Incident Summary
DISPATCH:
Officer Diaz assisted on a call of an armed robbery to a person at Pine Ave.
FORCE USED:
Officer Diaz located the suspect in the area of PCH and Pine Ave, placed him at gunpoint, and the suspect began to flee
on his bicycle. The suspect crashed his bicycle into a wall, got up and continued to flee on foot despite lawful orders
from Officer Diaz to stop. Officer Diaz attempted to gain control of the suspect three times but each time suspect began
to violently pull away and swing his elbows behind him to hit Officer Diaz. During Officer Diaz's third attempt to gain
control of the suspect the suspect fell forward onto his stomach. The suspect continued to strike Officer Diaz with his
elbows and also began placing his hands underneath his body near his waistband, where he believed the firearm may be
concealed. Officer Diaz used bodily force and a carotid restraint to subdue the suspect and take him into custody.
Officer Skeen used bodily force to assist in handcuffing the suspect. LB Unified School Police Sergeant Woodruff used
bodily force to assist in handcuffing the suspect. Officer Longoria handcuffed the suspect along with Officer Chairez.
The suspect did loose consciousness and was treated at St. Mary's Hospital. Officer Diaz received an abrasion on his
right forearm.
PHOTOGRAPHS/VIDEOS:
Officer Skeen took photos of the suspect, the scene, evidence, and Officer Diaz. There was no video available because
there were no cameras on the exterior of the liquor store. Nor would any inside cameras have captured the incident.
STATEMENTS:
I digitally recorded the interview with the suspect and after advising the suspect of his rights he refused to provide a
statement. I uploaded the interview into Mideo. I documented this in Supplemental # 3.
CONCLUSION/ACTIONS:
In my opinion, the force used was reasonable, effective, and within policy. I discussed with Officer Diaz tactics regarding
using weaponless defense on an armed suspect.
NOTIFICATIONS:
Watch Commander Lt Giesige was notified of the use of force.
