Officer Rios made initial contact with ARR BARRIO, LAURA. (DR#17-19714 CALL #1731) FORCE USED: A wrist lock was applied to the left hand of the deft by Officer Rios and a wrist lock was applied to the right hand of the deft by Officer Curiel when escorted out of the boarding lounge to the garden area. The deft was handcuffed and later seated in the back of a patrol vehicle. INJURIES:A Supervisory use of force review was initiated due to an ongoing complaint of pain and X-rays determined the right wrist to be broken. PHOTOGRAPHS/VIDEOS: Photos were taken of the deft’s right wrist by Officer Bruyere. They have been uploaded into Mideo. CCTV footage of the contact between the officers and the deft has been uploaded into BlueTeam. Note: After several attempts the filing sergeant could not get the video uploaded into the BlueTeam database. The copy of the CD has been placed into evidence. STATEMENTS:The filing sergeant interviewed the deft BARRIO, LAURA with consent to record. In short, the deft was unable to recall if she her actions in the bar area. However, she did recall having her hands placed behind her back. She recalled asking the officer why he was being rough but did not say with certainty that she complained of pain. He said she heard a snap in her wrist and began to cry. She gave a complaint of pain to the jail nurse staff the following morning. There was no allegation of excessive force made by the deft. Witness Liptak was also interviewed with consent to record. In brief, the witness, who is a supervisor for JetBlue saw the deft throw multiple chairs in the bar area after she was told she was too intoxicated to fly. Liptak recalls Officer Rios escort the deft out the boarding lounge with the assistance of Supervisor Curiel. According to the witness, she did not hear the female complain of pain to her wrist, but ask why the officer were being rough. The deft then urinated on the floor. She did not feel the use of the wrist lock was excessive force. CONCLUSIONS/ACTIONS:It is inconclusive if the injury sustained to the deft was due to the application of the wrist lock by Supervisor Curiel or if during the handcuffing process. Or, if the injury occurred during the transport to booking, or while the deft was in women’s jail custody. In officer Martinez’s report, he does indicate that the female felt “discomfort” over the application of the handcuffs. An additional handcuff was strung together and satisfied her level of discomfort. The booking was received by Sgt. Dougan. It wasn't until the following day, that the filling officer was contacted by Sgt. Anderson that the deft may have broken her wrist. Based on the reports, video and statements from the witness, the application of a wrist lock on the deft was reasonable and appropriate. NOTIFICATIONS: Lt. O’Dowd and Sgt. Brown were notified of the Use of Force. Lt. Morgan was notified as well.
