****USE OF FORCE****
On Sunday, 7/7/2019, at approximately 2339 hours, I, Officer J. Asato #11333, was working in a full regulation
Long Beach Police Department uniform and assigned to work as unit 2A14. I assisted unit 2A12, Officer E. Shear
#11334, who was dispatched to regarding a domestic violence incident (call#1531).
The call stated to meet the calling party in the alley regarding a domestic violence incident. The calling party
pepper sprayed her drunken husband who attempted to hit her. The husband was described as a male White, 56
years old wearing a white T-shirt and Khaki pants. No weapons were mentioned.
Multiple units assisted including unit 2A11 (Officer J. Jenkin #11023) and unit 2A41 (Officer K. Lopez #11091).
is an east facing single story house located on the west side of Stanley Avenue south of 10th
Street. The house is accessed from the sidewalk by a pedestrian gate between the front yard and the sidewalk.
The north facing front door opens into an open living room. West of the living room is the kitchen with a sink
located on the west wall of the kitchen.
On arrival with Officer Jenkin and Officer Lopez, we contacted the victim, later identified as , who
informed us her husband/Arrestee, later identified as Wesley Clark, was inside of the residence. From the
sidewalk in front of the residence, I could clearly hear the sound of Clark screaming unintelligibly from inside of the
residence.
Due to the exigency of the domestic violence incident and the sound of distress from inside of the residence,
Officer Jenkin, Officer Lopez and I entered through the open front door of the residence to check the well being of
the Arrestee.
From the living room of the residence, I observed the Arrestee standing inside of the kitchen facing the sink away
from us. The Arrestee was wearing a white button up shirt and light colored pants (matching the dispatched
description). The Arrestee was yelling unintelligibly in anger. As we approached the Arrestee, I could see blood
smeared on both of his hands and large shards of broken glass next to him on the counter next to the kitchen
sink. The Arrestee's face was red and tears were streaming from his face. I smelled the strong odor of an
unknown alcoholic beverage emanating from the Arrestee's breath and person.

Narrative
Due to the report of possible domestic violence, the close proximity of large shards of glass to the Arrestee, the
Arrestee's heightened emotional state, and his location in the kitchen, I was fearful that he would arm himself with
shards of glass or other weapons nearby (kitchen knives) and attack others or injure himself. Due to these fears, I
decided the Arrestee needed to be immediately detained for our safety and his own. I told the Arrestee, "Police,
put your hands behind your back." The Arrestee did not comply and as he turned towards us he swung his arms
wildly.
In order to effect a lawful detention of the Arrestee, I grasped the Arrestee's right arm with both of my hands and
once again said, "Police, put your arms behind your back." Officer Lopez grasped the Arrestee's left arm. As I
attempted to place the Arrestee's right arm behind his back, he physically resisted by pulling his right arm away
from me and towards the front of his body. The Arrestee yelled, "Get off of me!"
The Arrestee then used his right elbow to strike me twice in my upper torso (I was still holding his arm and I was in
close proximity to him). Officer Lopez yelled, "Stop resisting!" Due to the Arrestee's violent resistance
(deliberately striking me with his elbow), I placed my left forearm behind the Arrestee's neck and while holding his
upper right arm with my right hand, I drove the Arrestee to the ground. The Arrestee landed on the kitchen floor
north of the sink with his stomach to the ground, I placed my upper torso on the right side of the Arrestee's back in
order to pin the Arrestee to the ground. Officer Jenkin again told the Arrestee to put his arms behind his back.
The Arrestee continued to resist by kicking his legs and refusing to place his arms behind his back.
Due to the Arrestee's continued violent resistance, I encircled the Arrestee's neck with my left arm, locked my left
hand to my right biceps and applied a Long Beach Police Department approved control hold - the carotid control
hold. I applied pressure to the Arrestee's carotid arteries located on the sides of his neck with my left arm. I held
the hold for approximately five seconds and during that duration, the Arrestee continued to resist while Officer
Jenkin placed handcuffs on him. Shortly before the time Officer Jenkin got the handcuffs on the Arrestee, he
suddenly stopped resisting. Officer Lopez informed me the Arrestee was unconscious (Officer Lopez had a direct
view of the Arrestee's face and I did not) and I immediately released the control hold. I observed the Arrestee was
unconscious and I immediately moved him onto his right side and checked his vital signs. The Arrestee was
breathing and had a pulse. Officer Jenkin later checked the handcuffs for fit and double locked them.
Due to the fact that I already had a significant position of advantage over the Arrestee (on the ground pinning the
Arrestee to the ground), I determined releasing the advantageous position in order to deploy pepper spray, an
Electronic Control Device (TASER), Sap, or baton, was not practical or safe. I also determined the Arrestee would
continue to violently resist and in order to stop his violent resistance, and to prevent injury to Officer Jenkin,
Officer Lopez, and myself, I decided to employ the carotid control so we could take the Arrestee into custody.
Officer Lopez immediately requested paramedics and a field supervisor.
Officer Lopez, Officer Jenkin, and I did not suffer any injuries as a result of the use of force against the Arrestee.
Due to my positioning on top of the Arrestee, I was not able to observe the actions of Officer Lopez or Officer
Jenkin once we were on the kitchen floor.
Unit 2S7 (Sergeant K. Green #6276) responded to the scene.
Long Beach Fire Department Engine 4, Rescue 4 and BLS 2 arrived and evaluated the Arrestee. Officer Lopez
rode in the back of BLS 2 as the Arrestee was transported to St. Mary Medical Center for medical clearance.
Officer Shear arrived and conducted knock and talk interviews. See Officer Shear's follow up report for further.
Officer Jenkin spoke with Hicks. See Officer Jenkin's follow up report for further on Hicks' statement.
Officer Shear took photographs of the scene, the Arrestee, Officer Jenkin, Officer Lopez, and myself. Officer
Shear later uploaded the photographs to MIDEO.
Officer Shear responded to St. Mary Medical Center and after the Arrestee was medically cleared by the hospital
staff, he transported the Arrestee to the Long Beach Police Department Jail where the Arrestee was booked for,
243(e)(1) PC Domestic battery, 148(a)(1) PC Resisting a Police Officer, and 69 PC Resisting an executive officer.

On 7/7/19 at 2338 hours, I (Officer K. Lopez #11091) was working full uniformed patrol in a marked black and
white patrol vehicle. I assisted Unit 2A14 (Officer J. Asato #11133) regarding a domestic violence that just
occurred a . (Call #1531)
The call advised the Victim pepper sprayed the Suspect because the Suspect attempted to hit her.
Upon arrival, I observed a female (later identified as ) running to the front gate. The female
appeared to be in distress and crying.
The Victim stated he (later identified as her husband, Suspect Wesley Clark) was inside. The Victim's voice was
shaky and frantic.
I heard a male screaming from inside the residence. I asked the Victim if that was him (Suspect). The Victim
stated it was and she pepper sprayed him because she was scared. The Victim stated the Suspect was a nice
guy and not to hurt him. The Victim informed us that she had dogs inside the residence and stated to be careful.
Officer Asato, Officer J. Jenkin #11023, and I went inside the residence to contact the Suspect due to the fact that
the Suspect was pepper sprayed and we could hear him yelling from the front gate of the residence which was
located approximately 15 away from the front door as if he was in distress. When I entered the residence, to check
the Suspect's well, I followed the screams into the kitchen.
I observed the Suspect learning over the sink and observed the Suspect's forearms covered in blood. At this time I
could not see where the blood was coming from or whose blood it belonged to.
Officer Asato advised the Suspect that we were the police and asked what was going on.
The Suspect continued to yell (unknown slurred words) and turned towards us. The Suspect had his eyes closed,
swaying from side to side, and began to swing his left arm towards us with an open hand in attempt for us to keep
our distance. The Suspect, still holding onto the sink, turned back towards the sink.
At this time, I could smell a strong alcoholic substance coming from the Suspect. Based on this, the Suspect
demeanor, slurred words, and unsteady balance, I believed the Suspect was intoxicated.
At this time, I believed the Suspect was involved in a domestic violence incident, had not been searched,
appeared to be intoxicated, was covered in blood, and swinging his arm towards officers. Based on these facts, I
was going to place the Suspect into handcuffs, for everyone's safety and pending further investigation. Officer
Asato told the Suspect to put his hands behind his back. The Suspect ignored the commands and remained

facing the sink with both hands on the counter.
The Suspect was still standing in front of the sink with both hands on the counter. Officer Asato reached for the
Suspect's right arm. At the same time, I reached for the Suspect's left arm. The Suspect immediately pulled in his
left arm to the center of his chest. In my peripheral vision I was able to observe the Suspect pull his right arm up
and attempted to elbow Officer Asato.
I told the Suspect, "Stop resisting", and to give me his arm.
The Suspect's body was leaning on the sink, his left hand was in a fist, and his forearm was tightly clenched to his
chest. I was able to place my right hand in between the Suspect's left forearm and chest and grab his wrist.
At this time, I observed Officer Asato place his left forearm around the back of the Suspect's neck. I felt the
Suspect turn to the right and begin to fall.
Based on my positioning, in between the sink and the Suspect, my right hand being pressed against the Suspect's
left forearm and chest. I was unable to release my grip of the Suspect's left wrist and I fell with the Suspect to the
ground.
I fell on the left side of the Suspect's back. I was able to release my grip of the Suspect's left wrist. I observed
Officer Asato begin to apply the carotid. I attempted to grab the Suspect's left arm and place it behind his back.
The Suspect's left arm was still tight to his chest and would not give it to me. I heard Officer Jenkin state
repeatedly to the Suspect to put his hands behind his back.
I looked at the Suspect's face as Officer Asato was applying the carotid. The Suspect's face went from teeth
clenched, and eyes tightly shut to a relaxed face, indicating to me that Officer Asato had successfully applied the
carotid and the Suspect was rendered unconscious. I advised Officer Asato that the Suspect was unconscious.
I was able to obtain the Suspect's left forearm and place it behind his back. Officer Jenkin grabbed the Suspect's
right hand and placed it behind his back. Officer Jenkin placed the Suspect into handcuffs (checked for fit and
double-locked).
Officer Asato checked the Suspect's pulse and observed the Suspect's breathing.
The Suspect regained consciousness and was confused about what had just occurred. The Suspect could not
remember anything.
The Suspect was transported to the hospital by Long Beach Fire Department.
The Suspect was later transported to jail.

Narrative
I then asked the victim if she observed the use of force between Clark and officers in the kitchen. The victim
stated she walked inside the house to see what was going on and did not see where officers were until she
walked into the kitchen. While standing at the door way in between the dining area and the kitchen, the victim
observed officers on the ground around Clark. The victim stated she could not see what was happening, just that
we were, "On top," of Clark. The victim walked away, but heard an officer say, "Put your hands behind your back."
Unit 2S7 (Sergeant K. Green #6276) responded to the scene.

I collected the pepper spray used by the victim. I kept it in my possession until later placing it into evidence. For

The victim declined the Long Beach Police Department Domestic Violence Forms, for further refer to submitted

FOLLOW-UP INVESTIGATION:
I took photographs of the exterior, kitchen, dining room and living room of . In the kitchen I
photographed the broken glass and the blood on the ground. I also took photographs of the front, back and both
sides of Officer Jenkins while she was at .
I responded to St. Mary's Medical Center to assist Officers Lopez and Asato with the medical clearance of Clark.
Doctor medically cleared Clark for booking prior to my arrival at the hospital.
At the hospital I photographed the front, back and both sides of Officers Asato and Lopez. I also took a closer
photograph of the front right side of Officer Asato's uniform which appeared to have scuff marks on it. I took
overview photographs of Clark while at St. Mary's Medical Center.
I walked Clark out to my car to transport him to 400 West Broadway for booking. Clark was asking me questions
about what was going on with his situation. While Clark was speaking to me, I could smell the strong odor of
alcohol emanating from his breath and person. Clark would repeatedly ask me the same questions over and over
and did not seem to understand the simple responses I was providing him. Clark's eyes were watery and red,
however he told me he had gotten pepper spray in his eyes and face. Clark's demeanor was argumentative
when speaking with him, however he generally complied with instructions given.
Prior to transporting Clark, I checked his handcuffs for proper fit and made sure they were double locked. Clark
did not complain about his handcuffs while in custody.
BOOKING:
At 400 West Broadway, I took close up photos of Clark's neck and attempted to take photos of his hands. I was
not able to get good photos of his hands because Clark kept pulling away and turning his body away. He said he
did not want me taking photographs of his hands, but would not give me a reason why. Clark also refused to
provide a BAC sample.
At the request of Officer Asato, I had Clark booked for violations of 69 PC - Obstructing an Officer by Force or
Violence, 148(a)(1) PC - Obstruct/Resist/Delay an Officer and 243(e)(1) PC - Domestic Battery (Booking #
5681565). I left Clark in the custody of the 6th floor men's jail staff.
NOTIFICATIONS:
I notified the jail nurse, the booking Sergeant (Sgt. Deprete) and the 6th floor jail staff of the use of the carotid
restraint.
EVIDENCE:
I seized Clark's white outer shirt which appeared to have pepper spray on it and booked it as evidence at 400
West Broadway.
ADDITIONAL INFORMATION:
Officer Jenkins provided me photographs she took of Hicks,and the kitchen of Hicks' residence. I downloaded all
the photos to Mideo.

Narrative
On 07/08/2019 I (Detective A. Vega #5944), working in the Domestic Violence Detail, was assigned domestic
violence incident DR 190037145 that was reported on 07/07/2019. The report lists as the victim and
Wesley Clark as the suspect. Clark was arrested and resisted with force and struck one of the officers with his
elbow twice. For further see Officers J. Asato #11333, K. Lopez #11091, and J. Jenkin #11023 reports.
I went to 6th Floor Men's Jail to contact defendant Clark for his statement. I escorted Clark to the interview room
in the Men's Jail. I had read his Miranda Rights per PD Form 1000.008 and I read him his Miranda Rights. I
asked Clark if he understood his rights and he said, "Yeah, I should probably do that then, right?" I asked him
what he meant by his question and he said, "Number 4." I told Clark I could not advise him on what he should do
but that it is his right to have a lawyer present during questioning.
He asked me what his charges are and I advised of he was arrested for domestic battery and resisting arrest. I
asked him if he is invoking his rights to have a lawyer present during questioning and he told me, "Yes, its the
smart thing to do."
I did not question Clark regarding his arrest.

Narrative
On Sunday 7/7/19, at approximately 2352 hours, I (Sgt. K. Green #6276) responded to
regarding a use of force incident that had just occurred. Call #1531.
Upon my arrival, I contacted the Officers involved in the use of force incident to ascertain what had occurred and
conduct an administrative investigation surrounding the incident.
As a part of my investigation, I responded to our booking facility at 400 West Broadway to conduct an interview of
ARR Wesley Clark. At approximately 0115 hours, on 7/8/19, I spoke to Clark inside of our booking area. I audio
recorded this conversation. I placed a copy of this recording into Mideo.
Upon speaking to Clark I immediately detected a strong odor of alcohol emanating from his person. Clark had a
flushed face, his speech was slurred, and his demeanor would fluctuate from cooperative and calm to
argumentative and hostile. Clark was difficult to speak to due to his apparent level of intoxication. He would not
directly answer questions and would ramble when speaking, not always making sense.
It should be noted that I did not observe any visible injuries to Clark's face/head/neck areas. He had dried blood
on his hands. He did not appear to have any other injuries.
The following is a synopsis of my interview with Clark. For further on the interview, please refer to the audio file in
Mideo.
I explained to Clark that I was conducting an administrative investigation into the use of force incident involving
him. He explained that he had gotten into an argument into his wife which led her to pepper spray him. He stated
that he had been drinking earlier in the night and had consumed 2-3 beers.
Clark recalled officers arriving at his home and recalls being in the kitchen at the time. I asked Clark if he recalled
the officer saying anything to him and he stated they made "agreements". I asked him to explain what he meant
but he was unable to be more specific.
He stated he recalled the officers grabbing his arms after his wife pepper sprayed him in the face. Clark then
stated that the officers read him his rights, then put him to the ground and handcuffed him.
Clark was extremely argumentative during my interview and I was unable to obtain any further details surrounding
the incident from him.
At the conclusion of my interview, I released Clark back to Officer Shear to continue the booking process. I had no
further contact with Clark.
