On 7/11/14 at 2058 hours, I (Officer Smigla #10224) responded to assist Unit 2C16 (Officer Nguyen #10066)
regarding an auto theft in progress (Call #1492). Unit K5 (Officer Wooldridge #5331) and DE20 (Officer Cohen
#5540 and Officer Cole #6169) assisted.
Upon arrival, I observed a male White subject sitting in the driver's seat of a dark colored sport utility vehicle. The
driver's side window was down. Officer Nguyen gave the subject repeated verbal commands to "open the door
and step out of the vehicle with your hands up" over his patrol vehicle's P.A. system. The subject responded by
yelling, "Fuck you," and flipping his middle in our direction.
Officer Wooldridge responded to the scene, set up an Emergency Action Team, and directed me to gain
"hands-on" control of the subject, if needed. Officer Wooldridge gave the subject verbal commands to exit the
vehicle and after several attempts, the subject opened the driver's side door. He stepped out of the vehicle facing
us, but refused to comply with verbal commands to put his hands up. The subject flipped his middle fingers in our
direction again and turned his body back toward the vehicle.
Officer Cohen yelled, "Less lethal!" and deployed the 40mm less-lethal launcher once, striking the subject in the
right arm. The subject was given additional verbal commands; however, he still refused to comply. Officer Cohen
yelled, "Less lethal!" again and fired the launcher a second time, striking the subject in the back. The subject
moved towards the driver's side door of the vehicle and Officer Wooldridge initiated a K9 contact (for further see
Officer Wooldridge's report).
Officer Wooldridge directed me to go, "hands-on". Officer Cole took control of the subject's right arm. Officer
Wooldridge gained control of the subject's left arm and I grabbed the subject's legs to prevent him from kicking
officers. We moved the subject from a standing to a prone position to facilitate handcuffing. Officer Wooldridge
directed me to take control of the subject's left arm. I placed my left shin across the back of the subject's legs, took
control of his left hand, and held it until Officer Cole was able to place him in double-locked handcuffs.
The subject's left arm was bleeding from the K9 contact, and I applied pressure to the wound until Long Beach
Fire Department personnel arrived on scene and directed me to release him. No further force was used.

While working as unit DE20, Officer J. Cole (#6169) and I (Officer D. Cohen #5540) assisted several units who
were enroute to a call of a subject who was stealing a vehicle across from San Anseline Avenue.
The call advised that a male, White was sitting inside of a blue, Ford Explorer and was trying to start the vehicle.
The suspect had been sitting in the vehicle for about 10 minutes and appeared to be intoxicated. The calling party
identified himself as the step-father of the owner of the vehicle, and he did not recognize the suspect in the
vehicle.
We arrived onscene, and I saw that the suspect was sitting in the driver's seat of the vehicle. The driver's window
was down, and he was extending his left arm and hand out the window. From time to time, he would pull his arm
back into the vehicle and out of our sight.
I saw that the street was well-lit with street lights, along with several spotlights from the first two police cars to
arrive.
Unit DE2 (Sgt. B. Lee #5406) was onscene, and was giving verbal commands to the suspect by yelling and also
using a police car's PA, but the suspect was not complying. Sgt. Lee directed the suspect to exit the vehicle
several times, and aired on the radio that the suspect had "flipped them off" several times. I was standing behind
vehicles parked behind the vehicle that the suspect was inside (two parked-cars back), and was trying to see the
suspect's right arm and hand inside the car. I did not see the suspect "flipping them off," but could see his right
arm and hand up in the air inside of the vehicle. He continually dropped his arm and hand down and out of my
sight. I could see the suspect leaning his head out the window. It appeared he was yelling at the officers, but I
could not hear what he was saying.
Unit 2S27 (Sgt. H. Nieves #4020) arrived onscene and directed me to deploy his 40mm less-lethal launcher. I
deployed the launcher on the eastside of the street, to have a better vantage point of the suspect. I was standing
at the front end of the driver's side of the police car on the eastside of the middle of the street. I estimated that I
was at least 40 feet away from the suspect. Officer Cole was my lethal-cover officer.
It had been at least five (5) minutes since we arrived onscene, and I could still hear Sgt. Lee directing commands
to the suspect to exit the vehicle with his raised voice as well as over the PA system. The suspect was still
placing only his left arm and hand back and forth out the window and back inside the vehicle. I saw the suspect
"flip us off" with the middle finger of his left hand and pull his arm back inside the vehicle.

About this time, Unit K5 (Officer M. Wooldridge #5331) arrived onscene. He joined several of us (including Units
2C14, Officer B. Elliot #10027 and Unit 2C13. Officer J. Smigla #10224) at the front of the Police car. He set up
our EAT and directed Officer Cole to be his lethal cover. Officer S. Costa (Unit 2C70, DID# 6265) advised me that
he was now my lethal-cover officer.
Officer Wooldridge advised Sgt. Lee that he would be taking over directing the suspect with verbal commands. I
heard Officer Wooldridge yelling very loudly at the suspect to exit the vehicle with his hands up, but the suspect
still did not comply. Officer Wooldridge's K9 began to bark very loudly, and I could see that the suspect heard it
too.
The suspect began to put both arms out the driver's side window and was leaning out the window to look at us.
He still pulled his arms back and forth several times,before finally opening the driver's door. He then leaned
down and pushed it all the way open with his left hand. He sat in the driver's seat for a moment, then got out of
the vehicle with his hands half-raised up.
He appeared to be intoxicated, as I could see a glazed look on his face. He was moving slowly and deliberately,
as he tried to understand the directions from Officer Wooldridge. Instead of laying down on the ground as
directed, he spun in a circle and stood there. After a moment, he waved his hands at us dismissively and began
to turn away.
I knew he would violently resist our attempts to arrest him, and I did not want to allow him to get back into the
vehicle. I could see that he was intoxicated and would be a danger to others, if he drove away. I also considered
that we did not know if there was anyone else inside the vehicle (of their own free will, or otherwise), so I began to
launch a 40mm projectile at the suspect.
I heard someone direct me, "Forty millimeter!" (possibly Officer Wooldridge), as I said, "Stun bag" and fired my
first round at the suspect. I also heard Officer Costa repeat "Stun bag" very loudly. I was aiming at the suspect's
stomach, but he turned and I saw the projectile strike him on his left arm. The suspect stopped, and yelled,
"Ouch!" but still did not comply with the directions to get down on the ground from Officer Wooldridge. The
suspect seemed to be stunned for a moment, then started walking back toward the open door of the vehicle.
Seeing this, I fired a second round from the 40mm less-lethal launcher at him (as someone was yelling to me,
"Forty, again!" I yelled "Stun bag" prior to firing, and heard Officer Costa yell, "Less lethal!" I was targeting the
suspect's buttocks and upper-right leg, but I saw my projectile strike him near the middle of his back.
This second projectile seemed to have more effect,and the suspect leaned his back against the driver's side
fender of the vehicle. I noticed that the driver's door was closed, and that he was still not complying with Officer
Wooldridge's commands to prone himself out on the ground.Officer Wooldridge advised the suspect that if he did
not comply with his commands, he would send his K9. The suspect still did not comply, and Officer Wooldridge
deployed his K9.
The K9 ran towards the suspect and vehicle, and diverted to try to jump into the vehicle through the open driver's
window. The K9 did not get into the vehicle, but hung onto the window for a few seconds. I began to widely
approach the suspect in order to improve my angle, in case he decided to attack/hurt the K9. I stopped at about
20 feet away from the suspect, as Officer Wooldridge re-directed his K9 to engage the suspect.
The K9 engaged the suspect, contacting him on his upper-left arm. I approached the suspect with the rest of the
EAT (Officers Cole, Elliot, Smigla, and Costa) as directed by Officer Wooldridge. The officers grabbed the
suspect's arms and slowly lowered him to the ground for handcuffing, since the K9 was still engaged with the
suspect's arm. Officer Cole handcuffed the suspect, as Officer Wooldridge dis-engaged his K9 from the suspect.
I could see that the suspect was bleeding profusely from the wound on his arm. An officer requested Long Beach
Fire to respond and treat the suspect, and Officer Smigla administered first aid by applying direct pressure to the
suspect's wound until Fire arrived. The suspect was then transported to Long Beach Memorial Hospital (for
further, see original DR, filed by Unit 2C16, Officer M. Nguyen #10066).
I advised Sergeants Lee and Nieves that I had fired two 40mm projectiles at the suspect, and pointed out to them
where the rounds were later located along with my two spent casings (these were recovered by Officer Nguyen,

I paced off the distance of the two rounds I fired at the suspect and determined the distance to be approximately
57 feet.

While working Unit K5 in a marked black and white police car, I was requested by Unit DE2, Sergeant B. Lee
#5406, to respond to the area of 2178 San Anseline Avenue, in regards to a possible stolen vehicle with a suspect
inside refusing to get out. Sgt. B. Lee authorized me to drive "Code-3" ( lights and siren) due to the suspect not
complying with officers. It took me approximately six minutes to drive to the scene. During that time, Sgt. Lee
advised over the police radio that the suspect was not complying with orders to get out of the car.
As I arrived on San Anseline Avenue, I noticed that there were several police cars in the middle of the street,
facing southbound just south of Stearns Street. It appeared to me that a felony traffic stop was being conducted.
These police cars had their spot lights pointed at the suspect, which illuminated the interior of the vehicle. Unit
2C16 , Officer M. Nguyen #10066 was on a police car P.A. system trying to get the suspect to come out of the car.
I got my K-9 partner, Basco, out of the police car and went to where Officer Nguyen was standing. I saw the
suspect, a male White with a beard about 40 years old, sitting in the driver's seat of a dark blue or green Ford
SUV. The Ford was parked along the west side of San Anseline Avenue, directly across from San Anseline
Avenue. The suspect's left arm was out the driver's side open window, and he had his thumb up. I advised Sgt. B.
Lee of the possible use of my K-9 partner, Basco. I had an Emergency Action Team (E.A.T.) put together, which
consisted of the following officers: Unit DE20, Officer J. Cole #6169 and D. Cohen #5540; Unit 2C70, Officer S.
Costa #6265 and C. Kirk #10235; Unit 2C14, Officer B. Elliot #10027; and, Unit 2C13, Officer J. Smigla #10224.
Unit DE20 Officer D. Cohen and Unit 2C70 Officer S. Costa were both assigned 40mm less-lethal launchers.
Each of those officers had their lethal-cover officer. Officer J. Smigla was my lethal-cover officer. I assigned
Officer Smigla and Officer Cole to be the arrest team. I advised Sgt. Lee of our plan to take the suspect safely into
custody by continuing to use verbal commands. If the suspect came out, try to have the suspect go into prone
control, then the E.A.T. would approach the suspect and take him into custody. Sgt. Lee approved our tactical
plan. All of the officers on scene were advised of the tactical plan as well.
I took over giving the suspect verbal commands to exit the vehicle and to lay down on the ground at about 21:12
hours. I was approximately twenty-five (25) feet away from the vehicle the suspect was sitting in. I continued to
order the suspect to get out of the vehicle with his hands up and to walk towards the front of our police cars. My

K-9 partner was continually barking at the suspect inside the vehicle. The suspect refused to comply with my
orders. At one point, the suspect put up his middle finger and yelled "Fuck You!" I told the suspect if he did not
come out of the car I would use my K-9 partner to apprehend him from inside the car. The suspect had not been
searched and was inside a vehicle that he could drive away, endangering himself and the public. The suspect had
ample time and opportunity to surrender to officers, but chose not to.
After about two minutes, the suspect exited the vehicle. The suspect appeared to be intoxicated or under the
influence of something. He appeared to have a hard time understanding my commands to get on the ground. I
told the suspect to put his hands up over his head and to lay down on the ground. The suspect refused and stood
at the driver-side door area. I again told the suspect to put his hands up and to get down on the ground. This time,
the suspect turned back towards the driver's door. I believed the suspect was attempting to re-enter the vehicle
and drive away. Officer Cohen launched a 40mm baton round at the suspect and struck him. The baton round had
no effect on the suspect, so a second baton round was launched. This round also struck the suspect. For further,
see Officer Cohen's follow-up.
Seeing that the 40mm baton rounds had no effect on the suspect and he was still moving towards the drivers
door, I gave my K-9 partner the command to apprehend the suspect. My K-9 partner ran towards the suspect, but
at the last second my K-9 partner tried to jump into the driver-side window that was still down. The suspect was
leaning up against the left front fender of the vehicle and I redirected my K-9 partner to apprehend the suspect.
My partner made contact with the suspect on the left biceps area.
I had my E.A.T. moved towards the suspect to take him into custody. I took control of my K-9 partner and had
Officer Cole take the suspect's right arm. I held the suspects left wrist as Officer Smigla pulled his legs straight, so
we could help him to the ground. Once on the ground, Officer Smigla took control of the suspect's left arm and
assisted with handcuffing. I then gave my K-9 partner the command to release the contact. My partner was on the
contact for approximately 25 seconds. Once the suspect was handcuffed, I had Officer Smigla apply direct
pressure to the contact area to control the bleeding.
I requested Long Beach Fire to respond for further medical treatment. Engine 22 and Rescue 8 arrived and
started first aid. The suspect was transported to Memorial Hospital by Long Beach Fire Rescue 8 for medical
treatment. The suspect sustained to open wound to the left biceps area. One was on the top of his biceps, which
was about three inches long and three inches wide. There were smaller lacerations along the edges of the wound.
On the underside of the biceps there was an open wound about five inches long by about three inches long. The
top wound took thirteen staples to close and the bottom wound took twenty-four staples to close. The suspect
was treated by ER Doctor Evason.
Sgt. B. Lee was advised of the use of force along with Lt. Liberman #5438. I had the communications center
advise Unit SK9, Sgt. G. Brown #5638 regarding the K-9 contact. Sgt. Brown responded to the scene and
conducted his investigation. I had Unit 2C69 Officer Foerster #6088 take photos of the crime scene. Unit 2A11,
Officer D. Paul #10137 responded to Memorial Hospital and took photos of the suspect.
Internal Affairs Sergeant, J. Richardson #5663, responded to Memorial Hospital. Knock and Talks were
conducted, for further see follow-ups. No surveillance cameras were located or video identified.

Narrative
On July 11th, at approximately 20:52 hours, officers were dispatched to a report of a suspect, later identified as
attempting to steal a car, at San Anseline Avenue. The caller, who is the father of the registered car
owner, said the suspect had been in the car for about 10 minutes, trying to start the engine. For further regarding
the crime, see Officer Nguyen's report, DR #14-42130.
Once officers arrived onscene, was repeatedly given lawful commands to exit the car and surrender, but he
ignored them. Because he was inside a vehicle not complying with the officers' orders, K-9 Officer M.Woolridge
#5331 and his Police Service Dog, "Basco," were requested to assist. During the arrest, a police K-9 contact
occurred. For further regarding the arrest and K-9 contact, refer to Officer Wooldridge's report, DR
#14-42130.006.
Watch Commander Lt. J. Liberman was advised of the incident and K-9 contact. Due to injury, Internal
Affairs Sergeant J.Richardson was advised and later responded to the hospital.
Officer J. Foerster #6088 took photographs of the arrest scene, while Officer D. Paul #10137 later responded to
Memorial Medical Center and photographed after he had received medical treatment for his injury.
Knock-and-Talk interviews were conducted in the area of the arrest and no surveillance video or cameras were
located or identified.
Working as SK9, I responded to Memorial Medical Center, where had been transported to. While at
Memorial Medical Center, I advised of his Miranda Rights. I asked if he understood his rights, and he
said, "Yeah." I asked what happened, and he said after drinking a few beers, he was "chilling out in his car,"
which was parked "in a cul-de-sac." It should be noted San Anseline Avenue is not a cul-de-sac. When asked
where he was coming from, became evasive, and replied, "We'll just go with my friend lives on that street."
did not know the name of the street he was on or the street his "friend" lives on, whom he would not identify.
said he heard the police giving him verbal commands repeatedly to "get out of the car," and he saw the
police helicopter overhead. said he put his hands and arms outside of the window of the closed driver door,
but did not exit his body from the car. said he was sitting inside his car during the entire incident and did
not get out of the car the whole time, despite hearing the police tell him to. has no memory of how he got
