UOF2018-0151 Incident Summary_RedactedLong Beach Police Dept Use Of Force Report Incident Entered By: Sergeant Robert Ryan - 6303 Assigned Investigator: [Incident pending assignment] Incident Details Date Received Date of Occurrence Time of Occurrence 3/20/2018 3/20/2018 06:43 Record ID #DR Number IA No 12538 180017163 UOF2018-0151 Date/Time Entered 3/21/2018 05:26 Incident Summary Dispatch: North Division Officers responded to 5470 Atlantic Avenue regarding a 242 that just occurred. The calling party advised the neighbor just pushed and hit him to the floor and was threatening to kill him. The caller stated the suspect told his wife to get the gun and that he was going to kill the caller. No gun was seen. The Suspect address given was Avenue. During the initial dispatch, the call type was changed to a 273.5, but no further information was provided. Force Used: Officer K. Finch #3764 used other bodily force to pull the subject (later identified as Brian Contreras), who was in the prone position, to a safe area in order to handcuff the subject. After Contreras was handcuffed, Officer Finch used additional other bodily force by straddling the backside of Contreras' upper legs and holding onto his hands to control his movements. For further, see Officer Finch's report. Injuries: Contreras had no visible injuries due to the use of force. Contreras had a chipped tooth and was lightly bleeding from his mouth that he claimed occurred during the forced entry and was caused by the door striking him in the face (for further, see Blue Team entry regarding forced entry on this incident). Contreras also had a scratch on his right cheek area and upper right chest area. It is unknown how and when Contreras received the scratches. Photographs/Video: Officer E. Domingo #10782 took photographs of Contreras, Officer Finch, and the incident location. The photographs were later uploaded to Mideo Statements: I digitally recorded my interview with Contreras, and after advising him of his Miranda Rights he provided me with a brief statement regarding the incident. I documented Contreras' statement in my ARS follow-up report. I later uploaded the audio file of my interview into Mideo. Conclusion/Actions: In my opinion, the forced used was reasonable, necessary, and within policy. Notifications: Watch Commander, Lt. T. Burford #5655 was notified of the use of force. Internal Affairs Sgt. E. Fernandez #10062 was notified of the injury to Contreras' tooth due to the forced entry.
