Ernest #6082) assisted units who were en route to Pine Ave. regarding an armed robbery that had just occurred. The call stated an armed robbery had just occurred to a person. The suspect was a male Black with a baseball hat, half a ski mask, dark clothing armed with a black gun and the loss was $10. Call #37. While en route the communications center advised the victim was standing outside his vehicle when this occurred. The suspect stopped his bicycle, pulled out a gun and demanded the victim's cash. There was no other loss, there were no shots fired and the suspect was last seen southbound Pine Ave. I arrived on scene and was unable to locate the victim. The communications center then advised the victim was in a black Maserati and that he would be pulling up to his residence shortly. Further on the suspect clothing was a black shirt with a penguin logo and he was riding a bmx style bicycle. While waiting for the victim to return to his residence,the communications center continued giving further information. They advised the loss was not $10 cash, but was 2 $5 Lotto scratchers, one was a winner for $15 and the other was a winner for a free ticket. The suspect was approximately 22 years of age and he asked, "Where you from?" The victim did not see any facial hair due to the mask, the bike was a dark color, possibly black and his pants were dark colored jeans. Officer K. Skeen #6050 aired, via the police radio, that Officer T. Diaz #10234 had a possible suspect run from him in the area of E. Pacific Coast Hwy. Officer Skeen then aired that Officer Diaz had the possible suspect in front of E. Pacific Coast Hwy. and that he was struggling with him. I responded to Officer Diaz' location and as I was arriving, I observed Officer Diaz kneeling on the ground next to a male Black subject, who was later identified as ARR Chester. ARR Chester was in a seated position next to Officer Diaz. Officer Skeen was holding a dark colored handgun that he stated he recovered from the ground near ARR Chester. See Officer Diaz and Skeen's report for further on the arrest and the evidence collected. I returned to the victim's location and contacted him. He related the following. As he was standing next to his vehicle, he observed a male Black subject (ARR Chester) riding a bike northbound in his direction. He noticed ARR Chester getting closer and he appeared to be coming directly towards him. He thought it was suspicious because the entire street was clear and available to pass, however ARR Chester was still riding directly towards him. Fearing he was about to be robbed, he began walking backwards around his vehicle. He noticed ARR Chester was holding a drill, with no drill bit. ARR Chester got off his bike and asked him for money. He stated he did not have any money and continued walking around his vehicle. He made it to the drivers door, opened it and sat in the driver seat. ARR Chester walked right up to the door and said, "Come on man, I know you got money. You're driving a Maserati." ARR Chester then reached in the open driver window and placed a dark colored handgun on his leg and said, "Give me your money." Fearing ARR Chester was going to shoot him, he handed him 2 Lotto scratchers and said, "That's all I have." ARR Chester then got on his bike and fled southbound Pine Ave. Thinking ARR Chester may return and fearing for his life, he left in his vehicle and called the police. He described ARR Chester as being a male Black in his 20's, wearing all black clothing and what he thought was a penguin on the shirt along with a black hat. He was riding a dark colored or black bmx style bike and he was armed with a dark colored semi-automatic handgun. ARR Chester was also wearing some sort of mask that only covered half of his face. I advised him we had a possible suspect detained and asked if he would be able to possibly identify him. He stated he would be able to identify ARR Chester if he saw him at a later time. I read him the Field Show-Up Admonition form. He stated he understood and signed the form. I transported him to E. Pacific Coast Hwy. and had him look at ARR Chester. While looking at ARR Chester, he stated it looked like the person that robbed him, but because he was only able to see his eyes so he could not say for sure. I told him to look at the bike that was leaned up against one of the black and white police vehicle's. He stated the bike looked like the bike ARR Chester was riding at the time of the robbery. Officer Diaz then placed the mask and hat, that was found in ARR Chester's possession, onto ARR Chester and he immediately stated, "100% that's him. He's the one that I had the confrontation with. He's the one that pointed the gun at me." Officer P. Lyon #5889 showed the victim the gun that was found in ARR Chester's possession and he immediately stated, "Yes, that's the gun that was pointed at me." I spoke with Officer Diaz and he told me the bike that the victim identified as being used during the robbery was the same bike he observed ARR Chester riding when he first observed him. I transported the victim back to his residence and he told me the loss was 2 Lotto "Triple 7's" scratchers. I spoke with Officer Skeen and he stated he recovered 2 "Triple 7's" scratchers from ARR Chester. Officer Skeen photographed them and I returned them to the victim. When he observed them he stated, "Yup, those are them." See the loss report for further. The victim stated he was desirous of prosecution and he was provided with a report receipt. Skeen # 6050) was working uniform patrol in a marked black and white police vehicle as Unit 1A5 assisting Unit 1A4, (Officer J. Longoria # 10131) regarding a robbery at Pine Ave, call # 0037. Communications stated that the suspect was described as a male black, baseball cap, a half ski mask and dark clothing. The loss from the victim was (2) $5 Lotto scratchers; both already scratched and showing that (1) was a free ticket and (1) was a $15 win. The suspect used a black semi automatic handgun during the robbery and was last seen riding a BMX style bike southbound Pine Ave towards PCH. I drove to the area of Pacific Coast Highway and Pine Ave and observed a male black matching the description in the call at the front entrance door of the Golden West Donuts at W. Pacific Coast Highway. I pulled my vehicle into the parking lot of the business and was facing northbound keeping the subject insight. Unit 1A6, (Officer T. Diaz # 10234) who also observed the same subject drove his vehicle into the parking lot of the Golden West Donuts southbound from PCH just west of Pine Ave. We both exited our vehicle and began to approach him on foot. I heard officer Diaz order the subject, (Later identified as Kendrick Chester) to walk over to his vehicle. Chester immediately turned towards Diaz and hopped onto his BMX bicycle, riding away from Diaz into eastbound traffic on Pacific Coast Highway. Officer Diaz went into foot pursuit of Chester, running into lane number one of Pacific Coast Highway. I got back into my vehicle and drove after Chester to cut off his escape from Diaz. Chester was able to reach the parking lot of Mike's Liquor Store at E Pacific Coast Highway, when he crashed his bicycle into a yellow cement parking block just east of the open doors of the business. Chester fell forward over the handlebars of the bicycle, got up and ran westbound pass the front door of the business and around a white Cadillac SUV that was parked in the handicap zone. A Long Beach BOE, (Board of Education) unit was on scene and was also in foot pursuit of Chester. Both officer Diaz and the BOE Sergeant were able to catch Chester at the rear passenger side of the Cadillac. (For further information see follow ups) I exited my vehicle and observed that Chester was now on the ground not complying with officer Diaz's verbal commands to give up and stop resisting. He thrashed his body from side to side as both the BOE Sergeant and Diaz held him down. I attempted to place Chester's left hand behind his back at the same time ordering him to stop resisting officers. After several seconds, Chester stopped resisting and was taken into custody without any further use of force. Directly behind Chester's back on the ground was a black Sig Sauer 1911 45 cal handgun, serial # . I recovered the gun, cleared it and found it had a fully loaded, (bullets) eight round magazine, with no round, (bullet) in the camber. I took photos of the weapon and kept it in my possession until I placed it into evidence. Chester was found to be wearing a black Adidas baseball cap and inside the cap was a black doo rag, with a cut out hole for breathing. I took photos of each of the items and kept them in my possession until I placed them into evidence. While performing a pat down search of Chester, I located (2) $5 Lotto scratchers; both had been scratched, (1) was a free ticket and (1) was a $15 win. Those items were recovered from Chester's front right sweats pants pocket. I took photos of those two items and I gave them to Officer Ernest, who later returned them to the victim. (See his follow-up for further) (2) $1 dollar bills were also recovered from Chester's front right sweats pants pocket, later placed into evidence by me along with (2) cell phones that were found in Chester's front left sweat pants pocket. Bun #6313) and I (Officer R. Tith #10248) were working uniformed patrol as Unit 1A68 when we assisted Unit 1A4 (Officer J. Longoria #10131) en route to Pine Avenue regarding a robbery that just occurred (call #0037). Upon arrival, I was advised by Sergeant Hotchkiss (#5596) to locate any potential witnesses for a use-of-force that occurred when officers took the suspect into custody. I contacted and he told me the following: He was inside Mike's Liquor Store at E Pacific Coast Highway when he heard scuffling noises and people grunting outside. He walked outside and noticed a male White police officer wrestling/grappling with a male Black subject (later identified as defendant Kendrick Chester) in the parking lot. They started on the east side of the parking lot and ended up on the west side of the parking lot. The police officer was then able to take Chester the ground and soon after additional police officers arrived on scene. During their struggle on the ground, the witness noticed that a firearm had fallen to the ground. He believed the firearm belonged to the Chester. The witness does not remember what was said during the whole ordeal. The suspect fled eastbound on a bicycle. Officer Diaz attempted to take the suspect into custody and a Use of Force occurred. I responded to the arrest location at Mike's Liquor, E. Pacific Coast Hwy. I spoke to the employee of the liquor store (who happened to be fixing the camera system at the time) who explained that there are only cameras inside the store. There are no cameras outside and no inside cameras would have captured the incident. I responded to St. Marys Hospital emergency room where the suspect was taken. As I approached the area where the suspects bed was located he called out, "Hey Sarge. Can I have my lawyer." I turned on the recorder and read the suspect his Miranda Rights per PD Form 1000.008. He replied, "yeah" to the waiver question. When I asked if he wanted to speak to his lawyer and he replied, 'Yeah" The suspect did agree to sign the "Authorization for Release of Health Information" PD Form 2310.036. Diaz #10234) responded to the area of Pine Ave to assist Unit 1A4 (Officer J. Longoria #10131) regarding an armed robbery that just occurred (call #0037). This area has a high volume of violent crime, including burglaries, robberies, car jackings, and shootings. This area is home to many gang members and has a large amount of gang activity, and drug activity. Unit 1A5 (Officer K. Skeen #6050), Unit 1A3 (Officer D. Ernest #6082), Unit 1A68 (Officer R. Tith #10248 and Officer R. Bun #6313) assisted on the call. It should be noted I was driving a marked black and white police vehicle and I was wearing a Long Beach Police Department blue uniform with shoulder patches that read "Long Beach Police" and a visible badge on my front left chest. Any person would have known that I was an on-duty Police Officer. The call stated the victim was standing outside his vehicle when a male Black riding a BMX style bicycle came up to him and pulled a black semi-automatic handgun and demanded the victim's cash. The victim gave the suspect lottery scratchers and the suspect fled southbound Pine Ave on his bicycle. The suspect was described as a male Black wearing a black baseball cap, a black ski mask over half of his face, and dark clothing. Upon arrival, I began searching the area for the suspect. While driving westbound on Pacific Coast Hwy near Pine Ave I saw a subject matching the description sitting on a BMX style bicycle in front of 100 W. Pacific Coast Hwy (Golden West Donuts). I made a u-turn and pulled my vehicle into the driveway of the liquor store. I exited my vehicle, drew my firearm and ordered the suspect to put his hands up.The suspect looked at me, and then began riding his bicycle eastbound away from me. I again ordered the suspect to stop and put his hands up and he began riding away at full speed. I holstered my firearm and began pursuing the suspect on foot. I chased him eastbound on Pacific Coast Hwy and then into the parking lot of 100 E. Pacific Coast Hwy (Mike's Liquor). Once in the parking lot the suspect began losing control of his bicycle and collided with the front wall of the liquor store. The collision caused the suspect to fall off of his bike. I approached the suspect and grabbed his right arm. The suspect violently pulled away from me and began trying to flee again. As he ran around the front of a parked vehicle I heard something fall to the ground. I wrapped my arms around his upper body in an attempt to prevent him from fleeing and the suspect began swinging his elbows back towards me almost striking me in the side of my head. Due to the suspect's violent resistance I lost grasp of the suspect near the middle of the parking lot. I was able to grab the suspect a third time and take him to the ground. The suspect landed on his stomach and I ended up on top of the suspect with my stomach against his back.While on the ground the suspect continued fighting and swung one of his elbows back towards me and then put his hands underneath him towards his waistband. Due to the suspect's continued violent resistance, lesser force options being ineffective, the nature of the crime Report Officer 10234/DIAZ,TOMAS RODOLFO JR Printed At 11/02/2020 09:09 Page 2 of 3 14-64992 Supplement No 0004 LONG BEACH POLICE DEPARTMENT Narrative and my belief the suspect was armed and attempting to reach for a gun in his waistband I applied the carotid control hold. While applying the hold the suspect continued fighting and began pulling my arm away from his neck. I was still unable to see the suspect's right arm so I continued applying the hold. The hold was ineffective so I moved my left arm behind the suspect's head and placed my left hand on my right shoulder (chancery). This technique was effective and the suspect was rendered unconscious. Once the suspect was unconscious, I stood up so the suspect's hands could be placed behind his back. Officer Longoria handcuffed the suspect (double-locked). As I stood up I noticed a black 1911 style handgun lying next to the suspect's waistband. Officer Skeen recovered the firearm and placed it into evidence. I placed the suspect in the in the recovery position and checked his vital signs. The suspect had a pulse and was breathing. The suspect regained consciousness moments later and was brought to his feet. Officer Longoria took possession of the suspect and placed him in the back seat of his patrol car. During a search of the suspect (later identified as Kendrick Chester) Officer Skeen recovered his black baseball cap, a black ski mask, lotto scratchers from his right front pants pocket, $2 in US Currency (two $1 bills), two cellular phones from his left front pants pocket. Officer Skeen remained in possession of all these items until placing them into evidence (for further see his report). Dispatch advised the victim mentioned that the suspect was in possession of a power drill without a drill bit inside. I searched the area near one of the parked cars in search of the item I heard the suspect drop. I located a black and orange cordless handheld drill. I took possession of the drill and gave it to Officer Skeen. Officer Skeen remained in possession of the drill until placing it into evidence (for further see his report). Officer Ernest contacted and interviewed the victim of the armed robbery. Officer Ernest conducted a field show-up with the victim and the victim positively identified Chester as the person who robbed him (for further see Officer Ernest's report). Officer Skeen transported Chester to St Mary's Hospital to be medically cleared. I assisted and followed Officer Skeen to the hospital. While in the hospital, I read Chester his Miranda Rights per PD Form 1000.008 and he replied, "No" to both questions. No further questions were asked. Officer Longoria arrived a short time later and relieved Officer Skeen and I. After being medically cleared, Officer Longoria transported Chester to the downtown station where he was booked as charged. Officer Longoria notified Jail Sergeant Atkins #8040 that the carotid control hold was applied. Officer Skeen took photos of the scene, evidence, suspect and myself. Unit 1S40 (Sgt. J. We were informed over our police radios that the suspect rode a BMX bicycle southbound from the scene. A short time later, Officer Skeen advised they were in foot pursuit of the suspect in the area of Pacific Coast Highway and Pine Avenue. He noticed a male suspect run eastbound on the south side of Pacific Coast Highway and a Police Officer chasing him. The suspect and the Officer ran into the parking lot of Mike's Liquor ( E PCH) and the officer tackled the suspect.could not explain the tackle in further detail because it happened so quickly. When the two went to the ground, could not see what happened because his view was blocked. I also interviewed LBUSD Sgt. Woodruff and he stated he heard the call go out over the police radio and was in the area. He drove northbound on Pine Avenue towards PCH and saw an officer turn on his spotlight and illuminate the suspect. The suspect took off on his bicycle. He rode eastbound and an Officer was chasing him on foot. Sgt. Woodruff tuned eastbound onto PCH and the suspect turned southbound through the parking lot of Mike's Liquor. The suspect crashed his bicycle into the north wall of Mike's Liquor. He got off the bike and ran westbound through the parking lot. The officer wrapped his arms around the suspect's upper torso. The suspect had his back to Sgt. Woodruff so Sgt. Woodruff took control of the suspect's upper torso and guided him to the ground. Due to the information provided by dispatch, I formed the opinion that for our safety, we needed to use extreme caution when contacting the suspect. Officer Diaz spotted a suspect who matched the description at West Pacific Coast Highway (Golden Doughnuts). Upon my arrival at East Pacific Coast Highway I saw Officer Diaz applying the carotid restraint and Officer Skeen attempting to control the suspects left hand. I grabbed the suspect's left hand and felt his arm go limp. I then placed the suspect in handcuffs and placed him in the backseat of a patrol vehicle. For further, see follow up reports.
