My partner State Parole Agent Kashifalghita #4527 and I Officer A. Fox #6186 are currently assigned to the North
Long Beach Directed Enforcement Team. Call #1727.
While in the area of Long Beach Blvd. (Luxury Inn)I contacted the on duty employee who allowed me
access to check the registry.
I conducted a records check on Jose Castro (who was registered to room # and discovered him to be on
PRCS/AB109 probation. I also discovered ARR Castro to have an outstanding felony warrant for his arrest for a

probation violation.
I contacted the on duty Probation Officer, Officer Ornelas, who stated the warrant was valid and that ARR Castro
does have search conditions.
I obtained a key from the front desk employee to room and we walked up the stairs of the south building to
the third floor where we knocked on room .
I knocked on the door and announced our presence, there was still no response at the door. I used the keycard
obtained from the on duty employee and opened the door. When the door opened I observed a Female Hispanic
laying on the bed with her young child. I asked her where ARR Castro was and she stated he had gone to get
food. I then explained we were there to conduct a probation compliance check on ARR Castro and began to look
around the room as there were several luggage type bags in the room.
While searching the room there was a knock at the door and the door swung open. Agent Kashifalghita contacted
the Male Hispanic and had him sit in the chair while we attempted to identify him (to determine if he was ARR
Castro). I then looked outside to see if any other persons were coming to the room and I observed a Male
Hispanic getting on the elevator on the first floor.
I walked over by the elevator and waited for the doors to open and the Male Hispanic to exit. I then asked him his
name believing he was in fact ARR Castro and he replied "Tony." I know that ARR Castro uses the name Tony
(his middle name is Antonio) based of the probation screen showing an AKA of Tony. ARR Castro had his arms
full with groceries and had a single arm backpack, with an angled strap that goes over his head and across his
body. ARR Castro had the backpack in front of him so the pockets were over his chest and easily accessible. I
then asked ARR Castro which room was his and he pointed to room and stated it is one of these.
Based on the physical description and ARR Castro using the name "Tony" I believed he was actually ARR Castro.
I removed a wallet from ARR Castro's left rear pants pocket and observed a California identification verifying his
identity as ARR Castro.
We walked into room were I instructed ARR Castro to set the groceries down. ARR Castro just stood there
as we were just past the hallway leading to the door an bathroom. Agent Kashifalghita began removing the
groceries from his hands and set them down. After the last bag was removed, I ordered ARR Castro to interlace
his fingers behind his head. Just as ARR Castro did this I removed the backpack (over ARR Castro's head) and
handed it to Agent Kashifalghita.
As I handed the backpack to Agent Kashifalghita, he observed a small zipper that was open and observed a small
firearm. Due to the fact that I had to remove the backpack over his head, I had not regained control of his hands
and it appeared that ARR Castro was watching Agent Kashifalghita and when Agent Kashifalghita immediately
advised me that he observed a gun. ARR Castro then turned toward the door and attempted to push past me and
head for the door. ARR Castro's right side was nearest to me and as he was attempting to push past me, I put my
arms around his mid section causing us to both slam into the wall. I then swung ARR Castro back toward Agent
Kashifalghita who deployed his Electronic Controlled Device (ECD) striking ARR Castro in his stomach. ARR
Castro fell forward, landing on the floor where I ordered him to place his hands behind his back. ARR Castro
complied and I placed him in handcuffs.
I was then assisted by North Division Directed Enforcement Sgt R. Bernsen #5925 who responded to the scene.
I recovered the backpack again and discovered the following items inside:
1) 4 different size bags containing suspected methamphetamine.
2) an operational digital scale
3) zipper pouch holding items 1 and 2 (items 1 through 3 were located in the front pocket of the backpack)
4) .25 caliber Beretta ( serial ) in an open (unzipped) front pocket above the pocket that contained the
suspected methamphetamine. The firearm was loaded with one round in the chamber and additional rounds in the
magazine. The firearm also had the hammer cocked back and the safety was off.
5) Colt .38 Detective special (serial ) unloaded recovered from the large backpack pocket
6) brown zippered gun case containing item #5
7) blue US bank zippered money pouch in the pocket with item #5

I requested Long Beach Fire Department who responded and transported ARR Castro to Long Beach Memorial
where he was treated by DR. and was diagnosed with a broken nose. ARR Castro was admitted to the
Hospital and remained in Police custody while awaiting clearance for booking.
It should be noted that during the confrontation with ARR Castro my left index finger was injured. My finger was
bleeding from the bottom of the fingernail, was quickly swelling and bruised and was possibly broken. While at
Long Beach Memorial it was cleaned an wrapped.
I contacted Narcotics Detective A. Decarvalo #5364 who stated he believed the suspected methamphetamine was
possessed for the purpose of sales.
ARR Castro is self admitted member of the criminal street gang North Side Longo with the moniker "Chavillo"
ARR Castro has NSL tattooed on his left arm.

On 5/12/15 at 2148 hours I (Sergeant R. Bernsen #5925) working unit DE3, was advised of a Use Of Force by
Officer Fox at the Luxury Inn, Long Beach Blvd. Room (Call 1727).
When I arrived at the location I went to room and found Officer Fox #6186 and his partner, California State
Parole Agent M. Kashifalghita #4527 standing over the suspect who was prone on the floor. I could see that
Agent Kashifalghita was holding an Electronic Control Device and the wires were leading to the suspect. Long
Beach Fire Department was summoned and responded to the scene to treat the suspect. He was transported to
Memorial Hospital for treatment.
I contacted Officer Fox and asked him what happened. He told me that he and Agent Kashifalghita went to the
room looking for Jose Castro, a no-bail warrant suspect who was on PRCS. When the got to the room they found
a female and a baby, identified as and her son . The suspect was
not in the room. They advised that they were there to do a PRCS compliance check on Jose Castro. During the
investigation another male came to the room. He was identified as .
Officer Fox said that he looked outside and noticed a male Hispanic he believed to be Jose Castro getting on the
elevator. Officer Fox waited around the corner from the elevator and contacted the suspect when he exited the
elevator. The suspect identified himself as Tony as he walked toward room with his hands full of groceries.
Officer Fox determined that Tony was in fact Jose Castro. Once inside the room Officer Fox and Agent
Kashifalghita began to take the groceries from Castro and put them down. Officer Fox removed a single strap
backpack that was hanging to the front of Castro and handed it to Agent Kashifalghita. Agent Kashifalghita
immediately told Officer Fox "417", meaning gun. At that moment Jose Castro suddenly turned and tried to run
past Officer Fox, throwing him backwards. Officer Fox struggled with Castro and Agent Kashifalghita
administered the ECD. Castro fell to the floor and was handcuffed. Officer Fox told me that he injured his left
index finger during the incident. I could see that the nail bed was bloody and swollen. For further on Officer Fox's
actions see his report.
I spoke to Agent Kashifalghita and asked him what happened. Agent Kashifalghita told me that they were at the
room looking for Jose Castro. He said that during the investigation Castro walked into the room carrying groceries
with Officer Fox following behind him. Agent Kashifalghita said that Castro had a single sling backpack over his
shoulder, hanging to the front. He could see that the top of the bag was unzipped. Agent Kashifalghita began
taking the groceries from Castro's hands as Officer Fox took the backpack from over Castro's head. Officer Fox
handed Agent Kashifalghita the backpack. Agent Kashifalghita said that he immediately put his hand in the
backpack and felt the handle of a gun. He said that in a split second, Castro turned and lunged at Officer Fox with
his right elbow. Agent Kashifalghita said that Officer Fox grabbed Castro but the momentum that Castro had,
pushed Officer Fox backwards into the door of the motel room.
Agent Kashifalghita said that he was concerned because was in the room in close proximity to
both he and Officer Fox and he believed may try to interfere. There was still a gun in the backpack that
was not secured. Agent Kashifalghita felt that Castro was acting as if he had nothing to lose and that if not
controlled immediately Castro and may try and overpower both of them. Agent Kashifalghita said that he
placed himself between and Castro and deployed his Electronic Control Device (Serial #X3000105M

Cartridge # C6200HWNR) from approximately two feet towards Castro's abdomen. Agent Kashifalghita said that
he stepped back as his ECD cycled for five seconds and Castro fell forward to the floor. Once on the ground
Castro's hands were to his sides and Officer Fox was able to handcuff.
Agent Kashifalghita said that he immediately directed his attention to who was still standing close by.
Agent Kashifalghita pointed the ECD at and ordered him to his knees. During the entire incident
sat on the bed with the child she has with Jose Castro.
I spoke to and asked her what happened today. She told me that she was asleep when the
police came to the room looking for Jose Antonio Castro, the father of her infant child. She said that they were
searching the room when came inside. She said that moments later one officer went out of the
room and then walked back into the room with Jose Castro. She said that she was sitting on the bed trying to
keep the baby occupied. She said she did not know what Jose was doing, but he was acting like a "Jackass" and
tried to run. She said that the officers yelled at him "Get on the ground, Stop! get on the ground."said
that the officer was wrestling with Castro when the other officer tased him. I asked her if the Officers did anything
else to Castro and she said they did not. She kept saying that she did not know why Castro was acting like that.
I asked her if she knew that he was carrying a handgun and a large quantity of Methamphetamine and she said
that she had no idea.said that she was at the room so that Castro could see his son. She said she
did not stay there and was going to go home.
I spoke to and asked him what happened tonight. told me that he knows
but really does not know Jose Castro. He said that he was giving rides today to help her
out. said that he came over to the room tonight and walked inside. He did not know the police were in the
room. said that the police had him sit on the ground and moments later Castro came in the room. He
said that Castro made a quick move and tried to get out of the room. said that the officer tackled Castro
and the other tased him and he went to the ground. He said that nothing else happened and that he was
surprised that the officers did not shoot Castro. said that the Officers did nothing wrong and that they
were just doing their jobs.
showed me tattoos on his abdomen that said " ". I asked what gang he was from and he told me
and that his moniker is " ."
I directed Officer G. Nogueira #5868, to take pictures of the room, the suspect, and Officer Fox. I also directed
him to do knock and talks of the surrounding motel rooms. Officer Nogueira found that room was vacant,
and rooms and had no answer.
The incident occurred entirely in room with no view from the outside or any exterior cameras at the motel.
There was no video of the incident.
I responded to Memorial Hospital where Jose Castro was being treated by Doctor in the Trauma room.
Doctor said that Castro had suffered a broken nose. Castro was not responding to hospital staff and
they told me he would be admitted for observation.
I attempted to get a statement from Jose Castro in the emergency room. Castro was in bed 20 of the emergency
room and appeared to be asleep. I tapped him on the shoulder and told him who I was and that I wanted to talk to
him about what happened to him tonight. I was unable to get him to respond or acknowledge that I was in the
room. I digitally recorded the attempt and later placed it into Mideo.

Narrative
I (Officer J. Boshnack #10121) am currently assigned to the North Division Directed Enforcement Team. My team
and I have been tasked with impacting violent crimes committed by criminal street gang members on the north
side of Long Beach.
Training and Experience:
I have been a police officer for approximately eight years. I have an Advanced Police Officers and Standards and
Training (P.O.S.T.) Certificate and a Bachelor's Degree in Criminal Justice from California State University, Long
Beach. My training related to gang activity consists of gang investigations at the Long Beach Police Academy,
Detective School, a nine week Gang Investigators School, numerous gang classes, and gang specific
conferences.
My experience consists of having investigated gang related criminal activity and worked in conjunction with State
and Federal law enforcement agencies throughout the Los Angeles County area. I previously been special
detailed to the Long Beach Police Department Homicide unit to investigate gang related shootings and homicides.
I have been assigned to target gang activity working with the North Division Directed Enforcement Team and the
Long Beach Police Department Gang and Violent Crimes Division.
In addition, I have contacted numerous gang members, conducted field interviews with gang members, arrested
numerous gang members, and filed victim/witness statements from hundreds of gang related crimes. These
crimes include narcotics activity, vandalisms,illegal weapons possession, gang involved shootings, and
homicides. I have written and served numerous gang related search warrants and have testified as a court gang
expert.
Specifically related to this supplemental report, I have arrested, contacted, investigated crimes related to, and
interviewed North Side Longo 13 gang members in the Long Beach.
Statement of Purpose:
The purpose of this supplemental report is to provide documentation of Defendant Jose Antonio Castro as a North
Side Longo 13 gang member, and to provide an expert opinion as to a S.T.E.P. Act (186.22 PC) allegation.

Narrative
The North Side Longo gang was originally formed in the mid to late 1970's and has become a generational gang.
The North Side Longo criminal street gang is a primarily Hispanic street gang with approximately 200 members.
The North Side Longo gang members consider themselves SURENO gang members, who answer to the Mexican
Mafia criminal organization. The North Side Longo territory is primarily the northern portion of Long Beach. The
primary activities of North Side Longo gang member include armed robbery, auto theft, illegal weapons
possession, battery, narcotics sales, gang involved shootings, and murder.
These crimes were committed with the specific intent to promote and further the North Side Longo gang
reputation. These illicit and violent criminal acts have earned North Side Longo a feared reputation that affords
them an umbrella under which they can operate without the likelihood that their victims will resist protest, fight
back, or even cooperate with law enforcement.
I have arrested, contacted, investigated crimes related to, and interviewed numerous self-admitted North Side
Longo Gang members in the Long Beach area. The North Side Longo gang uses the letters "NSL" to identify
themselves. Some of the North Side Longo attire includes, but is not limited to; the colors blue, red, black and
white, clothing and jewelry brands depicting the letter "L". The Oakland Raiders logo, the Lakers "L" logo, and a
hand sign depicting the letter "L" with an individual's index finger and thumb. .
Documentation of Defendant Jose "Chavillo"Castro:
I reviewed the facts surrounding the arrest of Jose Castro.
I know Castro is an active member of the North Side Longo criminal street gang. I believe this based on the
following facts:
Castro has the following tattoos indicative of the North Side Longo Sureno 13 gang: "NSL" (North Side Longo) on
his left arm and "HA" (Harbor Area) on his right shoulder.
Officer Fox contacted the Post Community Supervised Release (PRCS) office and they informed him that Castro
is a self-admitted North Side Longo gang member who goes by the moniker "Chavillo".
On 02/19/14 Long Beach Police Officers Banuelos and Manu contacted Castro in north Long Beach and
conducted a field interview. During the field interview, Castro informed them he was a North Side Longo gang
member.
Gang Enhancement 186.22(b)(1)PC:
Based on all of the above facts I believe Castro to be an active North Side Longo gang member. I believe Castro
committed the crime of 29800(a)(1) PC: Felon in Possession of a Firearm, for the benefit of the gang.
I know based on my training and experience that gang members will commit the crime of carrying a concealed
firearm in order to enhance their gang's feared reputation to peaceful citizens and to intimidate and engage rival
gang members. These crimes are committed in order to instill fear within the community, which directly benefits
the criminal street gang by intimidating the public, who will refuse to report the gang's criminal activities to law
enforcement in fear of serious repercussions.
Notes:
It should be noted that the crime of possession of firearm is listed as a Gang Enhancement Predicate crime under
the California Penal Code Section 186.22 PC. I believe the above defendant has demonstrated a blatant defiance
and disrespect toward the laws, which sanction this society. The defendant continues to engage in gang activity,
gang affiliation, and the criminal acts associated with the North Side Longo 13 criminal street gang.
All citizens are entitled to be secure and protected from fear, intimidation, and or physical harm caused by the
criminal activities of violent criminal street gangs and individual gang members. The Long Beach Police
Department Gangs and Violent Crimes Details are proactively attempting to eradicate the criminal activity
committed by street gangs by focusing upon the patterns of the gang's criminal activity and the organized nature
and structure of the street gang which together, is believed to be the primary source of terror created by street
gangs.
