The victim stated her vehicle window did not roll up all the way, which left a small gap at the top. She did not know if this helped the suspect take her vehicle without breaking the glass. I asked her if she had all the keys to her vehicle, and she stated she lost one key "a long time ago", but still had her only other one. I asked her if she had any children or relatives who might have taken her vehicle, and she stated, "No." While speaking with the victim, she notified me that the neighboring apartment complex ( Elm Avenue) had video surveillance cameras that covered the parking lot. Further, she stated the manager of that apartment complex (later identified as Witness ) had informed her that the theft was captured on video surveillance. INTERVIEW WITH WITNESS I spoke with and she showed me the footage in question. At approximately 0315 hours, two male subjects walk into the parking lot from the west side. They appeared to have walked northbound on Elm Avenue before walking directly to the victim's vehicle. Suspect #1 stood by the driver's side door of the victim's vehicle and appeared to be making entry. Suspect #2 stood approximately twenty feet away and appeared to be acting like a lookout. After a few moments, suspect #2 walked toward the north-south alleyway located on the east end of the parking lot. Suspect #1 eventually joined him in the alleyway, where they have a brief discussion. After the discussion, suspect #1 returned to the vehicle and started it up (vehicle tail lights come one). He backed the vehicle up and struck two parked vehicles (California license #6KKD549 and 6YEN900) before fleeing with the stolen vehicle northbound on Elm Avenue. For further on the accident/hit and run, see my follow-up traffic accident report. The victim watched the video footage with us and stated she did not know or recognize either suspect. I asked her why they would only target her vehicle, and she stated she did not know. It should be noted that the victim's vehicle is a newer model vehicle, which means it is bound to be more difficult to steal than the other older vehicles in the lot. Additionally, the footage shows the suspects going directly to her vehicle rather than checking for an easier target. I asked the victim about this, but she was unable to provide me any more information beyond the fact that her vehicle was broken into a few days prior to this incident. She did not report that incident, but felt it must have been related. SUSPECT DESCRIPTIONS SUSPECT #1 Based on the video footage, suspect #1 appeared to be a male Hispanic. He was in his late teens to early twenties. He appeared to be of an average height with a large frame. His hair was bushy and appeared to be black. He was wearing a dark colored sweatshirt some type of design on the front and dark colored shorts. SUSPECT #2 Suspect #2 appeared to be a dark skinned Hispanic or Cambodian. He was taller than suspect #1, appearing to be approximately six feet tall, and was thin. He was wearing a dark colored jacket, white T-shirt, and khaki colored pants. CONCLUSION I had make a thumb drive copy of the video surveillance footage. However, Los Angeles County Sheriff's Deputy Bonilla #482259 (Unit 213A) arrived on scene and requested the thumb drive. Since their crime involved an assault on a deputy and we only had one thumb drive available to us, the decision was made to allow them to take the thumb drive as evidence. Deputy Bonilla provided me their investigator's name (Detective Kriste) and contact information (323-568-4800; LASD case number 13-16654-21) if we needed to view the footage again, via the thumb drive. I later had the victim's vehicle listed as a stolen vehicle that was also wanted for an assault with a deadly weapon. I provided the victim with a report receipt, and she desires prosecution. Neal #10128) was working as Unit 1A33 driving a marked black and white police vehicle westbound on Pacific Coast Highway in the area of Chestnut Avenue. While en route to assist Unit 1A34 (Officer T. Diaz #10234), I observed a silver vehicle drive southbound across Pacific Coast Highway on Chestnut Avenue. As the vehicle drove across Pacific Coast Highway, it almost caused an accident with another black and white police vehicle (Unit 1A32; Officer H. Moore #10319) that was driving westbound on Pacific Coast Highway in front of me. Unit 1A32 had to swerve from the number two lane to the number three lane to avoid striking the other vehicle.I watched as the vehicle continued southbound on Chestnut Avenue, and I immediately recognized that it matched the description of a stolen vehicle that had been used during an assault with a deadly weapon on a Los Angeles County Sheriff's Deputy on 10/31/2013 (see main DR and supplemental .0001). Further, I was the original officer who took the stolen report and subsequent hit and run. I followed the vehicle southbound on Chestnut Avenue and ran the vehicle's license plate (California license #5HRD759), via my radio. While waiting to confirm that the vehicle I was following was, in fact, the stolen vehicle, I observed the vehicle roll through the stop sign at Chestnut Avenue and 17th Street without stopping (in violation of 22450(a) VC) as it turned eastbound on 17th Street. I was still waiting for the Communication Center to confirm if the vehicle was wanted, when it rolled through the stop sign at Cedar Avenue and 17th Street without stopping (in violation of 22450(a) VC) as it turned southbound. At this point, the Communication Center confirmed the vehicle I was following was, in fact, the stolen wanted vehicle. Moore #10319) was on routine uniformed patrol in a marked black and white police vehicle as Unit 1A32, when I assisted Unit 1A33 (Officer W. Neal #10128) regarding a stolen vehicle (call #0434). Prior to this call, I was driving westbound Pacific Coast Highway towards Chestnut Avenue in lane #2 at approximately 30 mph, when I observed a silver Nissan 350 fail to stop at the southbound stop sign of PCH/Chestnut Avenue. The vehicle drove into east/west PCH traffic and I had to swerve into lane #3 to avoid striking the vehicle. I was en route to assist Unit 1A34 (Officer T. Diaz #10234) on an auto burglary call and continued on to assist him. Shortly after this, Officer Neal aired that he was in pursuit of a stolen vehicle (a silver 2004 Nissan 350 CA #5HDR759). The vehicle was wanted for being stolen and for being the suspect vehicle on an assault with a deadly weapon on a police officer. For further on the pursuit, see Officer Neal's report. It should be noted that I was wearing a Long Beach Police Department blue uniform with shoulder patches that read "Long Beach Police" and a visible badge on my front left chest. Any person would have known that I was an on-duty Police Officer. I assisted units on the pursuit and attempted to catch up to it by paralleling it. Unit 1A5 (Officer K. Skeen #6050) aired that the vehicle had been involved in a traffic collision at 5th Street and Elm Avenue, and that the driver (a male Hispanic wearing all black clothing) ran eastbound from the vehicle. I drove northbound Elm Avenue to 5th Street and observed the stolen vehicle had collided with a parked vehicle on the northeast corner. I observed Officers running eastbound 5th Street on the north sidewalk from Elm Avenue. I believed that these Officers were chasing the subject and joined them in their foot pursuit. I spoke with who told me the following; He was asleep in his bed when he heard people running in the alley just north of his apartment. did not see or hear anything else and he did not look outside to see who was running. went back to sleep. did not witness the use of force. I knocked at E 5th St and there was no response at the door. 5th St has a front door that faces south, however the rear portion of the residence faces northbound to the alley. Several minutes later ER noticed a bruise/welt to the juvenile's forehead. This injury was hidden behind the juvenile's hairline and Officer Skeen did not photograph it. Skeen #6050) was working uniform patrol in a marked black and white police vehicle as Unit 1A5 assisting unit 1A33, (Officer W. Neal #10128) that was following a Long Beach reported stolen vehicle in the area of 14th St and Cedar Ave, call #434. Officer Neal requested communications to verify that the vehicle, (2004 Nissan 350, plate #5HDR759) was a stolen, (DR #13-66654) while he maintained a visual until another unit could assist. As he did, the driver, later identified as , increased his acceleration in the vehicle and started to distance himself with Officer Neal. I was traveling westbound Anaheim St at Pacific Ave when I observed the Nissan enter the intersection of Cedar Ave and Anaheim St. Officer Neal had his vehicles emergency lights and siren activated and was in pursuit of the fleeing Nissan. The Nissan traveled eastbound from Cedar Ave towards my direction, then southbound Pacific Ave. There were multiple vehicles and pedestrians in that area, which subject , placed in danger, because of his intentional reckless driving. I activated my emergency lights and sirens and informed Officer Neal that I would be calling out the pursuit for him. (See supp 13-66654-003 for further information on the pursuit). Subject lost control of the stolen vehicle and crash into several parked vehicles at the northeast corner of 5th St and Elm Ave. Subject exited the drivers' door of the stolen vehicle and immediately ran eastbound 5th St along the north curb. It should be noted that I was wearing a Long Beach Police Department blue uniform with shoulder patches that read "Long Beach Police" and a visible badge on my front left chest. Any person would have known that I was an on-duty Police Officer. Both Officer Neal and I were now in a foot pursuit of subject and ordered him to stop. Subject refused to comply, never looking back at us. I aired the information of description and direction of travel via radio. While assisting units were arriving in the area, Officer Neal and I continued our foot pursuit of through the first north/south alley just east of Elm Ave, northbound. We followed as he ran eastbound onto Linden Ave from the west/east alley between 5th St and 6th St. then proceeded northbound Linden Ave to 6th St and then eastbound along the south sidewalk. I aired that he was approaching the parking lot of Atlantic Ave, Louie Burger Restaurant, and watched as he entered the drive thru. Officer Neal recovered an "Ozark Trail" folding knife from subject front left pants pocket. The item was kept in my possession. I photographed the item and placed it into evidence. Unit 1S24, (Sgt. J. Gludt # 5428) arrived on scene and requested that I take photos of the following: all officers involved in the use of force and their injuries, the location of the arrest, vehicles involved in the traffic collision and subject injuries. After taking photos of Officer Moore #10319, I observed that he had suffered multiple abrasions to the area of his left elbow. He had suffered these injuries during use of force when arresting felony subject . Officer Neal # 10128 was observed with an abrasion to his left thumb, which he had sustained during the use of force when arresting felony subject . Officer Tith # 10248 was observed with multiple abrasions to his left knee, lower left calf and left hand. These injuries occurred during the use of force when arresting felony subject . Officer Wood # 10040 was observed with multiple abrasions to his left and right knee, which he had sustained during the use of force when arresting felony subject . Subject was observed with the following injuries at St Mary's Hospital. 1) Abrasion to right arm, face and lip 2) A welt on the left forearm, abrasion to left wrist 3) Redness, abrasions and welts to both left and right shins 4) Laceration left eyebrow Emergency doctor treated subject . Vanden Bosch #6064) was working unit 1S32, uniformed patrol in a marked black and white sergeant's patrol vehicle. Unit 1A33 (Officer W. Neal #10128) located a rolling stolen vehicle and a pursuit was initiated. The suspect was eventually apprehended and during his apprehension an Use of Force occurred. For further on the UOF see connecting reports. I responded to St. Mary Hospital to interview the suspect,identified as . I interviewed while he was lying handcuffed to a hospital bed. I asked why he ran after the pursuit and he stated, "I didn't want to face the consequences." I read him his Miranda Admonishment from LBPD form PD-1000.008 and he stated, "Yes," to waiver question #1 indicating that he understood his rights. I asked him if he had been arrested before and he told me that he had a prior arrest for battery on his mother. I asked if he had heard the officers yelling at him to stop and he said, "Yeah." I asked him why he didn't stop and he told me that he didn't stop because he was, "Trying to get out of there." I asked why he fought with the officers after he was taken to the ground and he said, "I did not fight." I asked him if he did what the officers told him to do and he stated, "Yes." I asked him what they told him to do and he stated, "They told me to stop fighting and to stop kicking and I wasn't doing anything, they just kept on hitting me and hitting me." I asked him what he did when they told him to do this and he said, "I was just trying to tell them to stop and stop." I asked him, "Were you kicking your feet and trying to get them away from you?" replied, "Yeah." I asked where the officers struck him and he told me, "The legs. I remember getting bashed in the head." I asked him when he was bashed in the head and told me that he was struck in the head while the officers were striking his legs with batons and nightsticks. I asked , "While you were being arrested, did the officers tell you to not resist them?" replied, "Yes." I then stated, "But you continued to resist by kicking and stuff, huh?" I asked him when he obtained the car and he told me that he took it, "the night before yesterday" and admitted to taking it around 0200 hours. He told me that he got it from nearby the down town Long Beach post office. told me that the vehicle was unlocked and the keys were inside of the car. told me that vehicle was not his, that he did not know the owner, and that he did not have permission from the owner to drive the vehicle. did not let anyone else take it from him. told me that from the time he stole the vehicle until the time he was in the pursuit that he was the only one who had driven the vehicle and he had it the entire time. He told me that he was alone when he took the vehicle however he picked up a friend later in the morning and drove around with him in the car. told me that he did not stop when the police officer tried to pull him over because he had stolen the vehicle and was scared to get in trouble for it. I then asked him where he took the car when he originally stole it. told me that he originally drove the car around Long Beach and then he drove over and started to drive around Lynwood. I asked him what happened in Lynwood and he told me, "I encountered a Sheriff over there." I asked him to elaborate and he told me the following. The Sheriff attempted to pull him over but he left. He drove into a dead end so he turned around and he struck the Sheriff police vehicle on the door and it closed. Wood #10040) assisted officers who were in vehicle pursuit of a stolen vehicle (call #434). While en route officers aired via police radio that the suspect had crashed the stolen vehicle and was now fleeing on foot. The accident occurred in the area of 5th Street and Elm Avenue. Officers were airing the suspect description as well as his direction of travel. The suspect was described as a male Hispanic, wearing all black clothing, 5'8" tall and 180lbs. I arrived at the intersection of 6th Street and Atlantic Avenue and saw a person matching the suspect description run southbound on the west sidewalk in front of Atlantic Avenue. I parked my vehicle in front of Atlantic Avenue and a citizen pointed to the parking lot just south of the building and said, "He went that way!" I ran westbound through the parking lot and saw officers involved in a fight with the suspect. Officer Moore and Officer Tith were wrestling on the ground with the suspect. I saw the suspect on the ground resisting Officer Moore and Officer Tith by kicking his feet and using his arms trying to break free from their control holds. Officer Neal and Officer Diaz were standing near by holding their batons. I reached down and tried to grab a hold of the suspect's left arm and place it in a wrist lock to try and help handcuff the suspect. The suspect violently pulled his left arm away from me. The suspect then used his left arm and was reaching for Officer Moore's shirt collar as Officer Moore was trying to apply the carotid restraint. I again grabbed the suspect's left arm to prevent him from grabbing Officer Moore's shirt collar and possibly choking Officer Moore. I then used my Streamlight Sl-20x flashlight and struck the suspect's left forearm and wrist four times. I then noticed that the suspect was no longer resisting when his body went limp and was rendered unconscious by the application of the carotid restraint. Officer Diaz handcuffed the suspect. No further force was used. I assisted Officer Mendoza in placing the suspect in a police car and followed them to St. Mary's Hospital for medical clearance. While in the hospital I took the suspects clothing and placed them into evidence. Diaz #10234) responded to the area of Cedar Avenue to assist Unit 1A33 (Officer W. Neal #10128) who was in pursuit of a stolen vehicle (call #0434). It should be noted I was driving a marked black and white police vehicle and I was wearing a Long Beach Police Department blue uniform with shoulder patches that read "Long Beach Police" and a visible badge on my front left chest. Any person would have known that I was an on-duty Police Officer. Unit 1A5 (Officer K. Skeen #6050), Unit 1A4 (Officer J. Wood #10040), Unit 1A32 (Officer H. Moore #10319), Unit 1A31 (Officer J. Prior knowledge of Stolen Vehicle I recognized the vehicle description and license plate (Silver 2004 Nissan 350Z license plate 5HDR759) as vehicle that was stolen on 10/31/2013 from Elm Avenue (call #0328). During this incident, I viewed surveillance footage of two male subjects stealing the car and fleeing the area. The first subject was a male Hispanic in his late teens to early twenties. He appeared to have a stocky build and black bushy hair. He was wearing a dark colored sweatshirt. The second subject was male Hispanic with dark skin. WHILE EN ROUTE A police unit aired, via police radio, that the stolen vehicle was failing to yield and now a pursuit was authorized. As units were in pursuit of the stolen vehicle, they were updating their location as they were following it. Meanwhile, I was driving my patrol vehicle towards the general area of where officers were pursuing the vehicle. While still en route, a unit aired over the radio that the stolen vehicle had crashed in the area of 5th Street and Elm Avenue. Immediately, I heard Officer Skeen air that he was now in foot pursuit of the suspect. He described the suspect as a male Hispanic wearing all dark clothing. They were running in an alley between 6th Street and 7th Street, and then northbound on Linden Avenue. The suspect was then running eastbound 6th Street on the south side of the street towards Atlantic Avenue. As Officer Skeen was airing this information over the radio, I made my way to 6th Street and proceeded to drive my vehicle eastbound 6th Street towards Atlantic Avenue. UPON ARRIVAL I noticed Officer Skeen on the north side of the parking lot of Atlantic Avenue. He told me that the suspect had just run southbound through the parking lot and jumped over a fence and out of sight.
