Starbird #5742 was contacted by Investigator Ken Schiffner from the Orange County District Attorney's Office (714-834-3466) regarding a resident of Long Beach, ARR James BALL. I was familiar with BALL because he sent an email to the Long Beach Police Department on 08/23/2017 declaring himself the new Chief Justice. The email is attached to this DR# under Mideo. Inv. Schiffner told me he was investigating Ball for making threats against an Orange County judge as well as the Report Officer 10842/REYES,FELICIANO JR Printed At 08/22/2019 18:38 Page 2 of 4 17-54269 Supplement No ORIG LONG BEACH POLICE DEPARTMENT Narrative District Attorney of Orange County. BALL had a warrant for his arrest and was on probation out of Orange County with search conditions. On 09/07/2017, detectives from LBPD CIS were asked by Inv. Schiffner to assist the OC DA's investigations team with their plan to conduct a probation search on BALL and place him under arrest for his outstanding warrant. LBPD CIS detectives were asked to surveil BALL' s residence until the OC DA's team could muster in Long Beach and conduct the arrest. When two LBPD CIS detectives arrived in the area of BALL's residence, they saw BALL standing in his driveway at the open driver's side door of the vehicle BALL was known to drive. Detectives C. Rose #5294 and D. Fritz #5372 approached BALL, identified themselves as police officers and informed BALL he had a warrant for his arrest. BALL did not comply with orders given to him by Detectives Rose and Fritz which resulted in a use of force, which was necessary to safely take Ball into custody (for further see Detectives Fritz and Rose's follow up reports). When I arrived onscene, BALL had already been handcuffed and was seated on the ground next to a grey Ford Mustang that was parked in the driveway of his apartment. BALL appeared to be extremely agitated and was sceaming obscenities. BALL yelled that he was the Chief Magistrate and we did not have the authority to arrest him. After being taken into custody, BALL was transported by Long Beach Fire Rescue 11 to College Hospital of Long Beach for medical evaluation. BALL was initially placed under arrest for his outstanding warrant as well as 148.9, resisting arrest. OC DA's investigators conducted a probation search of BALL's residence and found a small quantity of a substance believed to be methamphetamine and a glass pipe consistent with thetypeofpipeusedtosmoke methamphetamine. OC DA's investigators collected those items for evidence (for further see Inv. Schiffner's follow up). While conducting the search, items believed to be used in the manufacturing of butane hash oil were found and detectives from the LBPD Narcotics Investigations Unit were called and responded to the scene. Narcotic Detective Sgt. T. Long #5630, S. Destefano #5688, and C. Thue #5701 arrived and confirmed all elements of a butane hash oil lab were present in BALL's apartment (for further see Det. Thue and Det. Destefano's follow up reports). LBPD CIS Sgt. B. Bell #5205 responded to College Hospital to interview BALL. Sgt. Bell Mirandized BALL per PD form 1008.001, to which BALL yelled "FUCK OFF" in response. BALL was extremely agitated so no other questions were asked at that time. While still on scene, I spoke with who witnessed Detective's Rose and Fritz initially contact BALL. WIT told me he does not know BALL and was at the location to prepare for maintenance work he was going to do on the building. Just prior to the incident, WIT was standing near the passenger side of BALL's car, which was parked in the driveway of BALL's apartment, and BALL was standing on the other side of the car near the driver's side door. WIT saw two men (later identified as Detectives Fritz and Rose) exit their vehicles and walk toward BALL. WIT could see that both men were wearing police badges around their necks and heard them identify themselves as police officers as they approached BALL. One of the officers ordered BALL to the ground and he did not comply. At this time both officers (Fritz and Rose) had drawn their guns and were pointing them at both BALL and WIT who guessed at that point the police officers thought was an associate of BALL. WIT said he did not know the person who was later identified to him as BALL and yelled that to the police while he raised his hands to show he was not a threat. WIT then asked the officers if he could leave and after seeing they were not interested in him, backed away from the scene. WIT saw one of the men try to put ARR BALL into handcuffs, at which time BALL resisted and started to fight. One of the other officers then told WIT to call 911 and get them some help. WIT called 911 and walked around the building where he could not see what was happening. After calling 911, walked back around the building and saw BALL on the ground where the two police officers were handcuffing him. WIT took pictures with his cell phone and later showed them to assisting officer H. Cohen #5701 (for further see her follow-up report). Before clearing the scene, Long Beach Animal Control responded to ARR Ball's residence and took custody of a small dog that was inside BALL's apartment. After being medically cleared, ARR BALL was transported to the LBPD Jail at 400 W. Ball began to resist by attempting to pull away from the officers.stated, "He was resisting, trying to fight the officers." only observed the initial part of the incident and then walked away across the street to the north sidewalk of 59th Street unable to see what was happening. I asked whom the subject was that the officers were trying to arrest.stated it was the subject that was sitting in the back seat of the patrol vehicle (referring to Ball). stated he knew the officers involved were undercover officers because they were not wearing a police uniform, but where wearing a police badge around their neck that he immediately recognized. stated he did not observe anything further. Penn #5906) and I (Officer A. Nolasco #11020) were working uniformed patrol in a marked black and white patrol vehicle when we assisted Unit 3B19 (Officer R. Kaiser #5458) regarding an unknown trouble call (Later determined to be a use of force) (Call# 1074). Upon arrival, I observed officers on scene and a suspect (later identified as James Kevin Ball) was in custody. I conducted knock and talks at . I knocked on the door, but was unable to speak to any residents at that location. Long Beach Fire Department Rescue 11 arrived on scene and transported the suspect to College Medical Center. I rode with the suspect to College Medical Center. The suspect was being treated by Doctor Wahidi for his injuries. Unit 3C21 (Officer M. Heady #10033) arrived to College Medical Center. My partner and I left the suspect to the custody of Unit 3C21. It shall be known that the handling detectives requested that the suspect be released not booked. Rose #5294 and I, Detective D. Fritz #5372 were working in a plain clothes capacity to conduct a surveillance at in the city of Long Beach. The purpose of the surveillance was to assist the Orange County District Attorney's Office with a suspect named James Ball who made threats to a Judge and a District Attorney in their jurisdiction. Rose and I were also made aware that the suspect was on probation and had a warrant out for his arrest out of Orange County. This information was provided to us by Long Beach Police Detective W. Starbird #5742 It should be noted that Suspect James Ball is a self-proclaimed Sovereign Citizen. Ball sent an e-mail to LBPD Narcotics with "Virtus junxit mors non separabit" in the subject line. Further the e-mail had "Att: Chief Robert Luna Aug 22 2017 under the subject line. For further see e-mail. Based on my training and experience, Sovereign Citizens are very anti police and do not recognize police officers as having any legal authority to enforce the law. It is common for Sovereigns to resist arrest or even use violence to evade arrest or apprehension by law enforcement. Detective Rose and I were both in separate unmarked vehicles traveling eastbound 59th street when Rose told me on the handheld police radio that he saw the suspect. Suspect Ball was standing outside of a grey Ford Mustang which was parked in the driveway of the location. Rose and I made the decision to stop our vehicles and contact the suspect. Prior to conducting the opperation Detective Starbird advised us that Ball owned a primer grey Ford Mustang. Rose exited his vehicle and made contact with Ball first by saying "James" which caused Ball to look at Rose. I immediately recognized Ball as the person in the photo I was provided by Detective W. Starbird. Rose walked up the driveway towards Ball and I was approximately 5-7 feet behind him. I heard Rose Identify himself as a Police Officer while showing Ball his badge which was hanging from his neck on a string. I also yelled, "Police Officer" while looking at Ball. I displayed my badge which was hanging from my neck on a string. I held up my badge and continued to yell, "Police Officer". I also yelled for Ball to get on the ground to which he did not comply. During this time both Rose and I had our guns pointed at Ball. This had no effect on Ball at all. Ball appeared very agitated and began yelling that he was the, "Supreme Justice" and started to yell profanity and told me, "Fuck you, what is your name and your badge number". I told him to just relax and I would talk to him in a minute. During this time I observed Ball to be clenching a pointed object in each one of his hands. These object were later identified as a screwdriver and a "Vaping device". I observed Rose attempt to place Ball in a Twist Lock control hold. Ball immediately appeared to tense up his whole body and resisted Roses' attempt at a twist lock. Ball became increasingly agitated and continued using profanity and at one point called me a "Nigger". While Rose was attempting to gain control of Ball I observed 2 other male individuals watching what was happening. At that time I was unsure if these 2 males were somehow related to Ball which raised my concern. I pointed my weapon at one of the males who was wearing a black t-shirt and told him to stay back. The subject complied and was able to re-focus my attention on Rose and Ball. I observed Rose continuing to attempt to gain control of Ball and Ball continued to resist. Ball would not comply with our orders to stop resisting and go to the ground and place his hands behind his back. I observed Detective Rose place Ball in a Carotid Restraint in an attempt to gain control of him. Ball's body appeared to go limp and Rose assisted him into a seated position. A brief moment later Ball started fighting again, yelling profanity and kicking his legs. I grabbed his lower left leg and foot in an attempt to gain control of his legs to keep him from kicking at me. A short time later Detective Rose was able to place Ball's hands behind his back and handcuff him. Thue and I went up into the apartment and observed the following: two approximately two feet long glass cylindrical tubes filled with marijuana on the ground next to the bed. Each tube had a small pointed open end. One of the tubes also had the other end sealed by a piece of cloth. We also observed (4) separate larger zip-loc baggies containing marijuana, located on the floor next to the bed as well.We observed a plastic plate, tin foil on a pan in a small convection toaster,and a 4"x4" baking pan that all appeared to have remnanants of Hash Oil on them. The plastic plate was right next to the toaster and the baking pan was in the refridgerator. We observed (2) marijuana plants, one outside the bedroom window and the other outside the front door. We observed (3) used Butane gas cans, one on a table next to the bed, the other two next to the plant outside the window. We also observed (3) separate pieces of mail with the Defendant Balls name on it. Based on my training and experience I believe that all these items, absent the mail, are being possessed for the production of Butane Hash Oil. Det. Rose # 5294) was working with Detective W. Starbird # 5742 in a plainclothes capacity. Detective Starbird received a call from the Orange County District Attorneys Office (OCDA). At the conclusion of her conversation she advised me that we were being requested to perform surveillance and possibly arrest Suspect James Ball at his residence at in Long Beach. Detective Starbird further advised me that the OCDA'S office was trying to get a team together to come to Suspect Ball address to arrest him, and perform a probation search, but they were going to be delayed in trying to get their team together. Detective Starbird and I then drove to the Police Department to assemble a team, and brief them on the situation. I was familiar with Suspect Ball's case. Prior to this OCDA request, I had been briefed that Ball was being investigated by OCDA for threatening a Judge, and a Prosecutor in Orange County. I knew that Suspect Ball had a criminal background, and had just written a letter to Long Beach Police Chief Robert Luna. I had read the letter where Suspect Ball proclaimed to be the new "Chief Justice" and that he wanted everyone charged, arrested, detained, or held to have his or her 7th amendment rights to common law invoked. He further stated if an Officer was caught charging a Sovereign American without their constitutional rights, he (suspect Ball) could charge the Officer with felony treason, which is punishable by death. The letter went on to say that he was a police explorer at Westminster Police Department, and how he at one time idolized police. The letter continues on, at the end of the letter Suspect Ball writes " one last thing Chief, every prophecy in the bible shall come into affect, Revelation 13.10 "He that leadeth into captivity shall go into captivity, he that killeth with the sword must be killed with the sword". After we arrived at the Long Beach Police Department, Detective Starbird briefed Detectives D. Fritz # 5372, S. Magee, Sgt B. Bell # 5205 and myself. Detective Starbird advised us that Suspect Ball was living at Long Beach, Ca. Suspect Ball was driving a primer grey Ford Mustang (that should be parked at the residence. He had an outstanding warrant for traffic, he was on probation, and that he was being investigated for threatening a judge and a prosecutor. Detective Fritz used computer resources and retrieved a photo of the location. In that photo Suspect Ball's ford mustang was parked in the driveway. I saw that the vehicle was very identifiable. Detective Starbird provided a photo of Suspect Ball. I kept both the photos of the vehicle and Suspect Ball in my possession. Detective Starbird advised that Suspect Ball frequents a liquor store in the area, and besides his trips to the liquor store, he is mostly in his residence. The OCDA had requested that we perform surveillance, attempt to locate Suspect Ball, and arrest him if possible.As a team we collectively planned on how we would take Suspect Ball into custody if he came out of his residence. As we left the Long Beach Police Department, Detective Fritz and I were in communication via the police radio. Detectives Starbird and Magee were slightly behind us, and just out of radio range. Prior to getting to the location I took another look at the photos of Suspect Ball and his vehicle. I arrived in the area and began driving slowly e/b on 59th St with Detective Fritz directly behind me in his undercover vehicle. As we approached I could see Suspect Ball's vehicle backed into the driveway on the south side of the street. I saw an older MW subject in a bright red shirt standing on the passenger side of the vehicle talking to someone on the driver's side of the vehicle. The MW subject walked away from the vehicle w/b on the south sidewalk directly towards me. I could clearly see the subject in the red shirt was not Suspect Ball. As I continued to slowly move forward, the MW in the red shirt turned around and said something to a person who was crouched down at the open driver's door of the vehicle. Suspect Ball stood up and looked directly at me. I could clearly see that it was Suspect Ball and an exact match to the photo I had been provided. Suspect Ball was standing at the driver's door working on his vehicle. At this point I believed that Detectives Starbird and Magee were not far behind Detective Fritz and myself. I saw that where Suspect Ball was standing he had limited if any avenues of escape, I did not see anyone else around him,and we had the element of surprise. I did not want to let Suspect Ball get back into his residence, which would lead us to have to door knock his residence at a later time, and could create a barricaded suspect situation. I did not want Suspect Ball to get into his vehicle and leave the location. I formed the opinion that the safest way to detain/arrest Suspect Ball was for Detective Fritz and myself to contact him immediately. I advised Detective Fritz via police radio that Suspect Ball was at the driver's side door, and that we needed to contact him. I exited my undercover vehicle having my badge clearly visible, and I was wearing a tactical thigh holster. As I approached I could hear what I thought was the engine of his vehicle running (actually a generator) and a MH subject wearing a black shirt to the rear passenger side of the vehicle. I stated "James." Suspect Ball looked up at me and stated "what" and in an agitated voice stated something I didn't understand because I was telling him in a clear loud voice that we were the police and he was under arrest. I could see Suspect Ball was clinching items in both hands. I held my firearm in my right hand by my thigh as I held my badge up with my left hand telling him again we were the police. Suspect Ball took two small steps back and I could see he was holding a small screwdriver in his right hand like a knife and two other items in his left hand. Suspect Ball started to yell at Detective Fritz and myself. Detective Fritz and I began to give clear loud commands for Suspect Ball to get on the ground. Suspect Ball refused and stood in a fighting type stance holding the screwdriver, and arguing with me. I was approximately 10ft away from Suspect Ball. Due to my training and experience, I know that if Suspect Ball was to lunge at me with the screwdriver he could possibly stab be before I was able to fire a shot with my firearm. I was using his open car door and a trashcan as a barrier between us in case he was to lunge at me. I was concerned about discharging my firearm due to the MH subject in the black shirt in the background. I was also concerned that the subject in the black shirt and the subject in the red shirt were possibly associates of Suspect Ball, and they could come to his aid. After approximately 2-3 times telling Suspect Ball to drop the screwdriver, he dropped the screwdriver to the ground. I could see the items in his left hand were not edged weapons. Any attempt to get Suspect Ball to get on the ground for handcuffing was useless in his agitated state. There is a staircase at the east portion of the driveway that leads to an apartment. I was concerned that Suspect Ball may try to run inside of that residence. Additionally, I did not want Suspect Ball getting any closer in proximity to the MH in the black shirt, who I could see in my periphery was near the staircase. There were various tools spread about the driveway where Suspect Ball was standing which could be used as weapons. I formed the opinion the safest way to take Suspect Ball into custody was to have him walk towards me, take a control hold, place him on his knees, and handcuff him. I gave Suspect Ball an order to walk towards me. He then began to slowly walk towards me still clinching the items in his left hand. I holstered my firearm to affect the control hold. Detective Fritz was behind me providing cover with his firearm and giving verbal commands. I took a few small steps towards Suspect Ball. I was able to close his car door with my left hand giving him a clearer path. During this entire time, Suspect Ball was claiming to be the Chief justice and that we did not have the right to arrest him. I took a hold of Suspect Ball's left hand and wrist and attempted to apply a rear wristlock for handcuffing. Suspect Ball then began to walk forward towards Detective Fritz making it even more difficult for me to attain the wristlock. Detective Fritz had his firearm out and was approximately 3-5 ft from Suspect Ball and myself. Suspect Ball continued to flail his right arm approaching Detective Fritz. I feared that Suspect Ball was going to strike Detective Fritz, or reach for his firearm. At this point I knew that Suspect Ball was going to continue to physically resist or assault Detective Fritz or myself. I was still holding Suspect Ball's left wrist, and due to my training and experience I knew that if I were to let go of Suspect Ball, I would give him the ability to flee, gain access to the screwdriver, or other tools on the ground, and a better ability to punch and kick. Due to my plain-clothes status, I did not have the availability of impact weapons. At this point I was now slightly behind Suspect Ball as he continued to walk towards Detective Fritz. For my safety and Detective Fritz's safety I applied the carotid restraint. After a few seconds I felt Suspect Ball stop resisting arrest and lose consciousness. As I began to guide him to the ground for handcuffing, he recovered and immediately began resisting arrest again. I continued to guide Suspect Ball to a seated position he continued to struggle. Once on the ground I attempted to place him on his stomach for handcuffing. Suspect Ball struggled and was briefly able to lie on his right side trying to ball up, and pull his arms tight to his body; he was slightly kicking his legs towards Detective Fritz. Detective Fritz was able to control Suspect Ball's legs; I was able to affect an arm bar hold to turn Suspect Ball to his stomach. I was then able to handcuff Suspect Ball. I immediately rolled Suspect Ball over to a seated position so I could monitor him after briefly losing consciousness. Suspect Ball was sweating, and breathing properly. I started to engage Suspect Ball in conversation in a calm voice to further check his well being. Suspect Ball was extremely lucid and agitated. Suspect Ball proceeded to tell me that he "Owned me" that I was a "fuckin nigger" he was going to get me, and that I did not have the authority to arrest him. Upon the arrival of LBPD patrol units, Suspect Ball was placed in the rear of a police vehicle. As Suspect Ball was being walked to the police car, he continued to yell that he owned us. Detective Starbird was on scene and attempted to talk to Suspect Ball prior to him being seated in the police car. Suspect Ball would only reply "Fuck You Cunt". No further contact was initiated.
