14. On 10/06/16, Sergeant Mendoza interviewed Accused Officer Moscoso.
Officer Moscoso denies all allegations. Officer Moscoso said he did not push
Complainant Cerda to the ground, but rather used an approved technique to
take Complainant Cerda into custody from his kneeling position.
Officer Moscoso said he did not observe Complainant Cerda to have any
injuries to his mouth consistent with a tooth contacting concrete. Officer
Moscoso added that he nor any other officer on scene was notified at the time
of the arrest of such an injury.
Officer Moscoso viewed the photographs taken of Complainant Cerda and
commented that he did not observe any injury to the area surrounding the
area of the broken tooth. He further added that during his visual scan and pat
down of Complainant Cerda he did not observe any bleeding or injury to the
mouth of Complainant Cerda.
15. To date (10/10/16), Sergeant Mendoza has had no form of communication
with either Witness nor Complainant Cerda.
