On 01/21/18 at 2000 hours my partner (Officer R. Corona #11140) and I (Officer R. Rodriguez #10051) were working uniform patrol in a marked black and white police vehicle as Unit 4C61. While driving our patrol vehicle eastbound on Pacific Coast Hwy (PCH), approaching Magnolia Ave, my attention was drawn to a male Black subject on a blue beach cruiser bike without a bike light, along the north/west sidewalk of the above-mentioned intersection. It was nighttime and the streetlights were on. We slowed our patrol vehicle to make a right turn onto southbound Magnolia Ave. There were 4 to 5 female Hispanics (Appeared to be teenagers)walking westbound across Magnolia Ave. ARR Rich stumbled and stopped his bike yelling unknown words at the teenagers or us. I instructed my partner to conduct a pedestrian stop for the above bike violation and to check on the welfare of ARR Rich (To investigate drunk in public). My partner stopped our patrol vehicle in front of 520 W. PCH facing eastbound; he activated his red lights and siren. I exited the passenger side of the vehicle and gave ARR Rich instructions to get off the bike. He replied, "Fuck no, and get out of my way." ARR Rich continued to ride his bike westbound the sidewalk towards me. I moved out of his way and gave him a second order to stop and get off his bike. He ignored me a second time and stated he was not on Parole so he does not have to listen to me. He went over the curb and rode his bike onto the eastbound lanes of PCH against traffic. He began to loose control and began walking his bike. He had the bike frame between his legs as he was walking/stumbling. The bike handle bars turned on him and he tripped over the frame. I held his left arm and we fell to the ground. I quickly took a hold of his left elbow with my left arm and held his left wrist using my right arm to gain control. I placed him in a twist lock and instructed him to stand up and get out of the street. I feared vehicle traffic would not see us and accidentally strike us. My partner took a hold of ARR Rich's right arm and we stood him up, and we safely escorted him to the south sidewalk of PCH. ARR Rich had the odor of an alcoholic beverage and marijuana on his breath. He was cursing at me to let him go or else he would kick my ass. He continued to yell that he was not on Parole and I could not stop him. As we were escorting him to the sidewalk, ARR Rich was uncoordinated and stumbling as he took steps. I formed the opinion that he was intoxicated to such a point that he could not take care of himself or others while in a public place. I instructed ARR Rich to place his hands behind his head because he was under arrest and he became even more aggressive by tensing his arms, twisting his torso to break free from our grasp. He lowered his center of gravity and pulled away from my partner's grasp to avoid being apprehended. ARR Rich is over 6-feet tall and approximately 275 pounds, once his right hand broke free from my partner's grasp, he had the ability of using his free arm to assault my partner or myself. I observed him either push my partner or attempted to assault him by extending his right arm towards him.I feared he could injure us, so I wrapped both of my arms around ARR Rich's waist, turned him towards my left and conducted take down. He lunged towards me, pushed me with his body causing me to fall and my right knee made contact with the curb (The fell due to ARR Rich's bodily force, which caused my knee get scraped, swell and bleed). ARR Rich tripped over me lower legs and landed on the grassy area between the sidewalk and the curb. ARR Rich landed on his stomach area and I took a hold of his left arm, assisting it towards his back. I instructed him to stop resisting and keep his arm behind his back. He ignored my commands and used his right hand to push himself off the ground. He was flailing his legs and twisting his body to prevent me from safely cuffing him. I used my left knee and placed his on ARR Rich's upper back to prevent him from getting up. My partner managed to get control of ARR Rich's right arm and we handcuffed him. I advised dispatch of our investigation and location. My voice sounded stressed as I was breathing heavy. 4S26 (Sergeant J. Flores #10007), Un it 4C62 (Officer B. Stein #5915 and Officer C. Alvarez #11101), and Unit 4C4 (Officer T. Erdelji #5754) assisted on scene. We stood ARR Rich to his feet and escorted him to our patrol vehicle. My partner opened the rear passenger door of our patrol vehicle and I instructed ARR Rich to walk towards my vehicle. ARR Rich yelled let go of his fucken hand. I instructed him to walk and I would release the pressure of his wrist. ARR Rich began to walk and I released the pressure of his wrist. Once we approached the rear seat of the patrol vehicle, ARR Rich began to stiffen his body and not sit in the seat. I asked him to place his left leg inside the vehicle and take a seat.He turned his body towards, placed his back against the doorframe of the vehicle and wedged his feet against the curb. ARR Rich was sweating profusely, and had white dehydration residue on his lips. Fearing he was going to become even more combative and spit on me, I wanted to quickly affect the arrest and safely sit him in the rear seat of our patrol vehicle. He told me to step away and not touch him and he would sit on the ground. I took a step back and held my baton in an upper cradle position incase ARR Rich wanted to attack me. I advised him I was not touching him, so know he needed to get in the car. He ignored my command to sit in the vehicle and he lunged his body towards me. Fearing he was going to use his big body to push me away, possibly causing harm, (I did not have time to advised him I was going thrust him with my baton if his did not stop his forward movement) I used my baton and thrusted/jabbed my baton into ARR Rich's stomach area. He had on a thick Jacket and the first trust was not affective, but did push him back onto the car door frame. I instructed him to get into the vehicle and he continued to refuse. I thrusted my baton a second time in his stomach area. The second trust was affective and ARR Rich sat in the vehicle. Officer Erdelji walked around to the rear driver side door to assist in sitting ARR Rich in the vehicle without any force. My partner requested Long Beach Fire Department (LBFD) to respond to our location. LBFD Engine #3 responded on scene. While waiting for paramedics to respond, ARR Rich managed to use both of his feet and kicked out the rear passenger side window of our patrol vehicle (Vehicle #18716). The frame ripped out of the outer frame causing the motor, which raises the window up/down not to work. The damage is estimated to be over $400. We escorted ARR Rich out of the patrol vehicle and sat him along the curb, so paramedics may medically evaluate him. I advised them of the baton thrust and the take down. ARR Rich did not have any marks on his torso/stomach area at this time. He did have scratches and was bleeding from his right hand/knuckle area (I believed was caused by the concrete as he was pushing himself away) He was very uncooperative with paramedics and refused further assistance. We escorted and sat him in the rear seat of Officer Stein's vehicle, since his vehicle had bars and ARR Rich could not kick out his windows. All the surrounding businesses were closed and we could not locate any witnesses or cameras. 4C62 transported ARR Rich to 400 W. Broadway (Booking) where he was booked as charged. We took custody of ARR Rich's bike, backpack with jars of marijuana and drove to booking to assist with the booking process. We placed all of his belonging into bulk property. For further see property report. ARR Rich continued to be uncooperative with Officers and Nurses. He called us name as we were taking inventory of his property. He began to spit and stated he would kick any Officer that gets closed to him. We safely placed a spit mask and he did not resist. ARR Rich was too combative to retrieve a breath sample of his Blood Alcohol Level. Officer Stein took photos of ARR Rich and the Officers involved. Officer Stein and his partner escorted ARR Rich to the 6th floor men's jail and released him to their custody without further incident. Flores #10007) assisted Unit 4C61 (Officer R. Rodriguez #10051 and Officer R. Corona #11140) who had conducted a pedestrian stop in the area of Pacific Coast Hwy and Daisy Avenue. (Call #1190) As Officer Corona advised dispatch of his pedestrian stop he sounded excited and out of breathe. Dispatch asked Officer Corona and Officer Rodriguez to confirm if they were Code-4 (no further assistance needed). Officer Rodriguez and Officer Corona did not respond. Dispatch went on to authorize Unit 4C65 (Officer C. Pruiet #10764 and Officer M. Mounts #10798) code-3 (forward facing red lights and siren). Soon after authorizing Unit 4C65 Code-3, Officer Rodriguez went on to advised dispatch a Use of Force had occurred and they had the suspect, who was later identified as Rich James, in custody. Upon my arrival I observed Officer Rodriguez attempting to place James in the backseat of the patrol vehicle. James made his body rigid and wedged himself between the door hinge and doorframe, preventing Officer Rodriguez from placing him in the backseat of the patrol vehicle. James told Officer Rodriguez he was not going to jail and to remove the handcuffs. James continued to yell at Officer Rodriguez and at one point had turned his body facing Officer Rodriguez, planted his feet on the corner of the south curb of Pacific Coast Hwy and placed his back against the door frame. By keeping his feet planted on the curb and his upper back against the door frame, James maintained his body rigid and straight, preventing even more Officer Rodriguez and Officer Corona from placing him in the backseat. Officer Rodriguez gave verbal orders to sit in the backseat of the Black and White patrol vehicle. I then observed Officer Rodriguez use his baton and thrust it in the abdomen of the James twice, which caused James to sit in the backseat of the Black and White patrol vehicle. For further see Officer Rodriguez police report. As James was in the backseat of the patrol vehicle he began to kick the back window of the black and white patrol vehicle, damaging the window. For further see the main police report. I drove to 400 W. Broadway (Booking tunnel) where I contacted the suspect and read him his Miranda Rights per PD Form 1000.008. I asked James question #1. James did not reply, closed his eyes, and ignored me. I ended my interview of James. I audio recorded my interview and uploaded it to Mideo. Rodriquez #10015) and I (Officer R. Corona #11140) were working uniform patrol in a marked black and white vehicle as unit 4C61. We were driving eastbound on Pacific Coast Highway east of Daisy Avenue and observed a male Black riding a blue bicycle on the south sidewalk of Pacific Coast Highway; he had no front headlight in violation of section 21201(d) V.C. As my partner and I passed the male black he screamed and slurred multiple vulgar words towards us and other pedestrians (approximately 4 to 5 female Hispanic) on the sidewalk. The subject also appeared to be intoxicated in public in violation of section 647(F) P.C. I heard the females say, "Are you going to do anything about that?" (call #1190). My partner instructed me to conduct a pedestrian stop. I turned southbound onto Magnolia Avenue and westbound onto the alley south of Pacific Coast Highway. We turned northbound onto Daisy Avenue to turn eastbound back onto Pacific Coast Highway. I observed the male Black on a blue bicycle talking to the females at the corner of Pacific Coast Highway and Magnolia Avenue. I conducted a pedestrian stop on the suspect for the above violations. I exited my patrol vehicle to make contact with the subject. Upon making contact, I advised the suspect (later identified as James Rich) to stop. He failed to obey my commands to stop. My partner told the suspect to stop he was being detained and the suspect replied, "Fuck no!" The suspect fail to obey commands to stop and continued to ride his bicycle towards my partner, out of the sidewalk and onto the #2 lane of eastbound traffic of Pacific Coast Highway. I observed the suspect lose control of his bicycle and stumble upon himself. My partner and I approached the suspect in attempt to detain the suspect and get him out of on coming traffic. As we approached the suspect, I smelled a strong of an alcoholic beverage and marijuana coming from the suspect. The suspect appeared to be intoxicated to the point where he was unable to care for himself. The suspect tried to flee our lawful detention by continuing to walk onto on coming traffic with his bicycle in between his legs saying, "I'm not on parole or probation you can't arrest me!" My partner approached the suspect and I observed the suspect stumble to his left side onto my partner causing my partner and the suspect to fall to the ground. While in the #2 lane of eastbound traffic of Pacific Coast Highway, My partner and I made every attempt to get the suspect out of the way of on coming traffic. I grabbed the suspect by his right arm to safely move him onto the south sidewalk of Pacific Coast Highway. The suspect continued to physically resisted by tensing up and twisting his body in an attempt to get away. I grabbed the suspect's right arm and put it in a twist lock in attempt to control the suspect. The suspect continued to resist by tensing and twisting his body and pulling his arm away from me in an attempt to escape. I observed my partner do a takedown on the suspect to prevent him from assaulting us and escaping. For further see Officer R. Rodriquez report. The suspect landed on the parkway between the sidewalk and the curb of Pacific Coast Highway on his stomach with his right hand under him. I placed my left knee behind the suspect's legs below his knees to prevent the suspect from kicking my partner and I. I ordered the suspect to place his right hand behind his back. The suspect failed to obey my commands and said, "Fuck you!" I grabbed the suspect's right arm and tried to place it behind his back. The suspect continued to resist by tensing his arm and twisting his body in an attempt to break free. I grabbed the suspect's right arm with my right arm and used bodily force to pull his arm out from underneath him and handcuff him. My partner and I stood the suspect up and walked him to the rear right passenger door of our patrol vehicle. The suspect continued to resist by tensing up his body and planting his feet in an attempt to avoid getting inside of our patrol vehicle. The suspect used the vehicles doorframe to help him plant his feet and push off against the vehicle. I observed my partner thrust his baton in attempt to get the suspect to comply. For further see Officer R. Rodriguez report. We were able to get the suspect seated in the backseat of our patrol vehicle. I noticed the suspect had a cut on his right hand. I advised dispatch to have the Long Beach Fire Department medically examine him. While waiting for the Long Beach Fire Department to Arrive, I observed the suspect kick towards the rear passenger side window of our patrol vehicle. The suspect was able to kick out the right rear window frame of our patrol. The Long Beach Fire Department Engine 3 arrived on scene to medically examine the suspect. My partner and I got the suspect out of our vehicle and sat the suspect on the south curb of Pacific Coast Highway. The suspect refused medical assistance and was cleared on scene by the Long Beach Fire Department. Unit 4C62 (Officer C. Ruiz #11101 and Officer B. Stein #5915) arrived on scene to assist. My partner and I sat the suspect in the backseat of Unit 4C62 patrol vehicle and seat belted the suspect. Unit 4C62 transported the suspect to 400 West Broadway (booking). Flores #10007) was advised by the Booking Sergeant (Sgt Ramirez) the suspect, who was identified as James Rich, had complained of pain to his hand to jail staff. Both booking and jail staff arranged for Rich to be transported to St. Mary's hospital to receive medical treatment regarding the pain to his hand. While at St. Mary's hospital, hospital staff determined James had a broken bone in his hand. James was placed in a soft cast and transported back to the 6th floor men's jail, where jailers took custody of him. I drove to 400 W. Broadway (6th floor men's jail) and re-contacted James, who had been escorted to an interview room by jailers. James appeared calm,but easily excited when speaking to him. I read Jame's his Miranda Rights per PD Form 1000.008. James replied to question #1, "Yes." I asked James if he wished to speak to me and he requested a lawyer. I continued my questioning regarding my administrative investigation. James advised me he was not aware why he was being detained, but understood Officer Rodriguez and Officer Corona were police officers. James told me he was moving away from Officer Rodriguez as he approached him. James advised me he felt threatened which was why he moved away from Officer Rodriguez. James went on to tell me Officer Rodriguez tackled him when he was moving away from him. James then told me he has been in fights with the police in the past, which was why he felt threatened by the police. James advised me his hand was broken when Officer Rodriguez took him to the ground. During my conversation with James would consistently speak over me and would at times become argumentative. James did not make any further statements and I ended my interview of James. I audio recorded my interview of James and uploaded it to Mideo. I transferred custody of James to jailers.
