I assisted Long Beach Police units who were dispatched to a unknown trouble call, located at Pacific Avenue apartment , call # 1922. The call stated that someone was possibly breaking into apartment and someone was yelling for someone to call the police. Units 3C82 Officer's J.Calvert #6136 and Officer C.Luther #10655, and 1A32 Officer K.Chang #5508 arrived on scene and contacted a male Hispanic subject, later identified as SUSPECT Johnny Lagunas. During their contact with SUSPECT Lagunas a Use Of Force occurred, for further see Unit 3C82 and 1A32 follow up reports. Upon arrival I contacted a male occupant at Pacific Avenue # he was identified as VICTIM . I could see that VICTIM was bleeding on the left ring finger from a laceration. I asked VICTIM if he needed medical attention. He refused, however Long Beach Fire Department personnel were on scene treating SUSPECT Lagunas. I asked them to treat VICTIM as well. They wrapped VICTIM left hand, and advised him to receive stitches at a later time. While VICITM was being treated I could see that the apartment was ransacked. There were two large glass tables that were broken and glass on the floor, as well as blood drops. There was a large flat screen T.V. on the floor in the living room that looked damaged. I asked VICITM what happened and he told me the following; he stated he has known SUSPECT Lagunas for approximately 3 weeks. They are not in a dating relationship however they have, "messed around" sexually. Tonight SUSPECT Lagunas came to his apartment to have some drinks and dinner. While at the apartment, they each drank about 2 beers. However he believes that SUSPECT Lagunas was under the influence of Methamphetamine. VICTIM does not know a "Pelon"and believes that SUSPECT Lagunas was hallucinating or crazy. SUSPECT Lagunas began to throw items all over the apartment, breaking both the living room and dinning room glass tables. SUSPECT Lagunas also picked up the Sharp 52" flat screen television that was on a television stand and threw it to the ground. VICTIM was scared he was going to get hurt so he ran for the door. VICTIM slipped and fell to the ground causing the cut to his hand. He then ran outside and yelled for someone to call for the police. VICTIM stated he did not see the Use Of Force. VICITM desires prosecution for the damage done to his tables and television. He read and signed a private persons arrest form. He was given a report receipt. N. Dumaplin #5234, was working uniformed patrol as Unit 1A2 when I assisted Unit 1A32, Ofc K. Chang #5508, who was dispatched to a possible burglary call at Pacific . For further see Call #1922. Prior to my arrival, officers who were onscene at Pacific requested units to assist Code 3 because they were fighting with suspect. Upon arrival, I saw three officers struggling with the suspect on the #5 lane of northbound Pacific in between two park cars. The suspect, who was later identified as Lagunas, was laying face down on the ground and I saw Ofc Chang sitting on suspect's upper torso and I heard him say " he's out". Ofc Calvert #6136 was kneeling on the left side of suspect holding the suspect's handcuffed left hand. His partner, Ofc Luther #10655, was also on the left side of the suspect trying to control the suspect.I went on the right side of the suspect, who seem to be unconscious, and grabbed his right hand which was located on his right side close to his right shoulder. I placed it behind his back where Ofc Calvert has holding his handcuffed left hand and assisted in handcuffing the suspect. I did knock and talks and spoke to Wit who told me the following: He was in his apartment with his wife (Wit when he heard glass breaking and heard his neighbor screaming that someone broke into his house and was breaking all his stuff. He heard him yell "get out of here " and heard him yell to call the police He looked outside his window and saw his neighbor (victim running down the stairs closely followed by suspect. His neighbor run out the front gate and the suspect stopped and sat by the stairway. He then saw two police cars arrive and saw three officers approach the suspect. He saw the suspect stand up and approach the officers. He did not hear was said between the officers and the suspect but he saw the suspect punch the tall/bald officer (Ofc Calvert) in the face and saw all three officers struggle to take the suspect down on the ground. I spoke to Wit and she told me the following: She was in her apartment with her husband when she heard screaming and glass breaking from the apartment directly on top of hers. She walked out and sat on her front steps and saw her neighbor running down the stairs and was followed by the suspect. ran out the front gate and the suspect stayed and sat on the stairway. She then saw two police cars arrive and saw three officers approach the suspect. She saw the suspect walk towards the officers and saw the suspect punched the tall bald officer (Ofc Calvert) in the face. She then saw the officers fight with the suspect and take him to the ground. I spoke to Wit and he told me the following: He was in his apartment watching TV when he heard screaming and glass breaking from outside his apartment. He went outside to check where it was coming from because he thought someone was breaking into his car.He then saw his next door neighbor ( standing on the sidewalk and was arguing with the suspect who was seated on the stairway. He saw officers approached the suspect and saw the suspect walk towards the officers. He then saw the suspect punch at the tall bald officer and then saw the officers scuffling with the suspect. I was dispatched to a person screaming call at Pacific . I was advised that the calling party was calling for a neighbor who stated that someone just broke into his residence. The suspect was described as a male Hispanic, 30's, wearing a gray shirt and yellow boots. I was then advised by another calling party that they heard glass breaking but they did not know what was going on. I was advised that the suspect was a male, White, wearing a gray long sleeve shirt, and shorts. I then advised that the suspect ran back into the residence. Upon arrival I was advised that the suspect was now outside sitting on the stairs. I parked my marked black and white police vehicle about 2 residents south of Pacific. As I approached Pacific walking north bound, I saw the defendant later identified as Johnny Lagunas standing on the sidewalk one resident south of Pacific. The defendant was wearing a gray long sleeve shirt but was pointing north bound towards several people sitting on the steps of Pacific. There was a male and female Hispanic sitting on the steps. I asked the defendant, "What's going on?". The defendant just mumbled something that I could not understand. The defendant stepped away from me, started to jump up and down, pointing north bound to the male and female Hispanic sitting on the stairs. I stepped towards the defendant and asked him, "Who?". The defendant again mumbled. I could not understand him as he pointed. I was assisted by Officers Calvert, J #6136 and Sauter-Luther, C #10655 who were walking south bound towards the defendant. The defendant did not answer my questions and was starting to move away from me towards the male and female Hispanic. I could see the male and female Hispanic just kept sitting on the stairs. I told the defendant to stop and he did not. I did not want the defendant to approach anyone. I started to reach out towards the defendant and he immediately stopped jumping up and down. I saw the defendant lower his weight over both of his feet in a modified fighting stance. I touched the defendant's left elbow and he immediately tightened up his left arm. The defendant closed both his fists and he took a large step backwards. The defendant pulled his right arm back looking right at me. The defendant turned, looked at Officer Calvert and swung his right closed fist at Officer Calvert. I saw the defendant strike Officer Calvert on the left side of his face. I saw the defendant then step in towards Officer Calvert and wrap both of his arms around Officer Calvert's chest. The defendant pushed Officer Calvert backwards forcing Officer Calvert to drop his police baton and flashlight. The defendant pushed Officer Calvert back so hard that they fell backwards over the hood of a parked black Toyota California license plate 5RKB434. I saw the defendant holding Officer Calvert down on top of the black vehicle. I approached and immediately deployed my Electronic Control Device from approximately 3 feet from the defendant's back. I saw that two prongs had contact with the defendant approximately 12 to 18 inches apart. I saw that my Electronic Control Device had no effect on the defendant's actions. The defendant kept holding Officer Calvert down against the vehicle. I heard Officer Calvert say, "Help get this guy off of me.". I continually engaged my Electronic Control Device my pressing on the trigger for approximately 10 to 15 seconds with no affect. I thought that the defendant may have injured Officer Calvert and was still holding him down on the hood on of the black vehicle. I saw Officer Luther use his Electronic Control Device on the defendant. This also had no effect. I dropped my Electronic Control Device and encircled the defendant's neck with my left arm. I started to pull the defendant off of Officer Calvert and at the same time I could feel Officer Calvert pushing the defendant off of himself. The defendant fell into the street in front of the black Toyota onto his stomach. My left arm was under the defendant when we fell. I told the defendant to "stop resisting". The defendant tried to push himself up even as Officers held him down. The defendant then tried to turn his body away from me as I laid on his right side and I could feel my left arm getting scraped against the street. I felt Officer Calvert holding onto the lower portion of the defendant. I told the defendant "You're under arrest." but he kept fighting rubbing my left arm against the street. I applied the carotid restraint on the defendant. The defendant kept fighting. I saw Officer Luther try to gain control of the defendant's left arm. The defendant pulled away from Officer Luther. I kept applying the carotid restraint with no effect. I could still feel the defendant trying to pull away from Officers. I applied the chancery enhancement to the carotid restraint and rendered the defendant unconscious. Officer Calvert handcuffed the defendant's left arm and Officer Dumaplin, N #5234 handcuffed the defendant's right hand. Officer Luther turned the defendant over onto his right side. After approximately 5-9 seconds I heard the defendant take 2 very deep breaths. After the defendant exhaled his second breath the defendant immediately began to resist again. The defendant tried to sit up then he began to kick his feet. I heard an Officer speaking Spanish to the defendant. The defendant ignored the Spanish speaking Officer and kept resisting. Officer Luther used the hobble restrain to restrain the defendant. The defendant continued to struggle with Officers even with the hobble restrain applied. Long Beach Fire was called to medically evaluate the defendant. The defendant struggled with Officers the entire time. Long Beach Fire Rescue 13 responded and treated the defendant. The defendant even struggled with the Long Beach Fire who was there to treat him. Rescue 13 transported the defendant to Memorial Hospital where he was treated by Dr . The defendant was so uncooperative that he refused to answer any questions. The defendant did not have any wallet or identification on him at the time of arrest. Officer Lyon used department resources to identify the defendant. At Memorial Hospital the defendant was uncooperative with hospital staff. Sgt Hall was notified of the use of force. Lt Berkencamp was notified of the use of force. Calvert #6136) and I (Officer C. Luther #10655) assisted Unit-1A32, Officer K. Chang #5508, with an unknown trouble call at Pacific Avenue (Call #1922). Upon arrival, I saw Officer Chang's vehicle on the east side of the street and I parked in front of the dispatched location. As I was exiting my patrol vehicle, I saw Officer Chang contacting a Hispanic male subject (later identified as Defendant Johnny Lagunas) who was walking northbound away from Officer Chang. Officer Chang attempted to gain control of the subject from a position of advantage to the left and behind Lagunas. Lagunas became combative and pulled his arm away from Officer Chang. I heard Officer Calvert yell something and I ran southbound towards Lagunas. Officer Calvert and I contacted Lagunas at approximately the same time. Lagunas turned towards Officer Calvert with a balled fist and his arm back in a punching stance. I believed that Lagunas was going to try and punch someone with his right fist. I attempted to grab Lagunas' right arm as he swung his right fist towards Officer Calvert but was unsuccessful. Lagunas wrapped his arms around Officer Calvert's torso and pushed him backwards. Both Officer Calvert and Lagunas fell towards a parked car (black Toyota License #5RKB434) along the east side of Pacific Avenue in front of the dispatched location. Officer Calvert landed on his back while Lagunas was on top of him. I attempted to grab Lagunas right arm and pull him away from Officer Calvert but was unable to. Officer Calvert and Lagunas rolled off the hood of the car and Lagunas' arms were still wrapped around Officer Calvert. Officer Calvert was on the ground with his back towards the front bumper of the vehicle. I saw that Lagunas' right arm was free and attempted to grab it and apply a control hold. Before I was able to, I heard Officer Chang yelling, "Taser!" Officer Chang then deployed his Electronic Control Device to Lagunas' upper back. I saw the spread on the Electronic Control Device prongs and believed it was very minimal. It did not appear to be affecting Lagunas. I then pulled my Electronic Control Device from the holster and deployed it to Lagunas' lower right back to create a larger spread and to incapacitate him. Report Officer 10655/SAUTER LUTHER,CAMERON J Printed At 10/28/2020 09:42 Page 1 of 2 15-34048 Supplement No 0003 LONG BEACH POLICE DEPARTMENT Narrative After deploying the Electronic Control Device, Lagunas appeared to tense up and stop fighting with Officer Calvert. Officer Chang appeared to lose control of his Electronic Control Device and it fell to the ground. Officer Chang then applied a Carotid Restraint to Lagunas. Officer Chang leaned back in an attempt to pull Lagunas off of Officer Calvert and roll him facedown onto the ground while applying the Carotid Restraint. Officer Chang continued to apply the Carotid Restraint and Officer Calvert placed his knees on Lagunas' right hip. Lagunas continued to thrash, kick, and refused to comply with our lawful orders to put his hands behind his back. I then pulled the trigger on my Electronic Control Device to reapply and incapacitate Lagunas and prevent him from moving. I cycled my Electronic Control Device a total of two times on Lagunas. I placed my right knee on Lagunas' left hip and grabbed his left arm and pulled it behind his back and applied a lower wristlock to control his movement. I then applied a handcuff to Lagunas' left wrist. I held the handcuff with my left hand while Officer Calvert brought Lagunas' right arm behind his back. Officer N. Dumaplin #5234 handcuffed Lagunas right arm. Officer Chang and Officer Calvert stepped away and I rolled Lagunas onto his right side in the recovery position. I could hear the subject breathing heavily and his chest was visibly rising and falling. Lagunas was bleeding from his nose. While I was holding Lagunas on his side, he regained consciousness and began thrashing and kicking. Lagunas continued to kick and I was unable to control him. I rolled Lagunas back onto his stomach and put my knee across his thighs so I could apply a hobble restraint to his ankles to control his movements and prevent him from kicking assisting Officers. Officer Calvert advised dispatch of the use of force and requested medical attention for Lagunas. Luther #10655) and I (Officer J. Calvert #6136) assisted unit 1A32 (Officer K. Chang #5508) who was enroute to a unknown trouble call at Pacific Ave . Call #1922. The calling party stated that someone had broken into apartment , and someone could be heard in the background yelling to call the police. The calling party additionally stated that his neighbor had come over and asked him to call the police, reporting that someone had broken into his house. That person (later identified as Defendant Legunas) was described as a male Hispanic in his 30's, wearing a ripped gray shirt, shorts, and yellow boots. The Defendant was also reported to be drunk or on drugs. The calling party was able to hear banging and the sound of broken glass. Upon arrival at approximately 2333 hours we observed unit 1A32 (Officer Chang) exiting his patrol vehicle and contacting the Defendant who was walking out towards the sidewalk area. As I exited our patrol vehicle I saw that the Defendant exhibited some common signs and symptoms of intoxication/alteration (unsteady gait, appearance of disorientation, appearance of an aggravated demeanor). Based on my observations and the information provided in the call I formed the belief that the Defendant was the individual described in the call who may have just broken into apartment . At that time I became concerned for the safety and well being of the resident(s) in apartment , as well as for Officer Chang's safety, my partner's, and that of my own. I observed Officer Chang attempt to detain the Defendant out on the sidewalk. As Officer Chang attempted to take control of the Defendant's left arm, the Defendant immediately pulled his arm away and dropped his weight and center of gravity into a fighting stance. The Defendant's face appeared to be very hostile, and his body language was aggressive. I stepped to within a distance of less than 10 feet in front of the Defendant as he pulled away from Officer Chang and attempted to give him verbal commands to not resist. However before I was able to speak to the Defendant he darted forward and punched me in the left side of my face with a closed right fist. I was able to anticipate this punch and step off of his line of attack (to my right), and as a result his punch connected with my head as a glance off the left side of my cheek. As I stepped off the line of his attack I drew my Streamlight SL20 flashlight (which is a department approved impact weapon) and struck the Defendant on his left upper thigh area. As my flashlight strike landed I could feel instant sharp pain in my right hand and wrist area, causing me to drop my flashlight to the ground. The Defendant then charged forward and attempted to tackle me onto the parkway. I then reversed the Defendant's attempted take down by grabbing him in a bear hug and spinning us 180 degrees. I then used the Defendant's momentum against him and applied downward bodily force whereupon we fell onto the hood of a parked vehicle on Pacific Ave. As we fell to the hood of the vehicle my right wrist became pinned beneath both of our bodies, and the impact with the hood of the vehicle caused me to further sharp pain to my hand and wrist. At this time both the Defendant and I were locked in a mutual bear hug we me on top and his back against the hood of the car. For a few seconds I maintained this grip as it prevented the Defendant from punching me again. The Defendant demonstrated great strength and resolve, and did not appear to be phased or effected by the first body slam. I then rolled us off the hood of the car and into the gutter area of Pacific Ave where I came to a rest with my back against the front bumper of the car we had just been on, and the Defendant down on his knees but still in my bear hug. At that time I began giving the Defendant clear orders to stop fighting us. Moments later I heard the "pop" of an Electronic Control Device (ECD) being deployed, and the subsequent sound of the device cycling. This seemed to have almost no effect on the Defendant who continued to grapple with me in the roadway. I feared that if I were to release the hold I currently had on him, he would punch me again or attempt to attack either Officer Chang or Luther. I also feared the possibility of being overpowered and pushed out into traffic on Pacific Ave if the Defendant was not quickly overcome and taken into custody. I then saw that Officer Luther was now standing in the road just behind the Defendant. I directed Officer Luther to use his ECD to help me overcome the Defendant's resistance.Any other force option (specifically including the use of impact weapons) were essentially impractical. Officer Luther then deployed his ECD. For further refer to Officer Luther's supplemental report. Officer Chang and I then used bodily force to roll the Defendant off of me and face-down onto the pavement. Officer Chang then attempted to perform a carotid restraint of the Defendant. As Officer Chang attempted this I saw that there was an ECD with its probes already discharged and wires hanging out lying in the road to my left. I believed that this was the first ECD used on the Defendant. I then picked it up and gave the Defendant several clear commands to stop fighting us. Because the Defendant was still actively fighting us I activated the ECD for a 5 second cycle, but to no apparent effect. I then utilized the ECD in a drive stun manner and delivered another 5-second cycle by making contact with the ECD to the Defendant's left upper back area. This second cycle appeared to have some effect on the Defendant, but it did not result in his voluntary compliance. At that time I determined that the Defendant was nearly impervious to all less lethal options available to us. I then used my police radio to ask for units to assist us Code-3. I then formed the opinion that Officer Chang's attempted carotid restraint was our best current force option to overcome the Defendant's violent resistance, and allow us to place him in handcuffs. I then delivered two additional 10-second cycles to the Defendant's upper left back area in order to diminish the Defendant's ability to resist Officer Chang's carotid restraint hold. After this last cycle it appeared that the Defendant was now no longer resisting us with the same strength that he previously had been. I then saw that I saw that Officer Luther had managed to take hold of the Defendant's left arm, and was placing handcuffs on that arm. I ceased utilizing the ECD and focused on taking the Defendant into custody. Officer Chang then released his carotid control hold, and I assisted him in pulling the Defendant's right arm from under his stomach. At that time I stood up and gave Officer Luther room to finish handcuffing the Defendant. I then used my police radio advise that we were Code-4, and also requested medics to respond to treat the Defendant due to the ECD and carotid restraint. During this time the Defendant was placed in a recovery position and monitored by Officer Luther. Within a few seconds the Defendant began to kick again, and Officer Luther applied a hobble restraint to his ankles. LBFD Rescue 13 arrived, and subsequently transported the now fully conscious Defendant to Long Beach Memorial Medical Center. At the conclusion of this incident I felt sharp pain and swelling to my right wrist and hand area, and also sharp pain, tightness, and lack of mobility to my neck. I was directed by responding Sgt.
