***Use of Force***
On 12/14/14 at 2227 hours, I (Officer B. Elliott, #10027) was dispatched to the area of E. 2nd Street
regarding a 911 emergency call for service involving a person screaming (call #1288).
I was assisted by 2S14 (Sgt. S. Jenson, #5816), unit 2C14 (Officer E. Barich, #10042), unit 2C15 (Officer M.
Nguyen, #10066), unit 2C71 (Officer L. Fleet, #10571 and Officer M. Sidders, #10562) and unit 2A17 (Officer K.
Myers, #10363).
The call stated, a male subject was standing in front of the dispatched location yelling, "Monsters!"
While en route, we were notified via dispatch of additional calling parties calling in regarding the same subject.
The second calling party stated he heard a male subject outside the dispatched location yelling and banging on
the building. This calling party also stated,he heard the male subject screaming about God.
A third calling party reported the subject was yelling and was completely naked. This calling party also stated, he
observed the male subject start yelling the police helicopter when it came overhead.
A fourth calling party reported the male subject was naked and was screaming that he killed someone. This
calling party also stated, another male subject came out of the apartment building and sat the naked subject
inside of a nearby vehicle.

As I arrived in the area, I overheard Sgt. Jenson via the in vehicle radio that he observed the subject flee from him
and enter the backyard of the residence on the north/west corner of 2nd Street and Bennett Avenue. At the
direction of Fox2, who was circling overhead, I entered the north/south alley rear of the location where the subject
fled.
A few moments later, I heard unit 2S14 via my in vehicle radio the subject (identified as Christopher Perciballi)
came back and was now in prone position in the driveway. I left the alleyway in order to assist Sgt. Jenson. As I
approached the location, I observed Sgt. Jenson standing on the sidewalk with his Electronic Control Device
drawn pointed at a male subject lying face down in the driveway of the residence. As soon as I made contact with
Sgt. Jenson the subject got up to his feet and started walking toward us speaking and yelling incoherently.
I heard Sgt. Jenson order to the subject to stop and to get down on the ground. However, the subject refused to
comply and continued to approach us.

Narrative
I too ordered the subject to stop and he again refused to comply. I noticed the subject had his hands up at
shoulder height and his palms were facing out. When subject came within approximately four feet of us, I reached
out and took control of the subject right wrist in order to attempt to place him into handcuffs to effect a lawful
investigative detention of his person. However, as soon as I took control of his right wrist the subject began to
violent resist. The subject attempted to pull his arm back toward his body and I could feel his wrist start to twist
and turn in what appeared to be an attempt to break free and escape the detention. Also, I noticed the subject
was attempting to step back in order to gain leverage in his attempt to break free.
When I felt the subject begin to struggle with me and violently attempt to break free of my grasp, I pulled the
subject by his arm closer to me pulling him off balance and then proceeded to apply an arm bar take down to
control the subject who was resisting our detention. The take down worked effectively and the subject went to the
ground landing his stomach and face. While the subject was lying face down on the sidewalk he began to
yell/scream and violently flailed his body back and forth and kick his legs in what appeared an attempt to break
free. As I maintained control of the subjects' right arm, I noticed Sgt. Jenson had control of the subjects left arm;
Officer Nguyen arrived on scene and placed the subject into handcuffs.
The subject yelled and screamed incoherently throughout the entire incident.

Once the subject was handcuffed, we turned him on his side in order to assess him for injuries. We noticed the
subject had sustained a large horizontal laceration to his chin. The subject was subsequently transported to
Community Hospital for treatment of his injury.

Narrative
On 12-14-14, at approximately 2227 hours, while working Unit 2S14, I (Sgt. S. Jenson #5816) was dispatched to
E. 2nd Street. Call# 1288.
Several citizens had called the police department's communication center regarding a male subject front of the
dispatched address yelling.
One calling party stated the subject was yelling something about monsters and believed he had a gun.
Another calling party stated the subject was possibly suffering from a mental illness, was banging on the building,
and yelling and screaming about god.
Another calling party stated a male White subject in his 20's was yelling and completely naked.
Another calling party stated there was a male White subject, in his early 20's, naked, screaming that he killed
someone, and that another male subject came out of the apartment building and put him inside of a gray Toyota
Corolla, passed him a backpack, and calmed him down before walking back into an apartment.
Another calling party stated the same subject yelled, "I killed Daniel!", was naked, and was a male White.
It should be noted that I was wearing a Long Beach Police Department uniform, with a Long Beach Police
Department badge pinned to the left side of my chest, and Long Beach Police Department patches on both of my
shoulders. I was also driving a marked black and white police vehicle, with the word Police written on the side,
and a light bar on top.
I arrived on scene at approximately 2229 hours and observed a male White, completely naked, yelling
incoherently, walking northbound the west sidewalk of Bennett Avenue from 2nd Street in front of a large brick
house on the corner. Once the subject got to the gate of the residence he began to shake it violently while yelling
incoherently into the air at the police helicopter that had arrived overhead.
Based on the information provided by the calling parties, and my observations, I believed the subject was possibly
under the influence of a narcotic or was suffering from a mental disorder, and was demonstrating violent and
erratic behavior.
It is my experience that individuals who are commonly under the influence of PCP, Bath Salts, or other similar
narcotics will exhibit the exact same behavior as the subject in front of me was exhibiting, and are usually very
violent, have incredible strength, and will commonly resist arrest when interacting with the police.

It is also my experience that individuals suffering from mental disorders will often times exhibit the same behavior
and are very violent, have incredible strength, and will commonly resist arrest when interacting with the police.
Based on these observations and my fears of a violent confrontation with the individual I asked for assisting units
to respond code 3. (Lights and sirens activated for a quicker response)
As I requested this the subject had broken through the gate he was violently shaking and was now pounding on
the side door to the residence. He was still yelling incoherently and was determined to gain entry.
Fearing for the safety of the occupants inside I approached the subject and identified myself as a police officer.
The subject immediately started walking towards me in an aggressive manner, closing the distance quickly.
Fearing the subject was going to assault me I removed my electronic control device and pointed at the subject
while ordering him in a loud clear voice to stop and get on the ground.
The subject immediately dropped to the ground and sat with his legs crossed on the ground. I then ordered him to
roll over on to his stomach and lay flat. Instead he kicked his feet out in front of him and laid straight back onto
the ground.
In order to allow myself the best position of advantage and safety over the subject I ordered him to roll over onto
his stomach into the prone position so he could not see me approach him. I ordered him approximately 5 to 10
times to roll over while standing approximately 20 feet away from him. He would not roll over and would just yell
incoherently at the sky.
Eventually, he rolled over onto his stomach at about the same time Unit 2C90 (Officer B. Elliott #10027) arrived on
scene. Fearing the subject would get to his feet again, attempt to attack us, flee or attempt to break into the
residence again, we started to approach the subject in order to detain him and safely handcuff him before he
could get back to his feet.
As we started to walk towards the subject he jumped to his feet, turned towards us, and quickly started walking
towards us while yelling. I immediately yelled to the subject to get back on the ground but he did not comply.
Officer Elliott was to my left and grabbed hold of the subject's right arm. I used my left hand and grabbed hold of
the subjects left hand.
As we grabbed hold of his arms and hand he tensed his body up, started to pull away, and raised his voice and
started to yell louder. Fearing the subject was going to violently resist further and attack us we both conducted
arm bar takedowns simultaneously forcing the subject to fall forward to the ground landing on his stomach.
Officer Elliott was able to place the subject's right arm behind his back while I kept hold of his left hand in a wrist
lock preventing him from rolling over.
Unit 2C14 (Officer E. Barich #10042), Unit 2C10 (Officer D. Quinones #10056), and Unit 2C15, (Officer M. Nguyen
#10066) all arrived on scene at approximately the same time. I handed the subject's left hand off to one of these
officers and stepped back as they handcuffed both of his hands behind his back.
I noticed the subject was bleeding from the chin and I immediately requested paramedics to respond and treat his
injury.
I also noticed that the subject continued to yell incoherently and attempted to get and resist resulting in all four
officers holding him down until paramedics arrived to treat him.
No further force was used.
Sgt. McPhail was notified of my use of force and responded to the scene to oversee the investigation.

On 12/14/15 at 2336 hours, my partner (Officer S. Rizzuto #6057) and I (Officer J. Garry #10245) assisted Unit
2S30 (Sergeant B. McPhail #5739) at Community Hospital of Long Beach regarding a prisoner receiving medical
attention following a use of force (Call #1288).
While en route, I contacted Unit 2S14 (Sergeant S. Jenson #5816) who had been involved in the use of force.
Sergeant Jenson stated the subject (later identified as Christopher Perciballi) was observed naked in a public
place damaging a door to a building. Perciballi was screaming, "I killed Daniel! I killed Jesus!"
Perciballi did not seem to comprehend instructions, and force was used to take him into custody. Sergeant
Jenson believed Perciballi may be under the influence of a controlled substance (for further see Sergeant
Jenson's use of force report).
Upon arrival to Community Hospital of Long Beach, I saw Perciballi in the emergency room. Perciballi was
restrained to the gurney by use of four point restraints. I conducted an assessment of Perciballi, but quickly
determined he was not under the influence at the time I contacted him.
Due to the nature of the event, I asked Perciballi if he would be willing to submit a sample of his blood for
evidence. Perciballi agreed to allow staff to draw a sample of his blood.
Registered Nurse drew a sample of Perciballi's blood from his right arm. I collected the sample, and
kept it in my possession until placing it into evidence.
Sergeant McPhail asked me to interview Perciballi regarding his statements regarding killing persons. Officer
Fleet had already admonished Perciballi regarding his Miranda Rights.
Perciballi appeared shocked he would make such statements. Perciballi initially stated he did not know anyone by
either name, and believed it may have had something to do with visiting a church earlier in the day.
Perciballi stated he constantly smokes marijuana, and has recently tried to quit. Perciballi did not smoke
marijuana for three days prior to today, but smoked some of marijuana when he got desperate.
Perciballi later stated he knows a manager at his workplace name however he does not know his last
name. Perciballi works for HMS House, which supplies the staffing for John Wayne Airport. Perciballi is a dish
washer of PeiWei Chinese food. " has always been friendly to Perciballi, and he would have no reason to
hurt him. Perciballi does not believe his statement would relate to this person.
Perciballi stated he has very little memory of what happened earlier in the evening.

Perciballi received medical clearance, and we transported him to 400 West Broadway for booking.
Perciballi was booked for public nudity (violation of 9.20.050(a) LBMC), the vandalism of the door (violation of
594(a)(2) PC), and resisting arrest (violation of 148(a)(1) PC).
Perciballi was later released to the custody of the 6th floor Men's Jail without further incident.

1. LOCATION: Community Hospital of Long Beach Emergency Room Bed A3
2. WITNESS: I (Officer J. Garry #10245) conducted the exam, while Officer S. Rizzuto #6057 witnessed the
exam.
3. BAC: I used my department issued PAS device (Intoximeters Alco-sensor FST #038357)to administer a
breath test. The results of the test were 0.00% BAC
4. ARRESTING OFFICER INTERVIEW: I contacted Sergeant S. Jenson who responded to the call and
observed a male subject (later identified as Christopher Perciballi) nude in a public place, in cold weather (less
than 60 degrees), screaming "I killed Daniel! I killed Jesus!" Perciballi did not appear to understand what he was
doing, and began punching a door, and attempting to rip it open. Perciballi did not comply with commands, and
for was used to take him into custody.
5. INITIAL OBSERVATIONS: I contacted Perciballi in the Emergency Room of Community Hospital of Long
Beach. Perciballi was restrained to a gurney by use of four point restraints. Perciballi appeared nervous, but
cooperative.
6. MEDICAL PROBLEMS: Perciballi had a laceration to his chin, measuring approximately 1-1/2 inches.
Perciballi had abrasions to both elbows, his left shoulder,and the tops of both feet. Perciballi had bruise to his left
cheek, and left knee. Perciballi had swelling to his right wrist and hand. Perciballi required sutures to close the
wound on his chin.
7. PSYCHOPHYSICAL: No tests were administered due to Perciballi being restrained to the gurney.
8. CLINCIAL INDICATORS: Perciballi exhibited an increased heart rate.
9. SIGNS OF INGESTION: Perciballi had a thick white pasty coating on his tongue.
10. STATEMENTS: Perciballi stated he had recently attempted to stop smoking marijuana, however smoked
some of "weed" at 2100 hours. Perciballi remembers taking his shirt off, but does not know what
transpired during the use of force.
11. DRE'S OPINION: At the time of the exam, Perciballi was not under the influence.
12. TOXICOLOGICAL: Registered Nurse drew a sample of Perciballi's blood from his right arm. I
collected the sample, and kept it in my possession until placing it into evidence.
