre turned him to our recovery position. For further see

I contacted Guy again and had him stand up. I placed handcuffs (Double locked) on Guy and walked him to Unit
1A6 (Officer J. Langoria #10131) patrol vehicle and seated him in the back seat.

Narrative
On Monday 1/12/14 at approximately 0024 hours, my partner (Sergeant M. Deprete #5403) and I (Sergeant J.
Magallanes #10123) were working uniformed patrol and were assisting Sergeant S. Vandenbosch (#6064) with a
possible burglary in progress at the residence at E 5th Street. A perimeter had been setup and traffic was
blocked in order to secure the scene. We were also advised that the residence contained firearms and that
suspects who may be inside the residence had access to them.
While I was on scene, Officer S. Alatorre (#10119) and Officer S. Perez (#10129) advised that they had two
subjects were who being uncooperative who were trying enter through the perimeter (Call #0039). After a few
minutes, Officer Perez advised that Officer Alatorre was engaged in a use of force with one of the subjects. We
proceeded to their location ( Cerritos Avenue) to assist.
Upon arrival, I observed that Officer Alatorre and Officer A. Cazares had both subjects detained and they were
handcuffed. We moved both suspects to a perimeter location (for their safety as they were close to the location of
the burglary) at 4th Street and Cerritos Avenue.
I contacted Officer Alatorre and he advised me that he used force on one of the subjects including and arm bar
take down and the carotid restraint. I requested Long Beach Fire Department to respond to our location to check
on DEF Jamiel Nowparvar. Long Beach Fire responded, treated and released Nowparvar at the scene. Officer D.
Geer (#10156) and Officer C. Sok (#10154) transported Nowparvar to St. Mary's Hospital for medical clearance.
I made contact with DEF Michael Guy who was seated in the back seat of Officer J. Longoria's (#10131) vehicle. I
read Guy his Miranda Rights per PD Form 1000.008 and he answered yes to both waiver questions. I asked Guy
if he was injured and he said no. I asked him if any force was used on him and he said no. I asked him why he
and Nowparvar did not listen to the officer's instructions to leave the area. Guy responded that his friend
Nowparvar was just mad that he could not go to his place of residence at Cerritos. Guy stated that the
Officers were telling him to go around, and that he was trying to calm down Nowparvar but that Nowparvar was
not listening. Nowparvar kept arguing with the officer saying, "We live right fuckin' here."
Guy saw the officer "take down" Nowparvar and then place his knee on Nowparvar's back. When Nowparvar was
on the ground, Guy reached down and took Nowparvar's cellular phone out of his hand while Nowpavar was being
contacted by the officer.
Guy was then contacted and handcuffed by another officer who arrived on scene. Guy states that he did not try to
resist any handcuffing, and no force was used on him by any officers.
I could smell the odor of an alcoholic beverage on Guy's breath and person. I asked Guy if he had consumed any

alcoholic beverages and he said that he had been drinking at a friend's residence at O'Connell's Bar in Long
Beach located at 4th Street and Temple Avenue.
I asked Guy if he had any questions and he said that he did not have any.
Officer J. Longoria (#10131) transported Guy to 400 W.Broadway for booking. He was booked as charged. It
should be noted that he voluntarily blew into an intoxilyzer resulting in a BAC of 0.04.
I then went to St. Mary's and contacted DEF Nowparvar. I read him his Miranda rights per PD form 1000.008 and
he answered yes to both waiver questions. I asked him why he did not listen to the Officers who were directing
him to leave the area and he replied that he just wanted to go home. When he was told by the officers that he
could not go home, Nowparvar tried to argue with the officer since has work at 0700 hours in the morning.
After trying to argue with the officer for sometime, he remembers the officer pushing him off of his bicycle onto the
ground and then being "choked out."
I asked Nowparvar if he had any injuries and he said no. I asked him if any other force was used on him and he
said no. I also asked him if he would sign the medical release form and he refused to sign the form.
Officer Geer and Officer Sok, following his treatment at St. Mary's, transported Nowparvar to 400 W Broadway for
booking where he was booked at charged. It should be noted that Nowparvar voluntarily blew into an intoxilyzer
while in booking resulting in a 0.09 BAC.
Officer Alatorre also advised me that Nowparvar recorded part of the contact on his cellular phone. I reviewed the
video that was recorded that shows Officer Alatorre repeatedly telling the person recording the video to leave the
area. A person off camera speaks to Officer Alatorre and asks him several times to explain why he could not go
past their perimeter position. Officer Alatorre even points out another location behind the camera where they can
wait, but the subject does not move. Officer Alatorre then makes physical contact with the subject holding the
camera and the camera goes out of focus and the video ends. For further please see the video which I uploaded

Narrative
On 01/12/14 at 0020 hours, my partner (Officer S. Alatorre #10119) and I (Officer S. Perez #10129) were working
as unit 1A67. We were in the area of 5th Street and Cerritos Avenue investigating a burglary in progress (call
#1845) with the suspect(s) possibly armed with rifles.
During our investigation, we confirmed a burglary just occurred and the suspect(s) were possibly still on scene.
We were advised the suspect(s) had access to several firearms as we established a perimeter. A large amount of
officers (approximately 30 officers) including a police helicopter and K9 unit assisted in the containment of the
location and surrounding area.
I was assigned to cover the entrance/exit point of the target location located on Cerritos Avenue south of 5th
Street. Due to the suspect(s) possibly having high power firearms, I deployed my patrol rifle and ballistic helmet
as I stood in a high-risk location. My task was to solely cover the point of entrance/exit as my partner (Ofc.
Alatorre) stood with me and provided additional cover for me as my full attention was on the window.
As the police helicopter continued to fly overhead, my partner advised me that two subjects entered our perimeter
and were approaching us on bicycles. The subjects continued to approach northbound Cerritos Avenue from 4th
Street and were now in the "danger zone" and the line of fire.
Officer Alatorre contacted the subjects (later identified as Jamiel Nowparvar and Michael Guy) who were
approximately 20 feet away from my location. I heard Officer Alatorre advise the subjects they needed to turn
around and ride back to 4th Street out of the perimeter. Nowparvar immediately responded by saying he was not
going around because he lived in the area. My partner advised them that a potential armed suspect was in the
area and it was not safe for them to continue through our crime scene. Nowparvar stated he was not going to
leave and was going to continue past us towards his house.
My partner's attention was now focused on the two subjects and had his back towards the window the suspect(s)
were possibly hiding in. I advised my partner he needed to immediately get the subjects out of the area and he
needed to get back behind cover because he was exposed and not in a safe position. My partner continued to
explain the reason why they needed to go around and exit the perimeter. They were approximately 50 yards into
the perimeter and only 50 feet away from the target location. My partner advised the subjects if they did not leave
the area they would be arrested for obstructing a police investigation. The subjects refused to comply and leave
the area after my partner gave them several explanations and chances to comply.
My partner used the police radio to ask for assistance as he attempted to detain Nowparvar. I heard my partner

Narrative
order Nowparvar to turn around as he attempted to place him in handcuffs. Nowparvar resisted and attempted to
pull away from my partner as he tried to handcuff Nowparvar. Due to the potential risk from the window, I was
unable to leave my location and assist my partner. When I looked back towards my partner, I observed him
applying a carotid hold on Nowparvar and ordering him to place his hands behind his back. I observed Guy
standing approximately 1-2 feet away from my partner as he was struggling with Nowparvar. I focused my
attention back on the target location as assisting officers arrived and took Nowparvar into custody. For further

I was later advised Nowparvar was recording the incident with his cell phone. I recovered the cell phone and
placed it into evidence. Officer J. Longoria #10131 recovered Defendant Guy's cell phone and handed it to me. I
maintained control of the cell phones until placing them into evidence. For further see property report.
