On 2/23/19 at 0104 hours, I (Officer D. Kasowski #10930), was working uniformed patrol in a marked black and
white patrol vehicle as unit 4A4. I assisted unit 4A33 (Officer M. Marschke #11002) at Alamo Court and 14th
Street on an occupied stolen vehicle (call #49).
While on scene, the suspect/driver fled the custody of officers northbound Alamo Court from 14th Street. Officers
were able to stop the suspect approximately one hundred yards from the location he attempted to run away from.
I checked the area for cameras and was unable to locate any surveillance footage. The west side of the alley was
occupied by commerical buildings that were not occupied at this time. All of the windows of the buildings were
boarded up and no one would be able to see the incident.
I did knock and talks at the directly to the east of the incident located at Elm Avenue.
Apartment : A female resident only answered through a closed door stating she did not hear or see anything
and did not want to talk anymore. She never opened the door and did not provide me with a name or contact
information.
Apartment : No answer.
Elm Avenue is a facility and no one was at the location during this time of the night.

On 02/23/19 at approximately 0057 hours, I (Officer M. Marschke #11002) was working uniformed patrol as Unit
4A33 driving a black and white patrol vehicle in the area of 15th Street and Elm Avenue.
As I drove northbound on Elm Avenue from 15th Street, I observed a Black Chevy Suburban turn southbound on
to Elm Avenue from the westbound lane of 16th Street. The Chevy Suburban did not have a front license plate, in
violation of Vehicle Code Section 5200(a). As the vehicle drove past me driving southbound, I looked in my
driver's side mirror and observed the vehicle had a white and red Nissan paper plate for a rear license plate.
I made a U-Turn at 16th Street, and drove southbound on Elm Avenue behind the vehicle. As I caught up to the
vehicle, I observed the vehicle fail to stop at the stop sign for southbound traffic on Elm Avenue at 14th Street, in
violation of Vehicle Code Section 22450 (a). The vehicle turned westbound on 14th Street.
I turned westbound on 14th Street and activated my red light and siren behind the vehicle. The vehicle turned
southbound onto Alamo Court from westbound 14th Street and came to a stop at the mouth of the alley (Call#
0049).
I approached the driver's side door and contacted the driver (Arrestee Jose Mora). The driver's side window is
still rolled up, so I gave Arrestee Mora commands to open the window. Mora stated the window did not open, so I
opened the driver's side door of the vehicle.
I noticed the vehicle was still in drive and I gave Arrestee Mora commands to put the vehicle in park and turn the
vehicle off. Mora put the vehicle in park, but stated the vehicle was already off.
I then asked Mora to take the keys out of the ignition and put them on the dashboard. Mora stated he had already
removed the keys, and then began to reach for the center console. I asked Mora where he put the keys, he then
mumbled to me that they might be in the cup holder or his pocket. Mora looked in the center console then
reached into his left front pants pocket and produced a single black and silver key on a key ring. When Mora put
the key on the dashboard, I observed the key was bent at the end. I asked Mora if the key worked for the vehicle,
and he stated it did.
I asked Mora if the vehicle belonged to him, and if he had any paperwork for the vehicle. Mora stated the vehicle
did belong to him, but he did not have any paperwork. I asked Mora for his identification and he stated he did not
have any. I asked the passenger (RNB if he had any identification and he stated he did not.
I ordered Mora to put his hands on the steering wheel and I ordered to put his hands on the dashboard.
I located the vehicle's VIN on the inside of the driver's door.
Using department resources, I determined the vehicle was reported stolen out of Long Beach.
Unit 4A3 (Officer V. Nguyenlieu #10744) arrived on scene and we ordered both subjects out of the vehicle.
I ordered Mora out of the vehicle and handcuffed him (double-locked).

Unit 4A64 (Officer Vandemoortel #10920 and Officer D. Gibson #10931) arrived on scene and assisted in clearing
the vehicle.
I escorted Mora to my patrol vehicle and conducted a search incident to arrest prior to seating him in the
backseat. During my search, I found a bent metal screwdriver with a green handle in his rear left pants pocket
and a set of six keys on a key chain in his front right pants pocket.
I then began to guide Mora into the backseat of my patrol vehicle with my left hand on his right bicep. As I turned
to grab the seatbelt, Mora pulled away from my grasp and ran northbound on Alamo Court.
Officer Vandemoortel, Officer Gibson and I gave chase to Mora northbound on Alamo Court for approximately 100
yards. During the chase, I gave Mora two commands to "stop." I then observed Officer Gibson catch up to Mora
and Officer Gibson extended his hands out in front of him in attempts to grab Mora's left arm. I could not see if
Officer Gibson was able to make contact with Mora before I observed Mora fall to the ground, face first. Officer
Vandemoortel and I contacted Mora as he was coming up into a kneeling position on the ground and we each
grabbed one of Mora's arms to restrain him from attempting to run any further.
I then observed Mora was bleeding from lacerations above and below his right eye. Officer Vandemoortel and I
escorted Mora to the backseat of my patrol vehicle and seatbelted him in.
Long Beach Fire Engine 3 and Rescue 3 responded to the scene to assess Mora's injuries.
Officer Vandemoortel determined all six keys on the key ring, the screwdriver, and key on the dashboard were
able to turn the ignition and start the vehicle.
I collected the six keys, the screwdriver, and the bent key as evidence. For further, refer to the Property Report.
The vehicle was towed from the scene by P.D. Tow under Tow Authority Section 22651 C CVC.
Officer Vandemoortel and Officer Gibson transported Mora to St. Mary's Medical Center, located at 1050 Linden
Avenue, to receive medical treatment for his injuries. For further, refer to Officer Gibson's Follow Up Report.
Unit 4S16 (Sergeant D. Alonzo #6323) responded to the scene and later to St. Mary's Medical Center to interview
Mora.
While at the scene, Officer Nguyenlieu interviewed and he told him the following:
stated he had never met Mora before today (02/23/19). stated he observed Mora driving
northbound on Elm Avenue at 16th Street. Mora made a u-turn at 16th Street and approached on the
west side of the street and asked him if he wanted to "chill." got into the vehicle, but stated he did not
know where the suspect was going to drive.
Officer Nguyenlieu did not ask any further questions.
was Released not Booked at the scene.
I responded to St. Mary's Medical Center to interview Mora. I contacted Mora in ER Room and read him his
Miranda Rights per P.D. Form 1000.008. He answered, "Yes" to waiver question one and told me the following:
On 02/22/19 at an unknown time, Mora was at the auto body shop located at Long Beach Boulevard.
Mora went to the auto body shop to borrow a vehicle from his friend " Mora stated " gave him
the vehicle and gave him the six keys for the vehicle. Mora stated the keys " gave him worked on the
door to the vehicle, but did not work to turn the ignition.
Mora stated the ignition appeared to be broken, but he tried the key he had in his possession. Mora stated the
bent key he had in his possession worked to turn the ignition on the vehicle and he was able to drive it.
Mora denies knowing the vehicle was stolen and stated he did not know the keys given to him did not match the
vehicle.

When I asked Mora why he ran from me he stated, "I have summary probation. I didn't want to go to jail. I have
little kids."
No further questions were asked.
After Mora was medically cleared, Officer Vandemoortel and Officer Gibson transported him to 400 West
Broadway for booking. Mora was booked as charged and released to the 6th Floor Men's Jail without further
incident.

***USE OF FORCE***
On 02/23/19, my partner (Officer J. Vandemoortel #10920) and I (Officer D. Gibson #10931) were working full
uniform patrol in a marked black and white police vehicle as Unit 4A64. At approximately 0102 hours, we assisted
Unit 4A33 (Officer M. Marschke#11002) at 14th Street and Alamo Ct. regarding a stolen vehicle she had stopped.
Multiple units assisted on the call (call #0049).
It should be noted that during this incident, I was wearing my basic long sleeve patrol uniform complete with two,
Long Beach Police shoulder patches and a Long Beach Police badge pinned on the left side of my chest. In
addition, I was also wearing my department issued duty belt, which held the necessary patrol equipment such as
my service firearm, police handheld radio, handcuffs, conducted electrical weapon (CEW), flashlight and
ammunition. All of these items are commonly recognized to be worn by police officers.
While en route, I heard over the police radio that the vehicle (a black Chevrolet Suburban with "Nissan" paper
plates) they had stopped was confirmed stolen with two occupants.
Upon arrival, I observed a black Chevrolet Suburban stopped facing southbound in Alamo Ct., just south of 14th
Street. I observed a police vehicle with its forward facing red light activated directly behind it. I also observed a
second police vehicle just west of their location. Officer Marschke had a subject in handcuffs, later determined to
be ARR Jose Mora. Officer Marschke had Mora just outside her rear passenger side door. Unit 4A3 (Officer V.
Nguyenlieu #10744) was in the process of handcuffing another subject on his knees, later determined to be RNB
I observed Officer Nguyenlieu handcuff I then assisted Officer Nguyenlieu in helping to his feet
and walking him to the backseat of his patrol vehicle. At this time, I heard Officer Marschke yell, "Stop!" As I heard
this, I looked northbound towards Alamo Ct. and observed Mora (still handcuffed) running northbound and away
from Officer Marschke.
I gave chase on foot northbound Alamo Ct. I also yelled,"Hey! Stop!" multiple times. Mora did not make any
attempt to stop as he continued to flee on foot northbound Alamo Ct against our lawful commands. Approximately
75-100 yards north of 14th Street, I caught up to Mora on Alamo Ct. As we were running, I reached out with my
right hand towards Mora's left tricep area. As I attempted to secure Mora's left arm, coupled with his forward
momentum, he fell face first towards the ground. It should be noted, I was unable to secure any part of his left

arm. My momentum carried me past Mora as I began to slow down from running. As soon as I turned around, I
observed Officer Vandemoortel on his knees at Mora's left side of his body holding him to the ground. I also
observed Mora bleeding from an approximate 1-inch laceration to his forehead. Officer Marschke caught up and
assisted Officer Vandemoortel in standing Mora onto his feet. They walked him back southbound Alamo Ct. and
back to Officer Marschke's police vehicle. They sat him in the backseat and awaited for Long Beach Fire. While in
the backseat, I also observed a small scrape under his right eye.
Long Beach Fire Engine #3 and Rescue #3 responded and medically treated Mora's injuries.
Unit 4S16 (Sgt. D. Alonzo #6323) was notified and responded to the scene.
My partner and I took custody of Mora and seatbelted him to the backseat of our patrol vehicle. We transported
Mora to St. Mary Medical Center, located at 1050 Linden Avenue, to receive medical treatment.
While at St. Marys, Officer Vandemoortel photographed myself and Mora. For further, refer to those photographs
uploaded into Mideo. Internal Affairs Sgt. Mendoza was notified and responded to St. Mary Medical Center.
Mora was treated by Emergency Medical Doctor in the emergency room. Mora received eleven
sutures for the laceration to his right forehead, two sutures for a laceration above his left eye, and was cleared for
booking by the medical staff. I seatbelted Mora to the backseat of our patrol vehicle and transported him to
booking, located at 400 W. Broadway. Mora was booked as charged and released to the 6th Floor Men's Jail
without further incident.

Narrative
On 2/23/2019 at 0101 hours, while working uniformed patrol as Unit 4A64, my partner (Officer D. Gibson #10931)
and I (Officer J. Vandemoortel #10920) assisted Unit 4A33 (Officer M. Marschke #11002) in the area of 14th St
and Alamo Ct regarding a stolen vehicle (Call #0049).
It should be noted, my partner and I were in our department issued dark blue Police long sleeve uniform with Long
Beach Police patches on both our shoulders and our department issued badge over our hearts. We also wearing
our Police duty belt which includes our gun, radio, handcuffs, taser, etc.
Upon arrival on scene, Officer Marschke and Unit 4A3 (Officer V. Nguyenlieu #10744) had two subjects in
handcuffs outside of a black Chevrolet Suburban with paper plates. I immediately recognized the vehicle as the
vehicle that had just been determined stolen by departmental resources. The vehicle was facing southbound
Alamo Ct on the south side of 14th St,
As I exited our patrol vehicle, I assisted by beginning to conduct an inventory of the stolen vehicle. While
conducting an inventory of the vehicle, I heard a loud commotion coming from the area of the parked patrol
vehicles. As I turned to see what was happening, I observed a subject in handcuffs running northbound Alamo Ct
with Officer Gibson and Officer Marschke in chase.As I saw the officers running, I too began to chase after the
fleeing Suspect.
While chasing the fleeing Suspect, I heard Officer Gibson yell, "Hey, stop!" The fleeing Suspect continued running
northbound Alamo Ct refusing to listen to Officer Gibson's lawful command.
I began to run northbound Alamo Ct for approximately 50-100 yards when I observed Officer Gibson quickly
catching up to the Suspect. When I was approximately 20 feet away from the Suspect and Officer Gibson, I
observed Officer Gibson reach for the Suspect's left arms bicep/tricep area with his right hand. It appeared that as
soon as Officer Gibson made contact with the Suspect, the Suspect lost his balance and fell to the ground.
Still running, I quickly approached the now fallen Suspect and observed him still moving around on the ground. As
I approached the Suspect, I placed my right knee on the Suspect's lower back to help gain control of him and
prevent him from continuing fleeing. Once the Suspect stopped moving, I moved my right knee to the ground and
helped stand the still handcuffed Suspect up. As I helped stand him up, I observed the Suspect's head had a
laceration on his forehead from which he was bleeding.

My partner and I transported the Suspect to St. Mary's Medical Center for further medical evaluation.

400 W Broadway) without further incident where he was booked as charged.

On 2/23/19, I Sgt. D. Alonzo # 6323 responded to the area of 14th St. and Alamo Ct to assist units on scene with
a stolen vehicle investigation.
While on scene Officer M. Marschke advised me that as she was attempting to place Suspect Jose Mora into her
police vehicle when he pulled away from her and attempted to flee on foot. Mora was handcuffed and running
northbound Alamo Ct. away from officers.
Officer D. Gibson advised me that he gave chase, caught up to Mora and as he reached for Mora's arm, Mora fell
to the ground striking his head on the ground.
I saw Long Beach Fire Personnel tending to a laceration on Mora's head.
I contacted Mora and asked him what happened. Mora advised me that he was on probation and did not want to
go to jail. Mora stated that he fled in an attempt to get away from the officers and while he was running he was
pushed by an officer which caused him to fall to the ground and strike his head.
I later contacted Mora at St. Mary's Hospital where I spoke with him again. I digitally recorded my interview with
Mora and uploaded it into Mideo.
