On 1/27/14 at approximately 1820 hours, my partner (Officer A. Fox #6186) and I, Officer J. Brearley #6226 were
working as unit DE35 as part of the North Division Directed Enforcement Team.
While driving northbound in alley to the rear of Long Beach Blvd, we observed a male White subject (later
identified as Michael Snyder) and a female Hispanic subject (later identified as Lucia Velasquez) walking
northbound in the alley. Snyder was swaying side to side and it appeared he may be intoxicated. It should be
noted that Snyder and Velasquez were walking in the middle of the alley and were preventing us from proceeding
along the roadway.
We contacted the subjects to investigate Snyder's level of impairment and to inquire as to why they were blocking
vehicle traffic. Snyder stated he had hurt his left leg and it was causing him to limp. He stated he was not under
the influence.
Snyder and Velasquez each gave us false names on multiple occasions before we discovered their true identities.
Both subjects were found to have no-bail warrants for their arrest out of San Bernardino. Snyder for narcotics
and Velasquez for 459 PC.
Both subjects were transported to 400 W. Broadway where they were booked as charged.
Officer Fox released Velasquez to the 4th floor Women's jail without incident.
I accompanied Snyder to the 6th floor Men's jail. Jail Officer J. Lira #8347 directed Snyder to the strip search
room to conduct a thorough search of his person. This is typical for subjects arrested for narcotics or weapons
offenses. Jail Officer Lira directed Snyder to remove his clothing items one at a time. Snyder complied until he
was left with his shorts and boxer shorts. When asked for his shorts Snyder refused. Jail Officer Lira insisted that
Snyder comply and he removed his shorts and handed them to Lira. I then observed Snyder remove a plastic
baggie from the front right side of his boxer shorts waistband. Snyder quickly put the item in his mouth and dove
face first onto the ground of the strip search room. Snyder pulled his hands underneath his body and Jail Officer
Lira began trying to gain control of his arms so that he could be placed in handcuffs.
Based on my training and experience I know that this is typical behavior of subjects who are trying avoid being

charged with possession of narcotics. I know Snyder has a history of methamphetamine abuse and I feared if he
was able to consume this quantity of what I believed was likely methamphetamine, his life would be in danger. I
immediately began ordered Snyder to spit out the baggie but he did not comply. Snyder was facing me, lying on
his stomach, with his hands underneath his body. I used my right thumb to apply pressure to the mandibular
pressure point under the ear and behind the jaw. This pressure point causes pain and can distract a person from
swallowing the narcotics in their mouths. As I applied this pressure I ordered Snyder to spit out the item out but
he did not comply. Rather, Snyder grabbed my right wrist with his left hand and pulled it towards the floor.
Snyder turned his head towards my hand and attempted to bite my hand. Snyder's mouth closed on the outside
of my right hand glove but missed my skin. I pulled my hand away from Snyder's mouth and told Jail Officer Lira
that Snyder was biting. I could see Snyder was kicking his legs and resisting Officer Lira's attempts to get him
handcuffed. I heard Jail Officer Lira calling for assistance from the other jailers. Snyder still had control of my right
wrist and was pulling it back towards his mouth. I feared that if we did not quickly gain control of Snyder he would
be able to injure myself of Officer Lira. I encircled Snyder's neck with my left arm and began to apply a carotid
control hold in an attempt to overcome his resistance.I was able to free my right wrist from Snyder's grasp. I
grabbed my left fist with my right hand and increased the pressure of the carotid control hold. After several
seconds I could feel the tension in Snyder's muscle dissipate and observed Officer Lira gain control of his arms. I
immediately released the carotid control hold and Officer Lira was able to secure Snyder in handcuffs.
I turned Snyder on his side, checked his vitals, and requested medical assistance. The on-duty jail nurse
responded to my location and assisted in monitoring Snyder. Long Beach Fire Department Engine and Rescue 1
responded and transported Snyder to St. Mary's Medical Center. Snyder was treated by ER Doctor . As of
the writing of this report Snyder is under the care of St. Mary's Medical Staff.
Sergeant R. Bernsen #5925 was notified of the incident and responded to the hospital.
Officers L. Mulock #10060 and A. Hunt #10011 responded to the hospital and relieved Officer Fox and I. Officer
Mulock photographed Snyder and I to document the lack of injuries.

On 01/27/14 at 1950 hours I, Sergeant R. Bernsen #5925, working unit DE3 was advised of a Use Of Force in the
Men's Jail involving Officer Brearley and a suspect he had arrested for a narcotics warrant.
I responded to the Men's Jail and arrived as the Defendant, Michael Snyder, was being transported to St. Mary's
Hospital. I spoke to Booking Sergeant S. Solarzano who told me he would obtain a copy of the jail video
surveillance and place it into evidence.
I spoke to Jail Officer J. Lira #8347. He told me that he was conducting a strip search on the defendant as is
standard procedure for narcotic warrant arrests that are less than one year old. Officer Lira said that as he was
walking the defendant to the strip search area the defendant was limping and Officer Lira believed that he was
faking. Officer Lira said that when they got to the strip search room the defendant wanted to sit down and went to
the floor. Officer Lira said that the defendant was acting like this was his first time being strip searched and was
asking why this was happening. The defendant said that he had a leg injury and was having difficulty standing.
When the defendant was down to his boxer shorts, Officer Lira noticed that he went for his waistband with his
hands. He heard Officer Brearley tell Snyder to keep his hands where he could see them. Officer Lira said that
Snyder took something from his waistband and put it in his mouth before going to the ground. He said that Officer
Brearley was struggling with Snyder on the ground and then Snyder stopped resisting and Officer Lira was able
to gain control of his left hand and handcuff him once again. Officer Lira said he did not use force.
I responded to St. Mary's Hospital to speak with Defendant Snyder. Defendant Snyder was in the Emergency
Room. I watched as he kept twitching and moving on the hospital gurney. I read him his Miranda Rights as per
PD Form 1000.008. Snyder looked at me but did not respond to the waiver questions. I believed that he was
impaired to the level that he was unable to answer my questions. No further questions were asked. As I was still
in the area I watched as he talked to the nurse quitely, leading me to believe that his lack of response to me was
deliberate.
