At the time of this Use Of Force I was equipped with a Body Worn Camera (#BWC) which captured the incident. I
reviewed the footage prior to filing my police report.
On 02/03/18, my partner (Officer H. Vong #10124) and I (Officer C. Del Real #6228) were assigned to work
uniformed patrol as part of the West Division Directed Enforcement Team as Unit DE45. At approximately 2000
hours while conducting gang investigations in the area of Pacific Coast Highway (PCH) and Atlantic Avenue, our
attention was drawn to a male Hispanic, whom I recognized as Juan Reyes (DOB 07/08/86), a documented and
self-admitted member of the Eastside Longo Criminal Street gang with a moniker of "Cosmo." Reyes was walking
northbound Atlantic Avenue along the east sidewalk. Officer Vong advised me that he had observed Reyes walk
against a red light (Violation of 21453(D) CVC, pedestrian enter roadway on red light) at Jack Rabbit Lane. Call
#1583.
It should be noted that Reyes is also a served member under the "Longo Sureno Gang Injunction"
. He was served on 06/15/2015 by Detective C. Zamora #5991. It should be noted that Reyes was
also in direct violation of the gang injunction condition, "M" Obey all laws. Which was committed in my partners
presence and well within the "Safety Zone."

Narrative
As I drove northbound Atlantic Avenue, Reyes had now reached the southeast corner of Atlantic Avenue and PCH
at which time he stopped at the corner. I stopped our patrol vehicle along the east curb of Atlantic Avenue just
south of PCH beside Reyes. Officer Vong engaged Reyes in conversation in an attempt to further investigate the
aforementioned violations. I quickly attempted to run his name via our departmental computer for any wants or
warrants. I recalled that several months ago (11/30/17) we were contacted by Officer J. Cozine #10977 and she
advised that Reyes had fled from her detention. I have also had prior contacts with Reyes where he fled from my
detention and I know he has also been violent with other officers in the past during arrest.
As Officer Vong talked to Reyes about his red light violation, I heard Officer Vong order Reyes to stop as he exited
our patrol vehicle. I quickly looked up and saw the pedestrian red light was blinking red as Reyes disobeyed my
partner's lawful command to stop and entered the roadway (Violation of 21453(D) CVC) northbound onto PCH. At
this time I felt that Reyes was not going to make it across PCH in time for the light change since it is a large major
highway (7 lanes of traffic) and for his safety and our safety I drove our patrol vehicle to the middle of the
intersection and activated our emergency lights to prevent Reyes and us being struck by a vehicle.
I immediately exited our patrol vehicle and saw that he had an unknown object clenched in his right hand. The
object in his right hand was a straight object dark in color that could potentially be used as a weapon against my
partner and I. I withdrew my Conducted Electrical Weapon (CEW) from my holster to be prepared for an attack
from Reyes since he had already failed to comply with my partners lawful commands to stop and get on the
ground.
As I exited my patrol vehicle, I approached Reyes to take control of him and to safely take him out of the lanes of
traffic. As I approached Reyes, I advised him that he was going to be "Tazed." He asked me, "For what?" and I
told him that he was walking on a red light. I then attempted to calm Reyes by telling him to relax as my partner
and I approached him to take control of him and take him into custody.
Reyes now directed his attention to me and began to blad his body leading with his left shoulder and his right fist
still holding onto an unknown object behind him. As I came close to Reyes, he swung his right fist and punched
the right side of my face. At this time Officer Vong performed a takedown on Reyes. Reyes landed on his stomach
as Officer Vong landed on top of Reyes. Since Reyes had clearly demonstrated disregard for the law, our lawful
commands and his intention to violently resist (Punching me in the face) I quickly discharged my CEW against
Reyes right shoulder to prevent him from assaulting us. I discharged my CEW for a 5 second cycle. After I saw
that he was still violently resisting I again activated my CEW for a second cycle until I saw that he had stopped
resisting and Unit 4C75 (Officer G. Payan #10557 and Officer O. Ponce #11018) assisted us into taking Reyes
into custody. The object that Reyes was holding in his right hand was later found to be a comb.
Reyes punch to the left side of the face caused swelling and bruising to the left side of my nose. He also
connected with my lower lip causing it to split open, swell and bleed.
While at the scene I was informed that Reyes was found in possession of methamphetamine and a glass pipe a
direction violation of the "Longo Sureno Gang Injuction" case , which is a listed injunction violation in
section "C" Stay Away From Drugs. This violation was committed in a public place well within the "Safety Zone."

Once Reyes was taken into custody, Long Beach Fire Department Engine #7 and Rescue #10 arrived on scene.
Reyes was treated at the scene by LBFD and transported to St. Mary's Hospital to be cleared for booking.
Unit FEL40 (Officer F. Archuleta #10667 and Officer L. Newton #10649) transported Reyes from the hospital to
our booking facility were he was booked as charged.
Unit DE4 () arrived on scene and was advised of the use of force.

On February 3, 2018 at approximately 2006 hours, my partner (Officer O. Ponce #11018) and I (Officer G.
Villescas Payan #10557) were working uniform patrol in a mark black and white vehicle as unit 4C75. We
assisted Unit DE45 (Officer H. Vong #10124 and Officer C. Del Real #6228) in the area of Pacific Coast Highway
and Atlantic Avenue, regarding a pedestrian stop (call #1583).
While driving eastbound PCH in the #1 lane of traffic toward Atlantic Avenue, I observed (from approximately 40
yards away) unit DE45 attempting to contact a male subject (later identified as Arrestee Juan Reyes) who was on
the east crosswalk of Atlantic Avenue walking northbound. I advised Officer Ponce to assist unit DE45.
As we approached, Officer Vong and Officer Del Real where contacting Reyes. Officer Vong had his weapon
drawn and it appeared he was giving Reyes some sort of commands. I was unable to hear what was said due to
the distance. It appeared Reyes refused to comply with their commands and began to backpedal away from
Officer Vong and Officer Del Real. Officer Vong quickly holstered his weapon and prevented Reyes from fleeing
the scene by wrapping his arms around him and conducted a takedown.
Once on the ground Reyes was faced down on his stomach and Officer Vong was on top of him. Reyes had his
arms tucked in underneath his stomach/ chest areas. Officer Vong had his right arm wrapped around Reyes' head
area.
We exited our vehicle and assisted unit DE45 in handcuffing Reyes. I took control of Reyes' left arm and my
partner took control of Reyes' right and handcuffed him.
After Reyes was handcuffed I noticed Officer Del Real had discharged his Conducted Electrical Weapon (CEW)
during the incident.

On 2/3/18 at approximately 2006 hours, my partner (Officer G. Payan #10557) and I (Officer O. Ponce #11018)
were working uniformed patrol as Unit 4C75. We assisted Unit DE45 (Officer H. Vong #10124 and Officer C. Del
Real #6228) at the intersection of Pacific Coast Highway and Atlantic Avenue regarding a pedestrian stop (Call
#1583).
Prior to the stop my partner and I were in stopped in the #1 eastbound lane of Pacific Coast Highway, just west of
Atlantic Avenue. We were behind approximately 4-5 vehicles west of the intersection. My partner observed Unit
DE45 attempting to make a pedestrian stop on a subject (Later identified as Juan Reyes) at the north cross walk
of the intersection. My partner advised me to drive towards the crosswalk to assist them. I activated my patrol
vehicle light bar and drove eastbound in the westbound lanes of traffic towards the north crosswalk of the
intersection.
As we were approaching the intersection I observed Reyes standing near the center of the north crosswalk.
Officer Vong was just west of Reyes and Officer Del Real was just east of Reyes. Officer Vong and Officer Del
Real appeared to be attempting to detain Reyes. As we entered the intersection of Pacific Coast Highway and
Atlantic Avenue, Officer Vong approached Reyes from behind and Officer Vong wrapped both his arms around
Reyes torso and performed a take down on Reyes.
I exited my vehicle and noticed Reyes was face down on the ground and Officer Vong was on top of Reyes' back.
Officer Vong's right arm was wrapped around Reyes' head area, and Reyes had his arms tucked under his body.
Officer Del Real was kneeling down near Reyes' left side.
I kneeled down on Reyes' right side and my partner was on Reyes' left side. My partner and I were both able to
get Reyes' arms out from under his body. After my partner and I had control of Reyes' arms, Officer Vong got off

Reyes' back. I handcuffed Reyes. Reyes appeared to be conscious during the entirety of the incident. After I
was handcuffed Reyes I noticed Officer Del Real had his Conducted Electrical Weapon (CEW) in his hand and it
appeared to have been discharged.
My partner and I assisted Reyes to his feet and I escorted him to the back of our patrol vehicle. I opened the rear
passenger door and told Reyes to enter the vehicle. Reyes entered the vehicle and sat himself in the seat, I
placed a seatbelt onto Reyes.
Long Beach Fire Department Truck 7 and Rescue 10 arrived on scene. Long Beach Fire Department personnel
advised us that Reyes was going to be transported to St.Mary's Medical Center. Prior to being transported, I
conducted a pre-booking search of Reyes and located a small cylindrical glass tube with a bulbous end, in the
right pocket of his shorts. The glass tube appeared to be charred on the bulbous end. Due to my training and
experience I believed this to be a device used to smoke Methamphetamine. Also in his front right pocket was a
small plastic baggie containing an off white crystalline substance which I believed to be Methamphetamine. I
gave possession of the items to Officer B. Vriens #10658, and he kept possession of the items until placing them
into evidence. For further, see Property Report.
Reyes was transported to St. Mary's Medical Center to be medically evaluated.

Incident:
On 02/03/2018 at approximately 2006 hours, I () was working unit DE4. I was
working uniformed patrol in a marked black and white patrol vehicle. I was on patrol in the area of Pacific Coast
Highway and Atlantic Avenue.
I was facing southbound on Atlantic Avenue about 50 feet south of Pacific Coast Highway. I heard a police siren
from behind me, near the intersection of Pacific Coast Highway and Atlantic Avenue. I looked in my driver's side
rear view mirror and I observed that there were two to three officers near the northeast corner of the intersection.
The officers appeared to be wrestling with someone on the ground.
I made a U-turn and drove northbound on Atlantic Avenue. I pulled into the intersection and blocked northbound
lane number 2 traffic with my patrol vehicle to divert traffic away from the officers. At that point, I identified the
officers as Officer H. Vong (#10124), Officer C. Del Real (#6228), Officer G. Payan (#10557) and Officer O. Ponce
(#11018). The suspect was later identified as Juan Carlos Reyes.
I exited my patrol vehicle and observed that the officers were placing Reyes into handcuffs. I approached and
observed that Reyes had two CEW probes attached to his left shoulder blade area and that the wires were
attached and hanging from his hooded sweatshirt.
I asked Officer Vong and Officer Del Real what had occurred and I was told that a use of force incident had
occurred and that an CEW had been applied to Reyes. In addition, I was advised by Officer Vong that a carotid
restraint had been applied to Reyes and that Reyes had possibly been rendered unconscious.
I observed that Reyes was now conscious and breathing and lying in a prone position. Officer Ponce assisted
Reyes into a standing position and Reyes was able to stand in an upright position without assistance. Reyes had
an abrasion on the left side of his forehead, just above his left eye. This injury appeared to be consistent with a
scrape against the pavement. I later observed that he had abrasions on both of his knees which also appeared to
be consistent with a contact with the asphalt of the street.
Based upon the type of force used and the apparent injuries, I requested that the Long Beach Fire Department

further medical evaluation.
I observed that Officer Del Real had redness and swelling to his lower lip and a small amount of blood in his

mouth. I also observed that he had redness on the left side of his nose and his face appeared flushed red. I
asked him about his injuries and Officer Del Real advised me that Reyes had struck him in the face with a closed
fist. I asked LBFD personnel to provide first aid to Officer Del Real.
I observed that Officer Vong had a laceration on the middle finger of his left hand. I asked him about it and he
informed me that he had received the injury while attempting to apprehend Reyes. LBFD personnel provided first
aid and bandaged Officer Vong's injury.
Video of Incident:
Officer Vong and Officer Del Real were both equipped with body worn camera devices. I later reviewed their
video.
I was unable to locate any other video cameras that may have captured this incident.
Interview of Suspect Reyes:
I went to St Mary Medical Center and conducted an audio recorded interview of Suspect Reyes. I read him his
Miranda Admonishment from LBPD form 1000.008. Reyes informed me that he did not understand his Miranda
rights and that he wanted to speak with a lawyer.
I attempted to conduct an Administrative Interview of Reyes however he refused cooperate with the questioning. I
asked him why he had been involved in a fight with the police officers and he told me that he had not been
involved in any fight. He advised me that the officers had stopped him for no reason and that he did not want to
talk to me. I asked him how he had received his injuries and he refused to make any statements to me.
I uploaded the audio file to MIDEO.

Narrative
- On the date/time of this incident, I was equipped with a Body Worn Camera (#BWC).
- Prior to filing this report, I viewed my BWC footage of the incident.
USE OF FORCE:
On 02/03/2018, my partner (Officer C. Del Real #6228) and I (Officer H. Vong #10124) were assigned to the West
Division Directed Enforcement Team and working as Unit DE45. On this date, we were conducting a follow-up
gang investigation in the area of Atlantic Avenue and Pacific Coast Highway.
My partner and I were dressed in Long Beach Police Department uniforms. The uniform consisted of a name
plate on the right chest, a police badge on the left chest, a LBPD shoulder patch on both shoulders, and a Sam
brown duty belt. We were driving a dual purpose vehicle equipped with emergency lights and siren. We were
easily identified as police officers.
At approximately 2005 hours, my partner and I were in the area of Atlantic Avenue and Jackrabbit Lane. As my
partner drove southbound on Atlantic Avenue, my attention was drawn to a male subject (later identified as Juan
Carlos Reyes) walking northbound on the east sidewalk of Atlantic Avenue just south of Jackrabbit Lane. While
watching the subject, I observed him walk against the solid red light at this intersection and continue northbound
on Atlantic Avenue. Reyes was in violation of 21453 (b) VC - pedestrian in roadway during a red light.
Due to vehicle traffic, we were unable to immediately contact Reyes for the above violation. I continue to watch
Reyes as he approached the intersection of Pacific Coast Highway and Atlantic Avenue. As vehicle traffic cleared
up, my partner was then able to make a U-turn and drove northbound Atlantic Avenue.
Officer Del Real drove our vehicle towards Reyes. It was at this point, Reyes was standing on the sidewalk at the
southeast corner of Pacific Coast Highway and Atlantic Avenue. Officer Del Real paralleled our vehicle next to
Reyes. From inside the vehicle, I contacted Reyes and saw Reyes wore a loose dark colored sweat shirt and
baggy white shorts.
As I spoke to Reyes, I soon recognized him as East Side Longo Gang Member "Juan Carlos Reyes" with the
moniker of "Cosmo". I know Reyes from prior contacts and from speaking with other officers who have contacted
him. In fact, on November, 29 2017, Officer J. Cozine #10977 told me that Reyes fled from her in the area of
Doidge Court and Orange Avenue when she attempted to contact him. In addition, I know Reyes is on the

Longos/Surenos gang injunction case number . Jackrabbit Lane and Atlantic Avenue falls within the
"Safety Zone", which is outlined in the court case. Subsection "M" of the injunction mandates that restrained
person(s) must obey all laws.
Based on the above facts and my observation, I believed Reyes to be in violation of the gang injunction, 166 (a) 9
PC.
As I spoke to Reyes, his body was oriented in a northerly direction. Reyes' body was bladed and I could only see
the left side of his body. While speaking with Reyes, he kept on adjusting his waistband area with both of his
hands. Through my training and experience, I know the waistband area is a common place where weapons are
concealed.
I advised Reyes of the above violation (crossing against the red) and told Reyes I wanted to talk to him. Reyes
stated, "For what?" As I exited my police vehicle, Reyes immediately began to walk away from me. Reyes walked
northbound in the east crosswalk of Atlantic Avenue at Pacific Coast Highway.
As Reyes walked away from me, his back was turned to me. Reyes' hands were partially obscured from my
vision and I could see an unknown black object in right his hand. Fearing that Reyes was armed, I loudly ordered
Reyes to "Stop" several times, which he refused to comply.
As Reyes got 3/4 of the way through the crosswalk, Reyes quickly turned around and faced me. Fearing that
Reyes was armed with a weapon, I drew my pistol and pointed it at him. I used my pistol's weapon mounted light
and illuminated Reyes' body. It was at this time I could see that the object in his right hand appeared to be a black
hair comb.
As Reyes faced me, I saw Officer Del Real had moved our police vehicle into the intersection closer to Reyes and
me. Officer Del Real exited the vehicle and was approaching Reyes from the west. As Officer Del Real walked
towards Reyes, I saw Reyes square up his body towards Officer Del Real. Fearing that Reyes was going to
attack Officer Del Real and use the comb as a weapon, I quickly holstered my pistol and attempted to take control
of Reyes's arms. I approached Reyes and attempt to wrap my arms around Reyes's arms. As I did this, I felt
Reyes violently twist his upper torso to his right towards Officer Del Real. Using my forward momentum, I pushed
Reyes to the ground.
Reyes fell forward in a northeasterly direction. As Reyes fell, I maintained my position and fell on top of him.
While on the ground, I saw Reyes had his right hand tucked underneath his midsection and felt Reyes attempting
to push himself up. Given the fact that Reyes had not been searched and already violently resisted, I did not want
Reyes to recover to his feet and fight with my partner and me.
Because Reyes fled from my lawful detention during the initial contact, I was not able to retrieve any of my impact
weapons from my vehicle. In addition, once Reyes and I were on the ground we were in close proximity. At this
distance, I believe that a Conductive Electrical Weapon (Tazer) would not be effective.
I believed that the most effective and viable option I had was to apply the "Carotid restraint." While on the ground
with Reyes, I encircled my right arm around his neck area. My right bicep and right forearm applied pressure to
the left and right side of Reyes' carotid arteries.
As I applied the hold on Reyes, I heard Officer Del Real tell me that he was going to deploy this Conductive
Electrical Weapon (Tazer). I applied the hold for approximately 10 second until Reyes ceased to resist and
stopped moving. I believed Reyes was rendered unconscious as a result of the carotid restraint.
It was at this time, Officers G. Payan #10557 and O. Ponce #11018 assisted us on scene. Officers Payan and
Ponce took control of Reyes' wrist, placed him into handcuffs, and rolled Reyes over to his right side (recovery
position). After several seconds, Reyes regained consciousness and began to yell at officers.
Once handcuffed, no further force was used on Reyes.
Unit DE4 () assisted us on scene within seconds. I advised of the
use of force.immediately requested for Long Beach Fire Department to respond and render
