Incident Summary
CALL/INCIDENT
Units responded to the area of 2nd Street and Bennett Ave regarding a naked man in public screaming that he killed
someone, something about monsters, and was possibly armed. Officers located the subject in an attempt to
detain/arrest him.
USE OF FORCE
Officer Elliott used body force to execute a take down to affect a lawful arrest of a resistive subject. Sgt. Jenson used
body force to control a resistive subject and protect himself and others from injury.
INVESTIGATION
The defendant sustained injuries. He sustained a cut to his chin that required sutures. This injury is consistent with the
take down. He sustained abrasions to his left cheek, minor abrasions to both elbows, an abrasion to his right knee cap,
minor abrasions to the knuckles of his toes, an abrasion to the outside ankle bone, and a bruise to the inside of his left
knee. These injuries are consistent with the defendant's struggle while on concrete to escape once he was taken to the
ground. The defendant sustained swelling to his right wrist and hand. This injury is consistent with his continued struggle
to break free once the handcuffs were applied. A medical release was obtained, signed by the defendant.
The officer and sergeant did not sustain injuries.
Knock and talks were conducted. Witnesses statements did not conflict with the officer's or sergeant's account of
events.
Officer Myers #10363 took photographs of the scene, Officer Elliott and Sergeant Jenson. Officer Cornell #10328 took
photographs of the defendant.
No surveillance video was identified to have captured the use of force.
INTERVIEW
I (Sgt. B. McPhail #5739) contacted the defendant at Community Hospital and conducted a recorded interview. He was
read his Miranda Rights by Officer Fleet #10571. He did not recall how he got the cut to his chin or how the other injuries
were sustained. His statements did not conflict with the officer's or sergeant's account of events.
DISPOSITION
Based on my investigation, Officer Elliott's use of force was reasonable and within policy. Sergeant Jenson's use of force
was reasonable and within policy. No administrative action is recommended.
NOTIFICATIONS
WC Lt. Coble was notified and was on scene. IA Sgt. B. Johnson was notified and responded.
