Force Used: Officer Sidders used bodily force, a take down and applied the carotid restraint on ARR Ortiz. Officer Sears used bodily force as well as pain compliance with the CEW (drive stun). Officer Jenkin used pain compliance with the CEW (drive stun). The force being used by officers was in response to ARR Ortiz being physically combative. ARR Ortiz stated he was not injured (for further, see BWC interview), but had a visible abrasion to the left side of his forehead. Injuries: had a complaint of pain to his left ankle and left knee. There was visible redness to the right knee. suffered bruising to left knee. For further, see photos. Photographs/Videos: Officer Rodriguez took photos of the scene, the officers involved, their injuries and ARR Ortiz. Officer George and Officer Van went to three locations in the area where the incident took place to try and obtain video footage (for further, see follow up report). Sergeant Benson observed video on 2nd St. (city cameras), it did not capture the use of force incident (for further, see Medio). A business nearby captured a portion of the incident. After reviewing the footage, the video was consistent with the officers report (for further, see Medio). I provided the officers involved with alternative force options, such a utilizing the CEW with a cartridge or using the baton to create distance with an assaultive suspect. I also went over control holds and discussed searching techniques with Officer Sidders and requested that he retrain Officer Sears, or take him to an ACT Instructor for further training if this is an issue. Comments/Response From [ Lieutenant James Richardson ] Approved - In Policy - No further action recommended. Sergeants Quinones and Benson had discussions with the involved officers about other options while using force, such as using a cartridge on the CEW, and changing tools when one is not working. Officer Sears was given additional training on the standing modified search, facilitated by FTO staff, on 8/29/19. Sergeant Benson and I discussed the option of calling IA regarding this UOF. Although the scrapes to the arrestees head were not the reason the arrestee was taken to the hospital, the use of the carotid being the reason, I would have suggested making a phone call to the on-call IA sergeant to allow them to determine if they wanted to respond. Officers Sears, Sidders, and Jenkin received verbal counseling regarding the consideration of other force options when the current one does not seem to be effective. Sergeants Quinones and Benson received verbal counseling regarding their decision to not call the on-call IA sergeant to allow him/her to make the decision as to whether or not to respond due to the arrestee's injuries. However, the incident was captured on video from cameras on a residence. Correct Actions: Involved officers were given verbal retraining regarding force options. Probationary officer Sears was given retraining on standing modified searches and the sergeants were given retraining on when they should call IA and make appropriate notifications.
