************USE OF FORCE************
On 2/12/15 at approximately 1511 hours, I (Officer C. Brammer #10014) was working uniformed patrol, as Unit
DE13, when I was dispatched to an assist fire call at Long Beach Boulevard (call #1087).
I was driving a unmarked, gray colored crown victoria affixed with forward facing red light, and siren. I was
wearing a Long Beach Police Department "Class B" uniform affixed with "Long Beach Police" patches on each
shoulder and a badge over the left side of my chest. This uniform clearly depicts me as a police officer.
Unit FT1 (Officer A. Lawrence #5243) and 1B61 (Officer A. Castellanos #5705) assisted on the call.
The call indicated the Long Beach Fire Department was advised of a subject who was screaming and spitting
inside of the business, Pancho Villas ( Long Beach Boulevard). The subject was described as a male that
was approximately 32 years old. No further description was given in the call.
I arrived on scene and observed Long Beach Fire Department Engine 13 parked along the east curb of Long
Beach Boulevard just north of Hill Street. I pulled into the strip mall parking lot of Long Beach Boulevard and
observed the business, Pancho Villas, on the southeast corner of the strip mall. I walked into the business and

did not notice in Long Beach Fire Fighters in the establishment. I asked a female Hispanic who appeared to be an
employee (later identified as ) if everything was ok and if she needed police assistance.
pointed to the far northeast wall inside of the business and stated, "He was spitting and causing
problems...he is sleeping now." requested me to have the subject leave the business. I looked to the
northeast corner and observed a male White subject (later identified as Donovan Clyde) laying across two chairs.
Two of the chairs were on the west side of the table and two on the east side of the table. Clyde appeared to be
asleep. I walked over to Clyde to see if he was breathing and noticed his chest was rising and falling. Clyde was
wearing a baggy sweatshirt and shirt that concealed his waistband. Believing that Clyde could be possibly armed,
I lifted his sweatshirt and shirt to view Clyde's waistband. I conducted a brief pat down search on Clyde's baggy
shorts as he was sleeping for any weapons. I observed a small box that resembled a laundry detergent fabric
softener on the table Clyde was sitting next to. The box appeared to contained miscellaneous items. I checked
the box for any weapons that could be concealed within the box. The box was void of any weapons.
I placed my left hand on Clyde's right shoulder and attempted to wake him up. Clyde immediately awoke and
jumped backwards into the sitting position in the chair from his laying position he was previously in. Clyde's eyes
were wide open and he was staring at me. Clyde had dilated pupils but I did not smell an odor of an alcoholic
beverage emitting from him. Clyde stated in a loud voice, "Did I win?" I did not know what Clyde was talking
about but was aware of a California Lottery Powerball drawing from the previous night worth 500 million dollars. I
asked Clyde to stand up and walk outside. Clyde complied with my orders and stood up. Clyde had an
off-balance gait and had trouble maintaining his balance.
Based on my observations of Clyde as well as the observations that advised me of, I believed that Clyde
was possibly under the influence of a controlled substance or other substance.
Clyde walked west through the business and stopped approximately twelve feet away from the entrance to the
business. I got directly behind Clyde and guided him toward the entrance by placing both of my hands on each
shoulder. I told Clyde to exit the store and that everything was going to be ok.
As I spoke to Clyde, I observed a marked black and white Long Beach police vehicle park just south of the Fire
Engine along Long Beach Boulevard. I continued to council Clyde and escort him towards the outside of the
business. As we came within six feet of the door, I observed Clyde make a closed fist with his left hand.
Believing that Clyde was possibly going to fight, I moved along the left arm of Clyde to attempt to place him in a
control hold, wrist lock. As I grabbed Clyde's left wrist, he tightened his left fist and started to turn around. I could
not see Clyde's right arm as he turned around. I believed that Clyde was going to fight with me due to his actions.
I observed Officer Lawrence walking east towards my direction through the parking lot of Long Beach
Boulevard.
I was attempting to detain Clyde for a lawful investigation. Clyde was becoming increasingly resistive as well as
combative. Clyde continued to not comply to my lawful orders. I believed that if I did not gain control of Clyde that
he could hurt myself, other officers, or the public.
I grabbed Clyde by the shoulders and pushed him into the front door that was propped open (inwards) to the
business. My plan was to hold Clyde against the door until Officer Lawrence was able to assist in placing Clyde
into handcuffs (for further investigation). Clyde placed both of his hands against the door and pushed off of the
door. This motion propelled Clyde's body back towards me. I grabbed Clyde's upper torso of clothing and pulled
him with his momentum around the right side of my body as well as placing my right leg in front of Clyde to effect
a takedown. I tripped Clyde with my right leg and he fell to the ground. I told Clyde to lay on the ground and stop
resisting. Clyde started to grab at me with both of his hands as he was in the seated position on the floor and not
comply with my orders.
Due to the close proximity of Clyde and him being under the influence of a controlled substance or substance, I
did not believe my sap would be a good tool to gain compliance. I believed that using a sap could aggravate
Clyde further and/or he might not feel pain due to him being under the influence of a controlled substance or
substance. Also, I believed that my electronic control device (ECD) would not be effective because of the close
proximity and Clyde actively resisting. I did not believe I could create the neuro-muscular incapacitation (NMI)
with the ECD to gain control of Clyde.

I believed the carotid restraint hold was the best control use I could apply to Clyde to gain compliance. I encircled
the neck of Clyde and applied pressure by squeezing inward with my biceps and forearm. Clyde did not appear to
feel the effects of the hold and I applied more pressure by pushing the side of my forearm inward by flexing my
wrist. As I was placing Clyde into carotid control hold, Officer Lawrence arrived in the business. Officer Lawrence
and I made a plan to handcuff Clyde as soon as I released the carotid hold. Clyde appeared to lose
consciousness and I immediately released the carotid hold.Officer Lawrence and I rolled Clyde onto his stomach.
Officer Lawrence handcuffed the right wrist of Clyde and I assisted in handcuffing his left wrist.
I checked Clyde's vital signs and breathing. Clyde had strong vitals and was breathing normally. Moments later,
Clyde regained consciousness and started to kick his legs as well as contort his body in an up and down motion.
Clyde was continuing to kick his feet and I believed that he was a danger to himself or others. I told Clyde to stop
resisting and not to kick his feet. Clyde stopped kicking and I applied the hobble restraint to both of his legs.
I aired for additional police unit and sergeant to respond. Dispatch aired that fire would be notified that it was clear
to enter. Long Beach Fire Department entered the business and provided medical aid to Clyde.
It should be noted that during the incident, my sunglasses fell onto the ground, and Clyde fell on top of them
causing them to break.
Sergeant Solomita (#5704) responded to the scene and I advised him of the use of force.
Clyde was transported to Community Hospital to be cleared for booking.
Clyde was identified on Parole and had an outstanding warrant for his arrest. Later, Officer Vong contacted
Officer Edin #0101 and he advised the parole warrant is no longer valid. However, parole placed a parole hold on
Clyde.
While at Long Beach Community Hospital, I read Clyde his Miranda Rights (per PD Form 1000.008) and he
responded, "Yes" to the first statement and told me the following:
Clyde has been using methamphetamine and heroin since he was 18 years old. Clyde will use methamphetamine
how ever he can but prefers to snort it. Clyde indicated that he used heroin approximately three hours ago.
Clyde did not remember the incident when I contacted him. Clyde indicated that he was acting the way he was
due to his narcotic use. I advised Clyde that he had a parole warrant for his arrest. Clyde indicated that he did
not know he had a warrant. I started to ask Clyde additional questions regarding booking and he started to fall
asleep from time to time.
Sergeant Solomita was unable to interview Clyde due to him falling asleep constantly.
Unit 1C67 (Officer E. Olmos #10574 and Officer G. Payan #10557) responded to the scene and hospital to take
photographs.
Clyde was cleared to be booked and Unit DE14 (Officer H. Vong #10124 and Officer R. Solorio #6297)
transported Clyde to 400 W. Broadway. Jail staff was notified of the carotid restraint hold. Clyde was booked as
charged and released into the custody of the sixth floor men's jail without incident.

Narrative
On 2/12/15, I was instructed to place this report into RMS for Officer Lawrence.
I (A. Lawrence #5243) was in the area of the Poncho Villa restaurant at Long Beach Blvd, when I heard
Officer Brammer arrive on a unruly customer who was yelling and spitting inside.
As I exited my vehicle I could see Officer Brammer trying to walk a male white suspect out of the restaurant. The
suspect appeared rather animated and looked to be in an altered state from either drugs, alcohol, or mental
illness. Before Officer Brammer could get the suspect out of the front door the suspect appeared to aggressively
turn on Officer Brammer in an attempt to attack him. Officer Brammer's quick reflexes prevented the suspect from
injuring him by taking the suspect to the ground. I ran to assist Officer Brammer and could see that he was able to
spin the aggressive and combative suspect around and place him in a carotid control hold.
Once in the restaurant I took hold of the suspects right arm and Officer Brammer and I discussed our handcuffing
procedure once the suspect was unconscious. Officer Brammer was able to render the suspect unconscious and
we quickly rolled him onto his stomach and handcuffed him. I kept hold of the suspect anticipating the impending
fight once the suspect regained consciousness.
As soon as the suspect regained consciousness, he began yelling and contort his body, I attempted to calm the
suspect but his violent and unpredictable actions led Officer Brammer to apply the hobble restraint before he was
able to kick anyone. The Long Beach Fire Department then arrived and began caring for the suspect.
As the fire department cared for the suspect, I talked to the restaurant owner ( , , ,
, dob , address )told me the suspect entered her restaurant
and appeared agitated, he was yelling at customers and spitting which drove away patrons. The suspect then
entered the restroom and believes ingested drugs just prior to Officer Brammer's arrival.
said when Officer Brammer first contacted the suspect he was very nice with him and tried to persuade the
suspect to come outside. said the suspect became more aggressive with Officer Brammer and appeared
to be readying for a fight. said the suspect attempted to turn and hit Officer Brammer which forced Officer
Brammer to take the suspect to the ground. said she then watched the suspect rendered unconscious and
handcuffed.
The suspect was treated by Community Hospital and later booked.
