USE OF FORCE
I, Officer P. Dougherty #5923, and my partner, Officer S. Holder #5489, were working as Special Events Unit
BT25 and Unit BT21, respectively. We were assigned to work the area of the peninsula on Ocean Boulevard and
the area of Bayshore Avenue and 54th Place.
It should be noted that both of these areas during the Fourth of July holiday are crowded with thousands of
people, and there are major problems with public intoxication and under age drinking. I was walking westbound on
the beach of the East Ocean Boulevard peninsula, which faces Alamitos Bay, when I noticed a lifeguard who was
speaking with a male White subject with long blond hair.The subject had no shirt on and was wearing a pair of
torn denim blue jeans.
I recognized this person from earlier in the afternoon, when he pulled his small boat onto the beach. Inside the
boat Cianciolo had a medium-sized Labrador Retriever-type dog. On the beach approach, he came very close to
hitting two small children and still had the prop spinning on the outboard motor, which was in the upmost tilt
position. A man who appeared to be the father of the children, had a brief dispute with the boater, but it was
resolved quickly, and I continued with my patrol.
When I contacted him with the City of Long Beach lifeguard present, I noticed immediately when I was

approximately five (5) feet away, that the man, later identified as Shane Cianciolo, exhibited the objective
symptoms of being intoxicated in a public place. He had a staggered gait, watery bloodshot eyes, and was heavily
slurring his speech. I approached closer to the subject and noted he had a heavy odor of alcohol on his breath. I
asked Cianciolo if he had been drinking, and he stated he had not been drinking at all. I also informed him that he
could not have an unleashed dog on the beach. I noticed Cianciolo's dog was running on the beach 20 feet away.
Cianciolo said he would get his dog, and he attempted to leave.
I told him to stay where he was, and I needed to get his name and information. Cianciolo said he would not stay,
and that I could not keep him there. I told him that he was being detained legally for suspicion of being intoxicated
in a public place and having an off-leash dog on the beach. Cianciolo walked away from me and into the water,
which was just a foot or two behind him. He stood in the waist-deep water and refused to come on to the beach.
After a short period of time, he came towards me, and I attempted to place him in a rear wrist-lock of his left wrist,
to handcuffing. I made this decision due to the fact that Cianciolo was being completely unreasonable, would not
give his name, would not comply with commands, and appeared to be heavily intoxicated.
When I began to place the wristlock on Cianciolo, he pulled away from me with his left arm, and wrapped his right
arm around my waist. Officer Holder gained control of the subject's right arm, while I tried to gain control of his left.
Cianciolo was clenching his fists and continuing to move us towards the water. I did not want to get into a use of
force or a physical altercation in the water, where my equipment to include my duty belt, gun, ammunition, and
ballistic vest would weigh me down and possibly cause me to be at a severe disadvantage.
There was no time to use the baton and the ECD (electronic control device) would not be a viable option in the
water. I had to use the carotid control to gain compliance from the subject. I placed the hold on the subject as he
was facing me and bent at the waist. I was able to get my right arm around his neck and apply the hold for a
period of a few seconds. I felt the subject lose muscle control and go unconscious. I realized that we were
standing in approximately six inches of water, and I made sure I kept his head above the water level so he would
not drown.
Officer Jenson #5882, assisted us in handcuffing the subject, and I rolled the individual on his side and checked
his pulse, which was steady and regular. We requested a paramedic. Several minutes later, Long Beach Fire
Department Rescue 8 arrived and treated Cianciolo. Sgt. T. Long #5630 arrived and took photos of myself,
Officer Holder, Officer Jenson, and Cianciolo.
Officer Holder and I then transported Cianciolo to Long Beach Community Hospital where he was treated by Dr.
and cleared for booking. Cianciolo maintained a very poor attitude while enroute to Booking and refused to
submit to a breath alcohol test. While we were in the booking area, I noted he had a small scrape on his left
elbow. He was booked as charged and released to the sixth floor men's jail without incident.

Narrative
While working unit Boat 5, Officer Lubchenko and I (G.Jensen #5882) responded to assist Units BT21 (Holder)
and BT25 (Dougherty) with an uncooperative subject, who was attempting to evade detention by entering the
water. Upon arrival from the water in front of the dispatch location, I saw Officer Holder and Officer Dougherty
speaking with ARRESTEE Cianciolo at the water's edge. As we approached the beach area, I began to look for a
safe landing location for Officer Lubchenko to moor the patrol boat.
As the patrol boat landed on the beach, I saw that Officer Holder and Officer Dougherty were attempting to detain
Cianciolo at the waters edge. I jumped from the patrol boat and handcuffed Cianciolo while he was kneeling in
approximately 6 inches of water, as Officer Holder and Officer Dougherty attempted to detain him, without further
incident.
Officer Lubchenko and I stored the vessel that Cianciolo used to transport himself to the location on the beach.

I, Officer Holder #5489, and my partner, Officer P. Dougherty #5923, were working a special events unit in the
area of Ocean Boulevard, along the boardwalk as Units BT21 and BT25, respectively.
As Officer Dougherty walked forward to detain the suspect, I walked forward toward the Suspect to grab his right
wrist in an attempt to secure a rear wrist lock. As Officer Dougherty grabbed the Suspect's left wrist, the suspect
tried to pull away and run. I grabbed the Suspect's right wrist, and he tried to pull away from me. I told him he
was under arrest and to stop resisting. He tried to pull away from both myself and Officer Dougherty, repeatedly.
As myself and Officer Dougherty were attempting to control the Suspect, we all fell partially into the water. I kept
repeating, "Stop resisting and put your hands behind your back."
The Suspect tried to straighten his right arm, and, again, I told him to stop resisting. The Suspect's right arm went
limp. I pulled the Suspect's right wrist behind his back in a rear wrist lock. Officer Jensen #5882 jumped off of
Boat 3 that was assisting. He handcuffed the Suspect. For further, see his follow-up supplemental report.
