Rodriguez #10051) was working uniform patrol in a marked black and white police vehicle as Unit 4B4. I had a female Hispanic ride along (I assisted Unit 4B5 (Officer A. Garcia #6074) at the Rocky Inn Motel (1045 E. Pacific Coast Hwy), regarding trespassing subject (Later identified as ARR Saenz). Call #717 I have worked with Officer Garcia for years and heard him air for a Unit to assist at his location with an uncooperative naked male. His voice sounded a bit distressed and not as calm as usual. I believed he was involved/engaged in a struggle with the naked subject. I advised dispatch I was going to drive with my red lights and sirens, to check on Officer Garcia's well being or until he advised he is ok. I arrived at the Motel and dispatch informs me it was room #112. I observed the door was open, but could not see Officer Garcia or ARR Saenz in the room. I entered the room and walked toward the restroom and observed ARR Saenz inside the bathtub, on his back, and without any clothing. He was sweating profusely or still had water from the shower. Officer Garcia was holding ARR Saenz' wrist preventing up from getting up, until a Unit arrived. Officer Garcia appeared slightly fatigued as he was holding ARR Saenz for several minutes. Report Officer 10051/RODRIGUEZ,RODOLFO Printed At 08/22/2019 18:35 Page 2 of 3 17-69019 Supplement No ORIG LONG BEACH POLICE DEPARTMENT Narrative Let it be noted, that subjects whom I come in contact in the field who are naked, sweating profusely and not cooperating, usually means they have ingested some type of narcotic. I began to speak with ARR Saenz and advised him to cooperate with us and we were not there to hurt him. We needed to take ARR Saenz into custody (Tresspassing, refused to leave after an Officer advised him to do so) quickly and request Long Beach Fire Department to medically evaluate him. I took a hold of ARR Saenz' right wrist as Officer Garcia held his left wrist and we assisted him to his feet. ARR Saenz walked out of the restroom without resistance. Once we exited the restroom, he began to pull away and lower his center of gravity to break free from our grasp. We pushed him towards the mattress. We managed to place his chest on the mattress, but he squirmed away and rolled to the floor onto his left arm on the ground. Officer Garcia held ARR Saenz' left arm, but could not manage to assist it to his back and handcuff him. I took a hold of ARR Saenz' right wrist and bicep and tried to place it on his back, so I may safely handcuff him. ARR Saenz pulled his arm away from me and towards his body, to prevent being apprehended. We managed to get him on his stomach, but he began to flailed his hands and feet. I told ARR Saenz to stop resisting and place his hands behind his back. He ignored my command and instead pushed me away from my waist. ARR Saenz' arm slipped from my grasp, grabbed my rear pant pocket and began pulling it downward (Caused it to rip). He then grabbed my Sam-brown (Duty belt). He placed his hand on my Conductive Electrical Weapon (CEW). Fearing he was going to remove my CEW and use it on one of us, I released his arm and stood up. I could see Officer Garcia still struggling to with ARR Saenz left arm. ARR Saenz turned and placed himself in a fetal position. I instructed ARR Saenz to get on his stomach in both English and Spanish or I will strike him with my baton. He ignored my command and continued to push Officer Garcia's hand away. I retrieved my department issued baton from its ring and held it in an upper cradle position. I waited a few seconds to see if ARR Saenz would follow my instructions. After seeing him still not adhering to my lawful instructions, I used my baton and struck him on his lower right leg area. I instructed him to get on his stomach once again and he continued to ignore my commands. He placed both knees towards his chest and used his right hand to rub his right lower leg. The baton strike was not effective, so I instructed ARR Saenz to get on his stomach or I will strike him again. ARR Saenz ignored my command and I struck him a second time in his lower leg area.The second baton strike was not effective, so I advised him to get on his stomach or I will strike him once again. ARR Saenz continued to ignore my commands, so I struck him a third time on his lower leg area. The third baton strike caused ARR Saenz to get on his stomach, but he place both of his arms underneath his stomach. I holstered my baton and took a hold of his right arm. We were able place both of his hand behind his back and I safely handcuffed him. No further force was used. We requested paramedics and Long Beach Fire Department Engine #10 responded. We advised dispatch of the Use of Force and Unit 4S34 (Sgt. A. Sturgeon #10055) responded on scene. Unit 4B65 (Officer R. Tith #10248 and Officer M. Brunson #10240) assisted on scene with witness statements and photos. I contacted the calling party to confirm he was willing to prosecute and he informed me he did and signed a private person's arrest form. I gave the form to Officer Tith. For further see attached. Pacific Coast Hwy) room #112. Call #727. Upon arrival, I contacted the calling party and asked if the subject who he called in regards to was still on the property. The calling party, who is the manager, told me that he was and has locked himself in the bathroom of room #112. Per the calling party, the subject was not the original renter of this room and he has no idea who he is. I asked the calling party if he wanted the subject off of the property. The calling party told me yes and gave me permission to enter room #112. I entered room #112 and knocked on the closed bathroom door. I identified myself to be a Police Officer and told the occupant to exit the bathroom. The occupant, identified as ARR Saenz, responded to me by telling me he is waiting for his migraine headache to stop. I told Saenz to open the door so I can get him some help for his migraine. Saenz told me no and he will leave later. The door knob to the bathroom can be unlocked from the outside by use of a flat object. I unlocked the door and opened it to confirm no medical attention was needed for Saenz. Saenz was sitting in the bathtub with a small wash cloth over his penis. The bathtub was not filled with any water. The bathroom had moisture in the air as if a recent shower had been made. Saenz was almost completely dry and laid in the bathtub. There were no signs of injury or complaint of one and Saenz declined medical help. I told Saenz he needs to leave because the manager wants him off the property. Saenz told me that he will leave in a bit after he rested more. I picked up a clean towel and gave it to Saenz to cover himself to stand up. Saenz refused to stand up when I told him to. Saenz had committed the crime of trespassing (602(s)PC) according to the calling party and now obstructing my investigation into the trespassing (148(a)PC). I touched Saenz' left arm to assist him in standing up to move my investigation out of the small bathroom. Saenz pulled his left arm in at the moment I touched it. I then struck Saenz on the left cheek with my right palm to distract him from concentrating on pulling his arm from me. I was able to pull his left arm back out to now detain Saenz. Saenz then tried to use his right hand to free his left arm from my control. I then secured Saenz' left arm with my right knee on his forearm, pressing it against his chest. Saenz was not able to move his arms. I then used my free left hand to request a unit to assist. Unit 4B4 Officer R. Rodriguez #10051 advised he was enroute.I held Saenz in this position until Officer Rodriguez arrived. We both assisted Saenz to stand up in which he used his own strength to stand up. We exited the bathroom and Saenz immediately spun and acted in a erratic behavior to pull away from us. I was attempting to complete a hammer lock on Saenz' left arm but I was not able to.Officer Rodriguez and myself pushed Saenz against the bed in the room but Saenz used his legs and pushed the mattress allowing him to lay on the ground. I told Saenz to stop resisting and put his arms behind his back. Saenz was laying on his left side and I was trying to get his left arm behind his back. I heard Officer Rodriguez warn Saenz he would be struck if he continued to resist. Saenz still would not put his arms behind his back. I heard a baton strike against Saenz and immediately Saenz yelled out in pain. I told Saenz to get his arm behind his back and he did not do as I ordered him to. I heard two more baton strikes and Saenz rolled onto his stomach. Officer Rodriguez and myself were able to put Saenz arms behind his back. Officer Rodriguez handcuffed Saenz. No more force was used. I requested for Fire and a field Supervisor to respond. Sgt. Sturgeon #10055 responded to the scene and was notified of the use of force. Long Beach Fire Engine and Rescue #10 responded and cleared Saenz. Saenz would be later transported to St. Mary's Hospital for medical clearance to be booked. Tith #10248) and I (Officer M. Brunson #10240) responded to the Rocky Inn at 1045 E Pacific Coast Hwy regarding an unwelcome guest call (call #727). Several units assisted on the call, including Unit 4B5 (Officer A. Garcia #6074) , Unit 4B4 (Officer R. Rodriguez #10051), and Unit 4C65 (Officer S. Kim #10564 and Officer H. Lizardo #10860). While en route, I heard Officer Garcia advise dispatch that he needed a unit to assist with an uncooperative naked man in a restroom. Upon arrival, I found Officer Garcia and Officer Rodriguez on scene with a male Hispanic (later identified as Jorge Luis Saenz) detained in handcuffs in room #112. Officer Garcia and Officer Rodriguez told me they were involved in a Use of Force and I began doing knock and talks and witness statements. I first knocked on the door to room #111, which is one room south of #112. A subject (later identified as opened the door and he told me that he was the only person inside the room. stated he was watching the "Rams" football game and he had the TV on too loud to hear anything else going on. Therefore, he did not hear or see anything that occurred in room #112. I then went to room #114, which is one room north of #112. I knocked on the door and there was no answer. I then looked through the window and noted that the room appeared to be vacant. After conducting knock and talks, Officer Rodriguez informed me that he had a "ride-a-long" (later identified as and she may have witnessed the Use of Force. She did not see how he fell, but she stated that it appeared as if he "stumbled out of the bathroom." She watched as Saenz refused to roll over and Officer Rodriguez hit him one more time in the leg area with his baton. stated she did not see any other force used. Officer Tith contacted the owner of the business (later indented as and he told Officer Tith the following: stated the person who rented room #112 checked out at 1000 hours. watched as the person checked out and left the property. went into the room at approximately 1030 hours to clear it and have it cleaned, and he found a bag of property in the room with the bathroom door closed. knocked on the bathroom door and Saenz opened it. did not recognized ever seeing Saenz before and stated that he did not belong inside the room. told Saenz that the person who rented the room already checked out and told Saenz that he needed to leave. also told Saenz that he would give him time to gather his things and leave before he calls the police. went back to the room at approximately 1245 hours and he found that Saenz was still inside the bathroom. then called the police to have the Saenz removed the property. Saenz did not complain of pain from the incident and Officer Tith and I transported him to booking at 400 W Broadway. While in booking, the Nurse checked Saenz's blood pressure and told us that he needed to go to the Hospital to be medically cleared for booking. Officer Tith and I transported Saenz to St Mary's Hospital. While we were at the hospital, Saenz began complaining of pain to his right hand. I observed his hand and noted it was swelling around the knuckle line. Officer Tith took photographs of Saenz's injuries (for further see photographs). Officer Kim and Officer Lizardo responded to St Mary's Hospital and remained with Saenz while he was medically treated and cleared for booking. A. Sturgeon #10055) was advised that a Use of Force occurred at the Rocky Inn Motel (1045 E Pacific Coast Hwy), call #727. I responded to the location and observed the officers had a male Hispanic subject detained in motel room #112. The subject was nude and his lower body was covered with a bath towel. I was advised that officers used a baton and struck the subject in the lower extremities. Long Beach Fire Personnel were onscene and had treated the subject for any injuries. I contacted the subject (later identified as Jorge Saenz) and conducted an interview with, which was recorded by digital recorder and Body Worn Camera. I read Saenz his Miranda rights per PD form 1000.008 and when asked if he understood his rights, he seemed to be confused. I then re-read his rights line by line and asked if he understood each right read to him. Saenz stated he understood each of his rights. I asked Saenz if he could tell me what happened between him and the officers and he told me that "nothing happened." Saenz said he was taking a shower and must have slipped in the shower. Saenz said he rented the room just prior to 12pm and was resting. He stated that he took a shower and "slipped or something." Saenz kept saying he did not remember anything. I looked for possible head injuries and he did not appear to have any visible injuries to the face or head. Saenz also said that he did not have any pain and was not hurt in anyway. Saenz stated he might have been treated for mental health issues, but he did not remember what it was or what medication he was treated with. Saenz stated the last time he drank was one drink the night prior. Saenz stated he has not used any narcotics. Saenz continued to say he did not remember any portion of the encounter with the police. Saenz even stated that he may have gotten water in his ears from the shower, which could have prevented him from hearing the officer's orders. Saenz did not provide me any further information. The digitally recording was uploaded to Mideo and the BWC footage is available via Availweb. I noticed that Saenz had bruising to his lower legs, which were consistent with the use of the baton. Report Officer 10055/STURGEON,ADAM P Printed At 08/22/2019 18:35 Page 1 of 2 17-69019 Supplement No 0004 LONG BEACH POLICE DEPARTMENT Narrative It should be noted that Officer Rodriguez had been assigned a police ride along for the duration of his shift. The ride along (had been assigned to West Division day watch by the Patrol Bureau staff. was a witness to the incident and was interviewed at the scene by Officer Brunson #10240. I was later advised by Officer Brunson that Saenz would need to be medically cleared due to high blood pressure. Upon responding to the hospital, Saenz was found to have a fractured right hand. I responded to the hospital and spoke to Saenz again. This conversation was recorded by digital recording. Upon contacting Saenz, I asked if he could provide me with anything further regarding the incident. Saenz stated that his hand was fractured due to him being "an ass." When asked what he meant, he stated he was not "there 100 percent." Saenz stated he was hanging out with some people who were smoking an unknown substance. Saenz stated he began to feel weird from the substance (even though he was not smoking it himself). Saenz went to his truck and drank a beer to calm down. Saenz then said that he told the people he was with that he was going to get his own room. Saenz stated he rented the room from the manager in the office. He also stated that the manager came by the room and asked him for "more money." Saenz stated that the manager came to the room around 10-1030 am and asked for either more money or for him to leave. When he said he did not have more money, the manager said that he had to go. Saenz stated he had two hours to leave. Saenz stated that he estimated when the police spoke to him at the hotel, it was approximately 3 pm. Saenz was clearly off by a couple of hours, but he agreed that it had been more than two hours from the time he was told to leave. Saenz also stated that the police hit him with a baton in the right lower leg (he pointed to the bruising on his leg). Saenz stated he was also hit in the hand with the baton. Saenz stated he did not remember hearing the officers say anything to him. All Saenz remembers is being struck by the baton. Saenz did not provide further regarding the incident. Lizardo #10860) and I (Officer S. Kim #10564) were working uniformed patrol in a marked police vehicle as Unit 4C65. We responded to assist Unit 4B65 (Officer R. Tith #10248 and M. Brunson #10240) at St Mary Medical Center (Call #727). Upon arrival, we contacted Unit 4B65 at Emergency Room #M. Unit 4B65 was waiting for medical clearance for subject (later identified as DEFENDANT JORGE SAENZ).
