Officer Castillo detained the suspect, Trent Dupree, and asked for another unit because the suspect would not comply with his orders and said he would not be arrested. Officer Del Rosario did an initial investigation and advised Officer Castillo that suspect Dupree was to be arrested for domestic violence. Officer Del Rosario took the suspects right hand and Officer Castillo took the suspects left hand. Suspect Dupree then tensed up and grabbed hold of the tow bar and advised he was not going to jail. Suspect Dupree was repeatedly told to relax but did not comply. Suspect Dupree was able to break free of Officer Del Rosario grip and then faced him throwing his arm toward him. Officer Castillo then encircled his right arm around the neck of Dupree and applied the carotid hold. Officer Del Rosario thought Officer Castillo was struggling to maintain control of the suspect and used his baton three times striking the suspect two times to the lower right leg, one to right wrist. Officer Castillo then went to his knees bringing the suspect down with him while still applying the carotid. The suspect continued to resist by throwing punches at Officer Del Rosario. The suspect finally lost consciousness, just long enough to roll him onto his stomach and handcuff him. No other force was used. Defendant Dupree had two contusions to his lower right leg, and a complaint of pain to his right arm. The defendant was transported to Pacific Hospital and x-rays revealed a broken bone, right forearm. IA investigator Richardson responded per policy. Photos were taken, witnesses contacted, no video. Lt Assef was notified. The force used was justified and within policy.
