I heard over the radio that unit 2A9 (Officer Herrera #10047) was enroute, but he was approximately 5 minutes away. Ricardo started to walk eastbound on the sidewalk and I ordered him to stop and he said, "Fuck you man" and continued to walk. I followed a short distance behind him and he stopped and turned towards me. He raised both his arms out to his side, as if he was preparing to tackle me. I took a defensive stance and told him not to do it or I would "taze" him (referring to my electronic control device). Ricardo told me to "taze" him because he has been trained with them before. Ricardo began walking westbound back towards the entrance of the bar. Again, I ordered him to stop and he refused. He turned towards me again and raised his arms and said, "Let's go." Fearing Ricardo was challenging me to a fight, I asked for a unit to roll "code 3". I observed 2 separate police vehicles pulling up to my location. As they approached, I observed Ricardo start walking towards the security guards standing at the front entrance. Fearing Ricardo was going to physically harm them, I reached out and grabbed his left wrist and attempted to place him in a twist lock. As soon as I made contact with his arm, Ricardo immediately pulled away from me and spun in my direction and faced me. I tried to grab his left arm and Ricardo was able to break free again by pulling his arm away. Ricardo tried to force his way past the guards and I grabbed his left wrist and I was able to pull him away from the guards and I attempted to conduct an arm bar take down. Ricardo was physically resisting my attempts and he was able to maintain his balance. At that point, I observed Officer Herrera run up and grab Ricardo's right arm and we were able to take Ricardo to the ground. Ricardo landed face down on the sidewalk and I fell down on his right side. While on the ground I maintained control of Ricardo's right wrist in order to handcuff him. I observed Officer Herrera on Ricardo's back and he appeared to be applying the carotid control hold on Ricardo. Unit 2A13 (Officer Hansen #3319) arrived on scene and attempted to gain control of Ricardo's left arm, for further, see his report. I could feel Ricardo trying to break free from our grip and I yelled out, "Stop resisting!" and I struggled to maintain control of his right arm. Unit 2A11 (Officer Fritz #6248) arrived on scene and I told him to prepare his electronic control device. After a few seconds, I felt Ricardo's arm go limp and he stopped resisting. I heard what sounded like snoring noises coming from Ricardo, as if he was unconscious. I told Officer Herrera Ricardo appeared to be unconscious and we needed to handcuff him. I was able to place a handcuff on Ricardo's right wrist and placed his arm behind his back. Officer Herrera was able to place Ricardo's left arm behind his back. Due to Ricardo's large build, we had to use two sets of handcuffs in order to secure him. Once we were able to handcuff him, all use of force ceased. I advised dispatch that we needed Paramedics to respond to evaluate Ricardo. LBFD Engine 14 and Rescue 8 responded. Unit 2S20 (Sergeant Richens #6056) responded to the scene. I observed I had a small tear on my uniform on my left thigh. I had some scuff marks on my right sleeve and right shin. Officer Thai took photographs of the Officers, the scene, and of Ricardo. For further, see his follow up. I observed several surveillance cameras were outside of the bar and Officer Fritz went to check to footage. Officer Herrera transported Ricardo to Community Hospital to be medically cleared. Officer Herrera read Ricardo his Miranda Rights and Ricardo responded that he understood them. Upon my arrival at the hospital, I observed Ricardo was crying. He stated, "I fucked up." While waiting for Ricardo to be cleared, Sergeant Richens advised him of his Miranda Rights. Ricardo stated he understood his rights. Sergeant Richens asked Ricardo where he was drinking and he stated he did not know. Sergeant Richens asked him what he had been drinking and he stated he had been drinking whiskey. When asked how much whiskey, he stated "A lot". Sergeant Richens asked Ricardo if he was injured anywhere and Ricardo stated he had an and he had from that. Ricardo provided limited statements and his behavior would change from laughter to crying. Sergeant Richens digitally recorded the interview and he uploaded it to Mideo. I observed Ricardo appeared to have a small scrape to his forehead above his right eye brow. I did not see any other injuries to him. Once Ricardo was cleared to be booked, Officer Herrera and I transported him to booking. Once in booking, I advised Sergeant Solorzano #5565 and the jail Nurse that the carotid was applied on Ricardo and he went unconscious. Ricardo refused to blow into the intoxilyzer. While in booking, Ricardo's mood would change drastically and he would make statements on how he lost several friends in the war and then how he loved us. Ricardo was booked for public intoxication and resisting arrest. We transported Ricardo to the 6th floor and released him to the custody of jailers. I advised them of the use of force and the carotid had been applied. I then asked if there was any video of the incident outside the bar. I was escorted to the office by where the video was viewed. At 01:04 on the bar's security footage, it shows Parizal exiting the bar. He stood around the front door for a brief amount of time and at approximately 01:05, Parizal pushed one of the bouncers, . informed me that another officer took his statement of what happened when he was pushed. At 01:12:36, the video shows a black and white police vehicle pulls up in front of the bar. Just east of the front door and on the sidewalk, Officer Corbett attempts to take hold one of Parizal's arms but he quickly breaks away from Officer Corbett. Officer Corbett then contacts Parizal again by grabbing his right arm and as he does, Officer Herrera takes Parizal's left arm shortly after. They briefly go out of the camera's view but when they return, Parizal is taken to the ground with what appears to be minimal force. Once on the ground, the front door to the bar blocks the camera. When the door closes, what is able to be seen is officers on top of Parizal, but it is difficult to see what is being done because one of the bar's bouncers is standing immediately in front of the camera and is blocking the footage. The staff at did not have very much knowledge of how the video system worked. I was informed that no one on scene would be able to burn the footage to a DVD until morning when the manager arrived. Herrera #10047) assisted unit 2A10 (Officer T. Corbett #6062) on a pedestrian investigation call at 2nd Street and Granada Avenue (Call #0064). While on my way to Officer Corbett's location, he updated the call and asked for a unit to respond code-3 (red lights and siren). When I arrived on scene, I observed Officer Corbett in front of ( E. 2nd Street), and walking westbound towards a tall, muscular subject (later identified as suspect Ricardo). When I exited my patrol vehicle to contact Officer Corbett, I observed that he was talking to the suspect as the suspect was walking into to the bar. Because Officer Corbett was reaching for the suspect's left arm and appeared to be trying to prevent the suspect from entering the bar, I ran to his location to provide assistance. When I arrived at the east facing front doors of the bar, I observed Officer Corbett attempt to take control of the suspect's left arm in what appeared to be a twist lock. Immediately after Officer Corbett grabbed the suspect's left arm, I observed the suspect turn his body to the left and pull his arm away from Officer Corbett. After the suspect completed his turn, I attempted to take control of his right arm for a twist lock, but he pulled it away from me, causing me to let go and lose my balance. After I regained my balance, I attempted to take control of his right arm a second time, but he pulled it away from me and began turning to his left. Because the suspect was taller and significantly larger than Officer Corbett and me, was actively resisting our attempts to control him, and I feared that he was turning around to reach for a weapon to injure Officer Corbett or me, I jumped on his back and positioned my right arm around the front of his neck in an attempt to apply a carotid control hold. While I was on the suspect's back, he turned his body to the right in what felt like an attempt to throw me off of him. Immediately after he turned his body, I used my left hand to support my right arm and applied pressure to the suspect's carotid. When I began to apply pressure, the suspect fell to the ground and landed on his right side. When the suspect attempted to roll onto his back, I positioned my right leg around his stomach to support my body against his. After I positioned my right leg, I continued applying pressure to the suspect's carotid and he rolled onto his stomach. While he was on his stomach, he stopped moving and I felt his body relax. After his body relaxed, I leaned my head against his and heard snoring noises coming from his nose. Because I believed that the suspect was unconscious, I let go of my hold so we could safely handcuff him and provide medical aid. After I let go of my hold, I positioned myself on the suspect's left side because his left arm was pinned between his stomach and the ground. When I used both of my arms to lift the suspect's upper body, I took control of his left arm and positioned it behind his back. Report Officer 10047/HERRERA,ALVINO R JR Printed At 11/10/2020 06:29 Page 1 of 2 14-43081 Supplement No 0004 LONG BEACH POLICE DEPARTMENT Narrative While I had control of his left arm, Officer Corbett handcuffed his right wrist and because of the suspect's size, I used a pair of my handcuffs to handcuff his left wrist. After his left wrist was handcuffed, I connected my handcuffs to Officer Corbett's. After the suspect was secured, we positioned him on his right side and I checked his breathing and pulse. While I was checking the suspect, Officer Corbett requested that the Long Beach Fire Department respond and medically evaluate the suspect. While the fire personnel were on their way, the suspect woke up and assisting officers gave him orders to stay in his position. When Long Beach Fire Engine #14 and Long Beach Fire Department basic life support paramedic #8 arrived on scene, they medically evaluated the suspect.While the fire personnel were with the suspect, Officer Corbett notified unit 2S20 (Sergeant M. Richens #6056) of our use of force. After the fire personnel finished evaluating the suspect, I transported him to Long Beach Community Hospital to be further evaluated by the hospital staff. While I was transporting him, I read him his Miranda Rights (PD 1000.008) and when I asked him if he understood his rights, he answered, "Yes sir." When we arrived at the hospital, I escorted him into the emergency room and observed that his eyes were watery and red, his face was flushed and he could not maintain his balance. When I sat him down and began questioning him, I could smell a strong odor of an unknown alcoholic beverage emitting from his mouth. After he was checked and cleared by the medical staff, I transported him to 400 W. Broadway to be booked. When we arrived at 400 W. Broadway, Officer Corbett booked him and escorted him to the 6th floor men's jail (for further information, refer to his main report). It should be noted that as a result of the use of force, I felt a stinging pain and numbness in my left forearm and informed Sergeant Richens. Hansen #3319) Unit 2A10, Officer T. Corbett #6062, who had requested assistance at 2nd St/Granada Ave. When I arrived at the location, I observed Officer Corbett standing on the sidewalk on the south side of 2nd St, east of Granada Ave. I noted Officer Corbett was walking slowly towards a subject, later identified as defendant Parizal, who was facing Officer Corbett, but was walking backwards away from Officer Corbett. As I walked towards defendant Parizal, I noted he had both of his fists clenched and they were at his sides. I heard defendant Parizal state, "If that is what you want, then come on, let's do it." Officer Herrera #10047 then arrived and he walked towards Parizal. Officers Herrera and Corbett were then able to take the subject down onto the sidewalk where they rolled him onto his stomach. I heard Officer Corbett state, "Stop resisting" at least three times. I noted the defendant was attempting to roll away and was moving his legs and feet in kicking motions. I placed my feet on the defendant's legs to keep him from rolling away and from kicking. When the defendant stopped kicking, I knelt down and attempted to pull his left arm from underneath his body so that he could be handcuffed. The defendant had his left arm in a rigid and stiff position so that I was unable to pull his left arm out from under his body. I attempted to pry his left arm from under his body by using my police baton. I put the baton between his arm and body and tried to pry the arm out but was unsuccessful. I continued pulling on his left arm while Officer Herrera applied the carotid restraint to the defendant. I was finally able to pull his left arm out from under his body after the defendant lost consciousness as a result of the carotid restraint.
