Narrative
On Wednesday, March 15, 2016 my partner (Officer P. Thach #6319) and I (Officer I. Hughes #6263) was
assignment to work patrol in the Beat 12. At approximately 2350 hours we were on routine patrol northbound
Redondo Ave approaching Pacific Coast Highway when we observed a black Honda Accord stopped in traffic
while the light was in the green phase.
I observed that there was no vehicle in front of the black Honda as it was stopped. The accelerated and traveled

Narrative
northbound on Redondo Ave crossing Pacific Coast Highway. I observed that the vehicle did not have license
plates on the rear of the vehicle (violation 5200 a CVC). Then, the vehicle signaled and made an abrupt turn from
Redondo Ave onto Reservoir Drive (violation 22108 CVC, failure to signal 100 ft prior to turning).
My partner activated the overhead lights and siren to conduct a traffic stop on the driver. The driver pulled to the
left side of the road. Officer Thach contacted the driver, later identified as Marissa Hernandez. Hernandez told my
partner that she did not have a driver's license or any vehicle registration information. Hernandez told Officer
Thach that the vehicle belonged to her friend. When Officer Thach asked Hernandez for the name of the vehicle
owner she replied, "I don't know."
Officer Thach asked Hernandez to exit the vehicle so that we could further investigate. I ordered the passenger to
exit the vehicle there after. Both Hernandez and her passenger were asked to have a seat on the curb. I asked
the passenger his name and date of birth. He told me that his name was with a date of birth of
. I later identified the passenger using his California identification as Jaunito Chavez.
While Chavez was seated, I observed that he appeared to be nervous. I observed that Chavez was wearing a
button down, short sleeve collared shirt that was unbuttoned with a T-shirt underneath. As he was seated, he
repeatedly reached his left hand to the inside of his button down shirt. After observing Chavez's behavior, I
believed that he was trying to conceal contraband. I ordered Chavez to place his hands in front of him so that I
could see them. He raised his hands but kept his right hand closed. Then, I observed Chavez place his right hand
to his mouth and placed something into it. Then, he swallowed. I believed that Chavez was attempting to swallow
a dangerous drug. I asked for a patrol unit to respond urgently to assist us at the traffic stop.
I leaned forward and took control of Chavez's left arm to place him into handcuffs and prevent to him from
swallowing any more evidence. Chavez forcibly pulled his left arm away from my control taking me off balance.
Then, he violently swung his right arm towards me. I believed that he was swinging to attack me and to prevent
me from taking him into custody. It should be noted that Chavez has a stocky build. He is approximately 5'9" and
two hundred and thirty pounds. Also, the location were the traffic stop took place was not well lit. I noticed that
Chavez was very strong. I determined that attempting to control his arms would not have been effective nor would
baton strikes based on our close proximity.
Based on the above listed factors and Chavez's violent behavior, I placed him in the carotid control hold. I
believed that the carotid was the most effective force option to safely take Chavez into custody. As I applied the
carotid control hold, Chavez grabbed on right arm in an attempt to break free of the hold. We rolled on the ground
until I was able to effectively apply the carotid control hold. Chavez lost consciousness. I released the carotid
control hold. I asked Officer Thach to take control of Chavez's left arm so that we could place him into handcuffs.
Chavez regained consciousness prior to use being able to place him into handcuffs. Officer Thach attempted to
take control of his Chavez's left arm but it appeared that Chavez pulled away. I ordered Chavez to place his arms
behind his back but he did not comply. Then, I felt Chavez tensed his body. He placed his hands under his body
and lifted his himself from the ground. I attempted to use my body weight to prevent Chavez from standing. Then,
I applied the carotid control hold on him a second time. I feared that if he stood to his feet he could attack my
partner and I or evade arrest by running. Officer Thach used his Conducted Electrical Weapon (CEW) to drive
stun Chavez on his back.
The CEW was not effective nor was the carotid control hold effective. I was unable to prevent Chavez from
standing. He stood to his feet while I was still on his back with the carotid control hold applied. As he stood,
Chavez violently attempted to break free of my control. I was able to use bodily force to conduct a take down.
Chavez landed on gthe ground in the prone position. Again, I ordered him to place his hands behind his back. He
did not comply. I deployed the CEW approximately three inches away from his back. Both probes struck Chavez
on his back. The CEW deployment was effective. Chavez responded verbally. He stated, "OK. OK." Then, he
placed his arms behind his back. We were able to place him into handcuffs. There was no further force used.
I checked Chavez's vital signs. I noted that he was conscious, breathing and he had a pulse. I requested
paramedics to respond to the scene. Also, I requested a field supervisor to respond. Fire Rescue Engine 10
responded to the scene. The paramedics evaluated Chavez and transported him to Community Hospital. My
partner rode in the rescue unit with Chavez. I followed them to the hospital.

Narrative
Officer Larrieu # 10324 and his partner Officer Cortez # 10789 conducted a records check of the vehicle. He
discovered that the black Honda was a stolen vehicle. Hernandez was placed under arrest. Officer Larrieu and his
partner transported Hernandez to the Long Beach booking facility. For further on the arrest, see DR 16-16185.
Sgt Steinhauser responded to the scene.
While in the emergency room, Dr removed the probes from Chavez's back. I informed Dr that
Chavez possibly ingested a dangerous drug.Dr evaluated Chavez and released him to be booked. Officer
Thach took possession of the probes and cartridge. He turned the items over to my possession. I placed the
items into evidence. Officer Thach sustained an abrasion and swelling to his right leg, I sustained swelling to my
right hand and Chavez sustained abrasion on his forehead and swelling above his left eye.
I escorted Chavez to our patrol vehicle. Prior to placing him into the patrol vehicle, I asked Chavez if he had any
drugs or illegal items on his person. He replied, "I swallowed it." Officer Thach and I transported Chavez to the
Long Beach booking facility. While in booking, Chavez stated that he stole the black Honda. Chavez was booked
as charged. He was released to the custody of the men's jail detention officers without incident. Watch
Commander Lt Giesige #5376 was notified of the incident.

Narrative
On 03/15/16 at 2350 hours, my partner (Officer I. Hughes #6263) and I (Officer P. Thach #6319) were working
uniformed Patrol in a marked black and white Police vehicle.
We were stopped at a red light in the number two lane of northbound Redondo Ave at Pacific Coast Hwy behind a
black Honda Accord. The Honda had Norm Reeves plates instead of an actual license plate. When the light
turned green, the vehicle moved forward approximately five feet before stopping and then moving forward again. I
thought it was odd, so I continued driving northbound behind the vehicle. The vehicle crossed Pacific Coast Hwy
and made an abrupt right turn onto Reservoir without using turn signals.
I conducted a traffic stop on the vehicle at Reservoir just east of Redondo Ave. I asked the female driver (later
identified as Marissa Hernandez) for her license and registration. She stated she does not have a license and
does not know where the registration for the vehicle is at due to the fact that the vehicle belongs to her friend. I
asked her what is the name of her friend; she paused and said she does not know. I had Hernandez step out of
the vehicle. She was detained on the curb. Officer Hughes had the front passenger (later identified as Juanito
Chavez) step out of the vehicle and he was also detained on the curb.
I returned to my vehicle to attempt a records search of Marissa and Chavez as well as to look up the vehicle's vin
number. Before I could run the vehicle's vin number, I heard Officer Hughes yell something at Chavez but I could
not make out what he said. I then observed Chavez place one hand on his mouth, he appeared to have
swallowed something. I believed Chavez was in possession of narcotics and was now attempting to destroy the
evidence by swallowing it. I got out my vehicle and ran over to assist Officer Hughes in taking Chavez into
custody.
Chavez rolled over onto his belly and tucked both his arms underneath his body. I ordered him to place his hands
behind his back but he refused. Officer Hughes was attempting to control Chavez's right arm. I attempted to pull
Chavez's left arm out from underneath him. I continued to give him commands to place his arms behind his back
and to stop resisting. He would not allow me to pull his left arm out from underneath him. I removed my
Conducted Electrical Weapon and conducted a drive stun to Chavez's lower back. I ordered him to stop resisting

and to put his arms behind his back. He was attempting to get up. I conducted another cycle of the drive stun with
my CEW. He lay back down on the ground. Before I could place handcuffs on Chavez, he got up onto his feet and
began running eastbound. I still had control of his left arm. Officer Hughes conducted a take down on Chavez.
The three of us fell onto the ground . I landed on my right knee and right elbow, causing abrasions to both.
Once we were on the ground, Chavez continued to resist arrest. He kept both arms tucked in front of him. He was
moving his body from side to side and pulling his left arm away from me. Officer Hughes deployed his CEW into
Chavez's upper back. Chavez then yelled, "Ok Ok." I was able get control of both arms and I placed Chavez in
handcuffs.
When Assisting units arrived, I had Officer Cortes #10789 assist me in checking the vehicle's vin number. She
advised me the vehicle was reported as a stolen vehicle. Hernandez was placed in handcuffs and transported to
booking by Officer Cortes. For further see her arrest report.
Long Beach Fire treated Chavez at the scene. He was then transported to Community Hospital where he was
treated. We transported Chavez to 400 W. Broadway where he was booked. I read Chavez his Miranda Rights
per PD form 1000.008. He answered yes to both waiver questions. When asked if he would like to tell us what
occurred he said he wanted his lawyer. No further questions were asked of Chavez.
Sgt. Steinhauser was notified and responded to the scene. Officer G. Murray assisted in taking photographs at the
scene.
