On 5/3/15 at 1540 hours, my partner (Officer A. Garcia #6074) and I (Officer J. Garces #10656) were working as
Unit 1B65. We assisted Unit 1B2 (Officer D. Ernest #1B2)on an assist fire call on corner of Santa Fe and Pacific
Coast Highway (call #1013).
While en route dispatch advised fire was on the southwest corner of Pacific Coast Highway and Santa Fe with a
male subject who was being combative. Fire requested units respond code three (with overhead red and blue
lights and siren activated). Dispatch then advised per Fire the units could respond regular code.
Upon arrival I observed Fire Engine #13, Rescue #13 & a Long Beach Transit Supervisor on scene. I spoke to
Fire Personal and they told me, Fire was called out by Long Beach Transit regarding a male White (later identified
as ), who was laying on the ground at the Long Beach Transit bus stop on the southwest corner of
Pacific Coast Highway and Santa Fe Avenue. He was laying on the floor at the bus bench possibly in violation of
640(D)(4)PC. The subject was being combative with Fire personal prior to Officer arrival. Fire Personal stated
they attempted to take vital signs and he told them, "Fuck you!"then mumbled unintelligible
words.then verbally began to threaten Fire Personal. That is when Fire Personal asked for a Police
Unit to respond with lights and sirens activated.
I observed sitting on the bus bench facing west. On my initial observation, I observed was
beads of sweat dripping off of head. I observed his hands where clenched. His fingers began to
move as if was unable to control them. I observed red drops of what appeared to be blood coming from
his right arm.appeared to be highly agitated. He appeared to be unaware of his surroundings. Based
on my training and experience, I know these to be the objective symptoms of a subject who is under the influence
of a controlled substance (in violation of 11550(A)HS). I believed if was left at the scene, he would was
a danger to himself and could end up running into the busy thoroughfare of Pacific Coast Highway or Santa Fe
Avenue. His highly agitated state lead me to believe he would be a danger to others.
I made contact with the I informed him that Fire Personal wanted to take his vital signs. He mumbled
unintelligible words. Upon speaking to him, I observed him to be disoriented and was not responsive to my
questions. During our conversation, his mood fluctuated from calm to highly aggited several times. This further
supported my suspicion that he was under the influence of a controlled substance. I made my decision that I was
going to arrest for being under the influence of a controlled substance. As he sat on the bus bench, I
asked him to stand up and place his hands behind his head and interlace his fingers in an attempt to search him
incident to arrest. He stood up and placed his hands behind his head but did not interlace his fingers. I asked him
for a second time to interlace his fingers behind his head. He passively resisted by not obeying my commands. I
grasped his fingers in an attempt to interlace them behind his head. He began actively resisting by tensing his
fingers and hands, attempting to slip out of my grip.
Officer Garcia grabbed his left arm and placed in a rear wrist lock. I grabbed his right arm and placed
him in a rear wrist lock behind his back so we could handcuff him. He then began to move side to side in an
attempt to break free from our rear wrist locks. He then broke free from Officer Garcia's rear wrist lock. He again
quickly moved side to side causing me to lose my rear wrist lock also.
then took approximately three steps forward and turned around with his hands clenched into fists.
When he turned around he directed his full attention on me as I was standing directly in front of him,
approximately two to three feet away from him. Officer Ernest was standing on left side approximately
two to three feet away from him. Officer Ernest warned him not to resist and comply with orders.took
a step forward as if he was going to attack me. Officer Ernest wrapped both of his arms around upper
shoulder area. This caused to lose his balance and fall onto his stomach on a grassy area just west of
the bus stop. Upon losing his balance,suffered a small abrasion to the front of his face near his nose.

was laying on his stomach and Officer Ernest upper body was on top of shoulder area.
While on the ground continued to struggle and resist Officer Ernest.was trying to get up and
away from Officer Ernest.began screaming saying, "Get off me!" While Officer Ernest and
were on the ground, I observed a silver knife near right side. At this point had his right hand
hidden under his stomach, near the knife. I grabbed the knife and threw it towards Fire Personal for safekeeping.
I grabbed right arm with my right hand and placed my left knee onto his back at his rib area to
prevent him from getting up. At this point, Officer Garcia used both of his hands to grab left hand and
place it behind his back so we could handcuff him. Officer Garcia placed the left handcuff on. In an attempt to
distract from actively resisting and get his right hand behind his back, I used the knuckle on my middle
finger on my left hand placed it onto his rib cage. I applied pressure to his left rib cage. This did not have any
effect on him. I pulled his hand out from under his stomach and we were able to place him into handcuffs.
Officer Garcia applied the hobble for further see his report.
Officer Ernest applied the carotid control hold, for further see his report.
was checked out by Fire Personnel and transported to St. Marys.
Officer Garcia informed attending Doctor at St. Mary's Hospital that the carotid was applied to
was in need of immidate medical care per Fire Personal. He released not booked at St. Marys hospital.
Unit 1S14 (Sgt. Alexander #5345) responded to the scene and was notified of being Released Not
Booked.

***Use of Force***
On 5-3-15 at approximately 1540 hours I (Officer D. Ernest #6082) was dispatched to Santa Fe Ave. and Pacific
Coast Hwy. regarding an assist fire call. The call stated the fire department was out on a combative patient and
requested police assistance. Call #1013.
Just prior to arriving I heard over the police radio that unit 1B65 (Officer's A. Garcia #6074 and J. Garces #10656)
had arrived on scene. Upon my arrival I observed LBFD Engine and Rescue 13 stopped in the southbound lanes
of Santa Fe. Ave. just south of Pacific Coast Hwy. Fire personnel were standing around a male White subject
who was seated on the bus bench adjacent to Jack in the Box ( Santa Fe Ave.).
As soon as I exited my vehicle I could hear the male White subject screaming and yelling. I was not able to make
out what he was saying; however it was loud, continuous and aggressive. I observed Officer Garces take hold of
the subject's hands, which were interlaced behind his head.
The subject was now screaming at the top of his lungs, not saying anything just screaming. In between the
screaming outbursts I could see the subject clench his teeth together while tensing his body up. Due to the
subject's violent, aggressive and erratic behavior along with not following simple commands it appeared he was
under the influence of a controlled substance and was not able to exercise care for his own safety or the safety of
others.
Officer Garces advised the subject multiple times to stand up in an attempt to conduct a weapons pat down of the
subject so fire personnel could safely render medical aide.
As the subject stood up, while still screaming and flexing his muscles, he ripped away from Officer Garces'
control. The subject placed his hands down towards his mid section, which had not been searched, and turned
towards Officer Garces. Believing the subject was going to launch an attack on Officer Garces, I placed the
subject in a Carotid Control Hold with my left arm and took him to the ground. The subject landed on a patch of
grass, face down and I landed off to his right side. Once on the ground I was able to maintain the Carotid Control

Hold. The subject continued to scream and yell and I could feel his body thrashing from side to side and his legs
kicking. In an effort to prevent any further assault on Officer's Garcia and Garces I applied the Carotid Control
Hold for approximately 15-20 seconds. As soon as I felt the subject stop resisting and yelling I loosened my hold
to the point I was no longer applying any pressure and advised Officer Garces to place handcuffs on the subject.
Once the handcuffs were on, I released my hold and noticed the subject had been rendered unconscious. I
immediately rolled the subject on to his right side and checked for the radial pulse on his left wrist. I felt the pulse
and advised fire personnel that the subject had been rendered unconscious. After approximately 5-7 seconds the
subject regained consciousness and immediately began thrashing his body from side to side and kicking his legs.
Officer Garces was controlling the subject's mid-section and Officer Garcia was controlling the subject's legs
while I controlled the subject's upper body. Officer Garcia placed a hobble restraint on the subject's legs.
Officer Garces completed searching the subject and then we placed him on his side on the stretcher. The
stretcher was then placed in the back of Rescue 13 where fire personnel continued rendering medical aid.
Rescue 13 transported the subject to St. Mary Medical Center where Emergency Room personnel treated him.
Sgt. R. Alexander #5345 was advised of the use of force and responded to the scene. Watch Commander Lt. A.
Assef #5036 was advised of the use of force.
It was later determined the subject would be released to St. Mary Medical Center and not booked. Sgt. Alexander
was advised of the RNB.

Narrative
My partner Officer Garces #10656 and I, Officer Garcia# 6074 were en-route to an Assist Long Beach Fire Call.
Call #1013.
The call stated Fire was on scene at the bus stop with a combative subject.
While on scene, my partner began to search the Male subject for an investigation of 11550(A)HS. The subject
was verbally expressing his intent not to comply. Officer Garces had the subjects right arm and I assisted by
grabbing the subjects left arm. I placed the left arm in a rear wrist lock behind his back. The subject seemed to
be already slightly standing from the bus bench when he violently turned and stood up.
The subject then turned back toward us with his hands clenched. Officer Ernest #6082 was able to take the
subject to the ground applying a Carotid Control Hold.
While the subject was on the ground, I was able to pull his left arm behind his back which Officer Garces was able
to handcuff. I took control of the handcuffed left arm while Officer Garces brought the subjects right arm behind
his back. I handcuffed the right arm.
While on the ground, the subject began to kick with both his legs. I placed my left knee on the subjects right ankle
and my right foot on his left ankle. I was in this position to immobilize both legs from kicking and it afforded me
balance to maintain control of his kicking legs.
I placed a hobble restraint onto the subjects legs. This subject was later transported to St. Mary's Hospital for
medical treatment. I requested for a field supervisor to respond. For further, see all supplemental reports.

On 5/3/15 at 1604 hours I Off. D. Alonzo # 6323 responded to the area of Pacific Coast Highway and Santa Fe
Ave to assist units on scene with an Assist the Fire Department call. Call # 1013.
Upon arrival I was tasked with interviewing the employees and customers of W. Anaheim St (
I contacted Witness who advised me of the following. He was inside of the restaurant working
when he observed the Long Beach Fire Department attempting to speak with a subject at the bus stop located just
east of the restaurant's entrance. stated that the subject then began to scream and yell at the Fire
Fighters. then observed police officers respond who attempted to speak with the subject. The subject
then attempted to run southbound on Santa Fe Ave to which an officer tackled him to the ground. I asked how the
officer tackled the subject to which he stated, "It was not really a tackle, he was already tipping over."
further stated that the subject was, "Resisting" while an officer was attempting to put a mask on his face. I asked
if he heard the officers or the subjects speaking to which he stated that he could not really hear through
the restaurant but could hear the subject screaming through the drive through widow. gave no further
detail and stated that he did not observe any further force used by any police officer.
I then contacted Witness who advised me of the following. She was working at the restaurant as the
shift leader. She observed the Fire Department personnel attempting to speak with a subject at the bus stop. The
subject was, "Flipping" the firemen. then went about her job and when she looked back outside she
observed three police officer attempting to handcuff the subject who was lying on the ground. stated that
the subject was, "Resisting" to which I asked her how so? stated that the subject was not letting the police
officers handcuff him and that he was kicking at them and moving flailing around. stated that she could
only hear the subject screaming through the drive through window. advised me that the subject comes into
the location often and that he is really aggressive.further stated that the subject was a, "Drugy or
alcoholic." gave no further detail and stated that she did not observe any further force by any police officer.
I asked if the business had surveillance cameras to which she stated nothing that points towards the bus
stop.
There were no other subjects inside of the location who observed the incident.

I assisted by taking photographs of the scene, the officers involved in the use of force and taking witness
statements. On scene I contacted Officer Ernest's ride along () and she told me the following.
stated that she and her ride along officer arrived at an assist fire call at the bus bench near Santa Fe Ave and
Pacific Coast Hwy. and noticed several firemen standing around a subject. got out of the police vehicle and
watched as officers approached the subject who was sitting on the bus bench. One of the officers (Officer J.
Garces #10656) approached the subject and had him place his hands on his head. Officer Garces grabbed ahold
of the subject and told him to stand up. As the subject stood up he "ripped" away from Officer Garces. At that
moment her ride along officer (Officer D. Ernest #6082) grabbed the subject and tackled him to the ground.
watched as the officers then handcuffed the subject. After the officers handcuffed the subject, the subject began
screaming and kicking in which she believed was an attempt to get away from the officers. The officers then tied
the subjects feet together. The officers then searched the subject and placed him on the gurney. The fire
department then placed the subject into the ambulance and drove him to the hospital. had no further
statements.
I then responded to St. Mary's hospital and contacted LBFD personnel who were on scene at the time the use of
force occurred. I contacted firefighter Martin Turner #71200 and he told me the following. Turner responded to a
call of an unconscious subject near the bus bench at Santa Fe Ave. and PCH who appeared to be in need of
medical attention. Once they arrived on scene Turner noticed the subject was awake and lying on the ground near
the bus bench. Turner and other firefighters got the subject off of the ground and seated him on the bus bench to
evaluate him. As they asked the subject simple questions such as his name and other personal information the
subject became belligerent and began cursing and "flipping"the firefighters off. LBFD personnel tried to calm the
subject down to evaluate him but the subject was still belligerent and uncooperative. Fire then requested police
assistance and waited for police to arrive. While they waited for police assistance they did not try further to asses
the subject fearing that he may physically harm them. A short time later police arrived and an officer went to
search the subject. The officer stood the subject up at which time the subject wrestled away from the officer. A
second officer then took the subject to the ground and later handcuffed him. LBFD then transported the subject to
St. Mary's hospital for medical evaluation. Turner had no further statements.
I then contacted firefighter John Hyun #71504 and he told me the following. Hyun and fellow LBFD personnel
arrived at Santa Fe Ave. and PCH to a medical call. As they arrived on scene Hyun noticed a subject lying on the
ground near the bus bench. As they tried talking to the subject he jumped up and became real agitated and began

cursing at fire personnel. Hyun noticed that the subject was clenching his fists as he yelled and cursed at
firefighters. Police assistance was requested due to the fact that the subject was uncooperative with fire personnel
and they feared that the subject may harm them. Officers arrived on scene and one of the officers had the subject
put his hands behind his head. the officer grabbed the subject and stood him up. As the subject stood up he tried
to pull away from the officer. As the subject pulled away from the officer, anther officer grabbed the subject and
took him to the ground. The subject was handcuffed and later transported by LBFD to St. Mary's hospital for
further medical evaluation. Hyun had no further statements.
I then contacted () and his supervisor trainee (I
first spoke with and he told me the following. was driving by the bus stop at Santa Fe Ave. and
PCH when he noticed a male subject on the ground near the bus bench with his head leaned up against the bus
bench. stopped his vehicle, got out to check on the subject. called out to the subject who moved
his head but wasn't really responsive. then called 911 believing that the subject was in need of medical
attention. stayed with the subject until LBFD arrived. As LBFD arrived the subject became uncooperative
with them, yelling and cursing at them. LBFD then called for police assistance. Police arrived and tried to question
the subject who became uncooperative with police. One of the police officers had the subject place his hands
behind his head and had him stand up. As the subject stood up he pulled away from the officer and turned
towards and faced the officer. As the subject faced the officer another officer grabbed the subject and took him to
the ground. Once the subject was on the ground officers handcuffed him. stated that the subject, while on
the ground was kicking towards the officers and still being uncooperative. had no further statements.
I then contacted who told me the following.and her training officer ( were driving

Narrative
While on duty working unit TC4, I Officer K. Cruz #5502 heard over the Long Beach Transit Radio a call for
medical assistance at Pacific Coast Highway at Santa Fe. I was later notified that Long Beach Fire Department
arrived and called for Police assistance.
Upon my arrival, I was asked to interview witnesses of the detention. I contacted Long Beach Fire Department
Captain Sell #70836 who told me that he received a call for a man down at PCH and Santa Fe at the bus bench.
He told me that as they arrived on scene he contacted the subject that was lying on the ground face down and
unresponsive. He told me that he attempted to wake him up and he became agitated. He told me the subject
began telling them, "Fuck you" and waving his hands at him as if he was going to hit him in the face. He told me
that he created some distance between the subject and himself and called for police assistance. He told me the
other fireman kept their distance from the subject until the police arrived. He then explained to me the officers
arrived and officer Garces who he described attempted to pat down the subject who was then seated at the bus
bench. He further explained the subject was asked to stand for the pat down. The subject began to resist as he
stood up and pulled away from officer Garces. He described the subject then coming in an aggressive manner at
Officer Ernest #6082 who he described as the bald officer. He explained Officer Ernest tackled the subject and
then the subject was handcuffed and placed on the gurney. As the subject was on the gurney he began to spit so
they placed a mask on his face. He told me the subject was what they call ALOC (Altered Level of
Consciousness). He described the subject as ALOC because the subject appeared to be under the influence of
Drugs or Alcohol. The subject was then transported to St. Mary's Medical Center and released to the medical
staff.
I spoke to Long Beach Ambulance Operator Alex Morton who told me that he received a call for a man down at
Pacific Coast highway and Santa Fe. He told me he pulled up to the location and the subject was lying on the
ground face down. He said he was not sure if the subject was unconscious or sleeping. He told me they attempted
to wake him up and he became agitated and threatened the Captain. He told me they all backed off and Captain
Sells called for police assistance. He explained that the subject then was flipping the Captain off and putting his
hand in his face. He told me the officers arrived and Officer Garces #10656 attempted to pat down the subject and
he pulled away and lunged at another officer. He told me that subject was taken to the ground by officer Ernest
#6082 and handcuffed. He told me the subject was then placed on the gurney and placed in the ambulance. The
subject began spitting and a mask was placed on his face. He told me the subject was transported to St. Mary's
and released to the medical staff.
I spoke to Fireman Spander Fieze who told me he received a call for a man down at Pacific Coast Highway and
Santa Fe. He told me they arrived and tried to wake the subject up who was laying face down. When he woke up
he became aggressive and was pointing his finger in the Captains face and almost hitting him. He told me that the
Captain called for police assistance and they stepped back to give the subject room. He explained the police

face". Spander told me it did not make sense but was clearly a threat to the officers. He then turned toward the
officer aggressively and looked as if he was going to fight with the officer. He explained another officer tackled the
subject to the ground and the subject was handcuffed and placed in on the gurney. He said the subject was
spitting so they placed a mask on his face. The subject was then transported to St. Mary's and released.
I spoke to Long Beach Fireman Jason Bowers #70818 who told me that he received a call for a man down at
Pacific Coast Highway and Santa Fe. He told me as they contacted the subject who was face down they woke
him up and he became agitated and aggressive. He said the subject put his finger in the Fire Captains face and
acted like he was going to hit the Fire Captain. He explained the subject was so agitated and threatening the Fire
Captain called for police assistance and they backed off until the police arrived. He told me the subject was sitting
at the bus bench and an officer was attempting to get the subject to stand and be patted down when he turned
and acted like the was going to fight with the officer. He told me another Officer took the subject to the ground and
handcuffed him. He told me the officers assisted them by placing him on the gurney where he checked the vitals
and a mask was placed on the subject because he was spitting. The subject was transported to St. Mary's
Medical Center for treatment and released to the medical staff.
